One should plan for unassuming post-mortem issues, as most state laws do not provide a complete framework when there is no testamentary instruction by the deceased. Judicial determination is often needed, however reported opinions are scarce. Final disposition issues also arise in foreign law. Spain has no civil code regarding disposition of a deceased but delegates its funerary laws to local governments and autonomous communities, while the French have established an order of priority for funerary decisions and provide for a judicial determination and stay of the funerary process in case of dispute.

Sedimentary Fabrics In The Authigenic Carbonates From Bush Hill: Implication For Seabed Fluid Flow And Its Dynamic Signature, D. Feng, Duofu Chen, H. H. Roberts

Seep carbonates, the product of cold seep fluids mediated by microbial activity, archive information on seabed fluid flow and microbiological processes that led to their formation. Sedimentary fabrics are well developed in the authigenic carbonate from active seep sites at Bush Hill, Green Canyon Block 185 of the Gulf of Mexico. This authigenic carbonate has much lower carbon isotope values than typical marine cements and the carbonate is concluded to be derived from the oxidation of seeping petroleum. High profile sporting events in the United States have been identified by the Department of Homeland Security (DHS) as potential terrorist targets (Lipton, 2005). However, there has been an identified lack of training and education for key personnel responsible for sport security operations (Cunningham, 2007). Recognizing the demand and need for a specialized area in sport event security management, the University of Southern Mississippi School of Human Performance and Recreation developed an emphasis area in sports event security management as part of the Master of Science in Sport Management program. In this article, we discuss project-based learning in the context of a wheel garden as an instructional tool in science and mathematics education. A wheel garden provides multiple opportunities to teach across the curriculum, to integrate disciplines, and to promote community involvement. Grounded in the theoretical framework of constructivism, the wheel garden provides a multidisciplined educational tool that provides a hands-on, non-traditional arena for learning. We will examine some of the cultural, art, science, and mathematics connections made with this project

Run-Length-Encoding (RLE) is a data compression technique that is used in various applications, e.g., time series, biological sequences, and multimedia databases. One of the main challenges is how to operate on (e.g., index, search, and retrieve) compressed data without decompressing it. In this paper, we introduce the String B-tree for Compressed sequences, termed the SBC-tree, for indexing and searching RLE-compressed sequences of arbitrary length. The SBC-tree is a two-level index structure based on the well-known String B-tree and a 3-sided range query structure [7]. This study evaluated whether age effects on second language (L2) speech learning derive from changes in how the native language (L1) and L2 sound systems interact. According to the “interaction hypothesis” (IH), the older the L2 learner, the less likely the learner is able to establish new vowel categories needed for accurate L2 vowel production and perception because, with age, L1 vowel categories become more likely to perceptually encompass neighboring L2 vowels. These IH predictions were evaluated in two experiments involving 64 native Korean- and English-speaking children and adults. Water policy experts contend that the United States is heading toward a water scarcity crisis in the coming years. Global climate change is likely to make water scarcity much worse in the long run. This article argues that demands of current and projected water management challenges can best be met through a greater reliance on water markets. To facilitate this, water management must shift toward recognition of transferable rights in water that facilitate voluntary exchanges and the market pricing of water resources.

Use Of Trees By The Texas Ratsnake (Elaphe Obsoleta) In Eastern Texas, Josh B. Pierce, Robert R. Fleet, Lance Mcbrayer, D. Craig Rudolph

We present information on the use of trees by Elaphe obsoleta (Texas Ratsnake) in a mesic pine-hardwood forest in eastern Texas. Using radiotelemetry, seven snakes (3 females, 4 males) were relocated a total of 363 times from April 2004 to May 2005, resulting in 201 unique locations. Snakes selected trees containing cavities and used hardwoods and snags for a combined 95% of arboreal locations. Texas Ratsnake arboreal activity peaked during July and August, well after the peak of avian breeding activity, suggesting arboreal activity involves factors other than avian predation.

This chapter discusses four-selected software for data mining that are not available as free open-source software. The four-selected software for data mining are SAS® Enterprise MinerTM, Megaputer PolyAnalyst® 5.0, NeuralWare Predict® and BioDiscovery GeneSight ®, each of which was provided by partnerships with our university. These software are described and compared by their existing features, characteristics, and algorithms and also applied to a large database of forest cover types with 63,377 rows and 54 attributes. Background on related literature and software are also presented. Screen shots of each of the four-selected software are presented, as are future directions and conclusions.

Wood v. Lucy, Lady Duff-Gordon (the "Lucy Case") presents a rich teaching vehicle for the first year of contracts for multiple reasons. Another participant in this symposium has discussed the Lucy Case to laud its value in teaching fact analysis or issue spotting. Others have commented upon the case for its doctrinal utility in explaining the concepts of illusory contracts, exclusive dealing and best efforts. The historical background, the opinions of Benjamin Cardozo and the opportunity to introduce feminist jurisprudence and law and economics concepts into the first year course are also fertile ground for discussion. Talk of networks and "network theory" has become almost ubiquitous in the field of counterterrorism. Terrorist organizations are networks. Terrorists have been empowered by the Internet, ethnic diasporas, and cell phones—networks all. Many of the putative targets of terrorists—electrical grids, oil pipelines, and transportation systems, to name a few—are themselves networks. And, perhaps less often mentioned, terrorists are increasingly hampered by national and international laws that foster cooperation and coordination among states—a network of laws.

When the laws of a community reflect a dominant culture and yet many of its members are from other minority cultures, there is often conflict. When this conflict occurs in the legal regulation of the parent-child relationship, the consequences are tremendous for the children, the parents, and the State. This Article focuses on the federal statute criminalizing female genital surgeries, and, in doing so, it makes two major claims. Background/Aims - We examined associations among folate and alcohol intake, SNPs in genes involved in one-carbon metabolism and colon cancer risk.
Methods - Colon cancer cases (294 African Americans and 349 whites) were frequency matched to population controls (437 African Americans and 611 whites) by age, race and sex from 33 North Carolina counties from 1996 to 2000. Folate and alcohol intakes were collected by dietary interview. Five SNPs were genotyped using DNA from whole blood: SHMT C1420T; MTRR A66G; MTR A2756G, and the previously-reported MTHFR C677T and MTHFR A1298C. Adjusted odds ratios (OR) and 95% …

The pathological processes associated with development of cardiovascular disease begin early in life. For example, elevated blood pressure (BP) can be seen in childhood and tracks into adulthood. The relationship between physical activity (PA) and BP in adults is well-established, but findings in children have been inconsistent, with few studies measuring PA mechanically. Children aged 11 to 12 years were recruited from the Avon Longitudinal Study of Parents and Children. 5505 had systolic and diastolic BP measurements, plus valid (at least 10 hours for at least 3 days) accelerometer measures of PA; total PA recorded as average counts per minute …

Multilayered solid structures made of isotropic, transversely isotropic, or general anisotropic materials are frequently used in aerospace, mechanical, and civil structures. Ultrasonic fields developed in such structures by finite size transducers simulating actual experiments in laboratories or in the field have not been rigorously studied. Several attempts to compute the ultrasonic field inside solid media have been made based on approximate paraxial methods like the classical ray tracing and multi-Gaussian beam models. The effect of a glutamic acid (negatively charged) peptide (Glu6), which mimics the terminal region of the osteonectin glycoprotein of bone on the shear modulus of a synthetic hydorgel/apatite nanocomposite, was investigated. One end of the synthesized peptide was functionalized with an acrylate group (Ac-Glu6) to covalently attach the peptide to the hydrogel phase of the composite matrix. The addition of Ac-Glu6 to hydroxyapatite (HA) nanoparticles (50 nm in size) resulted in significant reinforcement of the shear modulus of the nanocomposite (~100% increase in elastic shear modulus). This article critiques current inheritance law relating to adopted children in light of the purposes of modern adoption law and the increasing prevalence of open adoptions. The article proposes an uncling principle to determine intestate inheritance rights in cases of open adoption in which a birth parent has maintained a qualifying functional relationship with the adopted-out child subsequent to the adoption. When applicable, the uncling principle would treat the adopted-out child and her birth parent as potential heirs of one another. Unlike the presently dominant all-or-nothing approach to inheritance rights arising from adoption, however, the proposal would not under any …

This article undertakes an ethnographic approach to the study of legal and societal norms surrounding motherhood in the U.S. It builds upon my more conventional legal and epidemiological work on maternal filicide by telling the stories, both legal and personal, of Vanessa, a woman I interviewed in the course of writing my most recent book, When Mothers Kill: Interviews from Prison. (NYU Press, 2008). In re-telling Vanessa's story, the current article exposes the limitations in the current binary classification of mothers as either good or bad. Whereas there has been substantial research on the potential effect of climate change upon water resources, there has been relatively little consideration of the role of institutional arrangements in mitigating (or exacerbating) the potential effects of warming-induced changes in water supplies. Climate change increases the urgency with which water managers and policymakers must address water supply concerns, moving toward water supply institutions and policies that are sufficiently flexible, adaptive, and robust to deal with the uncertain water future. This paper introduces a system that processes clinical trials using a combination of natural language processing and database techniques. We process web-based clinical trial recruitment pages to extract semantic information reflecting eligibility criteria for potential participants. From this information we then formulate a query that can match criteria against medical data in patient records. The resulting system reflects a tight coupling of web-based information extraction, natural language processing, medical informatic approaches to clinical knowledge representation, and large-scale database technologies. We present an evaluation of the system and future directions for further system development.
