The New Criminal Discovery Code In Oklahoma: A Two Way Street In The Wrong Direction, Rodney J. Uphoff

This article first examines criminal discovery in Oklahoma prior to the Allen decision. Next, section II of the article explores Allen and the court’s justifications for creating a reciprocal discovery system. The article reviews the Allen procedures and similar pre-trial discovery provisions contained in the American Bar Association’s Standards for Criminal Justice and questions whether Allen’s new discovery system will achieve the desired results. Section II also focuses on the constitutionality of the defendant’s disclosure obligations and the adverse effects of mandating such disclosures on the adversary system. Primo Levi's third book, written under the pseudonym of "Damiano Malabaila," was published for the first time in the fall of 1966 by Einaudi. Storie naturali is a collection of fifteen short stories which represent the beginning of a new Cours in the author's narrative. After the autobiographical Survival in Auschwitz of 1947 and his second book of 1963 The Reawakening–both dealing with the Holocaust and its aftermath–Storie Naturali ("Natural Stories," not yet published in English) represented such a break in the literary patter established by Levi up to that point, that the author decided to use a …

Ideology, Racism And Morality: Investigating The Structural Origins Of Drug Prohibition, John P. Hoffmann

This paper explores the origins of drug prohibition in the United States from a structural perspective. The primary locus ,son how certain economic conditions in U.S. history influenced attitudes toward racial and ethnic minorities during the 1800s and early 1900s. and indirectly affected the passage or prohibitory drug laws. The economic structure continues to Influence the current illegal drug market. Moreover, some consequences of legal and illegal drug use identify the impact of the economic structure on drug prohibition.

The study examined expressed reasons for choosing the University of Northern Iowa (UNI) by undergraduate students majoring in social work there. Responses of 205 social work majors to a questionnaire found that these students chose UNI primarily because of location; size; cost; the presence of a social work program; to get a good education; to be with their friends; and to continue a family tradition. Other findings indicated that 44% of students had attended other colleges previously; that many students considered other majors before deciding on social work; that 84% of the students had been born in Iowa; that 50% …

Role Of The Criminal Defense Lawyer In Representing The Mentally Impaired Defendant: Zealous Advocate Or Officer Of The Court, Rodney J. Uphoff

This article examines a difficult question in the representation of mentally impaired criminal defendants: should counsel be obligated to inform the court of doubts about a client's competency to stand trial even though doing so may be contrary to the client's wishes or best interests? Professor Rodney J. Uphoff analyzes authorities that impose such an obligation on defense lawyers, including an American Bar Association Criminal Justice Standard and a recent decision of the Wisconsin Supreme Court, State v. Johnson. Uphoff concludes that these authorities needlessly undercut the mentally impaired defendant's right to zealous representation. He proposes an alternative ethical model …
