Notes On A Bicentennial Constitution, Part I: Processes Of Change, William W. Van Alstyne

With the approach of the Bill of Rights bicentennial, this paper takes the cause for celebration as an equally important occasion for critique. This work argues that the most distinguishing aspects of our Constitution are not the Bill of Rights, federalism, and separation of powers, but rather the availability of judicial review, the political insulation of federal judges, and the limited mechanisms available for constitutional change.

International Relations Theory, Foreign Policy Substitutability, And "Nice" Laws, Benjamin A. Most, Harvey Starr

Two logical problems appear to have impeded the development of an integrative understanding of international and foreign policy phenomena. The first has to do with the potential for foreign policy substitutability: through time and across space, similar factors could plausibly be expected to trigger different foreign policy acts. The second concerns the potential existence of “sometimes true,” domain-specific laws. It is the logical opposite of the substitution problem, suggesting that different processes could plausibly be expected to lead to similar results. Current planning and development of collections in the social sciences and humanities for German-speaking Europe, the Netherlands, and Scandinavia reflect the changing needs of research, strict budgetary limits, the prevailing publishing market in those countries, and certain innovations in library automation. Librarians responsible for supporting an area study of Northern Europe may shape the trends to their advantage by careful policy planning, by informed financial choices, by the use of data bases and resource sharing, by privately-nurtured channels of acquisition and support and by a continuing self-education program that might include participation in the activities of the CES and WESS.

Interpreting This Constitution: The Unhelpful Contributions Of Special Theories Of Judicial Review, William W. Van Alstyne

This paper examines several different theories surrounding judicial review and finds many of these theories lacking. Modern trends of literal interpretations and precise language have removed the optimistic nature of Constitutional language and is largely responsible for the hesitancy of other nations to adopt a supreme constitution.

The historical legacy of the racist social meaning of rape and the consequences of that legacy are the focus of this article. The article, written in 1983, analyzes the U.S. law of rape, its history, and its legacy, from a perspective that is both feminist and antiracist. It examines the intersections and interactions of race and gender subordination in the context of rape, particularly looking at race and gender issues involving African-Americans and whites. It describes how the legal system’s selective acknowledgement of rape has disproportionately targeted African-American men for punishment and made African-American women both particularly vulnerable and particularly …

Two Features Of Working-Class Phonology In Valladolid, Lynn Williams

Two factors prompted the research which led to the writing of this article: first, the apparent general consensus amongst linguists both inside and outside Spain that the phonology of Old Castilian is monolithic in terms of geographic and sodal space, and that it has more or less stagnated in the mould of traditional grammars, and, secondly, the insistence of many linguists on seeing some aspects of contemporary Spanish phonology as characteristic of certain non-standard varieties of Spanish, wilhout investigating whether the same features might not also be found in Old Castile.

The Pronunciation Of Women: Some Spanish Evidence, Lynn Williams

The material for this article bas been drawn from a larger sociolinguistic survey of various aspects of tbe phonology of 18-26 yr olds in Valladolid carried out between October 1976 and April 1977. The methodology used is basically the same as that developed by William Labov for his New York survey and has become one of the most established methods of enquiry into the social differentiation of the phonology of urban speech-communities. Informants were selected from the Valladolid census records in a semi-random manner and assigned to their socio-economic class according to the criteria of Spanish sociologists. The Greek Military Regime (1967-1974) And The Cyprus Question — Origins And Goals, Constantine P. Danopoulos

This article employs the concept of military professionalism and its attributes to explain the Greek praetorian regime's handling of the Cyrprus problem. Upon examining the relevant data it was found that for strategic considerations the U.S. and NATO sought to achieve a negotiated solution to the cyprus problem which would have amounted to double Enosis. It was also found that professional needs created a dependency of the Greek. military on NA TO for arms, sophisticated training, and support which let them view participation in NATO as indespensable. Congregational And Mission Structures And How The Seventh-Day Adventist Church Has Related To Them, Bruce Bauer

This dissertation suggests that the Christian Church has expanded most rapidly when the outreach and nurture functions of the Church have been organized and promoted by separate structures that relate to each other in three ways: (1) they are semi-autonomous in decision making, (2) they share a common purpose and objective, and (3) they have an agreed upon common reference point.

This model for semi-autonomous congregational and mission structures is then supported by detailing the relationship between the Antioch Church and Paul's apostolic bands. Similar cases of semi-autonomy between the two structures in church history are then cited to further …

Diffusion, Reinforcement, Geopolitics, And The Spread Of War, Benjamin A. Most, Harvey Starr

The discussion reports the results of an examination of the possible diffusion of new war participations during the 1946-65 era. A theoretical argument is developed to yield more precise expectations about when, where, why, and how diffusion processs might operate. Four diffusion-related processes (positive spatial diffusion, positive reinforcement, negative spatial diffusion, and negative reinforcement) are discussed and analyzed. A series of simple turnover tables and a focus on nations' borders are used to go beyond the authors' previous stochastic modeling efforts.
