Mentoring Relationships During Student Teaching, Richard G. Stahlhut

Faculty Publications

This study sought to find out if mentoring styles were used by cooperating teachers as perceived by student teachers during their clinical field experience. After a specific mentoring model was constructed; the objectives of the study were to identify leadership behaviors cooperating teachers used; to determine if any of the inferred mentoring styles that incorporated the leadership behaviors tested were dominant; and to determine if any of these leadership behaviors or mentoring styles influenced a student teacher's success as measured by a final evaluation checklist. The Leader Behavior Description Questionnaire Form XII was administered to 212 University of Northern Iowa …

Investigating Expertise In Auditing, Paul E. Johnson, Andrew D. Bailey Jr, Rayman D. Meservy Oct 1986

Investigating Expertise In Auditing, Paul E. Johnson, Andrew D. Bailey Jr, Rayman D. Meservy

Faculty Publications

Research on human expertise in auditing contexts is an important area of study. Our objective in this paper is to present an approach to conducting research on human expertise. We begin with some issues of terminology and then propose a strategy for inquiry into the phenomena of expertise. Finally, we attempt to illustrate this strategy with three examples of recently completed work. The examples include: two from the auditing literature that involve the analysis of internal control and a medical diagnosis case which illustrates the "garden path" problem that is of concern in any decision making context, including auditing.

Sweatt V. Painter, The End Of Segregation, And The Transformation Of Education Law, Jonathan L. Entin Jan 1986

Sweatt V. Painter, The End Of Segregation, And The Transformation Of Education Law, Jonathan L. Entin

Faculty Publications

This Article will analyze these aspects of the Sweatt case. Part I describes the facts leading to the litigation. Part II examines the Supreme Court precedents facing Sweatt's attorneys, both in the area of school segregation and in the field of education generally. This section concludes that the Court at best seemed pre- pared only to enforce the Plessy doctrine, and none too rigorously at that. Part III focuses upon the process of making the record at the trial. This section demonstrates how Sweatt's counsel took advantage of ambiguities in the prior cases to lead the Curt to address the …

Five Views Of Church-State Relations In Contemporary American Thought, Carl H. Esbeck Jan 1986

Five Views Of Church-State Relations In Contemporary American Thought, Carl H. Esbeck

Faculty Publications

Views concerning the appropriate relationship between church and state are rapidly becoming almost as numerous as America's religious sects. The Constitution's treatment of religious liberty, thought by many to be a matter long settled, has now erupted into a many-sided debate. Not only lawyers, judges and legal commentators are involved; historians and sociologists, theologians and ecclesiastics, political theorists and statesmen also participate in the debate. It is part of a much larger struggle over a redefinition, or for some a reclamation, of the role of religion in American public life. At times this debate focuses on discrete environments, such as …

When Lawyer And Client Meet: Observations Of Interviewing And Counseling Behavior In The Consumer Bankruptcy Law Office, Gary Neustadter

Faculty Publications

What happens when lawyer and client first meet? How do they talk, how do they listen, what do they say, and what do they do? The answers to these questions are generated, and then lost, in thousands of law offices daily. There is thus a treasure of information, but it is mostly hidden from our view by legal barriers that protect privacy and confidentiality and by other barriers, economic, psychological, and logistical, that inhibit or preclude third party observation of lawyer-client contact. This Article reports an exploratory journey in search of that treasure, a journey into six law offices in …

The Union Of Legal And Political Theory, Noel B. Reynolds Jan 1986

The Union Of Legal And Political Theory, Noel B. Reynolds

Faculty Publications

This paper explores the social science concept of conventions as a way of understanding law that would bridge the enduring gap between natural law and legal positivist legal theories. It further finds in the conventionalist approach a promising account of the rule of law—both in how it may be characterized and in how it can be assessed in particular legal systems.

The Family Historian, G. Wesley Johnson Jr. Jan 1986

The Family Historian, G. Wesley Johnson Jr.

Faculty Publications

The archivist of a great university library was once asked his secret in collecting so many important materials. He smiled and said, "My success can be summed up in two very important words: vacuum sweeper." His approach was to locate as many relevant materials as possible and then to analyze and classify them. His success was linked to having a wide definition of what records might be of value for historical archives. Where others threw away phone books, he kept them (valuable information on professions and businesses in the Yellow Pages), where others threw away menus, he kept them (valuable …

The Place Of Procedural Control In Determining Who May Sue Or Be Sued: Lessons In Statutory Interpretation From Civil Rico And Sedima, Douglas E. Abrams Oct 1985

The Place Of Procedural Control In Determining Who May Sue Or Be Sued: Lessons In Statutory Interpretation From Civil Rico And Sedima, Douglas E. Abrams

Faculty Publications

When a federal court resolves equipoise in its effort to determine the contours of a litigant class created by an express private cause of action, the court should consider the control that the Federal Rules of Civil Procedure, taken as a whole, exercise on the conduct of litigation. With civil RICO as background, part II presents this thesis and discusses the circumstances in which procedural control would be an element supporting a determination *1481 that Congress created a broad litigant class. Implicit in the notion of equipoise is the threshold recognition that when a court engages in statutory interpretation, it …

The Gospel And Feminism: A Proposal For Lutheran Dogmatics, Lois E. Malcolm Jul 1985

The Gospel And Feminism: A Proposal For Lutheran Dogmatics, Lois E. Malcolm

Faculty Publications

The aim of this essay is to identify the theological, and deeply Christian, point of resonance between Lutheran and feminist theologies. It begins with a brief overview of themes in Christian feminist theologies; it then offers rationale and recommendations for why and how Lutheran dogmatics should critically engage feminist perspectives so that it can better serve the task of assisting Christians in their proclamation of the promise in Jesus’ gospel.

Statistical Assumption-Making In Library Collection Assessment: Peccadilloes And Pitfalls, Richard Hacken Jun 1985

Statistical Assumption-Making In Library Collection Assessment: Peccadilloes And Pitfalls, Richard Hacken

Faculty Publications

Assessing library collections in the Semiconductor Age necessarily involves a heavy use of quantitative data. The assumptions made during the process of gathering, manipulating, and reporting library statistics may or may not be valid ones. Objective and vigilant scrutiny, therefore, can make the difference between an assessment that adds to a greater knowledge of the collection and one that only adds greater bulk to The File. Among the areas affected by statistical assumptions are (in lay terms): the sample, the survey, the percentage, the average, the degree of accuracy.

From Balconies To Tanks: Post Junta Civil-Military Relations In Greece, Constantine P. Danopoulos Apr 1985

From Balconies To Tanks: Post Junta Civil-Military Relations In Greece, Constantine P. Danopoulos

Faculty Publications

This article analyzes the reasons why praetorianism in Greece has not been followed by more of the same, as appears to be the case in most states that have experienced military rule. After a careful examination of the available data, it was concluded that having learned their lesson, both the civilian and military elites have played a role in keeping the armed forces away from the levers of political authority, the civilians by following carrot and stick policies designed not to encroach on the military's corporate interests, and the armed forces by accepting the view that they can best protect …

Toward A General Theory Of Church-State Relations And The First Amendment, Carl H. Esbeck Jan 1985

Toward A General Theory Of Church-State Relations And The First Amendment, Carl H. Esbeck

Faculty Publications

Although government intervention in religious affairs is a new and understandably worrisome experience for many American churches, history instructs us that the confrontation is not novel. We can find some comfort in the fact that this double wrestle of state with church and state with individual believers is a perennial match. After all, it has been nearly sixty years since a brutish measure in Oregon making parochial school education unlawful had to be sidelined by the United States Supreme Court in Pierce v. Society of Sisters.' Over forty-five years ago the Supreme Court decided Lovell v. City of Griffin, snuffing …

The Naked Public Square: Religion And Democracy In America , Carl H. Esbeck

Faculty Publications

A crisis of confidence in our institutions and talk about loss of life's purpose are everywhere. Sociologists describe the modern individual's sense of isolation, his so-called spiritual homelessness, his weakening sense of values, and his bewilderment in the face of seemingly impersonal forces before which he feels helpless and often victimized.

Academic Library Services: The Literature Of Innovation, Jo Bell Whitlatch, Judy Reynolds Jan 1985

Academic Library Services: The Literature Of Innovation, Jo Bell Whitlatch, Judy Reynolds

Faculty Publications

Innovation has the potential for increasing the effectiveness of information service. As a result of this interest in innovation, organizational theorists have begun to explore the effect of organizational design upon flexibility, creativity, and productivity of organizations. A review of existing literature, however, provides no comprehensive theory of organizational innovation. Research on organizational design and innovation in libraries could contribute to the systematic study of the impact of organization structure . Studies by Howard and Luquire indicate that traditional library organizations may inhibit change as well as the reexamination of values and service. Further study is needed to determine how …

Effects Of Water Quality And Water Quantity On Nutritional Status: Findings From A South Indian Community, James R. Hébert Jan 1985

Effects Of Water Quality And Water Quantity On Nutritional Status: Findings From A South Indian Community, James R. Hébert

Faculty Publications

Quantitative assessments of the relative effects on health of various aspects of water supply are virtually absent from the literature. Despite the lack of information, resources are being allocated throughout the developing world, for projects related to water and sanitation. The present study was designed specifically to overcome many of the methodological problems that other researchers have faced. Data were collected concerning the nutritional status of 627 children in three urban communities in South India. Information was also collected on water quality, water quantity, household sanitation, socioeconomic conditions, and housing. A statistical technique is presented that allows for controlling potential …
