Equality Between Adults And Children: Its Meaning, Implications, And Opposition, James G. Dwyer Jan 2013

Equality Between Adults And Children: Its Meaning, Implications, And Opposition, James G. Dwyer

Faculty Publications

Family law scholars have devoted much attention to equality among groups of adults and some attention to equality between groups of children. There has been little exploration, however, of the notion of equality between adults and children. In this Article, I first explain what it means at a basic, theoretical level to speak of such equality. I then identify some practical implications. Finally, I consider why there is great resistance to many practical implications of children's equality, even among those who would consider themselves advocates for child welfare.

The Quality Of Spouses’ Social Networks Contributes To Each Other’S Cardiovascular Risk, Wendy C. Birmingham, Bert N. Uchino, Timothy W. Smith, Mckenzie Carlisle, Kathleen C. Light Jan 2013

The Quality Of Spouses’ Social Networks Contributes To Each Other’S Cardiovascular Risk, Wendy C. Birmingham, Bert N. Uchino, Timothy W. Smith, Mckenzie Carlisle, Kathleen C. Light

Faculty Publications

Objectives: Although the quality of one’s own social relationships has been related to cardiovascular morbidity and mortality, whether a partner’s social network quality can similarly influence one’s cardiovascular risk is unknown. In this study we tested whether the quality of a partner’s social networks influenced one’s own ambulatory blood pressure (ABP). Methods: The quality of 94 couples’ social networks was determined using a comprehensive model of relationships that separates out social ties that are sources of positivity(supportive), negativity (aversive), and both positivity and negativity (ambivalent). We then utilized statistical models (actor-partner analyses) that allowed us to separate out the links …

Academic Performance, Course Completion Rates, And Student Perception Of The Quality And Frequency Of Interaction In A Virtual High School, Abigail Hawkins, Charles R. Graham, Richard R. Sudweeks, Michael K. Barbour

Faculty Publications

This study examined the relationship between students’ perceptions of teacher– student interaction and academic performance at an asynchronous, self-paced, statewide virtual high school. Academic performance was measured by grade awarded and course completion. There were 2269 students who responded to an 18-item survey designed to measure student perceptions on the quality and frequency of teacher–student interaction. Quality of interaction was subdivided into three constructs representing feedback, procedural, and social interaction. A confirmatory factor analysis helped to establish the fit of the statistical model for teacher–student interaction. Hierarchical logistical regression indicates that an increase in the quality and frequency of interaction …

Caring In A Technology-Mediated Online High School Context, Andrea Velasquez, Charles R. Graham, Richard Osguthorpe Jan 2013

Caring In A Technology-Mediated Online High School Context, Andrea Velasquez, Charles R. Graham, Richard Osguthorpe

Faculty Publications

The objective of this study was to describe how caring is experienced in the technology-mediated context of the Open High School in Utah, an online charter high school. Two female teachers, two male students, and two female students were interviewed three times over 9 months regarding their experience of caring teacher–student interactions. Data were analyzed using interpretative phenomenological analysis (IPA). Discovered themes were then organized into three superordinate themes: engrossment, motivational displacement, and reciprocity. Results suggest not only that caring interactions are possible in the online context, but also that specific caring pedagogies can strengthen the teacher–student relationship online. Additionally, …

Parental Influence On Inhalant Use, Alina M. Baltazar, Gary L. Hopkins, Duane C. Mcbride, Curtis J. Vanderwaal, Sara Pepper, Sarah Mackey

Faculty Publications

The purpose of this article is to examine the dynamics of the relationship between parents and their adolescent children and their association with lifetime and past-month inhalant usage. The population studied was seventh- through ninth-grade students in rural Idaho (N = 570). The authors found a small, but consistent, significant inverse correlation between parental bonding and monitoring of behavior and inhalant usage. There was also a significant positive correlation between verbally aggressive behavior in the family and inhalant use. The data imply that family interaction may play a significant role in the use of inhalants and that the family can …

The Limits Of Violence: People And Property In Edward Abbey's "Monkeywrenching" Novels, David Thomas Sumner Jan 2013

The Limits Of Violence: People And Property In Edward Abbey's "Monkeywrenching" Novels, David Thomas Sumner

Faculty Publications

This paper explores Edward Abbey’s fiction asking what kind of ethical imperative his monkeywrenching novels offer. While advocating the destruction of property in defense of wilderness, The Monkey Wrench Gang draws a clear ethical distinction between the destruction of property in defense of wilderness and the harming of people. Yet the sequel, Hayduke Lives!, blurs this ethical line when a security guard is killed during the novel’s final eco-sabotage scene. After exploring several possible textual explanations for this apparent change and then interviewing several of Abbey’s close friends regarding this issue, the author concludes that the shift does not …

Eco-Terrorism Or Eco-Tage: An Argument For The Proper Frame, David Thomas Sumner, Lisa M. Weidman Jan 2013

Eco-Terrorism Or Eco-Tage: An Argument For The Proper Frame, David Thomas Sumner, Lisa M. Weidman

Faculty Publications

What does the term “terrorism” mean? Is it accurate to lump illegal acts that destroy property but carefully avoid harming people into the same category as acts clearly intended to kill? Is this a difference of kind or just of degree? While we (the authors) don't generally endorse the destruction of property as a method of generating social change, we believe that the destruction of property is fundamentally different from the intentional killing of people; therefore, to label acts of obstruction, trespassing, vandalism, sabotage, or arson as “terrorism” is inaccurate and has the potential to damage one's understanding of real …

The Face Of Fakes: U.S. Consumers And Counterfeit Fashion Products, Karen Edwards J.D., Jason Carpenter Jan 2013

The Face Of Fakes: U.S. Consumers And Counterfeit Fashion Products, Karen Edwards J.D., Jason Carpenter

Faculty Publications

Counterfeit products pose a serious threat to fashion product brand owners and to the world economy. While research on the demand side of counterfeiting has grown over the past two decades, few extant studies have been conducted among non-student consumers outside Asia and Europe and few studies have focused on product categories other than consumer electronic-related items. Using a sample of U.S. consumers (N=305), the current research investigates consumer attitudes in the context of fashion products. Findings suggest that gender and education are the two variables most frequently related to purchase intention for counterfeits, beliefs about counterfeit products, and ethicality. …

Attending To Reality: Iris Murdoch’S Ethical Realism, Ante Jeroncic Jan 2013

Attending To Reality: Iris Murdoch’S Ethical Realism, Ante Jeroncic

Faculty Publications

Even a scant acquaintance with current cultural and philosophical trends will readily point to a widespread predilection for subjectivist forms of moral reasoning. By “subjectivist” I refer to various non-cognitivist and constructionist paradigms in moral philosophy and popular parlance that reduce ethical statements to expressions of individual or collective preferences, feelings, or prejudices stripped of any object-given normativity. The following are but some of the factors that fuel such perspectives: the proverbial fact/value dichotomy and anti-realist sentiments pervading large swaths of analytic philosophy; poststructuralist and postcolonial “genealogies” that tie the language of universal morality to discourses of power, patriarchy, and …

Food Safety Attitudes In College Students: A Structural Equation Modeling Analysis Of A Conceptual Model, Rachelle Booth, Maggie Hernandez, Erica L. Baker, Tevni Grajales, Peter Pribis

Faculty Publications

College students are one of the most at-risk population groups for food poisoning, due to risky food safety behaviors. Using the Likert Scale, undergraduate students were asked to participate in a Food Safety Survey which was completed by 499 students ages 18–25. Data was analyzed using SPSS and AMOS statistical software. Four conceptual definitions regarding food safety were defined as: general food safety, bacterial food safety, produce food safety, and politics associated with food safety. Knowledge seems to be an important factor in shaping students attitudes regarding general and bacterial safety. Ethnicity plays a role in how people view the …

How About The Real Responders' Perceptions? A Comparative Case Study On School Principals' Perceptions Of School Administration Through Metaphors In Usa And Turkey, Harun Parpucu, Ibrahim H. Karatas

Faculty Publications

Expectations of school administration changed dramatically over the course of the 20th century. Today, the roles and responsibilities of school administrators must be re-defined for success in the 21st century. The current research aimed at revealing the perception of school leadership by school administrators who were expected to cope with problems and enable students to succeed in the U.S. and Turkey. Comparative case study design was used to analyze and compare the U.S. and Turkey school administrators’ perceptions of school leadership through metaphors. The study sample consisted of 47 school administrators employed in K-12 schools in Turkey and the U.S. …

(Excerpt)

In 2007, two very influential institutes published reports that challenged legal educators to reconsider how they design courses, deliver instruction, assess their students’ learning and explore new ways to prepare students for the profession of law. The Carnegie Foundation for the Advancement of Teaching published its report, Educating Lawyers: Preparation for the Profession of Law (“Carnegie Report”), and the Clinical Legal Education Association published its study, Best Practices for Legal Education (“Best Practices Report”) (collectively, the “Reports”). Both Reports came to the same conclusion: law schools must devote more attention and resources to helping students develop the professional skills …

Rights And Wrongs In The Debate Over Single-Sex Schooling, Rosemary C. Salomone Jan 2013

Rights And Wrongs In The Debate Over Single-Sex Schooling, Rosemary C. Salomone

Faculty Publications

(Excerpt)

In September 2011 an article entitled The Pseudoscience of Single-Sex Schooling appeared in the journal Science. Unlike articles typically published in peer-reviewed journals, the primary intent in this case was not to inform the scholarly community but rather to accomplish larger political and legal ends. Co-authored by eight prominent psychologists and neuroscientists, it immediately made the front pages of national newspapers and soon took the international media by storm. From the United Kingdom to Australia, New Zealand, India, and South Africa, it gave rise to a global debate about the pros and cons of single-sex schooling.

As directly …

What Sally Soprano Teaches Lawyers About Hitting The Right Ethical Note In Adr Advocacy, Elayne E. Greenberg Jan 2013

What Sally Soprano Teaches Lawyers About Hitting The Right Ethical Note In Adr Advocacy, Elayne E. Greenberg

Faculty Publications

(Excerpt)

Paradoxically, when lawyers opt to mediate or arbitrate, lawyers may still wind up selecting, shaping and advocating in these dispute resolution processes to resemble the very litigation process they have sought to avoid. After all, litigation likely comports with the lawyer’s own conflict style, comfort level and concepts of justice. As a consequence of this litigation bias, we see that the metaphorical doors of a multi-door courthouse that once offered a menu of dispute resolution choices are increasingly leading us back to one choice: a variation of the litigation door. Even though the Model Rules of Professional Conduct confirm …

Marks, Morals, And Markets, Jeremy N. Sheff Jan 2013

Marks, Morals, And Markets, Jeremy N. Sheff

Faculty Publications

The prevailing justification for trademark law depends on economic arguments that cannot account for much of the law's recent development, nor for mounting empirical evidence that consumer decisionmaking is inconsistent with assumptions of rational choice. But the only extant theoretical alternative to economic analysis is a Lockean "natural rights" theory that scholars have found even more unsatisfying. This Article proposes a third option. I analyze the law of trademarks and unfair competition as a system of moral obligations between producers and consumers. Drawing on the contractualist tradition in moral philosophy, I develop and apply a new theoretical framework to evaluate …

Family-Focused Physical Activity, Diet, And Obesity Interventions In African-American Girls: A Systematic Review, Daheia J. Barr-Anderson, Alexis W. Adams-Wynn, Katherine I. Disantis, Shiriki Kumanyika

Faculty Publications

Obesity interventions that involve family members may be effective with racial/ethnic minority youth. This review assessed the nature and effectiveness of family involvement in obesity interventions among African-American girls aged 5-18 years, a population group with high rates of obesity. Twenty-six databases were searched between January 2011 and March 2012, yielding 27 obesity pilot or full-length prevention or treatment studies with some degree of family involvement and data specific to African-American girls. Interventions varied in type and level of family involvement, cultural adaptation, delivery format, and behavior change intervention strategies; most targeted parent-child dyads. Some similarities in approach based on …

Clarity And Chaos: Is There A Preferred Citation Style In Business Academic Literature?, Leticia Camacho

Faculty Publications

While there is no official style for business writing, the most common citation style in business research has not been determined previously. The purpose of this study is to evaluate the top scholarly business journals to determine the most commonly used citation style in business academic research. The author used the list of 452 top business journals included in the Social Sciences Citation Index (SSCI) Journal Citation Report. The results show that 69% of business journals use a publisher-dictated style, whereas of the “traditional” citation styles, 11% use the American Psychological Association style, 10% use Harvard style, 8% use Chicago …

Teaching Care Ethics: Conceptual Understandings And Stories For Learning, Colette Rabin, Grinell Smith Jan 2013

Teaching Care Ethics: Conceptual Understandings And Stories For Learning, Colette Rabin, Grinell Smith

Faculty Publications

An ethic of care acknowledges the centrality of the role of caring relationships in moral education. Care ethics requires a conception of ‘care’ that differs from the quotidian use of the word. In order to teach care ethics more effectively, this article discusses four interrelated ways that teachers’ understandings of care differ from care ethics: (1) conflating the term of reference ‘care’ with its quotidian use; (2) overlooking the challenge of developing caring relationships; (3) tending toward monocultural understandings of care; and (4) separating affect and intellect. Awareness of these conceptions of care supports teacher educators to teach care ethics …

Teaching The Post-Sex Generation, Kerri Lynn Stone

There is a trend that I have observed in the course of leading my classes in discussions about the kinds of behavior that may constitute unlawful discrimination: the emergence of an attitude among students that society is simply “post-sex,” or no longer in need of most or all anti-sex discrimination jurisprudence. This Article details my own approach to teaching and to raising and conducting discussions about how anti-discrimination legislation and jurisprudence works in theory, in practice, and how it would/could work in an ideal world. I enjoy teaching students with a diversity of viewpoints. However, when I began to encounter …
