Integrated Optical Waveguides With Liquid Cores, Aaron R. Hawkins, John P. Barber, Dongliang Yin, D. W. Deamer, Holger Schmidt
Faculty Publications
We report the design, fabrication, and demonstration of single-mode integrated optical waveguides with liquid cores. The principle of the device is based on antiresonant reflecting optical (ARROW) waveguides with hollow cores. We describe design principles for waveguide loss optimization down to 0.1/cm. Using a fabrication process based on conventional silicon microfabrication and sacrificial core layers, waveguides of varying widths and lengths with volumes covering the pico- to nanoliter range were fabricated. We observe confined mode propagation, measure waveguide losses of 2.4/cm, and demonstrate that the waveguides possess tailorable wavelength selectivity. The potential for highly integrated, sensitive devices based on these …

Optical Properties And Application Of Uranium-Based Thin Films For The Extreme Ultraviolet And Soft X-Ray Region, Richard L. Sandberg, David D. Allred, Shannon Lunt, Marie K. Urry, R. Steven Turley
Faculty Publications
Uranium oxide and uranium nitride thin films reflect significantly more than all previously known/standard reflectors (e.g., nickel, gold, and iridium) for most of the 4-10 nm range at low angles of incidence. This work includes measurements of the EUV/soft x-ray (2-20 nm) reflectance of uranium-based thin films (~20 nm thick) and extraction of their optical constants (d and ?). We report the reflectances at 5, 10, and 15 degrees grazing incidence of air-oxidized sputtered uranium, reactively sputtered (O2) uranium oxide, and reactively sputtered (N2) uranium nitride thin films measured at Beamline 6.3.2 at the Advanced Light Source (ALS) at Lawrence …
The Role Of Optimal Healing Environments In The Management Of Childhood Obesity, Marjorie Freedman, Judith Stern
The Role Of Optimal Healing Environments In The Management Of Childhood Obesity, Marjorie Freedman, Judith Stern
Faculty Publications
The prevalence of childhood and adolescent obesity has increased steadily over the past three decades such that obesity is now a major worldwide pediatric health risk factor. Pediatric obesity is associated with significant health problems, and is an important early risk factor for adult morbidity and mortality. This paper focuses on the role and components of optimal healing environments (OHEs) that may be useful in the management of childhood obesity: healing intention, healing relationships, health promotion and disease prevention, and healing spaces. Diet, physical activity, and behavior modification strategies used in the treatment of childhood obesity are also reviewed.

Questioning Deference, Christina E. Wells
Questioning Deference, Christina E. Wells
Faculty Publications
This article examines the accepted axiom that courts should defer to the government's actions during national security crises even when such actions potentially violate citizens' constitutional rights. The paper questions two assumptions underlying that axiom - first, that executive officials are best equipped to determine when security needs justify liberty infringements and, second, that judges are particularly unqualified to meddle in security issues, even when civil liberties are involved. Relying on psychological theories regarding the role that fear plays in skewing risk assessment and historical analyses of past crises, the paper argues that times of crisis lend themselves to unnecessary …
Encouraging Courage: Law's Response To Fear And Risk, William B. Fisch
Encouraging Courage: Law's Response To Fear And Risk, William B. Fisch
Faculty Publications
Our three papers provide a helpful review of the many things that can go wrong with our system for the protection of civil liberties under the pressures of war or other emergencies. Professor Winfield focuses on the U.S. Attorney General, the non-judicial officer from whom the public might expect the highest fidelity to the law and the constitution. She offers a sobering perspective on the ways in which those expectations can be and have been disappointed. The star of her taxonomy, I take it, is the Leveler, who reaches an independent (and rights-protective!) view of the law and works to …

The articles and essays included or referenced in this volume discuss both the factors that affect decision making in times of crisis and their implications for law and democratic theory. Professor Cass Sunstein's keynote address, Fear and Liberty, noted that psychological biases such as the availability heuristic and probability neglect can skew risk perception, leading to excessive public fear of national security risks and unreasonable curtailment of civil liberties. According to Sunstein, courts, which are typically responsible for protecting civil liberties, often lack sufficient information to assess whether national security concerns justify incursions on civil liberties. Nevertheless, he concluded that …
"National Security" Information And The Freedom Of Information Act, Christina E. Wells
"National Security" Information And The Freedom Of Information Act, Christina E. Wells
Faculty Publications
Secrecy regarding national security information is a widely accepted phenomenon. Throughout history, however, such secrecy has proved problematic. Although officials often have credible and legitimate reasons to keep national security information secret, government secrecy initiatives have invariably expanded to encompass information beyond their initial rationale. Over time, we have come to realize the very real problems associated with excessive government secrecy.

Towards Scalable Linear-Optical Quantum Computers, J. P. Dowling, J. D. Franson, H. Lee, G. J. Milburn
Faculty Publications
Scalable quantum computation with linear optics was considered to be impossible due to the lack of efficient two-qubit logic gates, despite the ease of implementation of one-qubit gates. Two-qubit gates necessarily need a non-linear interaction between the two photons, and the efficiency of this non-linear interaction is typically very small in bulk materials. However, it has recently been shown that this barrier can be circumvented with effective non-linearities produced by projective measurements, and with this work linear-optical quantum computing becomes a new avenue towards scalable quantum computation. We review several issues concerning the principles and requirements of this scheme. © …

The Fable Of Federal Environmental Regulation: Reconsidering The Federal Role In Environmental Protection, Jonathan H. Adler
The Fable Of Federal Environmental Regulation: Reconsidering The Federal Role In Environmental Protection, Jonathan H. Adler

Cleveland was the site of one of the seminal events in environmental history. On the morning of June 22, 1969, a stray spark ignited oil and debris on the surface of the Cuyahoga River. The resulting fire attracted relatively little local attention in Cleveland, but became a national event. Subsequently, Time, National Geographic, and The New York Times all wrote about the fire. It even inspired a song by Randy Newman. By many accounts, it lit the spark that led to the passage of the Federal Clean Water Act.
There are some problems with the traditional story of the Cuyahoga …

Drifting Down The Dnieper With Prince Potemkin: Some Skeptical Reflections About The Place Of Compliance Programs In Federal Criminal Sentencing (Symposium), Frank O. Bowman Iii

This Article explains how the federal organizational sentencing guidelines work and how they have created incentives for businesses to set up compliance programs. It then considers the paucity of evidence that compliance programs actually prevent the occurrence of corporate crime. It also questions whether investments in compliance programs make sense even for companies caught in a federal criminal investigation. There is little evidence that compliance programs have any significant effect on the likelihood that federal prosecutors will file criminal charges in the first instance. Even more surprisingly, examination of U.S. Sentencing Commission statistics reveals that the compliance program movement seems …

Fear And Risk In 'Times Of Crisis': The Media's Challenge, Richard C. Reuben
Faculty Publications
As we have heard time and again during this conference, perspective is a crucial safeguard against the distorting effect of fear. While space and consumer patience may be thin, it is during times of crisis that the media's capacity to provide context becomes most important. This is part of the challenge of risk communication. Editors need to insist on this perspective rather than trying to cut it out if the story still reads, and reporters need to learn how to write about it effectively as well as compellingly. None of these challenges is easy. Institutional reform never is. But I …

There are a number of issues facing those who wish to employ learning objects to facilitate learning. These issues are not, however, inherent in the component-based paradigm. The first section of this paper describes some of the most difficult issues to be resolved. In the second section, we present a model of the use of learning objects that is grounded in a object-based paradigm. In the third section, we describe the …

Sponsorship: JPL Subcontract 961461. Nadir and off-nadir measurements of electromagnetic (EM) bias measurements are presented and compared with an off-nadir bias model. Measurements of the bias were made during the BYU Off-Nadir Experiment (Y-ONE) in the months of March and April, 2003. Using radar measurements of the surface and backscattered power, the EM bias was computed at angles from nadir to 17º degrees. Simultaneous surface measurements from a laser rangefinder provide accurate measurements of the long wave surface parameters. An off-nadir bias model incorporating the effects of hydrodynamic modulation of short waves and tilt modulation of long waves is developed …

The objectives of this study were to evaluate the effects of cryoprotectant, osmotic pressure, cooling rate, equilibration time, and sperm-to-extender ratio, as well as somatic relationships of body length, body weight, and testis weight to sperm density in the platyfish Xiphophorus couchianus. Sperm motility and survival duration after thawing were significantly different between cryopreservation with dimethyl sulfoxide (DMSO) and glycerol, with the highest motility at 10 min after thawing obtained with 14% glycerol. With subsequent use of 14% glycerol as cryoprotectant, the highest motility after thawing was observed with Hanks' balanced salt solution (HBSS) across a range of 240-300 mOsm/kg. …

The detection of saccharides in biological media is of great current importance for the monitoring of disease states. We have previously reported that solutions of boronic acid-functionalized macrocycles form acyclic oligomeric materials in situ. The oligomers contain fluorescent xanthene moieties. Current efforts are aimed at modulating the spectroscopic responses of these materials for the analysis of specific sugars. We describe conditions whereby the xanthene boronic acids exhibit high colorimetric fructose selectivity. In contrast, at physiological levels selective glucose monitoring can be achieved via fluorescence. Additionally, we describe a method which exhibits promise for detecting both glucose and fructose at dual …

The unicellular green alga Chlamydomonas reinhardtii acclimates to a low-CO2 environment by modifying the expression of a number of messages. Many of the genes that increase in abundance during acclimation to low-CO2 are under the control of the putative transcription factor Cia5. C. reinhardtii mutants null for cia5 do not express several of the known low-CO2 inducible genes and do not grow in a low-CO2 environment. Two of the genes under the control of Cia5, Ccp1 and Ccp2, encode polypeptides that are localized to the chloroplast envelope and have a high degree of similarity to members of the mitochondrial carrier …

A typical NURBS surface model has a large percentage of superfluous control points that significantly interfere with the design process. This paper presents an algorithm for eliminating such superfluous control points, producing a T-spline. The algorithm can remove substantially more control points than competing methods such as B-spline wavelet decomposition. The paper also presents a new T-spline local refinement algorithm and answers two fundamental open questions on T-spline theory.

Background: The genus Arachis is native to a region that includes Central Brazil and neighboring countries. Little is known about the genetic variability of the Brazilian cultivated peanut (Arachis hypogaea, genome AABB) germplasm collection at the DNA level. The understanding of the genetic diversity of cultivated and wild species of peanut (Arachis spp.) is essential to develop strategies of collection, conservation and use of the germplasm in variety development. The identity of the ancestor progenitor species of cultivated peanut has also been of great interest. Several species have been suggested as putative AA and BB genome donors …

After the first business plan competition, in May 2003, San José State University (SJSU) faculty and community entrepreneurs serving on the university’s Silicon Valley Center for Entrepreneurship (SVCE) concluded that the process should be spread over an academic year. Hence, the New Venture Fair (NVF) was born, which was held Dec. 16, 2003. The feedback from all sources has been very positive regarding the NVF. A significant NVF exhibit was the Hewlett Packard Mobile Computing Grant (HPMCG). All teams completed projects that were impressive to most observers from the university and greater community but additional lessons were learned that will …

The Evil Of Administrative Ethics, Melvin J. Dubnick, Jonathan B. Justice
The Evil Of Administrative Ethics, Melvin J. Dubnick, Jonathan B. Justice

One recent development in the literature concerned with administrative ethics has been an explicit concern with defining and then preventing or redressing a variety of forms of so-called administrative evil. Definitions of evil encompass a range of behaviors and consequences ranging from the genuinely horrific to the merely unpleasant. This essay locates the concern with administrative evil within the context of post-Enlightenment Western philosophers’ efforts to come to grips with ethically or metaphysically incomprehensible wrongs. In this context, “evil” can be understood as a social constructed category of agents and acts which is specific to particular moral communities and so …
