Exempting High-Level Employees And Small Employers From Legislation Invalidating Predispute Employment Arbitration Agreements, E. Gary Spitko Dec 2009

Exempting High-Level Employees And Small Employers From Legislation Invalidating Predispute Employment Arbitration Agreements, E. Gary Spitko

Faculty Publications

On February 12, 2009, lawmakers in the U.S.House of Representatives introduced the "Arbitration Fairness Act of 2009. " This bill, if enacted, will invalidate any predispute arbitration agreement between an employer and its employee. Last year, the 110th Congress considered the narrower "Preservation of Civil Rights Protections Act of 2008, " which would have invalidated such predispute arbitration agreements if they required "arbitration of a dispute arising under" federal civil rights laws. This Article explores how best to structure any such invalidation of predispute employment arbitration agreements, both in light of the rationales for and against regulation of the employment …

The Sound-Symbolic Expression Of Animacy In Amazonian Ecuador, Janis B. Nuckolls Dec 2009

The Sound-Symbolic Expression Of Animacy In Amazonian Ecuador, Janis B. Nuckolls

Faculty Publications

Several anthropologists of Amazonian societies in Ecuador have claimed that for Achuar [1] and Quichua speaking Runa [2,3,4] there is no fundamental distinction between humans on the one hand, and plants and animals on the other. A related observation is that Runa and Achuar people share an animistic cosmology whereby animals, plants, and even seemingly inert entities such as rocks and stones are believed to have a life force or essence with a subjectivity that can be expressed. This paper will focus on Quichua speaking Runa to seek linguistic evidence for animacy by examining the sound-symbolic properties of a class …

Why We Don't Understand The Rule Of Law, Noel B. Reynolds Oct 2009

Why We Don't Understand The Rule Of Law, Noel B. Reynolds

Faculty Publications

This paper presents an assessment of current theories of law and their continuing failure to account in a convincing way for the rule of law as an ideal that guides and reassures modern democratic societies. It then explores the possibility that emerging understandings of human evolution and brain function may help us understand the process of convention making in a way that could reveal the underlying moral and epistemological context of law and allow us to identify a complete set of standards for the rule of law in human societies.

Meeting The Need For K-8 Teachers For Classrooms With Culturally And Linguistically Diverse Students: The Promise And Challenge Of Early Field Experiences, Amy Strage, Susan Gomez, Kari Knutson-Miller, Ana Garcia-Nevarez

Faculty Publications

The writers present the findings of their study focused on teacher learning through early fieldwork experiences to address the problem of teachers working with a culturally and linguistically diverse student population. Data were analyzed from an archive collected from approximately 500 students enrolled in six undergraduate child development courses at three state university campuses located in urban areas of California. Findings suggest that early field experiences provide participants with opportunities for career goal clarification, and the context of field experience is significant and may lead to outcomes beyond the initial goal of the experience.

Podcasting: An Effective Tool For Honing Language Students' Pronunciation?, Lara Ducate, Lara Lomicka

Faculty Publications

This paper reports on an investigation of podcasting as a tool for honing pronunciation skills in intermediate language learning. We examined the effects of using podcasts to improve pronunciation in second language learning and how students' attitudes changed toward pronunciation over the semester. A total of 22 students in intermediate German and French courses made five scripted pronunciation recordings throughout the semester. After the pronunciation recordings, students produced three extemporaneous podcasts. Students also completed a pre- and post-survey based on Elliott's (1995) Pronunciation Attitude Inventory to assess their perspectives regarding pronunciation. Students' pronunciation, extemporaneous recordings, and surveys were analyzed to …

Acoustic And Spectral Patterns In Young Children's Stop Consonant Productions, Shawn L. Nissen, Robert Allen Fox Sep 2009

Acoustic And Spectral Patterns In Young Children's Stop Consonant Productions, Shawn L. Nissen, Robert Allen Fox

Faculty Publications

The aim of this study was to examine the acoustic and spectral patterns of stop articulation in the speech of pre-pubescent children. A set of voiceless stop consonants, /ptk/, produced by a group of adults and typically developing children 3-5 years of age were examined in terms of multiple acoustic and spectral parameters. Findings indicated that, with the exception of spectral kurtosis, the acoustic and spectral characteristics of the stop productions varied significantly as a function of place of articulation and vowel context. Sex-specific differences in spectral slope, mean, and skewness were found for the 5-year-old and adult speakers. Such …

A Narrative Account Of The Wider Impact Of The 7 July 2005 London Bomb Attacks, Shahid Bux, Sarah M. Coyne

Faculty Publications

The London bombings on 7 July 2005 highlighted the prevailing terrorist threat to the UK. The present study addressed the psychological response of community (n=294) indirectly exposed to the attacks to discern he broader impact and effects of terrorism. Qualitative content analysis was used to develop a profile of emotions and responses to the attacks. This was supplemented by the use of linguistic analysis demonstrating the enormous heterogeneity and complexity of responses to terrorism. In light of previous work on the wider impact of terrorism, the present study highlighted a relatively restrained impact of terrorism. Notwithstanding this observation, responses were …

Psychologism And American Instructional Technology, David Wiley, Bekir Gur

Faculty Publications

Note: This is not the final draft of the article. The centrality of psychology in the field of instructional technology has never been comprehensively questioned; most instructional technologists have assumed that (behaviorist, cognitivist, constructivist, or another) psychology is the natural foundation for education and thus for instructional technology. The driving question of this article is: What are the problems of psychologism as found in the theories and practices of instructional technology? We present a brief genealogy of American instructional technology in relation to the influence of psychology; review critical psychology and discuss some problems of psychologism focusing on positivism, metaphysics, …

Testimonial Deficiencies And Evidentiary Uncertainties In International Criminal Trials, Nancy Amoury Combs Apr 2009

Testimonial Deficiencies And Evidentiary Uncertainties In International Criminal Trials, Nancy Amoury Combs

Faculty Publications

In this article, the author describes the flaws inherent in the process of international criminal tribunals which seek to punish the inhumane actions of dictators. The author first describes how international criminal trials confront severe impediments to accurate factfinding. It continues on to discuss the failure of witnesses in these tribunals to accurately convey the information needed to make a fully- informed decision. This problem is compounded by the fact that what clear information is provided during witness testimony often is inconsistent with the information that the witness previously provided in a pre-trial statement. The author also explores the causes …

Prosecutorial Shaming: Naming Attorneys To Reduce Prosecutorial Misconduct, Adam M. Gershowitz Apr 2009

Prosecutorial Shaming: Naming Attorneys To Reduce Prosecutorial Misconduct, Adam M. Gershowitz

Faculty Publications

This Article explores the unfortunately large number of instances in which appellate courts reverse convictions for serious prosecutorial misconduct but do not identify the names of the prosecutors who committed that misconduct. Because judges are reluctant to publicly shame prosecutors whose cases are reversed, this Article advocates that a neutral set of third parties undertake the responsibility of publicly identifying prosecutors who have committed serious misconduct. The naming of prosecutors will shame bad actors, provide a valuable pedagogical lesson for junior prosecutors, and signal to trial judges that certain prosecutors must be monitored more closely to avoid future misconduct.

Swearing In The Cinema: An Analysis Of Profanity In Us Teen-Oriented Movies, 1980-2006, Dale Cressman, Mark Callister, Tom Robinson, Chris Near

Faculty Publications

The exposure of children to profanity continues to be a concern for parents, media researchers, and policy makers alike. This study examines the types, frequency, and usage of profanity in movies directed at and featuring teenagers. A review of relevant literature explores the nature, use, and psychology of profanity, its potential social effects, and its prevalence in the media. A content analysis was conducted of the ninety top-grossing domestic teen films in the 1980s, 1990s, and 2000s (thirty from each decade) in the US based on domestic gross box-office amounts. Results indicate no change in preferences in types of profanity …

Adult And Child Semantic Neighbors Of The Kroll And Potter (1984) Nonobjects, Holly L. Storkel, Suzanne M. Adlof

Faculty Publications

Purpose - The purpose was to determine the number of semantic neighbors, namely semantic set size, for 88 nonobjects (J. F. Kroll & M. C. Potter, 1984) and determine how semantic set size related to other measures and age.

Method - Data were collected from 82 adults and 92 preschool children in a discrete association task. The nonobjects were presented via computer, and participants reported the first word that came to mind that was meaningfully related to the nonobject. Words reported by two or more participants were considered semantic neighbors. The strength of each neighbor was computed as the …

A New Look At Translation: Teaching Tools For Language And Literature, Anne Fountain, Catherine Fountain Mar 2009

A New Look At Translation: Teaching Tools For Language And Literature, Anne Fountain, Catherine Fountain

Faculty Publications

Does translation have a place in the modern language or literature classroom? This article argues that as long as translation is recognized as a distinct skill rather than a path to language acquisition it can and should play a role in language instruction. The rising popularity of Web-based machine translation (WBMT) sites among students points to a need to help foreign language learners better understand the translation process. Along with a discussion of how instructors can minimize inappropriate use of WBMT, the article provides examples of how translation in the proper context can be used productively to teach both language …

Argument Structure Effects In Action Verb Naming In Static And Dynamic Conditions, Dirk B. Den Ouden, Steve Fix, Todd B. Parrish, Cynthia K. Thompson Mar 2009

Argument Structure Effects In Action Verb Naming In Static And Dynamic Conditions, Dirk B. Den Ouden, Steve Fix, Todd B. Parrish, Cynthia K. Thompson

Faculty Publications

Argument structure, as in the participant roles entailed within the lexical representation of verbs, affects verb processing. Recent neuroimaging studies show that when verbs are heard or read, the posterior temporoparietal region shows increased activation for verbs with greater versus lesser argument structure complexity, usually bilaterally. In addition, patients with agrammatic aphasia show verb production deficits, graded based on argument structure complexity. In the present study, we used fMRI to examine the neural correlates of verb production in overt action naming conditions. In addition, we tested the differential effects of naming when verbs were presented dynamically in video segments versus …
