Objective. HIV and tuberculosis represent diseases of major public health importance worldwide. Very little is known about HIV-TB coinfection among pregnant women, especially from industrialized settings. In this study, we examined the association between TB, HIV, and HIV-TB coinfection among pregnant mothers and obstetric complications, alcohol use, drug abuse, and depression. Method. We examined inpatient hospital discharges in the United States from January 1, 2002, through December 31, 2014. We employed multivariable survey logistic regression to generate adjusted estimates for the association between infection status and study outcomes. Results. We analyzed approximately 57 million records of pregnant women and their …

The primary purpose of this teaching case is to aid students in understanding how executive compensation plans are utilized to achieve organizational goals and to then construct their own executive compensation plan for the CEO of Greenleaf Grocery, a fictional retail business based on an actual company.
Students have the opportunity to create a comprehensive executive compensation plan using salary, bonuses, stock options, benefits, and other compensation tools. Additionally, the case provides the opportunity to discuss the use of both short-term and long-term incentive compensation. The company in this case is poised to undertake an initial public offering of stock …
Higher Education In The Era Of Illusions: Neoliberal Narratives, Capitalistic Realities, And The Need For Critical Praxis, Ali H. Hachem
Higher Education In The Era Of Illusions: Neoliberal Narratives, Capitalistic Realities, And The Need For Critical Praxis, Ali H. Hachem
Faculty Publications
The modern American university is in transition, undergoing major changes to its very structure and function. While few of these changes are reflective of the rhetorical language of economic freedom, liberty, choice, and rights used in promoting the neoliberal state project, many others are clear indications of the re-coronation of a capitalistic oligarchy and the reinstatement of its class supremacy through the exploitation of society. While most of the critical literature in higher education attends to the structural macroscopic effects of the new capitalism, it is the argument in this article that more attention should be paid to the subjective …

The purpose of this study was to provide initial validation of the Orientation & Mobility Visual Impairment Scale of Service Intensity of Texas (O&M VISSIT) intended for use by orientation and mobility (O&M) specialists to determine a recommended type and amount of O&M services for students on their caseloads based on each student’s identified needs. The validity and reliability of the scale were calculated using a mixed-methods survey research design, with purposive expert sampling. The O&M VISSIT was found to be significantly valid in social and content validity and moderately valid in consequential validity. The O&M VISSIT is a moderately …
Radial Growth Responses Of Upland Oaks Following Recurrent Restoration Treatments In Northern Mississippi, Kathryn R. Kidd, J. Morgan Varner, J. Stephen Brewer
Radial Growth Responses Of Upland Oaks Following Recurrent Restoration Treatments In Northern Mississippi, Kathryn R. Kidd, J. Morgan Varner, J. Stephen Brewer
Faculty Publications
Fire exclusion over the past century has substantially altered composition, structure, and fuel dynamics in upland oak-hickory (Quercus-Carya) forests in the Southeastern United States. Numerous restoration efforts have been made to re-establish historical disturbance regimes into these altered forests. However, our understanding of the implications of restorative disturbances on stand dynamics has primarily been limited to shifts in species composition and post-disturbance regeneration. Therefore, we examined annual radial growth responses of dominant upland oaks following a combination of prescribed fires (2004, 2006, 2008, 2010, 2012, and 2014) and thinning (starting in 2004) treatments (thin+burn) in stands which had previously been …
The Thin Blue Line Of Theodicy: Flannery O’Connor, Teilhard De Chardin, And Competitions Between Good/Good And Evil/Evil, Sue Whatley
Faculty Publications
This essay explores the concept of theodicy in Flannery O’Connor’s works of fiction. O’Connor’s fiction complicates the subjects of good and evil, moving the reader through what seem to be competitions not only between good and evil, but also between actions of good and actions of evil. Characters align themselves with one force, then another, in a constantly fluctuating system, and there is no traditional pattern of Christian warfare that we would expect orthodox Catholic writing to produce. Sometimes, evil brings about the resolution of the narratives, and sometimes actions of good fail to redeem. It is only through the …

Local County Hospital: A Review Of Challenges And Opportunities, Mary Fischer, Treba Marsh
Faculty Publications
There are multiple factors regarding current health care delivery in the U.S. These factors include the high-priced medical care, hospitals, equipment, and pharmaceutical charges, and the private system of health insurance. This discussion looks at these factors’ impact on Local County Hospital ranging from Obamacare to a host of other challenges. The hospital is going through difficult times as it struggles to make ends meet. Although it will take time to adjust to an inconsistent environment and changing health care industry, Local County Hospital continues to focus on the patients first and attempts to keep the region healthy.

Women are vastly underrepresented in the fields of computer science and engineering (CS&E). We examined whether women might view the intellectual characteristics of prototypical individuals in CS&E in more stereotype-consistent ways than men might and, consequently, show less interest in CS&E. We asked 269 U.S. college students (187, 69.5% women) to describe the prototypical computer scientist (Study 1) or engineer (Study 2) through open-ended descriptions as well as through a set of trait ratings. Participants also rated themselves on the same set of traits and rated their similarity to the prototype. Finally, participants in both studies were asked to describe …

National Income Inequality, Society, And Multinational Enterprises, Nathaniel C. Lupton, Guoliang Frank Jiang, Luis F. Escobar
Faculty Publications
This chapter calls for understanding the perspective of multinational enterprises (MNEs) on international differences in income inequality. The authors set a research agenda on how national differences in income inequality influence MNE expansion strategies. Applying a transaction cost framework, both negative and positive economic outcomes of income inequality, from the MNE's perspective, are identified. Low levels of income inequality may deter foreign investment, as MNEs prefer countries where they incur lower levels of transaction costs arising from interactions with various market and non-market actors. However, the positive effect of income inequality on location attractiveness will likely diminish at higher levels …

School gardens are an ideal space to deliver a healthy living curriculum, such as nutrition and physical activity education, to elementary school youth. However, public schools often lack the resources and support to establish sustainable garden-based programming. We created the Healthy Living Ambassador program, a collaborative after-school garden program in low-income communities that brought together resources from schools, community programs, and University of California Cooperative Extension. This school garden program featured culturally competent teens as teachers to serve as near-peer educators and mentors to elementary school youth. The program development model incorporated lessons from sustainable community-based health program interventions and …

We describe and analyze our efforts to support Learning Assistants (LAs)—undergraduate peereducators who simultaneously take a 3-credit pedagogy course—in fostering equitable teamdynamics and collaboration within a project-based engineering design course. Tonso andothers have shown that (a) inequities can “live” in mundane interactions such as those amongstudents within design teams and (b) those inequities both reflect and (re)produce broadercultural patterns and narratives (e.g. Wolfe & Powell, 2009; Tonso, 1996, 2006a, 2006b;McLoughlin, 2005). LAs could be well-positioned to notice and potentially disrupt inequitablepatterns of participation within design teams. In this paper, we explore (1) How do LAs notice, diagnose, and consider responding to …

Step Therapy: Legal And Ethical Implications Of A Cost-Cutting Measure, Sharona Hoffman
Faculty Publications
The very high and ever-increasing costs of medical care in the United States are well-recognized and much discussed. Health insurers have employed a variety of strategies in an effort to control their expenditures, including one that is common but has received relatively little attention: step therapy. Step therapy programs require patients to try less expensive treatments and find them to be ineffective or otherwise problematic before the insurer will approve a more high-priced option. This Article is the first law journal piece dedicated to analyzing this important cost control measure.
The Article explores the strengths and weaknesses of step therapy …

Increased risk of second primary malignancy (SPM) in papillary thyroid cancer (PTC) has been reported. Here, we present the most updated incidence rates of second primary malignancy from original diagnosis of PTC by using the data from the Surveillance, Epidemiology, and End Results. In this cohort, 3,200 patients developed SPM, a substantially higher number than in the reference population of 2,749 with observed to expected ratio (O/E) of 1.16 (95% CI; 1.12–1.21). Bone and joint cancer had the highest O/E ratio of 4.26 (95% confidence interval [CI] 2.33–7.15) followed by salivary gland (O/E 4.15; 95% CI 2.76–6.0) and acute lymphocytic …

“Nationwide” Injunctions Are Really “Universal” Injunctions And They Are Never Appropriate, Howard Wasserman
“Nationwide” Injunctions Are Really “Universal” Injunctions And They Are Never Appropriate, Howard Wasserman
Faculty Publications
Federal district courts are routinely issuing broad injunctions prohibiting the federal government from enforcing constitutionally invalid laws, regulations, and policies on immigration and immigration-adjacent issues. Styled “nationwide injunctions,” they prohibit enforcement of the challenges laws not only against the named plaintiffs, but against all people and entities everywhere.
The first problem with these injunctions is one of nomenclature. “Nationwide” suggests something about the “where” of the injunction, the geographic scope in which it protects. The better term is “universal injunction,” which captures the real controversy over the “who” of the injunction, as courts purport to protect the universe of all …

Developmentally appropriate practice (DAP) is a set of early childhood curricular recommendations published by the National Association for the Education of Young Children (NAEYC). DAP was introduced in the United States in the late 1980s through Bredekamp’s (1987) seminal work, “Developmentally Appropriate Practice in Early Childhood Programs Serving Children from Birth through Age 8.” Since the initial publication, DAP has been widely accepted as the standard for early childhood educational practice in the United States and in Westernized countries around the world. Whereas proponents of DAP assert its positive influence on children, those more critical of DAP question whether it …

Social Medicine And International Expert Networks In Latin America, 1930–1945, Eric D. Carter
Faculty Publications
This paper examines the international networks that influenced ideas and policy in social medicine in the 1930s and 1940s in Latin America, focusing on institutional networks organised by the League of Nations Health Organization, the International Labour Organization, and the Pan-American Sanitary Bureau. After examining the architecture of these networks, this paper traces their influence on social and health policy in two policy domains: social security and nutrition. Closer scrutiny of a series of international conferences and local media accounts of them reveals that international networks were not just ‘conveyor belts’ for policy ideas from the industrialised countries of the …

The elderly population in the United States is growing dramatically and is expected to reach over seventy-two million, or twenty percent of the citizenry, by 2030. But serious legislative and regulatory gaps leave the surging population of older adults with many unmet needs. Many Americans are aware of the Social Security and Medicare funds’ financial woes. This Article emphasizes that these challenges are only the tip of the iceberg. In addition, the elderly face under-funded Older Americans Act programs, unaffordable long-term care, inadequate driving regulations that fail to identify and protect at-risk drivers, and a significant shortage of geriatricians, among …

The mismatch between the expanding administrative and regulatory obligations of the United States Copyright Office and its limited institutional expertise is an emerging problem for the copyright system. The Office’s chief responsibility—registration and recordation of copyright claims—has taken a back seat in recent years to a more ambitious set of substantive rulemakings and policy recommendations. As the triennial rulemaking under the Digital Millennium Copyright Act highlights, the Office is frequently called upon to answer technological questions far beyond its plausible claims of subject matter expertise. This Article traces the Office’s history, identifies its substantial but discrete areas of expertise, and …

State-mandated falsehoods are rampant in the context of abortion regulation. State legislatures have required doctors, before performing abortions, to provide scientifically unsupported information to women, such as that having an abortion increases the risk of breast cancer, or that it has negative mental health effects. Given the lack of evidence to sustain these sorts of claims, it seems reasonable to refer to such statements as government-mandated lies. However, this article argues that government mandated lies in the abortion context are unique in several ways that make them unlikely to be found unconstitutional, despite the fact that they obviously hinder patients’ …
