Candidate Privacy, Rebecca Green Mar 2020

Candidate Privacy, Rebecca Green

Faculty Publications

In the United States, we have long accepted that candidates for public office who have voluntarily stepped into the public eye sacrifice claims to privacy. This refrain is rooted deep within the American enterprise, emanating from the Framers' concept of the informed citizen as a bedrock of democracy. Voters must have full information about candidates to make their choices at the ballot box. Even as privacy rights for ordinary citizens have expanded, privacy theorists and courts continue to exempt candidates from privacy protections. This Article suggests that two disruptions warrant revisiting the privacy interests of candidates. The first is a …

When Agencies Make Criminal Law, Brenner M. Fissell Mar 2020

When Agencies Make Criminal Law, Brenner M. Fissell

Faculty Publications

The nondelegation doctrine prohibits a legislature from delegating its power to an administrative agency, yet it is famously underenforced—even when the delegation results in the creation of criminal offenses (so-called “administrative crimes”). While this practice appears to scandalize the hornbook presumption that legislatures alone define criminal offenses, it has long been ratified by the Supreme Court and has received little scholarly attention. The few commentators who have addressed administrative crimes highlight the intuition that criminal sanctions are uniquely severe and thus deserving of a more rigorous nondelegation analysis, but they stop there. They do not precisely link the severe aspects …

Optimizing The Environmental And Economic Sustainability Of Remote Community Infrastructure, Jamie E. Filer, Justin D. Delorit, Andrew J. Hoisington, Steven J. Schuldt

Faculty Publications

Remote communities such as rural villages, post-disaster housing camps, and military forward operating bases are often located in remote and hostile areas with limited or no access to established infrastructure grids. Operating these communities with conventional assets requires constant resupply, which yields a significant logistical burden, creates negative environmental impacts, and increases costs. For example, a 2000-member isolated village in northern Canada relying on diesel generators required 8.6 million USD of fuel per year and emitted 8500 tons of carbon dioxide. Remote community planners can mitigate these negative impacts by selecting sustainable technologies that minimize resource consumption and emissions. However, …

The increase in vaccine-preventable disease (VPD) outbreaks has caused great alarm to the public health community. In recent years, VPD outbreaks have occurred across the globe in both developed and developing countries. Particularly troubling has been the resurgence of diseases formerly eradicated through years of concerted vaccination and other public health campaigns. Higher vaccination exemption rates have been implicated in the resurgence of VPDs. This is particularly evident in the United States where measles outbreaks reached 1,250 individual cases in 2019 alone, the most confirmed cases since 1992. Central to the discussion about measles resurgence is a better understanding of …

Cysteine Dioxygenase Enzyme Activity And Gene Expression In The Dimorphic Pathogenic Fungus Histoplasma Capsulatum Is In Both The Mold And Yeast Morphotypes And Exhibits Substantial Strain Variation, Melissa Adams, Glen Shearer

Faculty Publications

In the dimorphism (mold/yeast) Histoplasma capsulatum (Hc) literature are reports that yeast (the so-called pathogenic form) uniquely expresses a cysteine dioxygenase (CDO, approx. 10,500 dal) activity which the mold morphotype (the so-called saprophytic soil form) does not express (C.F., Kumar et al., Biochem 22, 762, 1983). This yeast-specific CDO activity is postulated to play a critical role in the mold-to-yeast shift. A number of years ago, our lab isolated the gene encoding the Hc cysteine dioxygenase (CDO1, Genbank accession AY804144) and noted significant expression in the mold morphotype of several Histoplasma strains and also determined that the predicted protein would …

For decades, the Indian Child Welfare Act (ICWA) has been considered the “gold standard” in Indigenous child protection. As a result, Indigenous advocates around the world have sought the passage of similar legislation. However, it is far from clear that the benefits of the ICWA are easily exported. The ICWA is based on a recognition of tribal sovereignty. Unfortunately, many of the countries that could benefit from ICWA-type protections do not recognize the sovereignty of their Indigenous populations.

This Article explores how the ICWA would have to be adapted to work in such countries and whether the needed changes would …

© 2019 The Author(s) 2019. Published by Oxford University Press on behalf of Entomological Society of America. Concerns on efficacies of termiticides used for soil treatment to prevent Formosan subterranean termite (Coptotermes formosanus Shiraki) infestations have prompted pest control companies to suggest that retreatments are necessary after flooding of homes. Therefore, to address concerns about the efficacy of termiticides after flooding, we designed a flooding simulation experiment in the laboratory. We used four formulated termiticides containing fipronil, imidacloprid, chlorantraniliprole, or bifenthrin as active ingredients (a.i.) and two colonies of field-collected C. formosanus for this study. Evaluations of each chemical at …

The Manifestation Of Neighborhood Effects: A Pattern For Community Growth?, Michael R. Cope, Jorden E. Jackson, Scott R. Sanders, Lance D. Erickson, Tippe Morlan, Ralph B. Brown

Faculty Publications

Neighborhood effects, or the development of community by neighborhoods, are often studied in an urban context. Previous research has neglected to examine the influence of neighborhoods in nonurban settings. Our case study, however, contributes to the existing literature as it takes place in a small, rural-to-urban town at an important point in time where the town was urbanizing. We find that neighborhood effects also influence community satisfaction and attachment in Creekdale, an urbanizing town. Using survey data (N = 1006) drawn from the Creekdale Community Citizens Viewpoint Survey (CCVS), we find that, contrary to conventional wisdom, population size and density …

The Role Of Climate Change Education On Individual Lifetime Carbon Emissions, Eugene Cordero, Diana Centeno Delgado, Anne Marie Todd

Faculty Publications

Strategies to mitigate climate change often center on clean technologies, such as electric vehicles and solar panels, while the mitigation potential of a quality educational experience is rarely discussed. In this paper, we investigate the long-term impact that an intensive one year university course had on individual carbon emissions by surveying students at least five years after having taken the course. A majority of course graduates reported pro-environmental decisions (i.e., type of car to buy, food choices) that they attributed at least in part to experiences gained in the course. Furthermore, our carbon footprint analysis suggests that for the average …

The Inclusion Of The Term ‘Color’ In Any Racial Label Is Racist, Is It Not?, Anita Kalunta-Crumpton Feb 2020

The Inclusion Of The Term ‘Color’ In Any Racial Label Is Racist, Is It Not?, Anita Kalunta-Crumpton

Faculty Publications

Through an examination of the term people of color, this conceptual paper illustrates how the use of historical racial labels in the US, supposedly aimed at denouncing racism, seems to reproduce that which the labels purport to condemn. With a primary focus on Blacks or African-Americans, this paper draws purely on a review and analysis of secondary information to argue that any antiracist agenda that utilizes terms that were associated with historical racism may well be reproducing the racist ideologies that justified slavery and Jim Crow laws. This paper calls for the elimination of the term people of color and …

© 2020 by the authors. Licensee MDPI, Basel, Switzerland. NCAPG is a subunit of condensin I that plays a crucial role in chromatin condensation during mitosis. NCAPG has been demonstrated to be associated with farm animal growth traits. However, its role in regulating myoblast differentiation is still unclear. We used myoblasts derived from fetal bovine tissue as an in vitro model and found that NCAPG was expressed during myogenic differentiation in the cytoplasm and nucleus. Silencing NCAPG prolonged the mitosis and impaired the differentiation due to increased myoblast apoptosis. After 1.5 days of differentiation, silencing NCAPG enhanced muscle-specific gene expression. …
