Background

Explosive compounds such as TNT and RDX are recalcitrant contaminants often found co-existing in the environment. In order to understand the joint effects of TNT and RDX on earthworms, an important ecological and bioindicator species at the molecular level, we sampled worms (Eisenia fetida) exposed singly or jointly to TNT (50 mg/kg soil) and RDX (30 mg/kg soil) for 28 days and profiled gene expression in an interwoven loop designed microarray experiment using a 4k-cDNA array. Lethality, growth and reproductive endpoints were measured.

Results

Sublethal doses of TNT and RDX had no significant effects on the survival …

There is no universal provider of health insurance or health care in the United States. Rather, a patchwork system of institutions exists, each covering different subgroups of the population. Certain types of health insurance are provided as a condition of employment, while other types of health insurance are more readily available when individuals are not employed or not fully employed, and still others are available regardless of employment status. The two most significant sources of health insurance coverage in the United States are employers, who collectively insure 63 percent of the non-elderly (below age 65) population, and governments, who collectively …

Courts have admitted bite mark comparison evidence in homicide, rape, and child abuse cases. By the 1980s, the technique had gained widespread judicial acceptance. Hundreds of cases have admitted this type of evidence, and no reported case has rejected it. Moreover, some courts speak of bite mark comparison as a "science." Indeed, its acceptance is so well-established that several courts have taken judicial notice of its reliability, implying that the validity of the technique is not subject to reasonable dispute.

The Tragedy Of Trips, Peter M. Gerhart

This Article argues that sound intellectual property policy requires not only that the policymaker establish an appropriate incentive for invention but also that the policymaker determine how the cost of that incentive should be distributed across various classes of consumers. It is the distributive dimension of intellectual property policy that makes existing international institutions such an unsound mechanism for determining global rules for intellectual policy--the policymakers are simply not able to make the appropriate kinds of decisions. I suggest some ways in which institutional structures can be modified to achieve a better balance.

This Article provides a description of the events leading up to the workshop, the discussion that took place, and the proposal that emerged. The proposal is intended to be a discussion document rather than a final product. It needs greater detail, a clearer sense of its costs and financing mechanisms, and input from stakeholders. Nevertheless, the workshop participants believe that Medicover may be a viable option for helping to solve the current health care crisis.

Purpose: To gain an understanding of the meaning of childbirth to women living in St. Petersburg, the Russian Federation.

Study Design and Method: Twenty-four Russian women who had given birth in the past 6 months participated in this phenomenological study and were interviewed and audio-taped about the meaning of childbirth. Data collection and analysis occurred concurrently.

Results: The Russian sociocultural context of childbirth was identified in specific themes: (1) adhering to cultural traditions, (2) accessing information, (3) maintaining a healthy lifestyle, (4) articulating the spiritual and emotional meaning of giving birth, and (5) transforming as a mother and a person. …

White Challengers, Black Majorities: Reconciling Competition In Majority-Minority Districts With The Promise Of The Voting Rights Act, Janai S. Nelson

Majority-minority districts have been the subject of extensive, and often rancorous, critique and debate. In their prime, these districts nearly single-handedly changed the face of American politics by enabling racial minorities to elect their preferred candidates who reflected both their interests and identity. However, precisely at the point when these districts achieve an optimal balance of majority and minority populations and host multi-candidate competition, they reveal a frailty that not only thwarts their immediate purpose but contradicts both the express and implicit goals of their source: The Voting Rights Act of 1965. Are Issuers Of And Dealers In Securities Immune From Lawsuits Arising Under Federal And State Antitrust Laws?, Hannibal Travis

Conduct potentially subject to regulatory scrutiny by federal agencies such as the Securities Exchange Commission (SEC) is not necessarily immune from antitrust liability. The Supreme Court previously held that an anticompetitive conspiracy in the mutual fund industry was immune from antitrust liability because the SEC had the primary statutory authority to prohibit or permit such conspiracies. This case raises the question of whether another alleged conspiracy—to restrict the availability of certain initial public offerings of securities (IPOs)—is similarly immune.

I use corporate strategy concepts and tools to focus on the dynamics of firm social initiatives and actions over time. I examine the different paths and positions taken by firms, and the processes that may underlie such paths and positions. My sample comprises 19 firms in the oil and gas industry, and covers the decade from 1991-2000. I use an exploratory approach that mixes qualitative and quantitative cluster analysis as the primary tools to examine this industry, and to isolate and examine distinct social responsibility positions and paths taken by these firms. Praying, Playing, And Successful Families: An Examination Of Family Religiosity, Family Leisure, And Family Functioning, Sarah Taylor Agate, Ramon B. Zabriskie, Dennis L. Eggett

The purpose of this study was to examine the relationship between family religiosity, family leisure, and family functioning. The sample consisted of 121 parents and 99 youth from various religious groups. Results indicated a positive relationship between family religiosity and family leisure. Both family religiosity and family leisure had a significant relationship with family functioning in this sample. Data collected from both parents and youth provided insight into the influence of family religiosity and family leisure on family functioning. Family religiosity was the strongest predictor of family functioning for parents. For youth, both family leisure and family religiosity were significant …

Before ERISA, employees faced a large risk that their employers would default or renege on pension obligations. By creating a federal guarantor of pensions (the PBGC), ERISA has greatly reduced this risk. All else being equal, low-risk pensions are worth more to employees but cost more to provide. Congress has never had a coherent policy on who should pay for these extra costs. Moreover, legal scholars have failed to create a theoretical framework for dealing with these costs, focusing instead on the supposed "moral hazard" that the PBGC guaranty creates. Responding to the absence of an international treaty expressly protecting people with disabilities, the United Nations General Assembly will soon adopt a disability-based human rights convention. This Article examines the theoretical implications of adding disability to the existing canon of human rights, both for individuals with disabilities and for other under-protected people. It develops a "disability human rights paradigm" by combining components of the social model of disability, the human right to development, and Martha Nussbaum's version of the capabilities approach, but filters them through a disability rights perspective to preserve that which provides for individual flourishing and modifying that …

Family Deepening: A Qualitative Inquiry Into The Experience Of Families Who Participate In Service Expeditions, Alexis A. Palmer, Patti A. Freeman, Ramon B. Zabriskie

The purpose of this study was to explore the familial impact of participating in a family service expedition. Grounded theory methodology was used. Five families were identified through a criteria-based snowball sampling technique. Based on the data analyses, a core category emerged that encapsulated the meaning and impact of the family service expedition. It was given the description of "family deepening." Emerging theory indicated that experiences that were unique; shared, interactive; purposive; challenging; and required sacrifice contributed to the process of family deepening. Despite the extensive scholarly literature assessing the proper role of federalism in environmental law, there has been relatively little analysis of why states adopt given environmental policies. There is even less consideration of how federal regulatory choices influence state environmental policy, and how a change in federal policy could influence states' willingness to adopt more environmental protections of their own. This Article articulates a set of principles for policymaking about alternative dispute resolution (ADR) to promote values of process pluralism, choice in dispute resolution processes, and sound decision making. It argues that policymakers should use a dispute system design (DSD) framework in analyzing policy options. DSD involves systematically managing a series of disputes rather than handling individual disputes on an ad hoc basis. It generally includes assessing the needs of disputants and other stakeholders, planning to address those needs, providing necessary training and education for disputants and dispute resolution professionals, implementing the system, evaluating it, and making periodic modifications as …
