Oscillations in ice sheet extent during early and middle Miocene are intermittently preserved in the sedimentary record from the Antarctic continental shelf, with widespread erosion occurring during major ice sheet advances, and open marine deposition during times of ice sheet retreat. Data from seismic reflection surveys and drill sites from Deep Sea Drilling Project Leg 28 and International Ocean Discovery Program Expedition 374, located across the present-day middle continental shelf of the central Ross Sea (Antarctica), indicate the presence of expanded early to middle Miocene sedimentary sections. These include the Miocene climate optimum (MCO ca. 17-14.6 Ma) and the middle …

Calcium-Rich Dravite From The Arignac Gypsum Mine, France: Implications For Tourmaline Development In A Sulfate-Rich, Highly Magnesian Meta-Evaporite, Barbara Dutrow, Darrell Henry
Faculty Publications
Tourmaline occurs in a wide range of compositional environments, but its occurrence in meta-evaporites is less commonly investigated. Highly magnesian (XMg = 0.90–0.98), poikiloblastic tourmaline occurs in a sulfate-rich, anhydrite– gypsum-bearing meta-evaporite in the Arignac Gypsum Mine, France and preserves a petrologic record of this unusual geochemical environment. Originally a Triassic evaporite deposit, the sample is interpreted to have undergone high-tem-perature–low-pressure (HT–LP) metamorphism and subsequently experienced low-grade, highly deformed overprints. Poikiloblastic tourmaline preserves relicts of the HT–LP mineral assemblage, as inclusions of anhydrite, phlogopite, dolomite, tremolite, Cl-rich scapolite (71–85 % marialite component), rutile, zircon, and fluor-apatite. The low-grade deformational overprints …

Reddit As A Source Of Covid-19 Information: A Content Analysis Of R/Coronavirus During The Early Pandemic, Brent Hale, Mark Alberta, Seung Woo Chae
Faculty Publications
Emerging research has begun examining the utility of social media platforms for information dissemination during the COVID-19 pandemic. Following this developing thread, this work examines discourse within r/coronavirus, a Reddit forum (i.e., subreddit) developed to curate COVID-19 information that burgeoned during the early months of the pandemic. Through a content analysis of 226 posts and 2260 corresponding comments generated between February and May, 2020, this study investigated early-pandemic communication patterns in this platform, including what information was deemed important and how users framed causes and solutions. Overall, findings indicate that users of r/coronavirus prioritized information about COVID-19 spread, public health …
Uncertainty-Autoencoder-Based Privacy And Utility Preserving Data Type Conscious Transformation, Bishwas Mandal, George Amariucai, Shuangqing Wei
Uncertainty-Autoencoder-Based Privacy And Utility Preserving Data Type Conscious Transformation, Bishwas Mandal, George Amariucai, Shuangqing Wei

We propose an adversarial learning framework that deals with the privacy-utility tradeoff problem under two types of conditions: data-type ignorant, and data-type aware. Under data-type aware conditions, the privacy mechanism provides a one-hot encoding of categorical features, representing exactly one class, while under data-type ignorant conditions the categorical variables are represented by a collection of scores, one for each class. We use a neural network architecture consisting of a generator and a discriminator, where the generator consists of an encoder-decoder pair, and the discriminator consists of an adversary and a utility provider. Unlike previous research considering this kind of architecture, …
Effect Of Ldh On The Dissolution And Adsorption Behaviors Of Sulfate In Portland Cement Early Hydration Process, Zedong Qiu, Limin Deng, Shuang Lu, Guoqiang Li, Zhen Tang
Effect Of Ldh On The Dissolution And Adsorption Behaviors Of Sulfate In Portland Cement Early Hydration Process, Zedong Qiu, Limin Deng, Shuang Lu, Guoqiang Li, Zhen Tang
Faculty Publications
In recent years, it has been widely recognized that the incorporation of Mg-Al-LDH into cement-based materials can improve the salt corrosion resistance of cement-based materials. The reason for the improvement comes from the anion adsorption capacity of Mg-Al-LDH. It was confirmed that the addition of Mg-Al-LDH would accelerate the setting and hardening of cement paste. With the increase in the Mg-Al-LDH content, the initial setting time of cement slurry with different gypsum contents will decrease by 10-50% and the viscosity of the cement slurry will increase by 100-200%. Depending on different gypsum contents, the degree of cement hydration varied. This …

Recent work has suggested that the phytoremediation potential of S. alterniflora may be linked to a selection by the plant for oil-degrading microbial communities in the soil, in combination with enhanced delivery of oxygen and plant enzymes to the soil. In salt marshes, where the soil is saline and hypoxic, this relationship may be enhanced as plants in extreme environments have been found to be especially dependent on their microbiome for resilience to stress and to respond to toxins in the soil. Optimizing methods for restoration of oiled salt marshes would be especially meaningful in the Gulf of Mexico, where …

The treatment and repair strategies for reflective and fatigue cracking that initiate at the pavement surface (i.e., top-down cracking) and at the bottom of the asphalt concrete layer (i.e., bottom-up cracking) are noticeably different. However, pavement management engineers are facing difficulties in identifying these cracks in the field because they usually appear in visually identical patterns. The objective of this study was to develop artificial neural network (ANN) and convolutional neural network (CNN) applications to differentiate and classify top-down, bottom-up, and cement-treated reflective cracking in in-service flexible pavements using deep-learning models. The developed CNN model achieved an accuracy of 93.8% …

Background: The COVID-19 pandemic is becoming one of the largest, unprecedented health crises, and chest X-ray radiography (CXR) plays a vital role in diagnosing COVID-19. However, extracting and finding useful image features from CXRs demand a heavy workload for radiologists. Objective: The aim of this study was to design a novel multiple-inputs (MI) convolutional neural network (CNN) for the classification of COVID-19 and extraction of critical regions from CXRs. We also investigated the effect of the number of inputs on the performance of our new MI-CNN model. Methods: A total of 6205 CXR images (including 3021 COVID-19 CXRs and 3184 …

Octo-Tiger, a large-scale 3D AMR code for the merger of stars, uses a combination of HPX, Kokkos and explicit SIMD types, aiming to achieve performance-portability for a broad range of heterogeneous hardware. However, on A64FX CPUs, we encountered several missing pieces, hindering performance by causing problems with the SIMD vectorization. Therefore, we add std:experimental:simd as an option to use in Octo-Tiger's Kokkos kernels alongside Kokkos SIMD, and further add a new SVE (Scalable Vector Extensions) SIMD backend. Additionally, we amend missing SIMD implementations in the Kokkos kernels within Octo-Tiger's hydro solver. We test our changes by running Octo-Tiger on three …

Including Unmarried Women In The Homestead Act Of 1862, Hannah Haksgaard
Faculty Publications
When Congress passed the Homestead Act of 1862, it decided to distribute land to single, unmarried women. Most Congressional members who supported including unmarried women did so because women were a necessary part of empire building—women were expected to marry, bear children, and engage in building permanent communities. Few Congressional members cared about women’s equality or the progressive goals of the women’s rights movements, although some Congressional members thought women would be incapable of successfully homesteading. This Article presents the fascinating history of including unmarried women in the Homestead Act of 1862 by conducting an intensive study of the Act’s …

Conducting effective quality control of weather observations in real time is vital to the 14th Weather Squadron’s mission of providing authoritative climate data. This study explored automated quality control of weather observations by applying multiple machine learning techniques to 43,487 surface weather observations from 5 years of data at a single location. Temperature predictors were evaluated using recursive feature elimination on linear regression and XGBoost algorithms, as well as using a neural network hyperparameter sweep. Modeling was repeated after calculating trigonometric transforms of temporal variables to give the models insight into the diurnal heating cycle of the Earth. All models …
“Shall Not Be Construed”: Reversal Of Supreme Court Decisions By Constitutional Amendment, John V. Orth
“Shall Not Be Construed”: Reversal Of Supreme Court Decisions By Constitutional Amendment, John V. Orth
Faculty Publications
This Article considers the way in which small changes of wording can signal large changes of thought in the United States Constitution (Constitution). Drawing upon examples found in the Eleventh and Sixteenth Amendments, and in the Reconstruction Amendments, the Article shows that there are two ways to reverse a U.S. Supreme Court decision by constitutional amendment. The first type of amendment may reverse the decision by instructing the Court on the proper construction of a particular provision, as in the case of the Eleventh Amendment. The second means involves reversing the decision by altering the constitutional provision in question, rather …
Restoring Faith In Military Justice, Eleanor T. Morales, John W. Brooker
Restoring Faith In Military Justice, Eleanor T. Morales, John W. Brooker
Faculty Publications
The military justice system was designed to maintain good order and discipline, strengthen national security, and achieve justice. After military leaders failed to effectively address the sexual assault crisis within the armed forces, Congress lost faith in this system. In response, Congress enacted sweeping legislative reform, transferring prosecutorial discretion for the most serious offenses from commanders to military lawyers. Unlike civilian prosecutions, most decisions within the military justice system have overwhelmingly favored one consideration: maintaining good order and discipline in the unit. While Congress’s reforms change who makes the decisions in many cases, they will have little effect unless military …

Sometimes acts of the federal government cause harm; sometimes acts of contractors hired by the federal government cause harm. In cases involving the latter, federal contractors often invoke the sovereign’s constitutionally granted and doctrinally expanded supremacy to restrict avenues for the injured to recover even from private actors. In prior work, we analyzed how federal contractors exploit three “sovereign shield” defenses—preemption, derivative sovereign immunity, and derivative intergovernmental immunity—to evade liability, accountability, and oversight.
This Article considers whether, when, and how private federal contractors should be held accountable in a court of law. We argue that a contractor should be required …

Not Child’S Play: A Constitutional Game Of Pass The Story In Dobbs, Shurtleff, And Kennedy, John V. Orth, Paul T. Babie

This Article suggests that in the effort to find fixed standards for rights, working with vague, indeterminate, silent text, the Supreme Court engages in a constitutional game of pass the story. No one outcome concludes the story; it merely adds another chapter, to which the next set of judges will add their own installment. The quest for standards never ends. The Court’s decisions in Dobbs v. Jackson Women’s Health Organization, Shurtleff v. City of Boston, and Kennedy v. Bremerton School District are merely the latest installments in stories that began with the founding. And as with any such story, …

Preemption Of Police Reform: A Roadblock To Racial Justice, Rick Su, Marissa Roy, Nestor Davidson

In 2020, nearly half of the largest U.S. cities reoriented municipal spending priorities by directing money from their police budgets to social services; for many cities, these budgetary changes reversed decades of increases. Cities began implementing additional police reforms as well: New York City became the first municipality to end qualified immunity for police officers while San Francisco shifted to deploying crisis response teams, rather than police officers, to respond to mental health calls.
Instead of supporting these critical reforms, some states targeted cities that prioritized racial justice by preempting those cities’ ability to engage in meaningful change. In the …

In 1825, France conditioned its grant of recognition to the new nation of Haiti on the payment of 150 million francs plus trade benefits. The payments were, at least in part, compensation for the losses that French plantation owners suffered, a key part of which was the loss of enslaved Haitians, who took their freedom via revolution. France has officially apologized and acknowledged a “moral debt” that it owes the Haitian people. But is there a legal debt that Haiti, one of the poorest nations in the world, could claim today from France, one of the richest?
Tax Issues Affecting Marijuana Businesses, Erik M. Jensen
Tax Issues Affecting Marijuana Businesses, Erik M. Jensen
Faculty Publications
This article considers several issues affecting Internal Revenue Code section 280E, which denies income-tax deductions and credits to businesses trafficking in controlled substances. Even though marijuana is legal in an increasing number of states, it remains a controlled substance under federal law and section 280E therefore applies to marijuana businesses. As a result, investing in a marijuana business is much less attractive than it would otherwise be. The article discusses issues of statutory interpretation but, more important, considers whether an almost complete denial of deductions and credits converts what is in form an income tax into something else. If the …

Addressing Big Tech's Market Power: A Comparative Institutional Analysis, Thomas A. Lambert
Faculty Publications
This Article provides a comparative institutional analysis of the three leading approaches to addressing the market power of large digital platforms: (1) traditional antitrust law, the approach thus far taken in the United States; (2) ex ante conduct rules, the approach embraced by the European Union's Digital Markets Act and several bills under consideration in the U.S. Congress; and (3) ongoing agency oversight, the approach embraced by the United Kingdom with its newly established "Digital Markets Unit." After identifying the general advantages and disadvantages of each approach, the Article examines how they are likely to play out in the context …

This research study examined pre-service teachers’ (N=250) intentions to adopt Twitter for professional development. The study used the Technology Acceptance Model to test research hypotheses grounded in the literature. The data were collected with a survey questionnaire and analyzed with Structural Equation Modelling. Findings indicated that ease of use, subjective norms, and perceived connectedness explained the variability in intentions to use Twitter. Perceived mobility, mediated through perceived behavioral control, explained participant differences in the perceived ease of use. Implications for stakeholders include highlighting the role subjective norms and mobile applications play in facilitating the ease of use and connectedness because …

Trust In Science: The Crisis Of Expertise As An Ideological, And Not Only A Scientific Controversy, David S. Caudill
Faculty Publications
Within the so-called "culture wars" dividing our nation politically, there is a law-related division over the trustworthiness of consensus science-the so-called "crisis of expertise." When the science concerning climate change, mask-wearing, or vaccinations becomes politicized, it loses its mooring in scientific evidence and impacts the effectiveness of regulatory law. Perhaps counter-intuitively, however, the solution is likely not to wear "Because Science" t-shirts while insisting on "cold, hard facts" and diagnosing as stupid those who believe the scientific theories of marginalized, minority-view scientists. Indeed, a certain level of modesty-regarding the uncertainties and tentativeness of even the best science-is necessary for the …

Establishment’S Political Priority To Free Exercise, Marc O. Degirolami

Americans are beset by disagreement about the First Amendment. Progressive scholars are attacking the venerable liberal view that First Amendment rights must not be constricted to secure communal, political benefits. To prioritize free speech rights, they say, reflects an unjust inflation of individual interest over our common political commitments. These disagreements afflict the Religion Clauses as well. Critics claim that religious exemption has become more important than the values of disestablishment that define the polity. Free exercise exemption, they argue, has subordinated establishment.
This Article contests these views. The fundamental rules and norms constituting the political regime—what the Article calls …

This Essay analyzes the role of the courts in handling Trump’s election lie. It argues that the courts were certainly correct in giving short shrift to Trump’s lawsuits, but further that the courts should have done more than simply dismiss Trump’s claims. Had the courts aggressively utilized existing tools to identify and punish prosecution of baseless claims, including Rule 11 of the Federal Rules of Civil Procedure and the courts’ inherent powers to control proceedings before them, the Trump election lie might well have been put to rest immediately before it could take root among die-hard Trump supporters. Fifty years ago, in Wisconsin v. Yoder, the Supreme Court famously indicated that “religion” denotes a communal rather than a purely individual phenomenon. An organized group like the Amish would qualify as religious, the Court wrote, but a solitary seeker like the nineteenth century transcendentalist Henry David Thoreau would not. At the time, the question was mostly peripheral; hardly any Americans claimed to have their own, personal religions that would make it difficult for them to comply with civil law. In the intervening decades, though, American religion has changed. One-fifth of us—roughly sixty-six million people—now claim, like Thoreau, to …

The systemic disregard for Black lives in America was on full display when footage of a police officer kneeling on the neck of George Floyd went viral. Mr. Floyd’s resultant death set off protests declaring that Black Lives Matter throughout the nation and across the world. While national attention rightfully turned to demanding police accountability for undue violence, the prevailing conversation also incorporated at least a declared concern for addressing institutionalized racism within the criminal justice system and other American institutions. The term of the day became “antiracism.” With regard to police killings, the lesson is that police officers disproportionately …

James M. Lang’s thesis in Small Teaching is simple: There are small things that educators can do to improve learning outcomes in their classrooms. Lang asserts that these “small but powerful modifications to our course design and teaching practices” are easy for teachers to incorporate and supported by research on learning. Lang is well steeped in pedagogical best practices—he is the former director of the Center for Teaching Excellence at Assumption College in Worcester, MA, and he regularly writes for the Chronicle of Higher Education.
