Board Of Curators Of The University Of Missouri V. Horowitz: Academic Versus Judicial Expertise, R. Lawrence Dessem Jan 1978

Board Of Curators Of The University Of Missouri V. Horowitz: Academic Versus Judicial Expertise, R. Lawrence Dessem

Faculty Publications

In Board of Curators of the University of Missouri v. Horowitz' the United States Supreme Court rejected the argument that public university students are constitutionally entitled to a hearing prior to their dismissal from school for academic reasons. In ruling against a former medical student at the University of Missouri-Kansas City, the Court concluded that "the determination whether to dismiss a student for academic reasons requires an expert evaluation of cumulative information and is not readily adapted to the procedural tools of judicial or administrative decisionmaking. ' In this article that conclusion and the several opinions in Horowitz will be …

Secrecy And Real Property, Dale A. Whitman Jan 1978

Secrecy And Real Property, Dale A. Whitman

Faculty Publications

It is not unusual for owners of real property to wish to conceal from government or the public either the fact of their ownership or certain salient characteristics of the property they hold. The objective of this article is to consider the extent to which this desire for secrecy is supported by sound policy and American legal doctrine. It will focus on the civil recourse available to an owner of real property against private persons who, without the owner's knowledge and consent, reveal information about the ownership or physical characteristics of the property. The article will also consider whether the …

Patriotic Unit, Judith M. Finkelstein, Jean Kelly, Delsie Charais Foreman Jan 1978

Patriotic Unit, Judith M. Finkelstein, Jean Kelly, Delsie Charais Foreman

Faculty Publications

The young child learns patriotism through music; art; games; and dramatic activities. Concepts in history (names; dates; events) geography; and civics are introduced through specific activities. The media are used as a source of information. Art activities; listening to original stories; musical activities; pantomime; and role playing provide opportunities for creativity development. Methods for interrelating the various subjects are detailed. Cognitive goals include: (1) the name and location of the United States; (2) why the Revolutionary War was fought; (3) the purpose of the U.S. Constitution; (4) the names of the founding fathers; (5) how life during the colonial era …

Does Article V Restrict The States To Calling Unlimited Conventions Only? - A Letter To A Colleague, William W. Van Alstyne

Faculty Publications

From time to time, various state legislatures have adopted resolutions designed to require Congress to call a limited convention in which one or another possible amendments to the Constitution might be proposed. In 1967, thirty-two states, two short of the requisite two-thirds filed such resolutions requesting a convention for the purpose of considering an amendment to "overrule" the Supreme Court's principal reapportionment decisions. In 1971, Senator Ervin of North Carolina introduced a bill to provide guidelines to be followed upon a state call for a convention. This year, approximately twenty-eight states have adopted some kind of resolution for the purpose …

The Use Of Nuclear Reactions And Sims For Quantitative Depth Profiling Of Hydrogen In Amorphous Silicon, David D. Allred, G. J. Clark, C. W. White, B. R. Appleton, C. W. Magee, D. E. Carlson Aug 1977

The Use Of Nuclear Reactions And Sims For Quantitative Depth Profiling Of Hydrogen In Amorphous Silicon, David D. Allred, G. J. Clark, C. W. White, B. R. Appleton, C. W. Magee, D. E. Carlson

Faculty Publications

Depth profiles for hydrogen in amorphous silicon have been determined by the use of resonant nuclear reactions [1H(15N,αγ)12C and 1H(19F,αγ)16O] and by secondary ion mass spectroscopy (SIMS). Independent calibration procedures were used for the two techniques. Measurements were made on the same amorphous silicon film to provide a direct comparison of the two hydrogen analysis techniques. The hydrogen concentration in the bulk of the film was determined to be about 9 at % H. The SIMS results agree with the resonant nuclear reaction results to within 10%, which demonstrates that quantitative hydrogen depth profiles can be obtained by SIMS analysis …

Measurement Of The Difference Between The Dynamic Nmr And Static Susceptibilites Of Superfluid 3he-B Using An Rf-Biased Superconducting Quantum-Interference Device, Richard A. Webb May 1977

Measurement Of The Difference Between The Dynamic Nmr And Static Susceptibilites Of Superfluid 3he-B Using An Rf-Biased Superconducting Quantum-Interference Device, Richard A. Webb

Faculty Publications

The temperature-dependent susceptiblity of superfluid 3He-B has been measured both statically and via a pulse technique in a field of 309 G using an rf-biased superconducting quantum-interference device (SQUID). In the pressure range 26.5 to 18 bar, the dynamic NMR susceptiblity agrees qualitatively with the theoretical weak-coupling predictions for the Balian-Werthamer state. However, the static susceptiblity, measured using the same rf-biased SQUID and detection system, is significantly smaller thatn the dynamic susceptibility.

Conspiracy: The Criminal Agreement, In Theory And In Practice, Paul Marcus Apr 1977

Conspiracy: The Criminal Agreement, In Theory And In Practice, Paul Marcus

Faculty Publications

Professor Marcus combines empirical research and theoretical analysis in this comprehensive study of the conspiracy doctrine. The article shows that the theoretical reasons for the conspiracy doctrine are inapplicable to most actual conspiracy prosecutions and that the practical reasons for conspiracy charges are often unacceptable prosecutorial shortcuts. Although ultimately concluding that the conspiracy doctrine is needed in some limited instances, Professor Marcus indicates that prosecutors should bring conspiracy charges only when justified by proper reasons and that courts should consider such charges more carefully.

Stomatal Opening, Transpiration, And Need/E Moisture In Loblolly Pine Seedlings From Two Texas Seed Sources, M. Victor Bilan, C.T. Hogan, H.B. Carter Jan 1977

Stomatal Opening, Transpiration, And Need/E Moisture In Loblolly Pine Seedlings From Two Texas Seed Sources, M. Victor Bilan, C.T. Hogan, H.B. Carter

Faculty Publications

Relationships among percentage of open stomates, transpiration, and needle moisture content in seedlings of loblolly pine of two Texas provenances were studied under changing soil moisture conditions. Needle moisture content correlated very well with transpiration under favorable moisture conditions, and with percentage of open stomates under soil moisture stress. Transpiration and percentage of open stomates were correlated under a wide range of moisture conditions. Foliage moisture content was still relatively high in both ecotypes when stomates closed and transpiration drastically declined. The "Lost Pines" seed source appeared to have superior ability to conserve moisture under droughty conditions by closure of …

The Installment Land Contract--A National Viewpoint, Dale A. Whitman, Grant S. Nelson Jan 1977

The Installment Land Contract--A National Viewpoint, Dale A. Whitman, Grant S. Nelson

Faculty Publications

The installment land contract is rarely used in some states, but in many it is the predominant means of vendor financing of land sales. Much has been written about it, but nearly all of the literature focuses on the law of one particular state or another. Our purpose here is to provide a nationwide perspective, with particular attention to the states in which the contract has been widely used and extensively litigated. We propose to examine the reasons for the installment contract's popularity, its advantages and disadvantages, and the risks it presents to both vendor and purchaser.
