Civilizing Pornography: The Case For An Exclusive Obscenity Nuisance Statute, Doug R. Rendleman
Civilizing Pornography: The Case For An Exclusive Obscenity Nuisance Statute, Doug R. Rendleman
Faculty Publications
Criminal penalties are increasingly perceived to be too severe for regulating obscenity. Professor Rendleman shares this perception and suggests that we replace criminal obscenity laws with an exclusive civil sanction utilizing injunctions. He proposes a comprehensive nuisance statute and discusses the various issues that arise in the equitable regulation of pornography.

Aggregation Of The Southern Pine Beetle In Response To Attractive Host Trees, Jack E. Coster, T.L. Payne, E.R. Hart, L.J. Edson
Faculty Publications
Dendroctonus frontalis Zimmerman were attracted to shortleaf pines, Pinus echinata MilL, using infested shortleaf pine bolts. Response was monitored during the ensuing mass attack period by the use of sticky traps suspended along the tree boles. Uninfested host materials or host materials containing only male beetles did not elicit mass attack of trees. Female beetles either alone or in combination with males, usually stimulated mass attack within 24 h. Traps at 3-4 m above the ground caught the greatest number (26.7%) of beetles. Trap catches peaked on the 3rd day of attack and declined rapidly thereafter. Daily flight activity was …

Fraudulently Induced Consent To Intentional Torts, David A. Fischer
Faculty Publications
This article will first proceed with a brief discussion of the nature of consent, the origin and application of the Restatement rule, and the exceptions to the rule which limit its application. A detailed analysis of the cases will follow.
An Analogue Of Oka’S Theorem For Weakly Normal Complex Spaces, William A. Adkins, Aldo Andreotti, J. V. Leahy
An Analogue Of Oka’S Theorem For Weakly Normal Complex Spaces, William A. Adkins, Aldo Andreotti, J. V. Leahy
Faculty Publications
Two well known results concerning normal complex spaces are the following. First, the singular set of a normal complex space has codimension at least two. Second, this property characterizes normality for complex spaces which are local complete intersections. This second result is a theorem of Abhyankar [1] which generalizes Oka’s theorem. The purpose of this paper is to prove analogues of these facts for the class of weakly normal complex spaces, which were introduced by Andreotti-Norguet [3] in a study of the space of cycles on an algebraic variety. A weakly normal complex space can have singularities in codimension one, …

Chapters Of The Civil Jury, Doug R. Rendleman
Chapters Of The Civil Jury, Doug R. Rendleman
Faculty Publications
The civil jury, though constitutionally protected by the seventh amendment, has remained a controversial institution throughout much of Anglo-American legal history. Our romantic ideals are questioned by critics who view the civil jury as prejudiced and unpredictable; proponents note the sense of fairness and "earthy wisdom" gained by community participation in the legal process. This debate surfaces in the process of accommodation between certain substantive goals of the law and the pre-verdict and post-verdict procedural devices courts have employed to control the jury. In this article, Professor Rendleman examines this conflict in his three "chapters" involving racially motivated discharges of …

Student Due Process Rights In Academic Dismissals From The Public Schools, R. Lawrence Dessem

This article, however, goes beyond the argument that education is one of the most valuable benefits which government in this country provides. The thesis of the article is that education is not only very important to millions of Americans, but that students have constitutionally protected liberty and property interests in their public educations and the courts should therefore require notice and hearing prior to the deprivation of these interests, even when the deprivation is for strictly academic reasons.
Potential Theory Associated With Uhlenbeck-Ornstein Process, Hui Hsiung Kuo
Potential Theory Associated With Uhlenbeck-Ornstein Process, Hui Hsiung Kuo
Faculty Publications
Some parallel results of Gross' paper (Potential theory on Hilbert space, J. Functional Analysis 1 (1967), 123-181) are obtained for Uhlenbeck-Ornstein process U(t) in an abstract Wiener space (H, B, i). Generalized number operator N is defined by Nf(x) = -lim∈←0{E[f(U(τ∈ξ))] - f(x)}/E[τ∈ξ, where τxε{lunate} is the first exit time of U(t) starting at x from the ball of radius ε{lunate} with center x. It is shown that Nf(x) = -trace D2f(x)+〈Df(x),x〉 for a large class of functions f. Let rt(x, dy) be the transition probabilities of U(t). The λ-potential Gλf, λ > 0, and normalized potential Rf of f are …
