Climate Entrenchment In Unstable Legal Regimes, Martin Lockman
Climate Entrenchment In Unstable Legal Regimes, Martin Lockman

American climate law is the subject of serious and ongoing debate, and policy change is part of the ordinary process of democratic governance. However, in recent years some policymakers have deliberately undermined climate action by injecting legal instability into American climate law. This Essay addresses a simple question: how can Americans build necessary climate infrastructure in the face of an unstable political and legal regime?
Some readers may be shocked by this question. Indeed, this framing is intentionally provocative. However, this Essay recognizes a simple fact: not all American polities, and not all American policymakers, are trustworthy and predictable partners …

Our jobs are not only about the work we do—they are also about when and where we do that work. For a variety of reasons, employees with disabilities often seek modifications of their employers’ policies regarding when and where work is performed. These accommodations are often necessary for the employee to remain employed. The Americans with Disabilities Act (“ADA”) requires employers to provide reasonable accommodations to employees with disabilities, and these accommodations can include schedule changes. But research demonstrates that when responding to accommodation requests under the ADA, employers are often reluctant to grant requests to modify the rules regarding …

Virtually every tax system relies upon accurate asset valuations. In some cases, this is an easy identification exercise, and the exact fair market value of an asset is readily ascertainable. Often, however, the reverse is true, and ascertaining an asset’s fair market value yields, at best, a numerical range of possible outcomes. Taxpayers commonly capitalize upon this uncertainty in their reporting practices, such that tax compliance lags and the IRS has a difficult time fulfilling its oversight responsibilities. As a by-product of this dynamic, the Treasury suffers.
This Article explores how tax systems, utilizing artificial intelligence, can strategically address asset-valuation …

A License To Play: Regulating Location-Based Augmented Reality Gameplay On Public Property, Kate Johnson, Evan Ringel, Amanda Reid
Faculty Publications
This novel research sits at the intersection of augmented reality gameplay and government licenses for use of public property. Governments have long used licensing schema to assure public safety and order. Augmented reality gameplay on public lands presents a new, contested use of public property. Under our proposed licensing scheme, those wishing to engage in location-based augmented reality (LoBAR) gameplay on public lands would need a license. This proposal is akin to how governments—federal, state, and municipal—have authorized permit schema for use of public property, including rock climbing, geocaching, street performing, and film photography. Our Article offers sample legislation for …
What Ever Happened To The Africa In African Human Rights, Thomas Kelley
What Ever Happened To The Africa In African Human Rights, Thomas Kelley
Faculty Publications
In the late 1970s, the Organization of African Unity (“OAU”) committed to drafting and adopting a human rights instrument that would uphold African values and traditions—those aspects of African culture that were unique and praiseworthy and, in the opinion of many African leaders, superior to those of Europe. The resulting document, the African Charter on Human and Peoples’ Rights (“the African Charter” or “the Charter”), included numerous provisions intended to do just that. However, in the decades following the African Charter’s adoption, African lawyers, judges, and tribunals produced little jurisprudence applying and further defining those uniquely African values and traditions. …
The Nightmare Of Dream Advertising, Dustin Marlan
The Nightmare Of Dream Advertising, Dustin Marlan

Advertisers are attempting to market to us while we dream. This is not science fiction, but rather a troubling new reality. Using a technique dubbed “targeted dream incubation” (TDI), companies have begun inserting commercial messages into people’s dreams. Roughly, TDI works by: (1) creating an association during waking life using sensory cues (for example, a pairing of sounds, visuals, or scents); and (2) as the subject is drifting off to sleep, the association is again introduced with the goal of triggering related dreams with related subject matter. Based on a 2021 American Marketing Association survey, 77 percent of 400 companies …
Judicial Moral Prophecy, Daniel B. Rice
Judicial Moral Prophecy, Daniel B. Rice
Faculty Publications
American judges decry past moral lapses as intolerable. They paint their predecessors’ worst mistakes as tragedies that must never be allowed to happen again. When given the chance to avoid new injustices, however, judges increasingly flaunt their moral indifference. They insist that legal fidelity requires them to ignore whether their own rulings will be remembered as monstrous. But this cavalier outlook—for all its devotion to the past—is remarkably ahistorical. Feats of legal craft have never survived cultural repudiation. When precedents become morally shameful, the quality of their reasoning ceases to matter. The opinions’ authors are remembered not for the technical …
Sociophonetics And Dialectology, Dominic Watt, Margaret E. L. Renwick, Joseph A. Stanley
Sociophonetics And Dialectology, Dominic Watt, Margaret E. L. Renwick, Joseph A. Stanley
Faculty Publications
In this chapter we explore how the investigation of phonetic detail in speech seen through a sociolinguistic lens can inform and enhance our understanding of dialectal variation in languages. We begin by examining how sociophonetics can be considered an offshoot of dialectology, later to mature into a free- standing discipline during the late twentieth century. We next discuss the reconvergence of sociophonetics and dialectology as it became clearer that the two approaches to the study of language variation are, in combination, greater than the sum of their parts, even if their agendas may place different emphases on what should be …

How Certain Robot Attributes Influence Human-To-Robot Social And Emotional Bonds, James Gaskin, P. Thomas Fife, Warren Rosengren

A growing population of humans are feeling lonely and isolated and may therefore benefit from social and emotional companionship. However, other humans cannot always be available to fulfill these needs, and such in-need individuals often cannot care for pets. Therefore, we explore how robot companions may be designed to facilitate bonds with humans. Our preliminary examination of 115 participants in a scenario based quasi-experimental study suggests that humans are more likely to develop social and emotional bonds with robots when those robots are good at communicating and conveying emotions. However, robots’ anthropomorphic attributes and responsiveness to external cues were found …

Life After Death: A Field Experiment With Small Businesses On Information Frictions, Stigma, And Bankruptcy, Shai Bernstein, Emanuele Colonnelli, Mitchell Hoffman

In an RCT with US small businesses, we document that a large share of firms are not well-informed about bankruptcy. Many assume that bankruptcy necessarily entails the death of a business and do not know about Chapter 11, where debts are renegotiated so that the business can continue operating. Firms also exhibit bankruptcy-related stigma, believing that bankruptcy is embarrassing, a sign of failure, and a negative signal to employees and customers. Short educational videos that address information or stigma increase knowledge and decrease stigma, both immediately and durably over 4 months. Videos increase reported interest in using Chapter 11 bankruptcy …

Annual estimates of survival for Common Snapping Turtles (Chelydra serpentina) in western Nebraska USA were generated from mark-recapture data from nesting females encountered in 2005–2017. Our population models suggested no annual variation in either adult annual survival (0.947 ± 0.017 SE) or annual capture probability (0.294 ± 0.027 SE). However, there was a tendency toward higher survival in larger females. High annual survival (e.g. > 90%) characterises populations of Chelydra from Ontario to Texas.

Inclusive workplaces start with inclusive hiring practices and then the design and support of inclusive workplace cultures once a hire is settled. The process includes consideration of why you are looking for diverse candidates, writing inclusive job descriptions and job ads, inclusive interviewing considerations, and building an inclusive work environment and culture. Each of these considerations can be examined through a tripartite approach, exploring ways to ensure physical, intellectual, and social needs are addressed and met throughout each stage of the hiring and retention process.

The scriptures consistently depict the significance of sacred space and sacred time in the lives of the Lord’s covenant people. Sacred time is still experienced today, as in the past, through commemorations and celebrations on specific days that are dedicated to God and thus regarded as holy. These days punctuate the passing of ordinary or common time and are intended to help bring focus and clarity to relationships with the divine.

The Securities and Exchange Commission encourages the presentation of information or data in graphical form to improve users’ ability to understand financial disclosures. We find a dramatic increase in the disclosure of both qualitative and quantitative infographics in 10-K filings over time and substantial cross-sectional variation in firms’ choices regarding image types, data content, and the placement of infographics within 10-Ks. We provide evidence on factors associated with firms’ use of infographics and explore the persistence with which they are disclosed over time. Finally, we investigate the relation between the use of infographics and uncertainty in capital markets.

For centuries, humans occupying arid regions of North America have maintained an intricate relationship with Agave (Agavoideae, Asparagaceae). Today Agave cultivation, primarily for beverage production, provides an economic engine for rural communities throughout Mexico. Among known dryland-farming methods, the use of rock piles and cattle-grazed areas stand out as promising approaches for Agave cultivation. Identifying new cultivation areas to apply these approaches in Arizona, USA and Sonora, Mexico warrants a geographic assessment of areas outside the known ranges of rock piles and grasslands. The objective of this study was to predict areas for dryland-farming of Agave and develop models to …

This population-based, case-control study aims to explore the relationship between prior tinnitus and the occurrence of chronic kidney disease (CKD) using a nationwide, population-based cohort study. We used data from the Taiwan National Health Insurance Research Database to explore the association of CKD with tinnitus. We identified 15,314 patients aged >= 40 years old with a first-time diagnosis of CKD as the cases. We used propensity-scored matching to select 45,942 controls (1:3 ratio). We performed multivariate logistic regression to estimate the odds ratio (OR) of a prior tinnitus diagnosis among the CKD group vs. the control group. Analysis showed that …

Pre-existing diabetes, hypertension and kidney disorders are prominent risk factors of pre-eclampsia (PE). It is a multifactorial pregnancy disorder associated with high blood pressure, proteinuria, and multiorgan failure, which develops after the 20th week of pregnancy. It is one of the most feared pregnancy disorders, as it consumes thousands of fetomaternal lives per annum. According to clinical and pathological studies, the placenta appears to be a key player in the pathogenesis of PE; however, the exact origin of this disorder is still under debate. Defective placentation and angiogenesis are the hallmarks of PE progression. This angiogenic imbalance, together with maternal …

The 2010 Deepwater Horizon (DWH) disaster led to extensive oil deposition in Louisiana’s coastal wetlands, followed two years later by Hurricane Isaac. These disturbances led to changes in saltmarsh invertebrate communities, potentially affecting higher-level predators and the saltmarsh food web. Seaside Sparrows (Ammospiza maritima) are ubiquitous, year-round residents of the coastal saltmarsh affected by the DWH spill, where they consume diverse invertebrates and may be considered an indicator species for the ecosystem’s integrity. We used DNA metabarcoding to evaluate prey consumed by Seaside Sparrows to understand how sparrows responded to residual contamination from the DWH oil spill and ecosystem disturbance …

Rising greenhouse gas emissions are causing climate change, and the world’s focus has shifted to the need to reduce our reliance on fossil fuels. There has been a rise in the published literature on the utilization of crops for bioenergy production in Louisiana. However, very few scholarly documents have used Geographic Information Systems (GIS) to map the distribution of potential bioenergy crops in Louisiana. This study seeks to fill the void by evaluating the potential of bioenergy crops in Louisiana for energy production using GIS. Given this objective, the agricultural census data for 1999, 2009, 2019, and 2020 obtained from …

Background: Orbivirus-induced hemorrhagic diseases cause high mortality in wild and captive white-tailed deer in North America. The role of different Culicoides species in Orbivirus transmission outside of areas of intensive animal production has not been established. At our study location, bluetongue virus (BTV) RNA-positive female Culicoides debilipalpis pools have been detected annually since 2012 when BTV transmission was noted in a captive deer herd. Identifying specific larval habitats of suspected vectors at active transmission sites is crucial both for identifying the source of the vectors and for subsequently planning intervention actions. Since C. debilipalpis larvae are known to develop in …

Geolocators are small devices that record and store time-stamped light levels that researchers typically use to approximate the latitude and longitude of small birds across the annual cycle. However, when geolocators are affixed to leg bands of larger-bodied birds, nest incubation by females interrupts the daily pattern of light and darkness. Thus, geolocators can provide information on nesting propensity, nest success, and renesting intensity; these demographic parameters are both difficult to measure unobtrusively and are critically important in determining population dynamics of birds, especially ducks. Here, we deployed 240 geolocators on mottled ducks Anas fulvigula in Louisiana and Texas in …
