The recent discovery that an anonymously published 1620 essay was an early writing of Thomas Hobbes invites investigation of his early thinking. Hobbes relied on mostly classical sources to advance a basically conventionalist theory of law and to anticipate twentieth century analyses of the principles of rule of law such as that made famous by F. A. Hayek.

DNase I hypersensitive site 2 (HS 2) of the human β-globin Locus Control Region (LCR) directs high level expression of the β-globin gene located 50 kilobases downstream. Experiments in cultured cells and in transgenic mice demonstrate that duplicated AP1-like sites in HS 2 are required for this powerful enhancer activity. A cDNA clone encoding a basic, leucine-zipper protein that binds to these sites was isolated and designated Locus Control Region-Factor 1 (LCR-F1). This protein is a member of a new family of regulatory factors that contain a 63 amino acid 'CNC domain' overlapping the basic region. This domain is approximately …

Humic acids (HA) and fulvic acids (FA) are common forms of organic matter in marine sediments, and are routinely ingested by deposit- and suspension-feeding animals. These compounds may be a sink for metals, implying that once metals are bound to humic substances they are no longer available to food webs. A series of experiments was conducted to quantitatively examine this premise using 2 estuarine bivalves from San Francisco Bay, USA: the suspension feeder Potarnocorbula arnurensis and the facultative deposit feeder Macoma balthica. The human β-globin Locus Control Region (LCR) has two important activities. First, the LCR opens a 200 kb chromosomal domain containing the human ε-, γ- and β-giobin genes and, secondly, these sequences function as a powerful enhancer of ε-, γ- and β-globin gene expression. Erythrold-specific, DNase I hypersensitive sites (HS) mark sequences that are critical for LCR activity. Previous experiments demonstrated that a 1.9 kb fragment containing the 5′ HS 2 site confers position-independent expression in transgenic mice and enhances human β-giobin gene expression 100-fold. The Value Of Salt Marsh Edge Vs Interior As A Habitat For Fish And Decapod Crustaceans In A Louisiana Tidal Marsh, G. W. Peterson, R. Eugene Turner

Flume nets of various lengths and a 3-m seine were used to sample the fishes and macrocrustaceans using a flooded Louisiana salt marsh and the adjacent tidal creek. The experiment allowed for species-specific comparisons of the flooded marsh at the creek edge versus the interior. Of the 37,667 organisms collected in flume nets from January through November 1989, 89% were decapods (nine species) and 11% were fish (29 species). An additional 18,539 organisms (75% decapods and 25% fish) were collected from concurrent seine samples taken from July through November. Thermoregulatory Effects Of Caffeine Ingestion During Rest And Exercise In Men, N Dunagan, J E. Greenleaf, C J. Cisar

Body temperatures and thermoregulatory responses were measured at rest and during submaximal exercise under normal ambient conditions in 11 aerobically-conditioned men (age = 29.2 +/- 6.2 yr, VO2(max) = 3.73 +/- 0.46 min(sup -1), relative body fat = 12.3 +/- 3.7 percent, mean +/- SD) with (CT) and without (NCT) the ingestion of 10 mg of caffeine per kg of body weight. Oxygen uptake (VO2), heart rate (HR), and rectal (T(sub re)) and mean skin (T-bar(sub sk)) temperatures were recorded for 100 minutes starting one minute after ingestion of caffeine or a placebo. Two gecko species, Hemidactylus turcicus and Cyrtopodion scabrum, have been introduced into the Port of Galveston, Texas. While H. turcicus has been established for a longer period of time, the relatively recent introduction of C. scabrum near the entrance of the Port has apparently led to the displacement of H. turcicus in that area. This has resulted in a distribution in which the two populations’ are largely allopatric except for a narrow band of sympatry at the periphery of each of their ranges. In this Comment, I will argue that courts have ignored bad faith's contractual heritage and have undervalued contract law's ability to respond to insurer misconduct. To draw upon Professor Powers's thoughtful analysis, I believe that courts invoked the tort paradigm before it was clear that the contract paradigm was inadequate. For lack of data, I will stop short of recommending where we should go from here, but I will suggest that our behavior in the face of bad faith liability in tort may have changed no less than the environment and that the perceived relative calm in the tort's current …

The coronavirus strain HECV‐4408 was isolated from diarrhea fluid of a 6‐year‐old child with acute diarrhea and propagated in human rectal tumor (HRT‐18) cells. Electron microscopy revealed coronavirus particles in the diarrhea fluid sample and the infected HRT‐18 cell cultures. This virus possessed hemagglutinating and acetylesterase activities and caused cytopathic effects in HRT‐18 cells but not in MDBK, GBK and FE cells. One of four S‐specific monoclonal antibodies reacted in Western blots with HECV‐4408, BCV‐L9 and BCV‐LY138 but not with HCV‐OC43, and two reacted with BCV‐L9 but not with HECV‐4408, BCV‐LY138 and HCV‐OC43. Results of an in vitro assay revealed that root-associated methane consumption was a common attribute of diverse emergent wetland macrophytes from a variety of habitats. Maximum potential uptake rates (V(maxp)) varied between about 1 and 10 μmol g (dry weight)-1 h-1, with no obvious correlation between rate and gross morphological characteristics of the plants. The V(maxp) corresponded to about 2 x 108 to 2 x 109 methanotrophs g (dry weight)-1, assuming that root-associated methanotrophs have cell- specific activities comparable to those of known isolates. The objective was to evaluate bull differences in chromosomal and spermatozoal areas related to the occurrence of the bovine leukocyte adhesion deficiency syndrome. Lymphocyte chromosomes from 30 Holstein bulls and 2 Holstein heifers were measured using image analysis and computer-enhanced video-microscopy. Spermatozoal head areas from 29 of the 30 bulls were measured. Autosomal rank was based on decreasing area. Average total autosomal areas were not the same across bulls. One group of bulls had significantly smaller average chromosomal areas than the others; this group carried bovine leukocyte adhesion deficiency syndrome. ABSTRACT: This study was to verify the usefulness of Nanovid microscopy techniques for evaluating induced modifications in bovine spermatozoal membranes. Frozen thawed bovine sperm were labeled with 20‐nm colloidal gold particles bound to concanavalin A (ConA) or heparin ligands. Sperm membrane changes were induced in vitro by capacitating and acrosome‐reacting procedures. Capacitatton was induced by incubation with 10 μg/ml of heparin for 4 hours at 37°C, 5% CO2, and high humidity. Membrane changes associated with the acrosome reaction were induced by addition of lysophosphatidyicholine (100 μg/ml) and incubation for 15 minutes at 37°C, 5% CO2, and high humidity. Although boron has long been known to be a required nutrient for plants, it was not until recently that there was any suggestion of a nutritional requirement for animals and humans. Addition of boron to the diet of vitamin D-deficient chicks indicated that boron may play a role in animal nutrition. Studies with rats have demonstrated that supplemental dietary boron has most marked effects when the diet is deficient in known nutrients. We observed higher apparent-balance values of calcium, magnesium, and phosphorus for rats fed a vitamin D-deprived diet with dietary supplemental boron (2.72 ppm), than for rats fed the …

The Human Remains From Carter-Ranch Pueblo,Arizona: Health In Isolation, Marie E. Danforth, Della Collins Cook, Stanley G. Knick Iii

Health patterns in the Pueblo III (A.D. 1100-1225) population from Carter Ranch Pueblo were investigated in skeletal remains from 34 individuals. Childhood health disruptions were assessed using stature, linear enamel hypoplasias, and Harris lines. Periostitis, arthritis, anemia, trauma, and dental pathology were also observed. Although the low juvenile representation is probably an effect of age-biased mortuary practices, results suggest a healthy population compared to larger southwestern sites. Trauma levels at the site are quite high, possibly indicating burial practices differentiated on the ability to work or other health criteria. Additionally, a number of genetic anomalies are present, suggesting an isolated …

Viewing the Takings Clause of the Fifth Amendment as a form of insurance appeals to our intuition. The government, like fire, does not often "take" property, but when faced with extraordinary risk property owners naturally desire compensation. Recent scholarship, however, has dissolved the attractiveness of this perspective. This literature, through economic analysis, claims that the Takings Clause should be repealed and replaced with private takings insurance. This is the "no-compensation" result. This article argues that the insurance-based understanding of the just compensation requirement can be preserved without reaching the surprising no-compensation result.
