The patent system provides a surprisingly rich archive of the interplay between social norms and technological change. Patent law requires applicants to publicly disclose the novelty and usefulness of their inventions, thereby bringing to light areas of innovation that may have previously lived in the shadows. In other words, patent law encourages public disclosure of technologies that are taboo—developed and practiced in secret, for reasons such as social approbation, illegality, or religious sanctity. To obtain a patent for a taboo technology, patentees must establish their legitimacy as innovators while navigating cultural norms that are hostile to their fields of innovation. …

Generative Identity Theft: Criminalizing Deepfakes Using The Right Of Publicity, Dustin Marlan
Generative Identity Theft: Criminalizing Deepfakes Using The Right Of Publicity, Dustin Marlan
Faculty Publications
The right of publicity grants individuals control over the commercial use of their identity, particularly name, image, and likeness. Currently, publicity laws are a fragmented patchwork of state statutes and case law, leading to frequent calls for reform, including the establishment of a federal right of publicity. This issue has gained renewed urgency amid the rise of generative artificial intelligence and deepfake technologies. In response, Congress has introduced multiple bipartisan proposals—most prominently, the Senate’s No FAKES Act and the House’s No AI FRAUD Act—that seek to create federal protections against unauthorized digital replicas of likeness, voice, and other aspects of …

Categorical Perception Of The Index Finger As An American Sign Language Phonological Construct, Lareina Hingson, Jeffrey Jack Green, Brooklyn Lorenc
Faculty Publications
In American Sign Language, specific handshapes found in the manual alphabet and/or numbering system (such as the pointed index finger—the number “1”—and its bent counterpart—the letter “x”) are assumed to be phonologically distinct under the rationale that bentness of the finger(s) constitutes a phonemic distinctive feature. This study investigates this notion, building on previous behavioral studies of American Sign Language categorical perception of bentness of the index finger. We examined varying levels of bentness between 180◦ and 90◦ using a scale ranging from the signs BLACK and SUMMER in the standard dialect. Experiment 1 found that when presented with all …
The Military's Constitutional Role, Brenner M. Fissell
The Military's Constitutional Role, Brenner M. Fissell
Faculty Publications
A basic principle of the American constitutional order is that civilian authority must be supreme over that of the military. The violation of this principle by the British was one of the grievances enumerated in the Declaration of Independence, and the Framers responded with a Constitution that made military rule impossible. But why is so-called “civilian control” of the military so important? This deep normative question has yet to be thoroughly answered by scholars, most of who assume it away as a given. This Article takes up that task, using contemporary political theory to defend the principle of civilian control. …

Environmental contamination can have lasting impacts on surrounding communities, though the long-term impacts can be difficult to ascertain. The disaster at the Chornobyl Nuclear Power Plant in 1986 and subsequent remediation efforts resulted in contamination of the local environment with radioactive material, heavy metals, and additional environmental toxicants. Many of these are mutagenic in nature, and the full effect of these exposures on local flora and fauna has yet to be understood. Several hundred free-roaming dogs occupy the contaminated area surrounding the Chornobyl Nuclear Power Plant, and previous studies have highlighted a striking level of genetic differentiation between two geographically …

This chapter brings together insights from Indigenous scholars and experts from the North Pacific, focusing on the Bering Strait region, within a framework emphasizing multi-level governance derived from western academic literature. The chapter highlights a ground-up view of the complexities and challenges Indigenous communities face in this region. Narratives emphasize community experiences in a rapidly changing Arctic with a particular focus on the environment and economy. Yet, there is great diversity in the experiences as well as the threats, emphasizing the need to Indigenize concepts such as environment, economy, governance, and sustainable development. Highlighting local narratives, we explore both unique …

The availability of natural resources drives the exploration and transformation of remote regions in the Arctic and beyond. Extractive infrastructure is one of the major sources of industrial development and environmental impact on landscapes. For Indigenous people, these landscapes are homely environments full of sentient beings, and for other local communities, they provide a wide variety of subsistence and hunting resources. While extractive infrastructure violence is the evident issue for many Indigenous communities, there are more complicated situations where extractive infrastructure is adopted and utilized for the subsistence and support of other human and more-than-human relations in local and Indigenous …

The Impacts Of Co-Occurring Developmental Language Disorder On The Academic, Interpersonal, And Behavioral Profiles Of Children With Adhd, Kirsten M. Hannig Russell, Sean M. Redmond
Faculty Publications
Purpose: Attention-deficit/hyperactivity disorder (ADHD) is a multifactorial disorder that has been linked to increased risk for behavioral, academic, and interpersonal problems. Developmental language disorder (DLD) has also been linked to poor outcomes in these areas. The presence of co-occurring disorders in children’s profiles is generally associated with poorer outcomes relative to profiles consisting of only one disorder. This study investigated the extent to which co-occurring DLD in children already identified with ADHD presented increased risk for severity of their primary ADHD symptoms, the presence of secondary behavioral problems, and/or increased problems in the tertiary areas of academic performance and interpersonal …
Everyone Brings Something To The Table: A Culturally Sustaining Analysis Of Teacher Candidates’ Mixed Reality Teaching Simulations, Erin Scott
Faculty Publications
Discussions of HBCU students’ content knowledge have centered around developing high impact, asset-based approaches to learning (Williams et al, 2022). So, HBCU teacher preparation providers (TPPs) can also focus efforts on culturally sustaining approaches to developing candidates’ content knowledge and researching how high impact practices, like teaching simulations, can help prepare candidates for classrooms. This exploratory case study uses critical cases (n=2); findings suggest candidates have a developing understanding of content, which forms a solid basis for increasing their knowledge. MRTSs are addressed as a potential high impact, culturally sustaining practice for building candidates’ content knowledge. Further, HBCU TPPs can …

“Sustainability” is in—but what does that term mean, when applied to products, services or brands? This article explores existing Federal Trade Commission (“FTC”) oversight of “sustainable” claims in marketing, centering on the FTC’s Guidelines for the Use of Environmental Marketing Claims (often referred to as the “Green Guides”). It analyzes thousands of public comments filed in a recent FTC quasi-rulemaking docket to inform proposed revisions to the Green Guides. The article suggests that the FTC include guidance on “sustainable” claims in its next revision to the Green Guides, and further recommends that the FTC formally extend the Green Guides to …

Africa accounts for a significant portion of the world’s sweetpotato production where it is widely grown as a staple crop. In sub-Saharan Africa (SSA), sweetpotato serves as an important year-round source of calories and nutrition, a form of income for smallholder and pre-commercial farmers, and is increasingly used as silage for animal feed. However, yield per hectare is considerably lower in SSA than from other regions primarily due to sweetpotato weevils (SPW, Cylas spp., Coleoptera: Brentidae). Weevil feeding causes physical damage to the root and can induce chemical responses that give the storage root a bitter taste, both of which …

The Arctic Ocean supports a unique and dynamic microbial community, yet its composition, structure, and response to environmental shifts remain incompletely understood. In this study, 16S rRNA gene metabarcoding (targeting the V3-V4 and V4-V5 hypervariable regions) was used to assess surface water microbial diversity across 20 stations in the Barents Sea, focusing on latitudinal variations within two contrasting current systems: the West Spitsbergen Current (WSC) and the East Spitsbergen Current (ESC). Our results showed that the microbial community is dominated by three primary families—Pseudoalteromonadaceae, Moraxellaceae, and Flavobacteriaceae (14.20%). Comparative analysis of the V3-V4 and V4-V5 regions reveals that each region …

Heavy and costly use of phosphorus (P) fertiliser is often needed to achieve high crop yields, but only a small amount of applied P fertiliser is available to most crop plants. Hakea prostrata (Proteaceae) is endemic to the P-impoverished landscape of southwest Australia and has several P-saving traits. We identified 16 members of the Phosphate Transporter 1 (PHT1) gene family (HpPHT1;1-HpPHT1;12d) in a long-read genome assembly of H. prostrata. Based on phylogenetics, sequence structure and expression patterns, we classified HpPHT1;1 as potentially involved in Pi uptake from soil and HpPHT1;8 and HpPHT1;9 as potentially involved in Pi uptake and root-to-shoot …

This study investigates the control of ciliary beat patterns during ammonium chemotaxis in the model ciliate microalga Chlamydomonas reinhardtii. Screening the chemotaxis response of mutant strains with ciliary defects revealed that a strain lacking CAV2, the alpha subunit of the voltage-gated calcium channel, is deficient in ammonium chemotaxis. CAV2 regulates the switching of the ciliary beat pattern from the asymmetric to the symmetric waveform. Strains lacking COP5/HKR1 (chlamyopsin 5/histidine kinase rhodopsin 1) are also deficient in ammonium chemotaxis. Conversely, strains defective in phototaxis perform ammonium chemotaxis normally. Cell motility analysis revealed wild-type cells reduce the incidences of switching the ciliary …

Abstract: Sugarcane (Saccharum officinarum) is Louisiana's number one row crop. Growing and processing sugarcane produces significant amounts of byproducts, including bagasse, crop residue, molasses, filter-press mud, and boiler fly ash. These products represent an important opportunity to generate value-added and specialty products and enhance sugarcane's sustainability by facilitating a circular economy, where agricultural by-products are reused instead of disposing them (linear economy), in order to reduce resource use and energy demand. Examples of value-added products range from biochar, construction materials, animal feed, biofuels, nanoparticles, and fertilizer. Paramount to the success of the bio-based circular economy is creating useful products that …

In Liberia, children are exposed to multiple forms of adversity which can negatively impact their health and development. Research is needed to examine the feasibility and benefits of integrated interventions that can be incorporated into existing health delivery programs to simultaneously address low responsive stimulation, undernutrition, and infection. This study assessed the feasibility of an integrated intervention promoting psychosocial stimulation and improved child feeding by the provision of eggs and fish. The integrated intervention was incorporated into an existing government health program. Thirty female caregiver-child dyads were randomly selected from two rural communities in Liberia. Participants received fortnightly group parenting …

Environmental concerns are growing in parts of the rural United States as drinking water wells become contaminated with agrichemicals, and climate change impacts such as drought and extreme rain events disrupt farming practices. Analyzing in-depth interviews with 29 U.S. rural journalists, we explore the role rural journalists play when reporting on the environment as it relates to agricultural issues. Findings show that reporting about the environment—such as weather, climate change, water shortages, and droughts—appear in rural journalists' stories given those topics' relevance to their rural communities and the social systems forces exerting influence on journalists, yet rural journalists often do …

Obesity, by any standard, is a global health crisis. Both genetic and dietary contributions to the development and maintenance of obesity were integral factors of our experimental design. As mutations of the melanocortin 4 receptors (MC4R) are the leading monogenetic cause of obesity, MC4R haploinsufficient rats were fed a range of dietary fat (0–12 %) in a longitudinal design. Physiological and motivational assessments were performed using a locomotor task, a 5-choice sucrose preference task, an operant task with fixed and progressive ratios, as well as a distraction operant task. Dendritic spine morphology of medium spiny neurons (MSNs) of the nucleus …

Triple-negative breast cancers (TNBC) are treated primarily by chemotherapy and lack clinically validated therapeutic targets. In particular, inhibitors of the PI3K/AKT/mTOR pathway, abnormally activated in many breast cancers, failed to achieve clinical efficacy in TNBC due to the development of adaptive drug resistance, which is largely driven by the transcriptomic plasticity of TNBC. Expression of CDK8/19 Mediator kinases that control transcriptional reprogramming correlates with relapse-free survival and treatment failure in breast cancer patients, including TNBC. We now investigated how CDK8/19 inhibitors affect the growth of TNBC tumors and their response to mTOR and AKT inhibitors. In contrast to the effects …

Surface waves are significantly damped by biogenic surfactants which accumulate at the ocean's surface from the high latitudes to the tropics. The growth, development, and breaking of short wind-driven surface waves is a key mediator of the air-sea exchange of momentum, heat, and trace gases consequently, the effect of surfactant compounds in the uppermost millimeters of the ocean in damping short surface waves bears on earth's climatic processes. The mechanisms through which surfactants suppress waves have been studied in great detail through careful laboratory experimentation in quasi one-dimensional wave tanks. However, the spatial scales over which this damping occurs in …

The term “offshore” with regards to aquaculture has hitherto encompassed various perspectives, including technology, geographic location, legal jurisdiction, and more. To resolve the ambiguity in this term and understand its implications for current and future aquaculture development, “offshore” should be resolved into two separate metrics: distance from shore and energy exposure. The United Nations Convention on the Law of the Sea (UNCLOS) distinguishes between internal waters, territorial sea, contiguous zone, exclusive economic zone (EEZ), and the high seas, but currently has no precise definition for “offshore” in its provisions, and therefore no applicable laws pertaining to “offshore” aquaculture.
