Child Sex Abuse In Institutional Settings: What Is Next, Marci A. Hamilton Jul 2012

Child Sex Abuse In Institutional Settings: What Is Next, Marci A. Hamilton

Articles

Reinforcing taboos have kept the topic of child sex abuse in institutions from public discussion in the United States until recently. Those walls are now crumbling, and we are entering an era of better public information and discourse, which, in turn, is fueling a movement for the improvement of the legal system's protection of children. In this Article, I will examine the taboos and the impact of their fall, and then chart the legal reforms that are flowing from their downfall.

Effectively Curbing The Gst Exemption For Perpetual Trusts, Lawrence W. Waggoner Jun 2012

Effectively Curbing The Gst Exemption For Perpetual Trusts, Lawrence W. Waggoner

Articles

In "Effectively Curbing the GST Exemption for Perpetual Trusts," I criticized the Treasury Department’s proposal for dealing with perpetual trusts. My objection is that Treasury’s approach would leave many trusts and much wealth GST-exempt for much longer than Congress originally intended. For perpetual trusts created before enactment, Treasury’s approach would allow them to continue to be unburdened by a durational limit. For perpetual trusts created after the effective date of enactment, Treasury’s approach would still allow them to qualify for the GST exemption, but would have the exemption expire 90 years after the trust was created.

Slicing The Shadow: A Proposal For Updating U.S. International Taxation, Reuven S. Avi-Yonah Jun 2012

Slicing The Shadow: A Proposal For Updating U.S. International Taxation, Reuven S. Avi-Yonah

Articles

In the article Avi-Yonah proposed that the United States tax multinational corporations using a formulary apportionment system based solely on income derived from sales. The background for the article was drawn principally from Robert Reich’s The Work of Nations (1991), and the analysis was inspired by Stanley I. Langbein’s work on transfer pricing, especially his seminal article "The Unitary Method and the Myth of Arm’s Length," Tax Notes, Feb. 17, 1986, p. 625; see also Louis Kauder, "Intercompany Pricing and Section 482: A Proposal to Shift From Uncontrolled Comparables to Formulary Apportionment Now," Tax Notes, Jan. 25, 1993, p. 485.

Identifying Knowledge, Skill And Competence For Nanoscience And Nanotechnology Research: A Study Of Postgraduate Researchers’ Experiences, Deepa Chari, Paul Irving, Robert Howard, Brian Bowe Jun 2012

Identifying Knowledge, Skill And Competence For Nanoscience And Nanotechnology Research: A Study Of Postgraduate Researchers’ Experiences, Deepa Chari, Paul Irving, Robert Howard, Brian Bowe

Articles

Over the past few decades, scientific disciplines have changed significantly with the introduction of new and complex aspects of research, particularly in the area of nanoscience and nanotechnology (N&N). Efforts to develop science education programmes in N&N area to adopt these complex changes are also evident from recent literature and educational reports. However, these attempts are focused towards identification and inclusion of contextual scientific knowledge in the curricula and very little is understood about the attributes knowledge, skill and competence necessary to successfully undertake N&N research. Identification of these attributes is important so that the contextual scientific knowledge can be …

From The Thief In The Night To The Guest Who Stayed Too Long: The Evolution Of Burglary In The Shadow Of The Common Law, Helen A. Anderson Jun 2012

From The Thief In The Night To The Guest Who Stayed Too Long: The Evolution Of Burglary In The Shadow Of The Common Law, Helen A. Anderson

Articles

Burglary began evolving from the common law crime almost as soon as Lord Coke defined it in 1641 as breaking and entering a dwelling of another in the night with the intent to commit a crime therein. But sometime between the Model Penal Code in 1962 and today, burglary lost its core actus reus, “entry.” In the majority of jurisdictions, burglary can now be accomplished by simply remaining in a building or vehicle with the intent to commit a crime. Not only does such an offense cover a wide range of situations, but it allows burglary to be attached to …

Optimized Monopole And Dipole Antennas For Uwb Asset Tag Location Systems, Antoine Dumoulin, Matthias John, Max Ammann, Patrick Mcevoy Jun 2012

Optimized Monopole And Dipole Antennas For Uwb Asset Tag Location Systems, Antoine Dumoulin, Matthias John, Max Ammann, Patrick Mcevoy

Articles

Miniaturized monopole and dipole antenna designs are reported with performances optimized for ultrawideband pulsed radio applications. The geometries are created using Bézier spline shapes, which have been refined with a genetic algorithm to simultaneously take account of both frequency- and time-domain criteria. Time-domain measurements of ultra wideband antennas with uniformly distributed energy across the full 3.1-10.6 GHz mask are reported for the first time and validate a new approach to minimization of pulse dispersion effects in the antenna designs.

Nanostructured Ti1‑Xsxo2‑Yny Heterojunctions For Efficient Visible- Light-Induced Photocatalysis, Vinodkumar Etacheri, Michael Seery, Stephen Hinder, Suresh Pillai Jun 2012

Nanostructured Ti1‑Xsxo2‑Yny Heterojunctions For Efficient Visible- Light-Induced Photocatalysis, Vinodkumar Etacheri, Michael Seery, Stephen Hinder, Suresh Pillai

Articles

Highly visible light active S, N co-doped anatase-rutile heterojunctions is reported for the first time. The formation of heterojunctions at a relatively low temperature and visible light activity are achieved through thiourea modification of the peroxo-titania complex. FT-IR spectroscopic studies indicated the formation of a Ti4+-thiourea complex upon reaction between peroxo-titania complex and thiourea. Decomposition of the Ti4+-thiourea complex and formation of visible light active S, N co-doped TiO2 heterojunctions are confirmed using X-ray diffraction (XRD), Raman spectroscopy, transmission electron microscopy (TEM) and UV/Vis spectroscopic studies. Existence of sulfur as sulfate ions (S6+) …

Tracing The Path To ‘Tiger Hood’: Ireland’S Move From Protectionism To Outward-Looking Economic Development, Paul Donnelly Jun 2012

Tracing The Path To ‘Tiger Hood’: Ireland’S Move From Protectionism To Outward-Looking Economic Development, Paul Donnelly

Articles

Up to very recently, Ireland was spoken of in very adulatory terms, to the point of being dubbed the ‘Celtic Tiger.’ However, the tiger is no more, having been consumed by a property-led boom, the collapse of which was compounded by the global financial crisis. Taking path dependence as lens, this paper looks at an early sequence of events that shaped the country’s path to ‘tiger hood’, i.e., the policy shift from protectionism to outward-looking economic development. From relatively contingent and unpredictable beginnings evolved an institutional matrix, with a clear focus on the global, that, ex ante, could not have …

The Embedded Epistemologist: Dispatches From The Legal Front, Susan Haack Jun 2012

The Embedded Epistemologist: Dispatches From The Legal Front, Susan Haack

Articles

In ordinary circumstances, we can assess the worth of evidence well enough without benefit of any theory; but when evidence is especially complex, ambiguous, or emotionally disturbing-as it often is in legal contexts-epistemological theory may be helpful. A legal fact-finder is asked to determine whether the proposition that the defendant is guilty, or is liable, is established to the required degree of proof by the [admissible] evidence presented; i.e., to make an epistemological appraisal. The foundherentist theory developed in Evidence and Inquiry can help us understand what this means; and reveals that degrees of proof cannot be construed as mathematical …

Strict Liability And Negligence In Property Theory, Stewart E. Sterk Jun 2012

Strict Liability And Negligence In Property Theory, Stewart E. Sterk

Articles

The article challenges the traditional view of property law as a strict liability regime by arguing that negligence principles play a significant role in cases where determining property boundaries or ownership is costly or uncertain. It suggests that when information costs are high, the law incorporates negligence-like standards to protect individuals who act reasonably, and proposes that intellectual property law could similarly benefit from this approach.

Omnidirectional Circularly Polarised Microstrip Patch Antenna, Max Ammann, Adam Narbudowicz, Xiulong Bao May 2012

Omnidirectional Circularly Polarised Microstrip Patch Antenna, Max Ammann, Adam Narbudowicz, Xiulong Bao

Articles

An omnidirectional circularly-polarised patch antenna is proposed. The antenna radiates right-handed circular-polarisation with an average axial ratio of 2.3 dB over a full 360° . A shallow diagonal CPW inset-feed was used to achieve good matching to the back-to-back coupled patches, providing a measured S11 < -15 dB at the centre frequency. The measured cross-polar performance is better than 13 dB and the realised gain variation is ~3 dB in the plane normal to the substrate.

Dimethylsulfoxide Exposure Modulates Hl-60 Cell Rolling Interaction, David Gee, Leslie Kate Wright, Jonathan Zimmerman, Kayla Cole, Karen Soule, Michelle Ubowski May 2012

Dimethylsulfoxide Exposure Modulates Hl-60 Cell Rolling Interaction, David Gee, Leslie Kate Wright, Jonathan Zimmerman, Kayla Cole, Karen Soule, Michelle Ubowski

Articles

Human leukaemic HL-60 cells are widely used for studying interactions involving adhesion molecules [e.g. P-selectin and PSGL-1 (P-selectin glycoprotein ligand-1)] since their rolling behaviour has been shown to mimic the dynamics of leucocyte rolling in vitro. HL-60 cells are neutrophilic promyelocytes that can undergo granulocytic differentiation upon exposure to compounds such as DMSO (dimethylsulfoxide). Using a parallel plate flow chamber functionalized with recombinant P-selectin–Fc chimaera, undifferentiated and DMSO-induced (48, 72 and 96 h) HL-60 cells were assayed for rolling behaviour. We found that depending on P-selectin incubation concentration, undifferentiated cells incurred up to a 6-fold increase in rolling velocity while …

Don't Overlook Homework Assignments - They're Simple, But Powerful, Henry Etlinger

Articles

Homework has been a staple of the educational world for decades. This essay outlines how homework assignments have been used effectively in two different courses in combination with a form of continuing group work I call "coalitions," and how the use of homework in each course has influenced the evolution of its use in the other course.

Polyamidoamine Dendrimer Nanoparticle Cytotoxicity, Oxidative Stress, Caspase Activation And Infammatory Response: Experimental Observation And Numerical Simulation, Sourav Prasanna Mukherjee, Hugh Byrne May 2012

Polyamidoamine Dendrimer Nanoparticle Cytotoxicity, Oxidative Stress, Caspase Activation And Infammatory Response: Experimental Observation And Numerical Simulation, Sourav Prasanna Mukherjee, Hugh Byrne

Articles

Mechanisms underlying the in vitro cytotoxicity of Polyamidoamine nano-dendrimers in human keratinocytes are explored. Previous studies demonstrated a systematic, dendrimer-generation-dependent cytotoxicity, oxidative stress, and genotoxicity. The emerging picture is of dendrimer endocytosis, endosomal rupture and subsequent mitochondrial attack and cell death. To understand the underlying mechanisms, the evolution of reactive oxygen species, intracellular glutathione, caspase activation, mitochondrial membrane potential decay, and inflammatory responses have been examined. Early-stage responses are associated with endosomal encapsulation, later-stage with mitochondrial attack. In all cases, the magnitude and evolution of responses depend on dendrimer generation and dose. The early-stage response is modelled using a rate …

Coffee Culture In Dublin: A Brief History, Máirtín Mac Con Iomaire May 2012

Coffee Culture In Dublin: A Brief History, Máirtín Mac Con Iomaire

Articles

This paper discusses the history and development of coffee and coffee houses in Dublin from the 17th century, charting how coffee culture in Dublin appeared, evolved, and stagnated before re-emerging at the beginning of the 21st century, with a remarkable win in the World Barista Championships. The historical links between coffeehouses and media—ranging from print media to electronic and social media—are discussed. In this, the coffee house acts as an informal public gathering space, what urban sociologist Ray Oldenburg calls a “third place,” neither work nor home. These “third places” provide anchors for community life and facilitate and foster broader, …

Vive La Petite Difference: Camp, Obama, And Territoriality Reconsidered, Reuven S. Avi-Yonah May 2012

Vive La Petite Difference: Camp, Obama, And Territoriality Reconsidered, Reuven S. Avi-Yonah

Articles

The recent tax reform proposals by House Ways and Means Committee Chair David Camp, R-Mich., and by President Obama seem to offer starkly contrasting visions of how to reform the taxation of foreign-source income earned by U.S.-based multinational enterprises.1 Both acknowledge the problem, which is that U.S.-based MNEs currently have more than $1 trillion of ‘‘permanently reinvested’’ income offshore, which they cannot bring back to the U.S. without incurring a 35 percent tax penalty. However, they seem to offer radically different solutions: Under the Camp proposal, a participation exemption will enable U.S.-based MNEs to bring back the income without paying …

An Investigation In Culinary Life And Professional Identity In Practice During Internship, Frank Cullen May 2012

An Investigation In Culinary Life And Professional Identity In Practice During Internship, Frank Cullen

Articles

The primary objective of this research was to investigate the selection process used by consumers when choosing a restaurant to dine. This study examined literature on consumer behavior, restaurant selection, and decision-making, underpinning the contention that service quality is linked to the consumer’s selection of a restaurant. It supports the utility theories that consumers buy bundles of attributes that simultaneously combined represent a certain level of service quality at a certain price. The findings of the research displayed a preference by Dublin consumers for Italian and Chinese styled restaurants and identified quality of the food, type of food, cleanliness of …

Women Are The Dominant Decision Makers When Selecting Restaurants To Dine, Frank Cullen

Articles

The primary objective of this research was to investigate the selection process used by consumers when choosing a restaurant to dine. The findings of the research displayed a preference by Dublin consumers for Italian and Chinese styled restaurants and identified quality of the food, type of food, cleanliness of the restaurant, its location and reputation were the key decision variables/attributes used by consumers to select restaurants. The study also established that the importance of the attributes changed, depending on the consumers age, prior experience, their mood and the occasion involved.

Brief Report: A Phase Ii "Window-Of-Opportunity" Frontline Study Of The Mtor Inhibitor, Temsirolimus Given As A Single Agent In Patients With Advanced Nsclc, An Ncctg Study, Nicholas F. Reuter Md

Articles

BACKGROUND:

In an effort to evaluate the single agent activity of temsirolimus in previously untreated non-small-cell lung cancer, the North Central Cancer Treatment Group undertook a frontline "window-of-opportunity" study.

METHODS:

Patients received 25 mg of temsirolimus administered intravenously as a weekly 30 minute infusion, on a 4-week cycle. Based on a two-stage Fleming design, the treatment would be promising if at least four of the first 25 evaluable patients in stage I or at least six of the 50 evaluable patients at the end of stage II have a confirmed response. Fresh tumor biopsies were obtained to evaluate predictive markers …

Three Key Challenges Facing Higher Education And Policymakers, Ellen Hazelkorn May 2012

Three Key Challenges Facing Higher Education And Policymakers, Ellen Hazelkorn

Articles

Our preoccupation with the relative standing of universities and national education systems—illustrated by the growing popularity and obsession with university rankings—reflects the consensus that higher education is essential for economic growth, global competitiveness and a civil society. Universities and nations are being measured according to indicators of global capacity and potential in which comparative and competitive advantages come into play. The more globalization drives a single market in education, as it does in most goods and services, the more higher education is a beacon for investment and talent—the more this kind of barometer is inevitable.

Antipodal Vivaldi Antenna For Water Pipe Sensor And Telemetry, Giuseppe Ruvio, Domenico Gaetano, Max Ammann, Patrick Mcevoy

Articles

An antipodal Vivaldi antenna operates simultaneously for telemetry and sensing when placed conformally onto PVC pipes. Good radiation efficiency is realised and the antenna impedance matching remains stable when the pipe is empty or contains water. The Fidelity Factor performance based on an input Ultra Wideband Gaussian pulse is a suitable figure of merit to detect water presence. Different water levels and pipe conditions correspond to Fidelity Factors between 90% and 96%, which are a suitable dynamic range for sensing and the appropriate quality for pulse communications for remote monitoring.

Understanding Policy Change Using A Critical Junctures Theory In Comparative Context: The Cases Of Ireland And Sweden, Paul Donnelly, John Hogan May 2012

Understanding Policy Change Using A Critical Junctures Theory In Comparative Context: The Cases Of Ireland And Sweden, Paul Donnelly, John Hogan

Articles

Utilizing a new theory for examining critical junctures, we seek to better understand the nature of industrial policy change in Ireland during the 1950s and macroeconomic policy change in Sweden in the 1980s. Did these policy changes constitute critical junctures, or something less, and if so why? The theory consists of three elements – economic crisis, ideational change, and the nature of the policy change – that must be identified for us to be able to declare with some certainty if a policy change constitutes a critical juncture. Herein, we will be examining the roles of a variety of change …

Articles

Burkholderia cenocepacia is an important human pathogen in patients with cystic fibrosis (CF). Non-clinical reservoirs may play a role in the acquisition of infections, so it is important to evaluate the pathogenic potential of environmental B. cenocepacia isolates. In this study, we investigated the interactions of two environmental B. cenocepacia strains (Mex1 and MCII-168) with two bronchial epithelial cell lines,16HBE14o- and CFBE41o-, which have a non-CF and a CF phenotype, respectively.

The environmental strains showed a significantly lower level of invasion into both CF- and non-CF cells in comparison with the clinical B. cenocepacia LMG16656T strain. Exposure of polarized …

Proportionality And Parole, Richard A. Bierschbach May 2012

Proportionality And Parole, Richard A. Bierschbach

Articles

Commentators analyzing the Supreme Court's watershed decision in Graham v. Florida, which prohibited sentences of life without parole for juveniles convicted of nonhomicide crimes, have generally done so in substantive proportionality terms, ignoring or downplaying parole in the process. This Article challenges that approach, focusing on the intersection of proportionality and parole as a jumping-off point. Taking parole seriously makes clear that Graham is difficult to understand solely in terms of substantive proportionality concepts like individual culpability and punishment severity. Instead, the decision can be seen as establishing a rule of constitutional criminal procedure, one that links the validity of …

Competing Into The Future: Responding To The Emerging Challenges Of Mnc Subsidiaries, Marty Reilly, Pamela Sharkey Scott, Vincent Mangematin

Articles

Purpose

Subsidiary units must respond to emerging threats including disaggregation of value chains and increased headquarters monitoring and control which have lead to a cycle of subsidiary decline. We recognize the value of subsidiary initiatives as a short term response but argue that subsidiary long term survival and growth will depend on the unit’s ability to align with its parent strategic activities and knowledge base.

Design/ Methodology

This research is part of an ongoing quantitative and qualitative study programme of Irish subsidiary operations of foreign MNCs. This paper integrates our broader research to date with both in-depth interviews of a …
