Revolution In Manipulation Law: The New Cftc Rules And The Urgent Need For Economic And Empirical Analyses, Rosa M. Abrantes-Metz, Gabriel V. Rauterberg, Andrew Verstein

Articles

Three major banks have now admitted that their employees manipulated worldwide interest rates through the London Interbank Offered Rate (Libor), the most widely used interest rate index. Libor is the interest rate term for trillions of dollars of swaps and loans, and its manipulation may have been used to extract billions of dollars. These allegations come just as commodities manipulation law has been dramatically reformed and the Commodity Futures Trading Commission (CFTC) given vast new regulatory powers. This Article provides the first extended, scholarly analysis of the CFTC’s new anti-manipulation rules. We consider the difficulty the rules address: Commodities manipulation …

The Effects Of Physical Activity On Greenhouse Gas Emissions For Common Transport Modes In European Countries, Aidan Duffy, Robert Crawford Mar 2013

The Effects Of Physical Activity On Greenhouse Gas Emissions For Common Transport Modes In European Countries, Aidan Duffy, Robert Crawford

Articles

This paper applies a life cycle methodology to estimate activity-related contributions of transport modes to GHG emissions. The methodology uses national input-output tables, environmental accounts, household budget data and nutritional data to derive food-sector GHG coefficients of consumption for ten European countries. The food energy requirements for each mode of transport are estimated taking account of the modal activity level and energy requirements. Walking, cycling, driving and bus travel are considered. Typical national food energy-related emissions for walking, cycling, and driving ranged from 25.6 - 77.3 gCO2-eq/pass.km, 10.4 - 31.4 gCO2-eq/pass.km and 1.7 - 5.2 gCO2-eq/pass.km; passenger transport was found …

Our Electoral Exceptionalism, Nicholas Stephanopoulos Mar 2013

Our Electoral Exceptionalism, Nicholas Stephanopoulos

Articles

Election law suffers from a comparative blind spot. Scholars in the field have devoted almost no attention to how other countries organize their electoral systems, let alone to the lessons that can be drawn from foreign experiences. This Article begins to fill this gap by carrying out the first systematic analysis of redistricting practices around the world. The Article initially separates district design into its three constituent components: institutions, criteria, and minority representation. For each component, the Article then describes the approaches used in America and abroad, introduces a new conceptual framework for classifying different policies, and challenges the exceptional …

The Social Production Of National Security, Aziz Huq Mar 2013

The Social Production Of National Security, Aziz Huq

Articles

This Article analyzes a recent policy innovation offered by governments on both sides of the Atlantic as a means of mitigating one form of national security risk: the idea that private individuals and voluntary associations have an untapped capacity for combating terrorism and in particular al Qaeda. Bold assertions in recent strategy statements mooting this possibility have wanted for any supporting account of how private behavior conduces to security. Even if the claimed social production of security against terrorism is causally well-founded, it is unclear how the state can elicit desirable private conduct. Consequently, the proposal's legal and policy ramifications …

Monkstown Enerphit And Passive House Extension, Joseph Little Mar 2013

Monkstown Enerphit And Passive House Extension, Joseph Little

Articles

Unlike new buildings which can be sequenced to maximise thermal continuity, airtightness and speed; the very existence of sub-optimal orientation and constructon methods, old rising walls, intermediate floors, decorative features of a bygone era etc., all complicate the works and impinge upon the performance possible in deep energy-efficient retrofits [1]. It is clear that the more that is stripped away of the old fabric, the more ‘sins of the past’ can become evident and the more control is gained (which ensures the standard is met); yet the building becomes less and less an old building and, if the issue isn’t …

Is Texas Hold 'Em A Game Of Chance? A Legal And Economic Analysis, Thomas J. Miles, Steven Levitt, Andrew M. Rosenfield Mar 2013

Is Texas Hold 'Em A Game Of Chance? A Legal And Economic Analysis, Thomas J. Miles, Steven Levitt, Andrew M. Rosenfield

Articles

In 2006, Congress passed the Unlawful Internet Gambling Enforcement Act (UIGEA), prohibiting the knowing receipt of funds for the purpose of unlawful gambling. The principal consequence of the UIGEA was the shutdown of the burgeoning online poker industry in the United States. Courts determine whether a game is prohibited gambling by asking whether skill or luck is the "dominant factor" in the game. We argue that courts' conception of a dominant factor— whether chance swamps the effect of skill in playing a single hand of poker—is unduly narrow. We develop four alternative tests to distinguish the impact of skill and …

Microwave Drying Kinetics And Quality Characteristics Of Corn, Songul Gursoy, Ruplal Choudhary, Dennis G. Watson Mar 2013

Microwave Drying Kinetics And Quality Characteristics Of Corn, Songul Gursoy, Ruplal Choudhary, Dennis G. Watson

Articles

In recent years, microwave (MW) drying has gained popularity as an alternative drying method for a wide variety of food and agricultural products because of increasing concerns over product quality and production costs. However, the determination of drying kinetics that accurately describes microwave drying characteristics is crucial for the optimization of operating parameters, performance improvement of the drying system and product quality. The objective of this study was to investigate the drying kinetics and the quality characteristics of corn kernels, especially the effects of different initial moisture contents (18.3%, 26.3%, 34.3% and 42.3% db), MW power levels (70, 175 and …

On The Quadratic Bundles Related To Hermitian Symmetric Spaces, Tihomir Valchev Mar 2013

On The Quadratic Bundles Related To Hermitian Symmetric Spaces, Tihomir Valchev

Articles

We develop the direct scattering problem for quadratic bundles associated to Hermitian symmetric spaces. We adapt the dressing method for quadratic bundles which allows us to find special solutions to multicomponent derivative Schrodinger equation for instance. The latter is an infinite dimensional Hamiltonian system possessing infinite number of integrals of motion. We demonstrate how one can derive them by block diagonalization of the corresponding Lax pair.

Personal Jurisdiction And Choice Of Law, Stewart E. Sterk Mar 2013

Personal Jurisdiction And Choice Of Law, Stewart E. Sterk

Articles

The article critiques the Supreme Court's recent personal jurisdiction decisions for failing to provide a clear doctrinal framework, arguing that the Court has oscillated between prioritizing state sovereignty and individual liberty without adequately balancing these interests. The author contends that personal jurisdiction doctrine must evolve to address the complexities of modern, interconnected commerce while protecting both state regulatory power and defendants' reliance interests. The analysis emphasizes the need for a coherent approach that integrates fairness, foreseeability, and sovereign authority in jurisdictional determinations.

Link Levy To Services- Not Urban Middle Class Assets, Tom Dunne Feb 2013

Link Levy To Services- Not Urban Middle Class Assets, Tom Dunne

Articles

Paying any tax is an unwelcome burden, but in Ireland many have a particular aversion to taxes on their homes. We are not alone in this. Elsewhere, taxes on homes are also unpopular; witness the People's Initiative to Limit Property Taxation which forced the California state government to cut property taxes. Nevertheless, residential property taxes remain an almost universal feature of developed countries because of compelling economic arguments for them. Also, local property taxes are regarded as the best means of funding local government.

Rarely, it seems to me, is there such a distance between what the public wants and …

Advances In The Synthesis Of Zno Nanomaterials For Varistor Devices, Suresh Pillai, John M. Kelly, Raghavendra Ramesh, Declan Mccormack

Articles

ZnO based varistors are widely used for overvoltage protection in many electrical and electronic circuits, at voltages ranging from a few to over a million volts. By careful control of the microstructure, through nanostructuring by chemical routes, it should be possible to produce varistors with high breakdown voltage (Vc), as this is proportional to the number of active grain boundaries in the sintered body. This property is particularly important for the production of the small-sized varistors needed for modern electronic instruments such as tablet computers and mobile phones. The current review will outline the recent advances in the chemical processing …

Should The Us Dictate World Tax Policy? Reflections On Ppl, Reuven S. Avi-Yonah Feb 2013

Should The Us Dictate World Tax Policy? Reflections On Ppl, Reuven S. Avi-Yonah

Articles

The U.S. Supreme Court’s decision to grant certiorari in PPL offers it a unique opportunity to change the law regarding foreign tax credits that has significantly impeded the ability of other countries to engage in meaningful tax reform. In 1938 the Court said in dicta that to qualify for the FTC a tax had to be an income or excess profits tax (or a tax imposed in lieu thereof) under U.S. tax principles. This statement has led to an elaborate set of regulations defining what is an income tax, which has significantly hampered the ability of foreign countries to adopt …

‘Moving In’: Difficulties And Support In The Transition To Higher Education For In-Service Social Care Students, Fiona Mcsweeney Feb 2013

‘Moving In’: Difficulties And Support In The Transition To Higher Education For In-Service Social Care Students, Fiona Mcsweeney

Articles

This paper reports on the difficulties and supports experienced by social care practitioners within the educational institution during their transition to higher education. A life transition such as entering higher education causes stress for individuals and social support is essential in successfully dealing with this stress (Anderson et al., 2012). Fifteen social care practitioners were interviewed twice during and once at the end of their first academic year in college. Findings indicate that participants were reluctant to approach staff for help despite anxiety about classes and assignments. Discussion and debate in class helped learning and contributed to feelings of being …

Measurement Of Granular Flow In A Vertical Column Using Pulse Induction (Pi), Nasreddine Meziane, Ahmed Bettahar, Ruplal Choudhary, Dennis G. Watson Feb 2013

Measurement Of Granular Flow In A Vertical Column Using Pulse Induction (Pi), Nasreddine Meziane, Ahmed Bettahar, Ruplal Choudhary, Dennis G. Watson

Articles

Gravity flow of granular materials in vertical columns can generate pressure and density fluctuations which are difficult to quantify. Examination of prior research led us to propose a new measurement technique based on the principle of pulse induction (PI) for metal detection. An experimental device using 8 mm diameter spherical particles flowing through a polyvinylchloride (PVC) pipe of 75 mm diameter and 1000 mm height was developed to demonstrate the feasibility of PI. Ten PI coils were used to quantify tracer movement through the column with time. Average and instantaneous velocities were determined for five diameters of outlet orifices: 68.0, …

Risk Assessment Of Erosion From Concentrated Flow On Rangelands Using Overland Flow Distribution And Shear Stress Partitioning, Osama Z. Al-Hamdan, Frederick B. Pierson, Mark A. Nearing, Christopher Jason Williams, Jeffry J. Stone, Patrick R. Kormos, Jan Boll, Mark A. Weltz

Articles

Erosion rates of overland flow on rangelands tend to be relatively low, but under certain conditions where flow is concentrated, soil loss can be significant. Therefore, a rangeland site can be highly vulnerable to soil erosion where overland flow is likely to concentrate and exert high shear stress on soil grains. This concept is commonly applied in cropland and wildland soil erosion modeling using predictions of flow effective shear stress (shear stress applied on soil grains). However, historical approaches to partition shear stress in erosion models are computationally complex and require extensive parameterization. Furthermore, most models are not capable of …

Anti-Bacterial Activity Of Indoor Light Activated Photocatalysts, Suresh Pillai, Michael Seery, Damian Synnott, Stephen Hinder, Georg Michlits Feb 2013

Anti-Bacterial Activity Of Indoor Light Activated Photocatalysts, Suresh Pillai, Michael Seery, Damian Synnott, Stephen Hinder, Georg Michlits

Articles

Nanocrystalline photocatalysts, prepared under ambient conditions using a microwave assisted syn-thesis, show indoor light photocatalytic activity for the degradation of Staphylococcus aureus and Escherichia coli. The zinc sulphide (ZnS) nanomaterials, prepared by a microwave assisted synthesis, are shown to be cubic blende structure with an average crystallite size of 4–6 nm. The anti-bacterial activ-ity of these nanomaterials is investigated under irradiation from a 60 W light bulb and photocatalytic activity is revealed to be due to the defects present in the crystal structure. The ZnS shows anti-bacterial action as both a bacteriostatic and bacteriocidal (88% reduction in the amount of …

Evaluation Of Time Series Techniques To Characterise Domestic Electricity Demand, Fintan Mcloughlin, Aidan Duffy, Michael Conlon

Articles

This paper discusses time series approaches, often used by Transmission System Operators (TSOs) to forecast system demand, and applies them at an individual dwelling level. In particular, two techniques, Fourier transforms and Gaussian processes were evaluated and used to characterise individual household electricity demand. The performance of the characterisation approaches were evaluated based on Pearson correlation coefficient, descriptive statistics and paired sample t-tests for electrical parameters: Total Electricity Consumption, Maximum Demand, Load Factor and Time of Use of maximum electricity demand. Finally, a number of time series tests were carried out to ensure certain properties remained between the original and …

Exposure Of Mortars To Cyclic Chloride Ingress And Carbonation, Jonathan Backus, Danny Mcpolin, Muhammed Basheer, Adrian Long, Niall Holmes

Articles

The presence of chloride ions is one of the primary factors causing the degradation of reinforced concrete structures. An investigation to monitor ingress of chlorides during a 24-week wetting and drying exposure regime to simulate conditions in which multiple-mode transport mechanisms are active was conducted on a variety of binders. Penetration was evaluated using free and total chloride profiles. Acid extraction of chlorides is quantitatively reliable and practical for assessing penetration. X-ray diffraction was used to determine the presence of bound chlorides and carbonation. The ability of the cement blends to resist chloride penetration was, from best to worst, ground …
