An Approach To Engaging Students In The Assessment Process, Henry Etlinger, Rajendra K. Raj Jan 2014

An Approach To Engaging Students In The Assessment Process, Henry Etlinger, Rajendra K. Raj

Articles

Haden, Antinori and Carr (2013) described an approach to engage faculty in the assessment process at Long Island University. Here we briefly describe a complementary approach to assessment that we have begun to experiment with at RIT: the active engagement of students in their own assessment.

Performance Of Meshed Tree Protocols For Loop Avoidance In Switched Networks, Kuhu Sharma, Bill Stackpole, Daryl Johnson, Nirmala Shenoy, Bruce Hartpence Jan 2014

Performance Of Meshed Tree Protocols For Loop Avoidance In Switched Networks, Kuhu Sharma, Bill Stackpole, Daryl Johnson, Nirmala Shenoy, Bruce Hartpence

Articles

Loop free frame forwarding in layer 2 switched networks that use meshed topologies to provision for link and path redundancy is a continuing challenge. The challenge is addressed through special protocols at layer 2 that build logical trees over the physically meshed topologies, along which frames can be forwarded. The first such protocol was based on the spanning tree. The spanning tree protocol (STP) had high convergence times subsequent to topology changes. Rapid STP and IETF RFC 5556 Transparent Interconnection of Lots of Links (TRILL) on Router Bridges (RBridges) were then developed to reduce the convergence times. RSTP cntinued to …

Self-Regulated Learning And The Role Of Eportfolios In Business Studies, Amparo Soler-Dominguez, Lucia Morales, Valentina Tarkovska Jan 2014

Self-Regulated Learning And The Role Of Eportfolios In Business Studies, Amparo Soler-Dominguez, Lucia Morales, Valentina Tarkovska

Articles

Through a case study supported by observation techniques, and questionnaires to gather data, we explored the use of ePortfolios as an efficient assessment tool to assist business degree students. Our main focus was a postgraduate course in which finance modules were a major component. We analysed the role of ePortfolios in Higher Education Institutions over a period of four academic years. Our findings suggest that ePortfolios could be used to facilitate and enhance students’ selfregulated learning. The role of the instructor was found to be fundamental in the early stages of the learning process. This role diminished as students became …

A Decade Of Adaptive Governance Scholarship: Synthesis And Future Directions, Barbara Cosens Jan 2014

A Decade Of Adaptive Governance Scholarship: Synthesis And Future Directions, Barbara Cosens

Articles

Adaptive governance is an emergent form of environmental governance that is increasingly called upon by scholars and practitioners to coordinate resource management regimes in the face of the complexity and uncertainty associated with rapid environmental change. Although the term “adaptive governance” is not exclusively applied to the governance of social-ecological systems, related research represents a significant outgrowth of literature on resilience, social-ecological systems, and environmental governance. We present a chronology of major scholarship on adaptive governance, synthesizing efforts to define the concept and identifying the array of governance concepts associated with transformation toward adaptive governance. Based on this synthesis, we …

Commercial Religious Exercise: Translating Commercial Speech Doctrine To The Free Exercise Clause, Danieli Evans Jan 2014

Commercial Religious Exercise: Translating Commercial Speech Doctrine To The Free Exercise Clause, Danieli Evans

Articles

The Patient Protection and Affordable Care Act and implementing regulations require for-profit businesses with more than fifty employees to include contraceptive products in their health care coverage for employees. Throughout the country, privately held corporations and their owners challenged this requirement on the grounds that it violates the Religious Freedom Restoration Act (RFRA), which states that the government shall not “substantially burden” a religious practice unless the regulation is “the least restrictive means” of serving a “compelling governmental interest.” The employers argued that requiring them to include contraceptives in employees’ health coverage substantially burdened their religious opposition to using certain …

Claim Funders And Commercial Claim Holders: A Common Interest Or A Common Problem?, Michele M. Destefano Jan 2014

Claim Funders And Commercial Claim Holders: A Common Interest Or A Common Problem?, Michele M. Destefano

Articles

Commercial claim funding, where funders invest in business disputes in exchange for a percentage of any eventual settlement or judgment, is a growing industry in the United States. Funders may request confidential information about the claim and litigation strategy both before deciding to invest (to analyze the strength of the claim) and during the course of the financial relationship (to manage the investment). Further, these funders may work and communicate with claim holders and lawyers about the claim. However, there has been little caselaw and little in-depth analysis on whether--and in what circumstances-the attorney--client privilege and work-product doctrine can be …

White Like Me: The Negative Impact Of The Diversity Rationale On White Identity Formation, Osamudia R. James Jan 2014

White Like Me: The Negative Impact Of The Diversity Rationale On White Identity Formation, Osamudia R. James

Articles

In several cases addressing the constitutionality of affirmative action admissions policies, the Supreme Court has recognized a compelling state interest in schools with diverse student populations. According to the Court and affirmative action proponents, the pursuit of diversity does not only benefit minority students who gain expanded access to elite institutions through affirmative action. Rather, diversity also benefits white students who grow through encounters with minority students, it contributes to social and intellectual life on campus, and it serves society at large by aiding the development of citizens equipped for employment and citizenship in an increasingly diverse country.

Military Justice As Justice: Fitting Confrontation Clause Jurisprudence Into Military Commissions, Christina Frohock Jan 2014

Military Justice As Justice: Fitting Confrontation Clause Jurisprudence Into Military Commissions, Christina Frohock

Articles

The Guantánamo prosecution of Abd al-Rahim al-Nashiri, the alleged mastermind behind the deadly USS Cole bombing, highlights an unresolved issue in military commissions: whether the Confrontation Clause of the Sixth Amendment to the Constitution applies to bar hearsay statements of unavailable witnesses. While al-Nashiri's counsel recently moved for the military judge to take judicial notice that the Confrontation Clause applies, it is worth considering that the question may be framed differently. Rather than ask whether the Confrontation Clause applies in a military commission, we may ask whether a "testimonial statement" - the only kind of hearsay evidence that triggers the …

Rationale: Poor adherence to inhaler use can be due to poor temporal and/or technique adherence. Up until now there has been no way of reliably tracking both these factors in everyday inhaler use. Objectives: This paper introduces a device developed to create time stamped acoustic recordings of an individual’s inhaler use, in which empirical evidence of temporal and technique adherence in inhaler use can be monitored over time. The correlation between clinical outcomes and adherence, as determined by this device, was compared for temporal adherence alone and combined temporal and technique adherence. Findings: The technology was validated by showing that …

Federalism, Treaty Implementation, And Political Process: Bond V United States, Curtis A. Bradley Jan 2014

Federalism, Treaty Implementation, And Political Process: Bond V United States, Curtis A. Bradley

Articles

In Bond v. United States,1 the U.S. Supreme Court disallowed the prosecution of a domestic poisoning case under legislation that implements the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction.2 In doing so, a majority of the Court declined to address constitutional issues concerning the relationship between the national government's treaty power and the U.S. federal system of government. Instead, the majority resolved the case by applying a presumption that federal statutes do not intrude on traditional areas of state authority, such as the prosecution of local crimes, …

After Recess: Historical Practice, Textual Ambiguity, And Constitutional Adverse Possession, Curtis A. Bradley, Neil S. Siegel Jan 2014

After Recess: Historical Practice, Textual Ambiguity, And Constitutional Adverse Possession, Curtis A. Bradley, Neil S. Siegel

Articles

The Supreme Court’s decision last Term in NLRB v. Noel Canning contains an especially strong and sustained endorsement of the relevance of historical practice to discerning the Constitution’s distribution of authority between Congress and the President.1 In interpreting the scope of the Recess Appointments Clause,2 the Court gave significant attention to how governmental actors had understood and applied the Clause throughout history. The Court did so, moreover, as part of a self-conscious approach to constitutional interpretation. When construing“constitutional provisions regulating the relationship between Congress and the President,” the Court explained, “great weight” should be given to “‘[l]ong settled and established …
