Patent Markets: A Framework For Evaluation, Michael J. Burstein Oct 2015

Patent Markets: A Framework For Evaluation, Michael J. Burstein

Articles

Patents have become financial assets, in both practice and theory. A nascent market for patents routinely produces headline-grabbing transactions in patent portfolios, and patent assertion entities frequently defend themselves as sources of liquidity essential for a patent market to function. Much of the discourse surrounding these developments assumes that a robust, liquid market for patents would improve the operation of the patent system. In this Essay, I challenge that assumption and systematically assess the cases for and against patent markets. I do so by taking seriously both the underlying innovation promotion goal of the patent system and the lessons of …

Vibrational Spectroscopic Studies To Elucidate The Structure Of Water At Biological Interfaces, Bahar Bahrani, Luke O'Neill, Hugh Byrne Oct 2015

Vibrational Spectroscopic Studies To Elucidate The Structure Of Water At Biological Interfaces, Bahar Bahrani, Luke O'Neill, Hugh Byrne

Articles

In biological systems, water takes up to 80% of the volume inside a cell. This water solubilizes the biological macromolecules such as the DNA, proteins and lipids. Recent advancements have shown that the water at the interface of a lipid membrane is structured, as five layers of structured water have been found at this solvent cage. Steady state Raman spectroscopy of water in lipids was performed in an attempt to elucidate the structure of water at the biological interface. Deuterium oxide (heavy water) was employed to hydrate lipid biomolecules. The heavier deuterium atom shifts the molecular vibrations and renders them …

Three Words And The Future Of The Affordable Care Act, Nicholas Bagley Oct 2015

Three Words And The Future Of The Affordable Care Act, Nicholas Bagley

Articles

As an essential part of its effort to achieve near universal coverage, the Affordable Care Act (ACA) extends sizable tax credits to most people who buy insurance on the newly established health care exchanges. Yet several lawsuits have been filed challenging the availability of those tax credits in the thirty-four states that refused to set up their own exchanges. The lawsuits are premised on a strained interpretation of the ACA that, if accepted, would make a hash of other provisions of the statute and undermine its effort to extend coverage to the uninsured. The courts should reject this latest effort …

With Marriage On The Decline And Cohabitation On The Rise, What About Marital Rights For Unmarried Partners?, Lawrence W. Waggoner

Articles

This article draws attention to a cultural shift in the formation of families that has been and is taking place in this country and in the developed world. Part I uses recent government data to trace the decline of marriage and the rise of cohabitation in the United States. Between 2000 and 2010, the population grew by 9.71 %, but the husband and wife households only grew by 3.7%, while the unmarried couple households grew by 41.4%. A counter-intuitive finding is that the early 21st century data show little correlation between the marriage rate and economic conditions. Because of the …

A Look Back At The "Gatehouses And Mansions" Of American Criminal Procedure, Yale Kamisar

Articles

I am indebted to Professor William Pizzi for remembering—and praising—the “Gatehouses and Mansions” essay I wrote fifty years ago. A great many articles and books have been written about Miranda. So it is nice to be remembered for an article published a year before that famous case was ever decided.

The Unintended Effects Of Government-Subsidized Weather Insurance, Omri Ben-Shahar, Kyle D. Logue Oct 2015

The Unintended Effects Of Government-Subsidized Weather Insurance, Omri Ben-Shahar, Kyle D. Logue

Articles

Catastrophes from severe weather are perhaps the costliest accidents humanity faces. While we are still a long way from technologies that would abate the destructive force of storms, there is much we can do to reduce their effect. True, we cannot regulate the weather, but through smart governance and correct incentives we can influence human exposure to the risk of bad weather. We may not be able to control wind or storm surge, but we can prompt people to build sturdier homes with stronger roofs far from floodplains. We call these catastrophes "natural disasters," but they are the result of …

Wrongs, Rights, And Third Parties, Nicholas Cornell Oct 2015

Wrongs, Rights, And Third Parties, Nicholas Cornell

Articles

In philosophical and legal arguments, it is commonly assumed that a person is wronged only if that person has had a right violated. This assumption is often viewed almost as a necessary conceptual truth: to be wronged is to have one's right violated, and to have a right is to be one who stands to be wronged. I will argue that this assumption is incorrect—that having a right and standing to be wronged are distinct and separable moral phenomena.

My argument begins from cases in which third parties are affected by the violation of someone else's rights. I will introduce …

Balancing Effects Across Markets, Daniel A. Crane Oct 2015

Balancing Effects Across Markets, Daniel A. Crane

Articles

In Philadelphia National Bank (PNB), the Supreme Court held that it is improper to weigh a merger's procompetitive effects in one market against the merger's anticompetitive effects in another. The merger in question, which ostensibly reduced retail competition in the Philadelphia area, could not be justified on the grounds that it increased competition against New York banks and hence perhaps enhanced competition in business banking in the mid-Atlantic region. I will refer to the Supreme Court's prohibition on balancing effects across markets as a "market-specificity" rule. Under this rule, efficiencies that may counterbalance anticompetitive aspects must be specific to …

Determination Of The Polymerisation Rate Of A Low-Toxicity Diacetone Acrylamide-Based Holographic Photopolymer Using Raman Spectroscopy, Dervil Cody, Emilia Mihaylova, Luke O'Neill, Izabela Naydenova Oct 2015

Determination Of The Polymerisation Rate Of A Low-Toxicity Diacetone Acrylamide-Based Holographic Photopolymer Using Raman Spectroscopy, Dervil Cody, Emilia Mihaylova, Luke O'Neill, Izabela Naydenova

Articles

The polymerisation rate of a low-toxicity Diacetone Acrylamide (DA)-based photopolymer has been measured for the first time using Raman spectroscopy. A value for the polymerisation rate of 0.020 s−1 has been obtained for the DA photopolymer by modelling the polymerisation reaction dynamics as a stretched exponential or Kohlrausch decay function. This is significantly lower than the polymerisation rate of 0.100 s−1 measured for the well known Acrylamide (AA)-based photopolymer composition. The effect of the additive glycerol on the polymerisation rate of the DA-based photopolymer has also been investigated. The inclusion of glycerol is observed to increase the rate …

Cold Plasma Inactivation Of Internalised Bacteria And Biofilms For Salmonella Enterica Serovar Typhimurium, Listeria Monocytogenes And Escherichia Coli, Dana Ziuzina, Lu Han, Patrick J. Cullen, Paula Bourke

Articles

Microbial biofilms and bacteria internalised in produce tissue may reduce the effectiveness of decontamination methods. In this study, the inactivation efficacy of in-package atmospheric cold plasma (ACP) afterglow was investigated against Salmonella Typhimurium, Listeria monocytogenes and Escherichia coli in the forms of planktonic cultures, biofilms formed on lettuce and associated bacteria internalised in lettuce tissue. Prepared lettuce broth (3%) was inoculated with bacteria resulting in a final concentration of ~ 7.0 log10 CFU/ml. For biofilm formation and internalisation, lettuce pieces (5 × 5 cm) were dip-inoculated in bacterial suspension of ~ 7.0 log10 CFU/ml for 2 h and …

Beiser, Laura Williams, Eavan Mcgovern, Fiona Molloy, Timothy Lynch, Dan G. Healy, Helena Moore, Richard Walsh, Richard B. Reilly, Sean O'Riordan, Cathal Walsh, Michael Hutchinson

Articles

Background: Adult-onset isolated focal dystonia (AOIFD) presenting in early adult life is more frequent in men, whereas in middle age it is female predominant. Temporal discrimination, an endophenotype of adult-onset idiopathic isolated focal dystonia, shows evidence of sexual dimorphism in healthy participants. Objectives: We assessed the distinctive features of age-related sexual dimorphism of (i) sex ratios in dystonia phenotypes and (ii) sexual dimorphism in temporal discrimination in unaffected relatives of cervical dystonia patients. Methods: We performed (i) a meta-regression analysis of the proportion of men in published cohorts of phenotypes of adult-onset dystonia in relation to their mean age of …

Congruent Visual Speech Enhances Entrainment To Continuous Auditory Speech In Noise-Free Conditions, Michael Crosse, John S. Butler, Edmumd Lalor Oct 2015

Congruent Visual Speech Enhances Entrainment To Continuous Auditory Speech In Noise-Free Conditions, Michael Crosse, John S. Butler, Edmumd Lalor

Articles

Congruent audiovisual speech enhances our ability to comprehend a speaker, even in noise-free conditions. When incongruent auditory and visual information is presented concurrently, it can hinder a listener’s perception and even cause him or her to perceive information that was not presented in either modality. Efforts to investigate the neural basis of these effects have often focused on the special case of discrete audiovisual syllables that are spatially and temporally congruent, with less work done on the case of natural, continuous speech. Recent electrophysiological studies have demonstrated that cortical response measures to continuous auditory speech can be easily obtained using …

Genetic Models For The Study Of Luteinizing Hormone Receptor Function, Prema Narayan Sep 2015

Genetic Models For The Study Of Luteinizing Hormone Receptor Function, Prema Narayan

Articles

The luteinizing hormone/chorionic gonadotropin receptor (LHCGR) is essential for fertility in men and women. LHCGR binds luteinizing hormone (LH) as well as the highly homologous chorionic gonadotropin. Signaling from LHCGR is required for steroidogenesis and gametogenesis in males and females and for sexual differentiation in the male. The importance of LHCGR in reproductive physiology is underscored by the large number of naturally occurring inactivating and activating mutations in the receptor that result in reproductive disorders. Consequently, several genetically modified mouse models have been developed for the study of LHCGR function. They include targeted deletion of LH and LHCGR that mimic …

Thermodynamic Analysis Of Closed Steady Or Cyclic Systems, Jim A. Mcgovern Sep 2015

Thermodynamic Analysis Of Closed Steady Or Cyclic Systems, Jim A. Mcgovern

Articles

Closed, steady or cyclic thermodynamic systems, which have temperature variations over their boundaries, can represent an extremely large range of plants, devices or natural objects, such as combined heating, cooling and power plants, computers and data centres, and planets. Energy transfer rates can occur across the boundary, which are characterized as heat or work. We focus on the finite time thermodynamics aspects, on energy-based performance parameters, on rational efficiency and on the environmental reference temperature. To do this, we examine the net work rate of a closed, steady or cyclic system bounded by thermal resistances linked to isothermal reservoirs in …

Improving Operator Situational Awareness With Wide Area Geographic Data View Displays Of The Electric Power Grid, Esa M. Rantanen, Limor Hochberg, Diego Klabjan, Mingyang Di Sep 2015

Improving Operator Situational Awareness With Wide Area Geographic Data View Displays Of The Electric Power Grid, Esa M. Rantanen, Limor Hochberg, Diego Klabjan, Mingyang Di

Articles

To reduce clutter on wide-area geographic data view displays of electric power systems, substations in geographically compact areas should be spread out and line overlaps and intersections minimized. Such pat- terns optimized with respect to given constraints can be modeled as a multicommodity flow problem. Due to the size of the developed model, we developed two clustering-based iterative algorithms to decompose the global network into smaller regions and then iteratively solve the subproblem in each region by readjusting some values. Three solutions were selected for experimental evaluation. The experimental results were somewhat inconclusive, due to naïve participants, simple task, and …

Novel Nucleosomal Particles Containing Core Histones And Linker Dna But No Histone H1, Hope A. Cole, Feng Cui, Tara L. Burke, Tatiana Nikitina, Vivekananthan Nargarajavel, Naoe Kotomura, Victor B. Zhurkin, David J. Clark

Articles

Eukaryotic chromosomal DNA is assembled into regularly spaced nucleosomes, which play a central role in gene regulation by determining accessibility of control regions. The nucleosome contains ∼147 bp of DNA wrapped ∼1.7 times around a central core histone octamer. The linker histone, H1, binds both to the nucleosome, sealing the DNA coils, and to the linker DNA between nucleosomes, directing chromatin folding. Micrococcal nuclease (MNase) digests the linker to yield the chromatosome, containing H1 and ∼160 bp, and then converts it to a core particle, containing ∼147 bp and no H1. Sequencing of nucleosomal DNA obtained after MNase digestion (MNase-seq) …

Cold Plasma Inactivation Of Bacterial Biofilms And Reduction Of Quorum Sensing Regulated Virulence Factors, Dana Ziuzina, Daniela Boehm, Sonal Patil, Patrick J. Cullen, Paula Bourke Sep 2015

Cold Plasma Inactivation Of Bacterial Biofilms And Reduction Of Quorum Sensing Regulated Virulence Factors, Dana Ziuzina, Daniela Boehm, Sonal Patil, Patrick J. Cullen, Paula Bourke

Articles

The main objectives of this work were to investigate the effect of atmospheric cold plasma (ACP) against a range of microbial biofilms commonly implicated in foodborne and health- care associated human infections and against P. aeruginosa quorum sensing (QS)-regu- lated virulence factors, such as pyocyanin, elastase (Las B) and biofilm formation capacity post-ACP treatment. The effect of processing factors, namely treatment time and mode of plasma exposure on antimicrobial activity of ACP were also examined. Antibiofilm activity was assessed for E. coli, L. monocytogenes and S. aureus in terms of reduction of cultur- ability and retention of metabolic activity using …

Applications And Comparison Of Continuous Wavelets Transforms On Analysis Of A-Wave Impulse Noise, Jun Qin, Pengfei Sun Sep 2015

Applications And Comparison Of Continuous Wavelets Transforms On Analysis Of A-Wave Impulse Noise, Jun Qin, Pengfei Sun

Articles

Noise induced hearing loss (NIHL) is a serious occupational related health problem worldwide. The A-wave impulse noise could cause severe hearing loss, and characteristics of such kind of impulse noise in the joint time-frequency (T-F) domain are critical for evaluation of auditory hazard level. This study focuses on the analysis of A-wave impulse noise in the T-F domain using continual wavelet transforms. Three different wavelets, referring to Morlet, Mexican hat, and Meyer wavelets, were investigated and compared based on theoretical analysis and applications to experimental generated A-wave impulse noise signals. The underlying theory of continuous wavelet transform was given and …

Taking Care Of Federal Law, Leah Litman Sep 2015

Taking Care Of Federal Law, Leah Litman

Articles

Article II of the Constitution vests the “executive power” in the President and directs the President to “take Care that the Laws be faithfully executed.” But do these provisions mean that only the President may execute federal law? Two lines of Supreme Court precedent suggest conflicting answers to that question. In several prominent separation-of-powers cases, the Court has suggested that only the President may execute federal law: “The Constitution requires that a President chosen by the entire Nation oversee the execution of the laws.” Therefore, the Court has reasoned, Congress may not create private rights of action that allow nonexecutive …

Sanctity In The Midst Of Mediocrity : Graham Greene's Whiskey Priest, Eamon Maher

Articles

The English novelist and convert to Catholicism, Graham Greene (1904-1991), saw the priest as being core to his literary portrayal of Catholicism. The Power and the Glory (1940), published four years after Bernanos' Diary of a Country Priest, is set in a Latin American country, most probably Mexico, which Greene visited in 1938.

Articles

Background: The University of Lurio, School of Optometry in Mozambique is a new program in Africa. The school, the first to serve Portuguese-speaking Africa, can act as a template for such initiatives in other African countries and other limited-resource settings around the world. A major challenge facing such programs is the lack of knowledge about the profession, which impacts the recruitment of students and their expectations of the program. This study was conducted to understand students’ pre-enrollment educational background, perceptions and career expectations as an optometrist in Mozambique so as to inform future enrollment and other similar initiatives. Methods: First-year …

Green Supply Chain Management In Chinese Electronic Manufacturing Organisations; An Analysis Of Senior Managements’ Perceptions., Eoin Plant, Yusen Xu, Gareth R.T. White

Articles

Green supply chain management and reverse logistics has emerged as a key area of research interest. Recent environmental regulations have also stimulated interest in this field. However, information sharing is a pre- requisite to efficient and effective logistics utilisation. Manufacturing organisations in China were argued to be 10-20 years behind their Western counterparts in relation to information sharing in their supply chains (Li and Yuan, 2009). This barrier needs to be addressed if China is going to maintain and grow its manufacturing position in the world, attempt to address green supply chain issues and their negative externalities. A systematic literature …

Unusual Behavior In Parental Care By A House Wren (Troglodytes Aedon): Post Fledging Use Of An Old Nest During Cold Nights, Micah N. Scholer

Articles

I report on the unusual behavior of an adult House Wren (Troglodytes aedon) leading recently fledged young back to the nest for two consecutive nights. The ambient temperature reached below 0°C during both nights. Despite disadvantages associated with remaining in the nest, this observation suggests that adult birds may assess trade-offs between perceived risks versus the benefits of engaging in other activities, in this case roosting communally for thermoregulation.

Remembering ‘The Dark’: Fifty Years On From The ‘Mcgahern Affair’, Eamon Maher

Articles

It is difficult to believe that 50 years have passed since 260 advance copies of John McGahern’s second novel, The Dark, were seized by Irish Customs and Excise officers. The Censorship of Publications Board would deem that the novel posed a risk to public morality because of its “indecent or obscene” content.
