Private Groundwater Management And Risk Awareness: A Cross-Sectional Analysis Of Two Age-Related Subsets In The Republic Of Ireland, Simon Mooney, J. O'Dwyer, Paul Hynds Jan 2021

Private Groundwater Management And Risk Awareness: A Cross-Sectional Analysis Of Two Age-Related Subsets In The Republic Of Ireland, Simon Mooney, J. O'Dwyer, Paul Hynds

Articles

Risk communication represents the optimal instrument for decreasing the incidence of private groundwater contamination and associated waterborne illnesses. However, despite attempts to promote voluntary well maintenance in high groundwater-reliant regions such as the Republic of Ireland, awareness levels of supply status (e.g. structural integrity) have remained low. As investigations of supply awareness are often thematically narrow and homogeneous with respect to sub-population, revised analyses of awareness among both current and future supply owners (i.e. adults of typical well owner and student age) are necessary. Accordingly, the current study utilised a national survey of well users and an age-based comparison of …

Exploring Evidence Of Lost And Forgotten Irish Food Traditions In Irish Cookbooks 1980-2015, Diarmaid Murphy Jan 2021

Exploring Evidence Of Lost And Forgotten Irish Food Traditions In Irish Cookbooks 1980-2015, Diarmaid Murphy

Articles

A study by the Irish Food Board, Bord Bia, in 2008 outlined some lost and forgotten food traditions in Ireland based on the evidence from a pre-selected expert group. This paper explores the inclusion of traditional Irish foods within seventy-nine Irish cookbooks, published between 1980 to 2015. Extant academic and grey literature on food traditions and cookbooks, together with the content of the cookbooks, identified a gradual decline in the presence of certain traditional Irish foods, to the point where they could be deemed lost or forgotten. The study, however, also finds a re-emergence in the most recent period. A …

Promises Made, Promises Broken: The Anatomy Of Idaho's School Funding Litigation, John E. Rumel Jan 2021

Promises Made, Promises Broken: The Anatomy Of Idaho's School Funding Litigation, John E. Rumel

Articles

This Article discusses the protracted Idaho Schools for Equal Educational Opportunity ("ISEEO") K-12 school funding litigation in Idaho - litigation initiated by plaintiffs under Idaho's state constitutional education clause in the early 1990s, which resulted in six reported decisions by the Idaho Supreme Court and two additional decisions in follow-on federal and state court cases and which, although leading to the state Supreme Court's affirming the trial court's determination that the Idaho legislature had failed to adequately fund public education under the thoroughness provision of the education clause, resulted in the state high court's dismissing the case without addressing the …

A Familiar Crossroads: Mcgirt V. Oklahoma And The Future Of The Federal Indian Law Canon, Dylan R. Hedden-Nicely Jan 2021

A Familiar Crossroads: Mcgirt V. Oklahoma And The Future Of The Federal Indian Law Canon, Dylan R. Hedden-Nicely

Articles

Federal Indian law forms part of the bedrock of American jurisprudence. Indeed, critical parts of the pre-civil war constitutional canon were defined in Federal Indian law cases that simultaneously provided legal justification for American westward expansion onto unceded Indian lands. As a result, Federal Indian law makes up an inextricable part of American rule of law. Despite its importance, Federal Indian law follows a long and circuitous road that requires "wander[ing] the maze of Indian statutes and case law tracing back [over] 100 years." That road has long oscillated between two poles, with the Supreme Court sometimes applying foundation principles …

Wealth Transfer Tax Planning After The Tax Cuts And Jobs Act, John A. Miller Jan 2021

Wealth Transfer Tax Planning After The Tax Cuts And Jobs Act, John A. Miller

Articles

On December 17, 2017, Congress passed the Tax Cuts and Jobs Act (TCJA). Among its many impacts, the TCJA increased the inflation-adjusted estate tax basic exclusion amount to $10,000,000 on a temporary basis. This has dramatic implications for many existing and future estate plans, including a major crossover impact on income tax planning. In this Article, we explain the operation of the federal wealth transfer taxes (the estate tax, the gift tax, and the generation skipping transfer tax) in the wake of the TCJA and dissect the basic tax planning techniques for wealth transmission. The overall design of this Article …

Reaching Across The Divide: The Role Of Cultural Events In Peacebuilding, Bernadette Quinn, Adrian Devine, Frances Devine Jan 2021

Reaching Across The Divide: The Role Of Cultural Events In Peacebuilding, Bernadette Quinn, Adrian Devine, Frances Devine

Articles

This article assesses whether or not a cultural event can play a peacebuilding role during the postviolence phase of conflict. Cultural expression has long been a contentious issue in Northern Ireland, no more so than in Derry/Londonderry, the city at the center of this study. Adopting a qualitative approach, the authors used the city’s Fleadh Cheoil (2013) event as a case study and found that it served three of the seven peacebuilding functions outlined by Paffenholz and Spurk: social cohesion, in-group socialization, and intermediation/facilitation. The findings suggest that the event enabled positive change by building “bridges” and developing intercommunal trust …

Labor Organization In Ride-Sharing: Unionization Or Cartelization?, Mark Anderson Jan 2021

Labor Organization In Ride-Sharing: Unionization Or Cartelization?, Mark Anderson

Articles

The sharing economy brings together the constituent parts of a business enterprise into a structure that, on its surface, resembles a business firm, but in crucial ways is nothing like the traditional firm. This includes the ownership of the primary capital assets used in the business, as well as one of the most fundamental features of a firm-the relationship with its labor force. Sharing economy workers are formally contractors, running small businesses as sole entrepreneurs, with the effect that they are excluded from many of the protections made available to workers across the economy. The result is a seeming disparity …

Fashion, Models, And Intellectual Property, Andres Sawicki Jan 2021

Fashion, Models, And Intellectual Property, Andres Sawicki

Articles

In this Article, I revisit the impact of Professor Kal Raustiala and Professor Christopher Sprigman 's landmark article, The Piracy Paradox. Their work identified an empirical anomaly that was difficult to explain in light of the standard justification for intellectual property rights: although IP law does not grant meaningful exclusivity in novel fashion designs, the fashion industry invests significant resources developing those novel designs. To account for this anomaly, The Piracy Paradox shifted the focus from the supply side of innovation to the demand side. The standard justification emphasized that innovators face threats of copying that they cannot easily …

Limiting The Pardon Power, Albert W. Alschuler Jan 2021

Limiting The Pardon Power, Albert W. Alschuler

Articles

Although our government is said to be one of checks and balances, the president’s power “to grant Reprieves and Pardons for Offenses against the United States” appears to be unlimited. In granting this power, the Framers deliberately cast structural safeguards aside. Nevertheless, the presidency of Donald Trump prompted a search for limits. This Article examines: (1) whether a president may pardon crimes that have not yet happened (or announce his intention to do so); (2) whether he may pardon himself; (3) whether he may use pardons to obstruct justice or commit other crimes; (4) whether criminal statutes should be construed …

Development And Testing Of A Dual‐Wavelength Sensitive Photopolymer Layer For Applications In Stacking Of Hoe Lense, Sanjay Keshri, Brian Rogers, Kevin Murphy, Kevin Reynolds, Izabela Naydenova, Suzanne Martin Jan 2021

Development And Testing Of A Dual‐Wavelength Sensitive Photopolymer Layer For Applications In Stacking Of Hoe Lense, Sanjay Keshri, Brian Rogers, Kevin Murphy, Kevin Reynolds, Izabela Naydenova, Suzanne Martin

Articles

Diffractive optical elements (DOEs) have been in development for many years and are an exciting technology with the capability to re‐direct light, using diffraction rather than refraction. Holographic Optical Elements (HOEs) are a subset of diffractive optical elements for which the pho‐ tonic structure is created holographically, i.e., by recording a specific interference pattern in a suit‐ able, photosensitive optical material. Volume HOEs are of particular interest for some applications because of their very high diffraction efficiency and single diffracted order; however, high disper‐ sion and angular wavelength selectivity still present significant challenges. This paper explores a method for producing …

Statebuilding In The Peace Agreements Of Sudan And South Sudan, Gene Carolan Jan 2021

Statebuilding In The Peace Agreements Of Sudan And South Sudan, Gene Carolan

Articles

This article presents a retrospective analysis of the principal peace agreements to emanate from the North–South conflict in Sudan and the civil war in South Sudan. In doing so, it argues that statebuilding practices dating back to the inception of the Sudanese state continue to inform and undermine contemporary efforts to resolve the conflicts in both countries. The article makes a unique contribution by linking the legacy of peace agreements in Sudan and South Sudan to the crises of governance that plague both countries today. In doing so, it seeks to further the discussion on statebuilding as part of a …

Feature Detection For Hand Hygiene Stages, Rashmi Bakshi, Jane Courtney, Damon Berry, Graham Gavin Jan 2021

Feature Detection For Hand Hygiene Stages, Rashmi Bakshi, Jane Courtney, Damon Berry, Graham Gavin

Articles

The process of hand washing involves complex hand movements. There are six principal sequential steps for washing hands as per the World Health Organization (WHO) guidelines. In this work, a detailed description of an aluminum rig construction for creating a robust hand-washing dataset is discussed. The preliminary results with the help of image processing and computer vision algorithms for hand pose extraction and feature detection such as Harris detector, Shi-Tomasi and SIFT are demonstrated. The hand hygiene pose- Rub hands palm to palm was captured as an input image for running all the experiments. The future work will focus upon …

Carbon Futures Trading And Short-Term Price Prediction:An Analysis Using The Fractal Market Hypothesis And Evolutionary Computing, Marc Lamphiere, Jonathan Blackledge, Derek Kearney Jan 2021

Carbon Futures Trading And Short-Term Price Prediction:An Analysis Using The Fractal Market Hypothesis And Evolutionary Computing, Marc Lamphiere, Jonathan Blackledge, Derek Kearney

Articles

This paper presents trend prediction results based on backtesting of the European UnionEmissions Trading Scheme futures market. This is based on the Intercontinental Exchange from 2005to 2019. An alternative trend prediction strategy is taken that is predicated on an application of theFractal Market Hypothesis (FMH) in order to develop an indicator that is predictive of short termfuture behaviour. To achieve this, we consider that a change in the polarity of the Lyapunov-to-Volatility Ratio precedes an associated change in the trend of the European Union Allowances (EUAs)price signal. The application of the FMH in this case is demonstrated to provide a …

An Ensemble Approach For Annotating Source Code Identifiers With Part-Of-Speech Tags, Christian D. Newman,, Michael J. Decker, Reem S. Alsuhaibani, Anthony Peruma, Mohamed Wiem Mkaouer, Satyajit Mohapatra, Tejal Vishnoi, Marcos Zampieri, Timothy Sheldon, Emily Hill

Articles

This paper presents an ensemble part-of-speech tagging approach for source code identifiers. Ensemble tagging is a technique that uses machine-learning and the output from multiple part-of-speech taggers to annotate natural language text at a higher quality than the part-of-speech taggers are able to obtain independently. Our ensemble uses three state-of-the-art part-of-speech taggers: SWUM, POSSE, and Stanford. We study the quality of the ensemble's annotations on five different types of identifier names: function, class, attribute, parameter, and declaration statement at the level of both individual words and full identifier names. We also study and discuss the weaknesses of our tagger to …

Star-Critical Ramsey Numbers For Cycles Versus K4, Chula J. Jayawardene, David E. Narvaez, Stanislaw Radziszowski Jan 2021

Star-Critical Ramsey Numbers For Cycles Versus K4, Chula J. Jayawardene, David E. Narvaez, Stanislaw Radziszowski

Articles

Given three graphs G, H and K we write K → (G, H), if in any red/blue coloring of the edges of K there exists a red copy of G or a blue copy of H. The Ramsey number r(G, H) is defined as the smallest natural number n such that Kn → (G, H) and the star-critical Ramsey number r∗(G, H) is defined as the smallest positive integer k such that Kn−1 ⊔ K1,k → (G, H), where n is the Ramsey number r(G, H). When n ≥ 3, we show that r∗(Cn, K4) = 2n except for r∗(C3, …

Language Policy-Making In Ireland: A Preliminary Study Of The Consultation Process Of Languages Connect, Iker Erdocia, Susanna Nocchi, Mary Ruane Jan 2021

Language Policy-Making In Ireland: A Preliminary Study Of The Consultation Process Of Languages Connect, Iker Erdocia, Susanna Nocchi, Mary Ruane

Articles

This study aims to explore the policy-making process of Languages Connect - Ireland’s Strategy for Foreign Languages in Education 2017-2026. For that purpose, we concentrate on the consultation process adopted by the Department of Education and Skills. Drawing on a concept of foreign language competence as human capital, the aim of this study is twofold. Firstly, we investigate the extent to which the submissions to the consultation process form a sequence with the final document, Languages Connect; secondly, we examine the Irish government documents and compare the submissions reflecting the government approach to language with those problematising such discourse. The …

French Military Masculinities And The Birth Of Cinéma Colonial: Triangulating Queer Desire In Jacques Feyder’S L’Atlantide (1921), Barry Nevin Jan 2021

French Military Masculinities And The Birth Of Cinéma Colonial: Triangulating Queer Desire In Jacques Feyder’S L’Atlantide (1921), Barry Nevin

Articles

Jacques Feyder’s L’Atlantide (1921) is widely considered not only cinéma colonial’s first major representative example but also one of the genre’s most emblematic narratives. However, ambiguities in the film’s portrayal of the mission civilisatrice have received comparatively little analysis. This article aims to expand on our understanding of L’Atlantide and the mirror it held up to interwar France in three main stages. First, it situates the film’s discourses of gender and colonialism within present post-colonial scholarship. Second, it analyses the aesthetic and political contexts of L’Atlantide, paying particular attention to how the film offered a remedy to France’s ailing postwar …

Latin American Film, Mirna Vohnsen Jan 2021

Latin American Film, Mirna Vohnsen

Articles

The scholarship on Latin American film in 2019 speaks of the rich and diverse critical studies that are being conducted in the field. This year the studies encompass a wide range of topics, like the role of Netflix in the production, distribution and consumption of Latin American films; the contention between national cinemas and transnationalism; and the re-examination of films made in the last century. Although publications showcasing the cinemas of Argentina, Mexico and Cuba continue to dominate the field, two special issues have been published shedding light on lesser-studied cinemas, Studies in Spanish and Latin American Cinemas has dedicated …

The Value Of Leadership Practices When There Is No One To Lead: A Nascent Entrepreneurship Context, Lucia Walsh, Bruce Martin Jan 2021

The Value Of Leadership Practices When There Is No One To Lead: A Nascent Entrepreneurship Context, Lucia Walsh, Bruce Martin

Articles

Although a considerable amount of literature shows how entrepreneurs develop and utilize social capital to create and grow their ventures, there is scant learning on how nascent entrepreneurs with few ties actually create and utilize social capital to help turn their early ideas into ventures. This paper reveals the role of relational leadership in social capital development and shows how it enhances persistence among very early-stage nascent entrepreneurs, even when they have no employees or partners to lead. Learning from our 18-month in-depth case studies of early-stage nascent entrepreneurs in one European country is used to propose a theory of …

Drug Education Best Practice For Health, Community And Youth Workers: A Practical And Accessible Tool-Kit, Clay Darcy Jan 2021

Drug Education Best Practice For Health, Community And Youth Workers: A Practical And Accessible Tool-Kit, Clay Darcy

Articles

Objectives Drug education is delivered by a broad spectrum of multi-disciplinary practitioners within the fields of health promotion, drug prevention and treatment, social care, and community and youth work. However, drug education is often misunderstood or conflated with drug information and/or drug prevention. This ambiguity of understanding is problematic and, when coupled with drug education being delivered by practitioners who may not have formal training in drug education, can result in poor delivery, poor participant engagement and poor outcomes. This paper provides conceptual clarity for practitioners on drug education, differentiating it from other approaches to drug issues. Methods The paper …

The Rules Of The Game: Discursive Norms And Limits In The Field Of Online Art Magazines, Tommie Soro, Tim Stott, Brendan K. O'Rourke Jan 2021

The Rules Of The Game: Discursive Norms And Limits In The Field Of Online Art Magazines, Tommie Soro, Tim Stott, Brendan K. O'Rourke

Articles

This article employs methods of discourse analysis and corpus linguistics within a Bourdieusian theoretical framework to examine the discursive norms and limits regulating the construction of reputation by online contemporary art magazines. Moving between quantitative and qualitative analysis of the websites of online contemporary art magazines, the article identifies salient patterns surrounding the use of modifiers and links these patterns to the normative principles of the artworld. Its findings suggest that positive evaluation is a norm but that the use of explicitly evaluative modifiers is prohibited, that artists are predominantly classified according to nationality and that these classifications can construct …

Configurations To Superior Environmental Innovation Strategy: A Both–And Approach, Tiziana Russo-Spena, Nadia Di Paola, Aidan O'Driscoll Jan 2021

Configurations To Superior Environmental Innovation Strategy: A Both–And Approach, Tiziana Russo-Spena, Nadia Di Paola, Aidan O'Driscoll

Articles

An effective climate change action involves the critical role that companies must play in assuring the long-term human and social well-being of future generations. In our study, we offer a more holistic, inclusive, both–and approach to the challenge of environmental innovation (EI) that uses a novel methodology to identify relevant configurations for firms engaging in a superior EI strategy. A conceptual framework is proposed that identifies six sets of driving characteristics of EI and two sets of beneficial outcomes, all inherently tensional. Our analysis utilizes a complementary rather than an oppositional point of view. A data set of 65 companies …
