It Started With Quinlan: The Ever Expanding 'Right To Die', Yale Kamisar Jan 1996

It Started With Quinlan: The Ever Expanding 'Right To Die', Yale Kamisar

Articles

Few rallying cries sound more straightforward than the "right to die"-but few are more fuzzy or more misunderstood. This becomes all too evident when comparing the right-to-die decision handed down by the U.S. Ninth Circuit Court of Appeals earlier this month and the New Jersey Supreme Court's decision in the Karen Ann Quinlan case twenty years ago. At different times, the "right to die" has embraced significantly different rights. On March 6, in Compassion in Dying v. Washington State, the Ninth Circuit held that because a Washington state statute prohibiting assisted suicide prevents physicians from providing assistance to competent, terminally …

The Rhythms Of Hope And Disappointment In The Language Of Judging (St. John's University School Of Law: Rededication Symposia), James Boyd White Jan 1996

The Rhythms Of Hope And Disappointment In The Language Of Judging (St. John's University School Of Law: Rededication Symposia), James Boyd White

Articles

I want to talk today about a certain aspect or dimension of the language of judging. From one point of view the quality I mean can be seen as a kind of idealism inherent in legal language; from another, as a kind of fundamental hypocrisy; from still another, as a simultaneously tragic and comic element in legal life.

Toward The Reformulation Of International Refugee Law, James C. Hathaway Jan 1996

Toward The Reformulation Of International Refugee Law, James C. Hathaway

Articles

As powerful states have increasingly come to question the consonance of the Convention-based refugee law system with their more general migratory control objectives, a political space has evolved in which fundamental issues of the nature of international refugee protection are tenable for the first time since the immediate post-War era. While it is true that recent reform initiatives have generally been regionalized in scope and often restrictionist in tendency, the Reformulation Project is examining the possibility of re-invigorating a universal protection regime characterized by an enhanced conceptual scope aligned with the norms of international human rights law, yet tailored to …

Globalisation Of Contract Law: Rules For Commercial Contracts In The 21st Century, Whitmore Gray

Articles

This is a paper given at the Asia-Pacific Lawyers Association meeting held in Bangkok in November 1995. The author describes the principles of international commercial contracts published in 1994 by the International Institute for the Unification of Private Law. Professor Gray sees a new era of harmonisation of contract law. An appendix gives an abstract of a contract law decision given by an Austrian Court in 1994.

Don't Try: Civil Jury Verdicts In A System Geared To Settlement, Samuel R. Gross, Kent D. Syverud Jan 1996

Don't Try: Civil Jury Verdicts In A System Geared To Settlement, Samuel R. Gross, Kent D. Syverud

Articles

If it is true, as we often hear, that we are one of the most litigious societies on earth, it is because of our propensity to sue, not our affinity for trials. Of the hundreds of thousands of civil lawsuits that are filed each year in America, the great majority are settled; of those that are not settled, most are ultimately dismissed by the plaintiffs or by the courts; only a few percent are tried to a jury or a judge. This is no accident. We prefer settlements and have designed a system of civil justice that embodies and expresses …

Theorists' Belief: A Comment On The Moral Tradition Of American Constitutionalism, Jospeh Vining Jan 1996

Theorists' Belief: A Comment On The Moral Tradition Of American Constitutionalism, Jospeh Vining

Articles

The Moral Tradition of American Constitutionalism is one of those rare works that leads us to face, at the center of law and legal thought, the largest questions about human life and human purpose. There is a special reader's shudder, a certain gestural shift in the chair, reserved for that moment of realizing where one is being led-not to the edge, but to the center, so that the questions become insistent, and whatever we and others say and do in the face of them becomes our response to them.

Remembrances Of William D. Murphy, Margaret A. Leary Jan 1996

Remembrances Of William D. Murphy, Margaret A. Leary

Articles

In mid-1988, as the time for me to assume the presidency of AALL at the end of the Atlanta meeting approached, the association's first executive director, William Jepson, announced that he would resign soon after the meeting. The presence of adequate staffing at headquarters had been a key element in my decision to run for president, so I was particularly appalled at the idea of the position being empty almost exactly as I took office. Then someone-I like to think it was Babe Russo but I can't remember definitely-suggested that Bill Murphy might be willing to serve as acting executive …

Tax Transitions, Opportunistic Retroactivity, And The Benefits Of Government Precommitment, Kyle D. Logue Jan 1996

Tax Transitions, Opportunistic Retroactivity, And The Benefits Of Government Precommitment, Kyle D. Logue

Articles

What if the current federal income tax laws were repealed and replaced with a simple flat tax? What if the entire Internal Revenue Code (with its graduated rates and countless deductions, exclusions, and credits) were scuttled in favor of a broad-based consumption tax? Only a few years ago, such proposals would have seemed radical and extremely unlikely to be adopted. But times are changing. Calls for a drastic overhaul of the Internal Revenue Code have become commonplace, even at the highest levels in the tax-policy community. In addition, proposals that would replace the income tax with a flat-rate broad-based consumption …

A Formal Preparation For Object-Oriented Query Optimisation, Catherine Higgins Jan 1996

A Formal Preparation For Object-Oriented Query Optimisation, Catherine Higgins

Articles

This paper describes work that is in progress on a formalised preparation to object-oriented query optimisation. Such preparation is conducive to the development of optimisation strategies. As an example of a formal preparation, this paper presents a formalised object algebra, a suggested optimisation method and an implementation of an algebraic converter suitable for DAPLEX.

On Transitive And Fully Transitive Abelian P-Groups, D. Carroll, Brendan Goldsmith Jan 1996

On Transitive And Fully Transitive Abelian P-Groups, D. Carroll, Brendan Goldsmith

Articles

It is a long standing problem of A.L.S. Corner as to whether there exists a non-transitive fully transitive Abelian p-group with finite Ulm subgroups. The principal result of this paper shows that no such group exists for a special class of p-groups if the Ulm subjgroup is the direct sum of two cyclic groups. Some results on summands of trnsitive and fully transitive groups are obtained.

Perceived Barriers To Innovation In Small To Mediume Enterprises (Smes), Thomas Cooney Jan 1996

Perceived Barriers To Innovation In Small To Mediume Enterprises (Smes), Thomas Cooney

Articles

Innovation is crucial to the successful development of small to medium-sized enterprises- and SMEs themselves are key to the continuing growth of the economy. Yet the owner/managers of many SMEs perceive the existence of many barriers to innovation. Whether such obstacles are real or merely perceived makes little difference to the strategic management and marketing practice of these firms. To illustrate this problem, this article reports both quantitative and qualitative research about barriers to innovation in smaller firms. A postal survey of 375 owner/managers who empoly fewer than 50 people indicated these managers' views and concerns about a range of …

The Cosmological Question: A Response To Milner S. Ball's 'All The Company Of Heaven', Joseph Vining Jan 1996

The Cosmological Question: A Response To Milner S. Ball's 'All The Company Of Heaven', Joseph Vining

Articles

We do not disagree, and I do not doubt, that legal processes are sources of injustice, violent oppression, crushing of the spirit, destruction of lives, actual death. I have only to look at The Trial1 again. Nor do we disagree that there are strings of words, statements, put out by officials, lawyers, and lawyer-academics, often called "rules," that cannot be taken into oneself and that by their very nature evoke manipulation in response, avoidance if they cannot be ignored. In their name violent imposition of pure will occurs all the time, and power is exercised by those who can secure …

Rotating Disk Ion Selective Electrodes, John Cassidy, David Mullen, Karen Casey, Patrick Cullen Jan 1996

Rotating Disk Ion Selective Electrodes, John Cassidy, David Mullen, Karen Casey, Patrick Cullen

Articles

A simulation was undertaken to predict the transient potential response following a concentration step at a rotating disk electrode comprised of an ion selective layer. A basis for this simulation was that the potential response would be independent of rotation rate since the diffusion layer is larger than the double layer at the electrode. In practice it was found that the potential response does vary with rotation rate. The response was such that the apparent concentration of the analyte in solution decreased with increased rotation rate. The reason for this behavior is due to the disruption of the double layer …

A Brief Defense Of Mass Market Software License Agreements, Robert W. Gomulkiewicz Jan 1996

A Brief Defense Of Mass Market Software License Agreements, Robert W. Gomulkiewicz

Articles

In the rapidly changing world of personal computer software, the end user license agreement ("EULA") has endured. The EULA is a familiar component of most personal computer software transactions. Many commentators, however, have maligned the practice of standard form software licensing. A survey of the literature on the subject might lead one to conclude that there are only critics--and no proponents--of EULAs.

Despite the din of criticism, EULAs continue to be widely usedby almost every mass-market software publisher, even though the cost of doing so is significant. This Article explains the value of EULAs for both software publishers and users, …

Liberty Without Equality: The Property-Rights Connection In A Negative Citizenship Regime, David Abraham Jan 1996

Liberty Without Equality: The Property-Rights Connection In A Negative Citizenship Regime, David Abraham

Articles

Why, in comparison with other liberal capitalist democracies, is the social welfare state so poorly anchored in American law and public discourse? Surely American political and social history have contributed much to the weakness of our "social state." But law, too, has played a significant material, as well as ideological, role and has provided the terrain for much of our social development. This essay explores the particular contribution of the property-liberty nexus to the stunted development of positive liberty and social citizenship in the United States. It traces this connection from the natural rights and bourgeois Founders through several key …
