A large academic literature discusses the nondelegation doctrin4 which is said to bar Congress from enacting excessively broad or excessively discretionary grants of statutory authority to the executive branch or other agents. The bulk of this literature accepts the existence of the doctrine and argues only about the terms of its application or the competence of the courts to enforce it. In this essay, we argue that there is no such nondelegation doctrine: A statutory grant of authority to the executive branch or other agents never effects a delegation of legislative power. Public choice theory has been used to explain a wide range of observable facts. It has also been influential in legal scholarship. In Part I of this article, Tom Ginsburg reviews the main premises behind public choice theory and discusses how these premises have fared when tested empirically. In this section, for example, the author discusses how casual empirical observation of the "free rider" problem suggests that individuals do not always seek to maximize their own self-interest. The author further points out that additional studies, like Ostrom's empirical observations of a Turkish fishery, are necessary in order to explain why …

Professor Harcourt develops and advocates a method to more rigorously measure and evaluate how qualitative "social meaning" variables relate to legal practices and public policies. The method integrates in-depth qualitative interviews with an experimental free associational component, map analysis of the interviews, and a methodology, correspondence analysis, that remains little known in the United States despite its acceptance in other parts of the world. Correspondence analysis, according to Professor Harcourt, is a tool that allows researchers to visually represent the relationship between structures of social meaning and the contexts and practices within which they are embedded. This paper discusses the issues of global IT/IS outsourcing from four interrelated aspects: forming an appropriate global IT strategy, using proper global IT platforms, managing international data sharing, and surviving the cultural environment. This article examines the limitations of the concept of sustainable consumption in terms of the inadequate attention given to the social, cultural and historical contextualization of consumption. I argue that Macromarketing should adopt modes of inquiry that more fully engage with this contextualization. The implicit assumptions of ‘sustainable consumption’ center on the rational individual and his or her needs and wants, and neglect the significance of consumption practices as embodying the relations between individuals. Acts of consumption are not in opposition to, and prior to, macro structures and processes, they are macro processes at work. Consumer practices are cultural and …

The purpose of this paper is to raise some very challenging questions about how to model new product development (NPD) issues in a computerized business simulation. Initially, we briefly review some of the key issues found in the NPD literature, framing each one as a question that challenges new product managers. The paper then addresses how a designer might model these questions in a strategy-oriented game that will include NPD elements. The overall purpose is to start an open forum whereby modelers could discuss and brainstorm contemporary business issues that warrant modeling into competitive business games.

This report provides the description of a recent fine art spectral imaging session at the National Gallery of Art, Washington D. C. This report also includes subsequent evaluation of the performance of our multi-channel visible-spectral imaging (MVSI) system. The multi-band channels analyzed in this report were obtained using a monochrome CCD and a liquid-crystal tunable filter (LCTF) capturing 31 narrow-band channels. The results showed the effectiveness of our designed spectral imaging when used at a museum environment to capture spectral imaging of fine art paintings. This report provides a comparative study of the spectral and colorimetric accuracy of various transformations from multi-band digital signals to spectral reflectance. The multiband channels were obtained by multi-channel visible-spectral imaging (MVSI) using a monochrome CCD and two different filtering systems. In the first system we used a liquid-crystal tunable filter (LCTF) capturing 31 narrow-band channels. We also used a filter wheel with a set of 6 glass filters imaging with and without an extra Wratten absorption filter giving a total of 12 channels.
