Over the past decade, attorneys have increasingly sought free electronic resources on the web to meet their research needs in order to control research costs. Amended Section 2-207 of the Uniform Commercial Code1 (the Code) states new contract rules. I call these "contract rules" to avoid the labels of contract formation and contract interpretation. These new rules cure many of the problems presented by current Section 2-2072 and remind courts that the purpose of Section 2-207 is to interpret a contract that has been made, not to see if a contract exists. Are investors in securitized receivables to be treated as the owners of an asset whose sale has taken it beyond the reach of the trustee in bankruptcy of their sellers? O are they to be treated as holders of a security interest in the transferred asset who have left behind an interest in the sellers' hands that would cause the asset to be subject to claims and interference by the sellers' grasping trustee? Yale is larger than life. And so was his damn crim pro casebook. My first experience of Kamisar was lugging that casebook around in law school. Everyone complained. It outweighed other casebooks by 3-5 pounds on average. Like everything Yale wrote, it was thorough and also featured many excerpts from Kamisar's writings. I must admit they were a pleasure and they stood out like a sore thumb from usual law school fare-for their passion, of course. But mostly because they were so well written. The good writing won me to his cause: yea beleaguered suspect, boo cops.

This Article takes a more functional approach to reconciling preemption doctrine with Chevron when Congress has not expressly delegated preemptive authority to an agency, an approach that considers a variety of concerns, including political accountability, institutional competence, and related concerns. The Article assumes that federalism values, such as ensuring core state regulatory authority and autonomy, are important and can be protected through political processes." It argues that although Congress's "regional structure" might hint at great sensitivity to state concerns, it actually may lead Congress to undervalue some federalism benefits that are more national in nature. In Cuba, a distinctive process of gradual emancipation brought a large number of enslaved and recently-freed men and women into the legal culture. What earlier might have remained oral or physical challenges now took legal form, as slaves and former slaves built alliances with those who could assist them in their appeals. The assertions of former slaves suggest an emerging conviction of a "right to have rights", going well beyond the immediate refusal of their own bondage. In this Article, I consider the possibility of giving the USPTO input from currently active technological practitioners in evaluating the obviousness of claimed inventions. Such input could potentially serve three useful functions. First, it could improve the accuracy of USPTO decisionmaking by providing access to the perspective of actual practitioners as to the obviousness of inventions from the perspective of the hypothetical PHOSITA. Second, it could help the USPTO document the evidentiary basis for rejections that rest in part upon tacit knowledge within technological communities. he technical feasibility and performance of photocatalytic Ti02 coatings in batch-process solar disinfection (SODIS) reactors to improve potability of drinking water in developing countries have been studied. Borosilicate glass and PET plastic SODIS reactors fitted with flexible plastic inserts coated with Ti02 powder were shown to be 2(Jt1o and 25% more effective, respectively, than standard SODIS reactors for the inactivation of E. coli K12. Isopropanol at 100 ppm concentration levels was observed to be completely photodegraded after 24 h continuous exposure to lOG mW/cm2 simulated sunlight in a similar solar photocatalytic disinfector (SPC-DIS) reactor. The public use requirement of eminent domain law may be working its way back into the United States Constitution. To be sure, the words "public use" appear in the document-and in many state constitutions as well, but the federal provision applies to the states in any event-as one of the Fifth Amendment's limitations on the government's inherent power to take private property against the will of its owners. (The other limitation is that "just compensation" must be paid, of which more later.) Any taking of private property, the text suggests, must be for public use. Those words, however, have amounted …

This paper studies lower bounds for classical multicolor Ramsey numbers, first by giving a short overview of past results, and then by presenting several general constructions establishing new lower bounds for many diagonal and off-diagonal multicolor Ramsey numbers. In particular, we improve several lower bounds for R_k(4) and R_k(5) for some small k, including 415 < = R_3(5), 634 < = R_4(4), 2721 < = R_4(5), 3416 < = R_5(4) and 26082 < = R_5(5). Most of the new lower bounds are consequences of general constructions.

We show that the classical Ramsey number R(3,3,3,3) is no greater than 62. That is, any edge coloring with four colors of a complete graph on 62 vertices must contain a monochromatic triangle. Basic notions and a historical overview are given along with the theoretical framework underlying the main result. The algorithms for the computational verification of the result are presented along with a brief discussion of the software tools that were utilized.

Identification of constituent gases in effluent plumes is performed using linear least-squares regression techniques. Overhead thermal hyperspectral imagery is used for this study. Synthetic imagery is employed as the test-case for algorithm development. Synthetic images are generated by the Digital Imaging and Remote Sensing Image Generation (DIRSIG) Model. The use of synthetic data provides a direct measure of the success of the algorithm through the comparison with truth map outputs. In image test-cases, plumes emanating from factory stacks will have been identified using a separate detection algorithm. There is an urgent need to build digital image databases with adequate colorimetric accuracy for museums, achieves and libraries. Traditional colorimetric imaging suffers from the possibilities of metameric problem, while spectral imaging can facilitate accurate tristimulus estimation and possibilities for spectral reconstruction of each pixel. Spectral image archives can be used to render accurate images both spectrally and colorimetrically to the original target for any illuminant and observer. The most convenient and practical capture system for spectral imaging combines a commercial trichromatic camera with two absorption filters to define image spectrally. A search technique was used to identify sets of colored glass filters that could be placed in the optical path of the Sinarback 54 camera system resulting in improved color accuracy compared with a production unit and the ability to perform spectral estimation. A green and blue filter, each a pair of filters, were identified and constructed from Schott glass. RGB images were collected through these two filters resulting in six image planes. Si-based resonant bipolar transistors are demonstrated by the monolithic vertical integration of Si-based resonant interband tunnel diodes atop the emitter of Si/SiGe heterojunction bipolar transistors ~HBTs! on a silicon substrate. In the common emitter configuration, IC versus VCE shows negative differential resistance characteristics. The resulting characteristics are adjustable peak-to-valley current ratios, including infinite and negative values, and tailorable peak current densities by the control of the HBT base current under room temperature operation. With the integrated RITD-HBT combination, latching properties which are the key operating principle for high-speed mixed-signal, memory, and logic circuitry, are experimentally demonstrated.

We present surface photometry for the central regions of a sample of 48 spiral galaxies (mostly unbarred and barred of types Sbc or Sc) observed with the Space Telescope Imaging Spectrograph on board the Hubble Space Telescope. Surface brightness profiles were derived and modeled with a Nuker law. We also analyzed archival Wide Field Planetary Camera 2 images with a larger field of view, available for 18 galaxies in our sample. We modeled the extracted bulge surface brightness profiles with an exponential, an r1/4, or an rn profile. In agreement with previous studies, we find that bulges of Sbc galaxies …

A great deal of concern has now been expressed about the authoritarian population control policies adopted by Asian countries such as Vietnam, India, and particularly China. Many of these autocratic policies and certainly the Chinese "one child policy" have failed in part because the framers of these policies have attempted to unsuccessfully circumvent a long standing cultural desire for male children. Therefore, in this note, we first propose an unconventional population control policy that is sensitive to this cultural desire for male progeny.
