Beyond The Juristic Orientation Of International Criminal Justice: The Relevance Of Criminological Insight To International Criminal Law And Its Control, Dawn L. Rothe, Christopher W. Mullins
Articles
This article draws attention to the relevance of criminological insight on issues of international criminal law and criminal justice. In particular, the ideology and theory of deterrence, legitimacy, and international criminal law are drawn from. After all, the deterrent effect has been touted as a solid empirical fact with the progression and development of 'international criminal justice', the international tribunals since the mid 1990s, and the International Criminal Court. Yet, the current rather blind belief in the deterrent impact of international criminal justice remains, regretfully, a bit premature. Additionally, beyond the concepts of deterrence and legitimacy, criminologists have much to …

Iso-Lines And Inbred-Lines Confirmed Loci That Underlie Resistance From Cultivar ‘Hartwig’ To Three Soybean Cyst Nematode Populations, Samreen Kazi, Jeffry Shultz, Jawad Afzal, Rizwan Hashmi, Mohammed Jasim, Jason Bond, Prakash R. Arelli, David A. Lightfoot
Articles
Soybean [Glycine max (L.) Merr.] cultivars varied in their resistance to different populations of the soybean cyst nematode (SCN), Heterodera glycines, called HG Types. The rhg1 locus on linkage group G was necessary for resistance to all HG types. However, the loci for resistance to H. glycines HG Type 1.3- (race 14) and HG Type 1.2.5- (race 2) of the soybean cyst nematode have varied in their reported locations. The aims were to compare the inheritance of resistance to three nematode HG Types in a population segregating for resistance to SCN and to identify the underlying quantitative trait loci (QTL). …

When Leadership Goes Unnoticed: The Moderating Role Of Follower Self-Esteem On The Relationship Between Ethical Leadership And Follower Behavior, James Avey, Michael Palanski, Fred Walumwa
Articles
The authors examined the effects of ethical leadership on follower organizational citizenship behavior (OCB) and deviant behavior. Drawing upon research related to the behavioral plasticity hypothesis, the authors examined a moderating role of follower self-esteem in these relationships. Results from a field study revealed that ethical leadership is positively related to follower OCB and negatively related to deviance. We found that these relationships are moderated by followers’ self-esteem, such that the relationships between ethical leadership and OCB as well as between ethical leadership and deviant behavior are weaker when followers’ self-esteem is high than low. Implications of these findings for …

Reseacher As Whistleblower: The Ethical Challenges Posed By Sensitive Research, Tom Clonan
Articles
This paper will explore the complex ethical issues raised when ‘non traditional’ insider research is conducted in sensitive and secretive workplace settings. The paper will outline the experiences of the author between 1996 and 2000 - as a Captain in the Irish Army - when he conducted PhD research into the status and roles assigned female personnel in the Irish military. This research uncovered evidence of the widespread bullying, harassment, sexual harassment and sexual assault of female soldiers, sailors and air crew in the Irish military. The paper will address a number of ethical issues as they apply to the …
What If: Hitler's Invasion Of Ireland, Tom Clonan
What If: Hitler's Invasion Of Ireland, Tom Clonan
Articles
Seventy years ago this summer, Hitler’s general staff drew up detailed plans to invade Ireland. In June of 1940, Germany’s 1st Panzer Division had just driven the British Expeditionary Force into the sea at Dunkirk. Churchill labeled Britain’s rout and the evacuation of approximately 330,000 British and allied troops a ‘miracle of deliverance’. The Nazis intoxicated with their victory in France considered themselves unstoppable and were determined to press their advance into Britain and Ireland. Germany’s invasion plans for Britain were codenamed ‘Operation Sealion’. Their invasion plans for Ireland were codenamed ‘Unternehmen Grun’ or ‘Operation Green’. Like Operation Sealion, Operation …
Women On The Frontline Across Irish Defence Forces, Tom Clonan
Women On The Frontline Across Irish Defence Forces, Tom Clonan
Articles
This year marks the 30th anniversary of the enlistment of women to the Irish Defence Forces. Whilst Irish women fought in the 1916 Rising and were combatants in the War of Independence and Civil War, they were largely excluded from the newly formed Free State Army of the 1920s. Dr. Bridget Lyons Thornton was an exception to this rule and was commissioned as an officer at the rank of Lieutenant in 1923. She was demobilised in 1924, and aside from the Army’s Nursing Service, the Defence Forces were to remain an all-male preserve for almost sixty years. The ‘men-only’ status …

Spin Boldoz is an Afghan town in Kandahar province close to the border with Pakistan. As we approach the town – with the US 2nd Cavalry Stryker Regiment – the town’s market square is teeming with Afghan civilians haggling over stalls of fruit and vegetables. Smoke from cooking fires and braziers mix with the diesel exhaust of the Stryker Brigade’s armoured vehicles. Donkeys, goats and sheep are tethered and ready for sale. The regiment’s radios are humming with chatter and overhead an unmanned aerial vehicle (UAV) buzzes lazily over the town. Lurching to a halt, the troops dismount from the …
Us Military And Civilian Surge In Afghanistan, Tom Clonan
Us Military And Civilian Surge In Afghanistan, Tom Clonan
Articles
US and British casualty figures in Afghanistan experienced a dramatic surge in 2010. A total of 499 US troops and 103 British soldiers were killed by the Taliban last year with thousands more seriously injured by improvised explosive devices (IEDs). The casualty statistics for Afghanistan paint a grim picture of the US-led International Security Assistance Force’s (ISAF) campaign against the Taliban. ISAF’s war in Afghanistan deteriorated significantly in 2007 as the Taliban re-grouped, re-organised and finessed its counter-insurgency strategy against NATO. For example, the number of US and British troops killed in action by the Taliban on an annual basis …
The Discourses Of Higher Education In Ireland: Religion, Nationalism And Economic Development, Nora French
The Discourses Of Higher Education In Ireland: Religion, Nationalism And Economic Development, Nora French
Articles
Higher education is shaped and changed by the context in which it operates. For the past several decades, it has been shaped in Ireland by plans for economic development and the focus has been on education as an enabler of wealth creation. It is claimed to have been an important factor in the rise of the Celtic Tiger economy, and the government are again looking to education as a main contributor to recovery from the current recession. This focus marked a major change in Irish higher education. It was in sharp opposition to the deep-seated tradition of liberal education based …

In many scenes with human characters, interacting groups are an important factor for maintaining a sense of realism. However, little is known about what makes these characters appear realistic. In this paper, we investigate human sensitivity to audio mismatches (i.e., when individuals’ voices are not matched to their gestures) and visual desynchronization (i.e., when the body motions of the individuals in a group are mis-aligned in time) in virtual human conversers. Using motion capture data from a range of both polite conversations and arguments, we conduct a series of perceptual experiments and determine some factors that contribute to the plausibility …

Care-Givers, Leisure And The Meaning Of Home: A Case Study Of Low Income Women In Dublin, Bernadette Quinn
Care-Givers, Leisure And The Meaning Of Home: A Case Study Of Low Income Women In Dublin, Bernadette Quinn
Articles
This article seeks to contribute to the literature on the meanings of domestic spaces by furthering understandings of the sorts of roles that space plays in shaping women’s leisure experiences. The study researched a group of 15 women who live in disadvantaged areas of Dublin city and care for dependent children. Focus groups and structured conversations revealed the poverty of the spatial capital available to these women, depicting local environments as difficult and stressful, and to be endured rather than enjoyed. They further revealed the extent to which the women’s lives were shaped by their obligations as care-givers. Within the …
The Benefits Of Holidaying For Children Experiencing Social Exclusion: Recent Irish Evidence, Bernadette Quinn, Jane Stacey
The Benefits Of Holidaying For Children Experiencing Social Exclusion: Recent Irish Evidence, Bernadette Quinn, Jane Stacey
Articles
There is a general assumption in contemporary society that holidaying is beneficial in many ways. Yet, even in affluent societies, access to holidaying opportunities continues to be constrained by a variety of factors relating to inter alia income, gender, health and race. This is problematic because it means that sizeable minorities within advanced societies are being denied the benefits that researchers have attributed to the practice of holidaying. Recently, there has been a renewed interest in problematising the exclusionist nature of holidaying with researchers arguing that a lack of holiday opportunities may compound social deprivation, reinforce social problems and heighten …

A general expression for the dielectric loss spectrum of an absorbing composite medium was obtained from a Maxwell-Garnett general equation. This expression was simplified for the cases of one, two and three dimensional dielectric confinement in both ordered and disordered thin layers, rods (wires) and spheres of absorbing medium which are considered as mesoparticles or mesoscopic molecules. This theoretical approach was verified experimentally using high purity organic liquids with strong absorption bands in the infrared range. Three organic liquids, namely benzene, chloroform and carbon disulphide, were measured in various dielectric confinement configurations using Fourier Transform Infrared (FTIR) spectroscopy with a …

A Macrobending Singlemode Fiber Refractive Index Sensor For Low Refractive Index Liquids, Pengfei Wang, Yuliya Semenova, Yong Li, Qiang Wu, Gerald Farrell
Articles
An all-fiber refractive index sensor with a simple configuration is proposed and investigated. The proposed fiber refractometer consists of a full-loop structure of bare high-bend loss singlemode fiber-1060XP, employing the well-known whispering gallery mode (WGM) effect induced by the evanescent wave excitation to measure the refractive index of an external medium. A competitive sensitivity is achieved (average 725.76nm/RIU at a bend diameter of 19.3mm) compared with other fiber-optic sensors, plus benefits resulting from simplicity, low cost and ease of fabrication.

Study Of The Effect Of Source Signal Bandwidth On Ratiometric Wavelength Measurement, Qiang Wu, Yuliya Semenova, Ginu Rajan, Pengfei Wang, Gerald Farrell
Articles
We derive an analytic equation for a ratiometric wavelength measurement system and analyze the influence of the optical source signal bandwidth. Our investigation shows that in a particular optical sensing system, the higher the bandwidth of the optical signal, the better resolution the system will achieve. Experiments based on two types of optical signals (output signal of a tunable laser and a fiber Bragg grating) were carried out, and experimental results verified both the simulation results and the theoretical analysis.
The Roberts Court And The Environment, Stephen M. Johnson
The Roberts Court And The Environment, Stephen M. Johnson
Articles
During the October 2008 Term, the Supreme Court decided five cases that raised issues of environmental law and the environment was the loser in each case. While it may be difficult to characterize the decisions of the Roberts Court, generally, as “pro-environment” or “antienvironment,” a couple themes consistently appear in the Court’s decisions. First, in most of the environmental cases, the Court has adopted a position advocated or defended by a federal, state or local government when governmental interests are at issue. Second, in all of the cases that implicate federalism concerns, the Court has rendered decisions that favor States’ …
Complex Absorbing Potential Method For Systems, Jimmy Kungsman
Complex Absorbing Potential Method For Systems, Jimmy Kungsman
Articles
The Complex Absorbing Potential (CAP) method is widely used to compute resonances in Quantum Chemistry, both for scalar valued and matrix valued Hamiltonians. In the semiclassical limit ℏ→0 we consider resonances near the real axis and we establish the CAP method rigorously in an abstract matrix valued setting by proving that resonances are perturbed eigenvalues of the nonselfadjoint CAP Hamiltonian, and vice versa. The proof is based on pseudodifferential operator theory and microlocal analysis.

The objective of the Endangered Species Act is to "recover" imperiled species and thus to render the Act's conservation tools unnecessary To achieve this goal, the drafters of the Act crafted a linear process that begins with an assessment of the threats facing the species and moves through the elimination of those threats to the recovery and delisting of the species. It has become increasingly apparent over the past decade that few species fit this model- most species face threats-altered habitats and competition with invasive species-that cannot be eliminated. These species are "conservation reliant" because they will require ongoing conservation …

Towards An Understanding Of International City Break Travel, Gerard Dunne, Sheila Flanagan, Joan Buckley
Articles
This paper explores city break tourism and in particular the distinctive characteristics of this form of travel. The city break is examined and compared to other types of trips. The research follows a sequential mixed methods approach involving both a visitor survey and in-depth interviews. The findings show the international city break trip to have a number of distinctive characteristics. These are summarised into five main areas (5 Ds) – duration, distance, date flexibility, discretionary nature, and destination travel party. These distinguishing features provide a useful insight into one of the most important yet least examined travel segments in tourism …

Regenerating The Quays In Salford: An Analysis Of Visitor Perception, Behaviour And Experience, Ruth Craggs, Peter Schofield
Articles
Tourism can generate substantial benefits to destination communities and has featured extensively in urban regeneration policy, but whilst there is now an extensive literature covering urban tourism and dockland regeneration, visitor perceptions of urban waterfront destinations and their on-site behaviour and experience remain largely unexplored. The paper focuses on the Quays in Salford, the city’s former docklands, which has been regenerated and repositioned as its flagship tourism product. It reports the findings from a questionnaire survey of visitors’ perceptions, behaviour and experience of the Quays. A principal components analysis revealed that four product performance dimensions: ‘primary attractions’, ‘secondary attractions’, ‘access’ …

Trends In The Mathematical Competency Of University Entrants In Ireland By Leaving Certificate Mathematics Grade, Fiona Faulkner, Ailish Hannigan, Olivia Gill
Articles
This article reports on the mathematical competency of students entering third-level education in the University of Limerick (UL). Data from diagnostic testing, gathered on 5,949 students between the years 1998 and 2008, are used to demonstrate the changes in competency levels of students entering UL. There has been a significant decline in the performance of students in the diagnostic test over time. The performance, on average, of students with the same leaving certificate mathematics grade on entry into university has not changed significantly over time. However, the profile of the entrants has changed considerably and this is contributing to the overall …

Property And Transitional Justice, Bernadette Atuahene
Property And Transitional Justice, Bernadette Atuahene
Articles
Transitional justice is the study of those mechanisms employed by communities, states and the international community to deal with a legacy of systematic human rights abuses and authoritarianism in order to promote social reconstruction. There is a well developed transitional justice literature on how states can deal with past violations of civil and political rights, which discusses the value of truth commissions, and international and domestic prosecutions. The transitional justice literature on how to deal with past violations of property rights, however, is significantly less developed. The goal of this essay is to begin an important conversation about how transitional …
