Twenty Years Of Undergraduate Libraries: Whence And Whither?, Mark Watson, Jody Bales Foote, Roland Person

Articles

Undergraduate libraries as part of university library systems have existed since 1949, but there is little statistical data prior to 1971. This study examines statistics reported since that time, supplemented with electronic mail surveying, to show how such libraries have responded to the changing needs of an undergraduate population. The results show that change, and rapid response to external forces, are hallmarks of undergraduate libraries past and present.

The Sense Of Justice And The Justice Of Sense: Native Hawaiian Sovereignty And The Second "Trial Of The Century", William H. Rodgers, Jr. Jan 1996

The Sense Of Justice And The Justice Of Sense: Native Hawaiian Sovereignty And The Second "Trial Of The Century", William H. Rodgers, Jr.

Articles

My approach in this Essay is to look at the Native Hawaiian Sovereignty conflict through a lens suggested by evolutionary theory, sometimes described in the law schools as "Law and Biology." In this world, the sense of justice is a set of expectations about how others should behave, backed by a proclivity towards moralistic aggression against deviators.

The sense of justice entails both cognition and emotion, with a match of expectations and then the fit that follows if there is no fit.

Compare and despair is the name of the game. Explored in detail are the actions of Dennis "Bumpy" …

What About The Children? Are Family Lawyers The Same (Ethically) As Criminal Lawyers? A Morality Play, Robert H. Aronson Jan 1996

What About The Children? Are Family Lawyers The Same (Ethically) As Criminal Lawyers? A Morality Play, Robert H. Aronson

Articles

A fictional account of a lawyer, representing a woman in a divorce case, who learns from her client that her live-in boyfriend has hit her and her five-year-old daughter. Is her ethical duty to protect the child greater than her responsibility to maintain the attorney-client privilege. She discusses the matter with two evidence professors in search of a solution.

Civil Forfeiture And The War On Drugs: Lessons From Economics And History, Donald J. Boudreaux, Adam C. Pritchard Jan 1996

Civil Forfeiture And The War On Drugs: Lessons From Economics And History, Donald J. Boudreaux, Adam C. Pritchard

Articles

This Article uses economic analysis to show how civil forfeiture’s role in the war on drugs creates contrary incentives for law enforcement officials and encourages abuses. The Article then reviews the history of civil forfeiture and the Supreme Court’s forfeiture jurisprudence, which seems incoherent. The Authors warn that the judiciary should be skeptical of civil forfeiture and its importance to the war on drugs. The Article proposes a constitutional framework, grounded in economics and history, to limit forfeiture abuses.

Physician Assisted Suicide: A Bad Idea, Yale Kamisar Jan 1996

Physician Assisted Suicide: A Bad Idea, Yale Kamisar

Articles

It would be hard to deny that there is a great deal of support in this country - and ever-growing support - for legalizing physician-assisted suicide (PAS). Why is this so? I believe there are a considerable number of reasons. I shall discuss five common reasons - and explain why I do not find any of them convincing.

The 'Right To Die': On Drawing (And Erasing) Lines, Yale Kamisar Jan 1996

The 'Right To Die': On Drawing (And Erasing) Lines, Yale Kamisar

Articles

Until this year, no state or federal appellate court had ever held that there was a right to assisted suicide no matter how narrow the circumstances or stringent the conditions. In 1996, however, within the span of a single month, two federal courts of appeals so held; in an 8-3 majority of the Ninth Circuit (sitting en banc) in Compassion in Dying v. Washington and a three-judge panel of the Second Circuit in Quill v. Vacco. What heartened proponents of a right to physician-assisted suicide even more, and pleased those resistant to the idea even less, was that the two …

The Cosmological Question: A Response To Milner S. Ball's 'All The Company Of Heaven', Joseph Vining Jan 1996

The Cosmological Question: A Response To Milner S. Ball's 'All The Company Of Heaven', Joseph Vining

Articles

We do not disagree, and I do not doubt, that legal processes are sources of injustice, violent oppression, crushing of the spirit, destruction of lives, actual death. I have only to look at The Trial1 again. Nor do we disagree that there are strings of words, statements, put out by officials, lawyers, and lawyer-academics, often called "rules," that cannot be taken into oneself and that by their very nature evoke manipulation in response, avoidance if they cannot be ignored. In their name violent imposition of pure will occurs all the time, and power is exercised by those who can secure …

Theoretical Investigations Of Electro-Optical Synchonisation Of Self-Pulsating Laser Diodes, A. Egan, P. Rees, J. O'Gorman, M. Harley-Stead, Gerald Farrell, Joe Hegarty, P. Phelan Jan 1996

Theoretical Investigations Of Electro-Optical Synchonisation Of Self-Pulsating Laser Diodes, A. Egan, P. Rees, J. O'Gorman, M. Harley-Stead, Gerald Farrell, Joe Hegarty, P. Phelan

Articles

The synchronisation mechanism of selfpulsating laser diodes is determined and it is shown how this results in a frequency-dependent phase difference between the electrical input and optical output. The time-to-lock of the electrical input to the optical output is examined, particularly with regard to the importance of the initial phase difference between the signals. The effect of synchronisation on timing jitter in self pulsating lasers is also investigated.
