Trends In The Law Of Damages, John W. Reed
Trends In The Law Of Damages, John W. Reed
Articles
The law of damages deals with the process of translating harm into dollars. It is not, however, a coherent body of knowledge. Rather, it consists of an amalgam of many concepts and rules having to do with fundamental policy questions about loss-shifting, risk-spreading, and allocation of functions between judge and jury. Because damages is a "non-subject," little attention is paid to it in law school curricula and there is little writing about it. As one commentator put it, the law of damages "plods its way, ignored by academicians and 'accepted' by the courts. . . . The 'winds of change' …

Affirmative Action: Hypocritical Euphemism Or Noble Mandate?, Theodore J. St. Antoine

Title VII of the Civil Rights Act of 1964 was adopted in an atmosphere of monumental naivete. Congress apparently believed that equal employment opportunity could be achieved simply by forbidding employers or unions to "discriminate" on the basis of "race, color, religion, sex, or national origin," and expressly disavowed any intention to require "preferential treatment." Perhaps animated by the Supreme Court's stirring desegregation decisions of the 1950's, the proponents of civil rights legislation made "color-blindness" the rallying cry of the hour. Today we know better. The dreary statistics, so familiar to anyone who works in this field, tell the story. …

Coherent And Noncoherent Detection Of Cpfsk, William P. Osborne, Michael B. Luntz
Coherent And Noncoherent Detection Of Cpfsk, William P. Osborne, Michael B. Luntz
Articles
Continuous phase frequency shift keying (CPFSK) is potentially an attractive modulation scheme for use on channels whose performance is limited by thermal noise. In this paper results for the performance available with CPFSK are given for coherent detection and noncoherent detection with arbitrary modulation indices and arbitrary observation intervals.
This work serves two purposes. First, it provides interesting, new results for the noncoherent detection of CPFSK which indicate that the performance of such a system can be better than the performance of coherent PSK. Secondly, it provides a complete analysis of the performance of CPFSK at high SNR as well …

Clearcutting: Can You See The Forest For The Trees?, James E. Bernstein, Penny Hazelton, Dennis J. Hubel
Articles
The Organic Act of 1897 provided for the establishment and ,management of the national forest and park lands. In West Virginia Division of the Izaak Walton League v. Butz the United States District Court, applying the "plain meaning" of the Organic Act, permanently enjoined clearcutting on the Monongahela National Forest of West Virginia. The meaning of isolated words, however, is rarely determinative of Congressional intent. This article will demonstrate the shortcomings of the court's decision through an examination of the doctrines of statutory construction and analysis of the legislative history and administrative interpretation of the Act and by addressing the …

Attempts And Monopolization: A Mildly Expansionary Answer To The Prophylactic Riddle Of Section Two, Edward H. Cooper
Attempts And Monopolization: A Mildly Expansionary Answer To The Prophylactic Riddle Of Section Two, Edward H. Cooper
Articles
The efforts of activist antitrust lawyers to redefine the contours of attempted monopolization under section 2 of the Sherman Act1 have again forced the courts to wrestle with the classic antitrust dilemma: How far must single-firm competitive behavior be restrained to make competition free? The answer given by the majority of current decisions is that, absent some other established offense, single-firm behavior should be prohibited as an attempt to monopolize only when there is a specific intent to monopolize and the firm has come dangerously near to unlawful monopolization. A contemporary challenge to this orthodox answer is rapidly gaining force. …
Queries 'N Theories: An Instructional Game On The Dot, Dot, Dot... Approach To Scientific Method, Layman E. Allen
Queries 'N Theories: An Instructional Game On The Dot, Dot, Dot... Approach To Scientific Method, Layman E. Allen
Articles
QUERIES 'N THEORIES provides a parallel to the strong inference approach to scientific method - designing experiments, observing data, and theorizing. The reiter- ated use of the DOT approach (Design, Observe, Theorize) in the problem-solving required by the game mirrors the regular, systematic application of strong inference in some areas of science (e.g., high energy physics and molecular biology) that have moved ahead much more rapidly than others. Moreover, the game embodies and provides practice in two aspects of scientific theorizing and designing which John Platt has pointed out as central to scientific advance: (1) the usefulness of multiple hypotheses …

Judicial Caution And The Supreme Court's Labor Decisions, October Term 1971, Theodore J. St. Antoine
Judicial Caution And The Supreme Court's Labor Decisions, October Term 1971, Theodore J. St. Antoine
Articles
Labor law, like most other law in the making, is intensely political at its margins. On certain central themes, such as the right to join a union and freedom of contract, judges and administrators of widely varying outlooks may be able to reach a consensus. But along the frontiers of the law, no such accord can be expected. Conscientious decision-makers will inevitably differ with one another, depending on their diverse social values. They may even differ with their own prior positions, depending on shifts in the political climate. Moreover, if the decision-makers happen to be justices of the United States, …
The National Industrial Pollution Control Council: Advise Or Collude?, William H. Rodgers, Jr.
The National Industrial Pollution Control Council: Advise Or Collude?, William H. Rodgers, Jr.
Articles
This article analyzes three aspects of the National Industrial Pollution Countrol Coucil's performance: (1) the promise and risks it has presented; (2) its procedural performance, as tested by governing law; and (3) its accomplishments, both on the record and sub rosa, as measured by the expectations. In brief, NIPCC is portrayed as a dangerously anticompetitive institution occasionally doing business in violation of the law. The Council has published both public relations material and some useful data, but it has served more importantly as a lobbying forum for industries chafing under the regulatory bit. The experience of NIPCC forms the basis …

A Theory Of Negligence, Richard A. Posner
A Theory Of Negligence, Richard A. Posner
Articles
Negligence--the failure to exercise the care of an ordinarily prudent and careful man-has been the dominant standard of civil liability for accidents for the last 150 years or so, in this as in most countries of the world; and accident cases, mainly negligence cases, constitute the largest item of business on the civil side of the nation's trial courts. Yet we lack a theory to explain the social function of the negligence concept and of the fault system of accident liability that is built upon it. This article attempts to formulate and test such a theory, primarily through a sample …
State Law Of Patent Exploitation, Edward H. Cooper
State Law Of Patent Exploitation, Edward H. Cooper
Articles
The main purpose of the present inquiry is to determine whether second thoughts support or undermine the instinctive supposition that the doctrines surrounding cooperative use of patents should be federal. The original creator of a patented invention is seldom in a position to exploit its commercial potential alone; even if the invention is created by the employee of a vast enterprise, it is almost inevitable that the patent will be assigned to his employer. Patent licensing plays a vitally important role in the development of many inventions. The contract doctrines surrounding such transactions, and various other consensual undertakings relating to …

Expropriation, Inflation, And Development, Keith S. Rosenn
Expropriation, Inflation, And Development, Keith S. Rosenn
Articles
Eminent domain is an important developmental device for countries attempting to generate rapid growth within a free enterprise context. In Brazil and Argentina, however, spiraling inflation, combined with delayed compensation, often result in public confiscation of private property, thereby seriously undermining the confidence of private investors in the governments of both countries. In examining various measures designed to correct the problem, Professor Rosenn illuminates one aspect of the relationship between law and development.

The primary purpose of this Article is to encourage a forceful implementation of the Refuse Act as a second chance to achieve water quality. The presentation commences in Section I with a brief outline of the dimensions of industrial water pollution and the legal and scientific barriers to effective control. Against this background, Section II summarizes the central features of the Refuse Act, presents a narrative history of its recent renovation, and analyzes the major issues arising under the statute.
Section III discusses the traditional industrial and governmental view of water pollution and how a change in regulatory attitude invites …
Discrete Analysis Of A Composite Video Signal, Frank F. Carden, William P. Osborne, Alton L. Gilbert
Discrete Analysis Of A Composite Video Signal, Frank F. Carden, William P. Osborne, Alton L. Gilbert
Articles
In this paper the problem of representing the composite video signal for monochromatic T. V. transmission is examined and a method for computing the required spectral bandwidth is devised suitable for computer applications. The results obtained numerically are compared to measured results and to analytical solutions for a determinate signal for special cases. Comparison is made with some "maximum horizontal resolution" methods with a resulting decrease in bandwidth requirements for most applications.

Federal Organization For Control Of Weather Modification, Ralph W. Johnson
Articles
This article is designed to explore the optimal institutional structures that might be adopted by the federal government to manage weather modification. Should all federal weather modification activities be managed by a new department? Should these activities be carried out by one of the existing mission agencies, or by a new one? Should the various weather modification functions of research, operations, data collection, monitoring, coordination, comprehensive planning, project review, regulation, licensing, and indemnification all be carried by one federal agency, or should they be scattered among a variety of agencies? Should some be assigned to new entities not yet created? …
