Does (Did) (Should) The Exclusionary Rule Rest On A 'Principled Basis' Rather Than An 'Empirical Proposition'?, Yale Kamisar

Articles

[U]ntil the [exclusionary rule] rests on a principled basis rather than an empirical proposition, [the rule] will remain in a state of unstable equilibrium. Mapp v. Ohio, which overruled the then twelve-year-old Wolf case and imposed the fourth amendment exclusionary rule (the Weeks doctrine) on the states as a matter of fourteenth amendment due process, seemed to mark the end of an era. Concurring in Mapp, Justice Douglas recalled that Wolf had evoked "a storm of constitutional controversy which only today finds its end."' But in the two decades since Justice Douglas made this observation, the storm of controversy has …

Litigation Abuse And The Law Schools, John W. Reed Jan 1983

Litigation Abuse And The Law Schools, John W. Reed

Articles

At the Ninth Circuit Judicial Conference in July, 1983, one session was devoted to a discussion of "Excessive Discovery: A Symptom of Litigation Abuse." (Without knowing, I would guess that a similar title appeared on just about every judicial conference program this year-and last year, and the one before that.) Frank Rothman, President of MGM/United Artists, addressed the subject from the point of view of a corporate client, and his remarks are printed in this issue, beginning at page 342. Judges and trial lawyers expressed their views. And I was asked to comment on the extent to which the law …

The Preoperative Treatment Of Severely Anemic Patients With A Perfluorochemical Oxygen-Transport Fluid, Fluosol-Da, K. Tremper, Alan Friedman, E. Levine Jul 1982

The Preoperative Treatment Of Severely Anemic Patients With A Perfluorochemical Oxygen-Transport Fluid, Fluosol-Da, K. Tremper, Alan Friedman, E. Levine

Articles

We gave a perfluorochemical oxygen-transport fluid and plasma expander, Fluosol-DA, to seven severely anemic patients before surgery to determine its effectiveness in supplementing oxygen transport. The dose of Fluosol in the five patients completing the study was 20 ml per kilogram of body weight. When the patients breathed low levels of supplemental oxygen (mean partial pressure of arterial oxygen +/- S.D., 101 +/- 25 torr), the perfluorochemical carried a small amount of oxygen, but when they received pure oxygen (arterial oxygen pressure, 361 +/- 65 torr) it carried approximately 0.8 per cent of oxygen (by volume). This increase accounted for …

Chemical Hyperthyroidism: Serum Triiodothyronine Levels In Clinically Euthyroid Individuals Treated With Levothyroxine, D. Salmon, M. Rendell, J. Williams Mar 1982

Chemical Hyperthyroidism: Serum Triiodothyronine Levels In Clinically Euthyroid Individuals Treated With Levothyroxine, D. Salmon, M. Rendell, J. Williams

Articles

We have observed many patients treated with levothyroxine sodium who have elevated serum thyroxine (T4) levels but appear clinically euthyroid. Such patients generally have normal serum triiodothyronine (T3) values. A retrospective review at The Johns Hopkins Hospital, Baltimore, comparing the correlation of T3 and T4 values in levothyroxine-treated patients with that in patients not so treated was carried out from 1977 to 1979. Mean free thyroxine index (FTI) value in 104 levothyroxine-treated patients was 4.70 +/- 0.2 and mean T3 value was 177 +/- 9 ng/dL. In a group of 50 hyperthyroid patients, mean FTI value was 7.26. +/- 0.5, …

International Trial Observers, David Weissbrodt Jan 1982

International Trial Observers, David Weissbrodt

Articles

Since the Dreyfus trial in 1899, governments have sent observers to foreign political trials both to increase their understanding of the affairs of other nations and to express concern about the fairness of the proceedings themselves. It is now common for a number of gov- ernments, including those of Canada, the Federal Republic of Ger- many, Japan, Sweden, the United Kingdom, and the United States, to send official observers to foreign trials of political or human rights significance.

How We Got The Fourth Amendment Exclusionary Rule And Why We Need It, Yale Kamisar Jan 1982

How We Got The Fourth Amendment Exclusionary Rule And Why We Need It, Yale Kamisar

Articles

Why the continuing storm of controversy over the exclusionary rule? Why the deep and widespread hostility to it? I think a recent law office search case, because it arose in a setting so unlike the typical search and seizure case, furnishes a clue. In O'Connor v. Johnson, St. Paul police obtained a warrant to search an attorney's office for business records of a client suspected of making false written statements in applying for a liquor license. The attorney happened to be present when the police arrived. Holding on to his work product file, which contained some of the records sought, …

Free Speech Or Economic Weapon? The Persisting Problem Of Picketing, Theodore J. St. Antoine Jan 1982

Free Speech Or Economic Weapon? The Persisting Problem Of Picketing, Theodore J. St. Antoine

Articles

"Peaceful picketing," the United States Supreme Court has said, "is the workingman's means of communication."' One line of analysis is that, as a means of communication, picketing is free speech and is therefore entitled to every constitutional protection afforded other forms of expression. This means that it cannot be subjected to special restrictions, such as antiboycott curbs, simply because it is picketing. The opposing line of analysis is that picketing is not simply speech; it is "speech plus." The "plus" element removes picketing from the realm of pure speech and enables it to be regulated in ways that the Constitution …

Stability Of Time-Delay Systems, T. Lee, Sohail Dianat Jan 1981

Stability Of Time-Delay Systems, T. Lee, Sohail Dianat

Articles

This paper gives necessary and sufficient conditions for the stability of time-delay systems of the formdot{x}(t)=A_{1}x(t)+A_{2}x(t-h). These new conditions are derived by Lyapunov's direct method through systematic construction of the corresponding "energy" function. This function is known to exist, if a solutionP_{1}(0)of the algebraic nonlinear matrix equationA_{2} =e^{[A_{1}+P_{1}(0)]h}P_{1}(0)can be determined (Refer to PDF file for exact formulas).

The 1980 U.N. Commission On Human Rights And The Disappeared, David Kramer, David Weissbrodt Jan 1981

The 1980 U.N. Commission On Human Rights And The Disappeared, David Kramer, David Weissbrodt

Articles

When the public debate began at the United Nations Commission on Human Rights on the question of disappeared persons, the atmosphere in the huge assembly hall was tense and expectant. The public gallery was jammed with the wives and families of those persons who had been "disappeared"- arrested, tortured, imprisoned, or possibly killed by governments which refused to admit any knowledge or responsibility. The concerned audience came from all over the world. A few had even been disappeared themselves, but had managed to escape.

Fact-Finding By International Nongovernmental Human Rights Organizations, David Weissbrodt, James Mccarthy

Articles

There are a considerable number of nongovernmental organizations (NGOs) engaged in overseeing the implementation of human rights by governments throughout the world.1 Working at the international2 and national levels,s these organizations function as unofficial ombudsmen safeguarding human rights against govern- mental infringement, using such techniques as diplomatic initia- tives,4 reports,5 public statements,6 efforts to influence the deliber- ations of intergovernmental human rights bodies, campaigns to mobilize public opinion,8 and attempts to affect the foreign policy of some countries with respect to their relations with other coun- tries that regularly commit human rights violations.9

The Distrust Of Politics, Terrance Sandalow Jan 1981

The Distrust Of Politics, Terrance Sandalow

Articles

In this Article, Dean Sandalow considers the justifications advanced by those who favor the removal of certain political issues from the political process by extending the reach of judicial review. He begins by examining the distrust of politics in a different context, discussing the proposals made by the Progressives for reforming municipal government, as a vehicle to expose the assumptions underlying the current debate. His comparison of the two historical settings reveals many similarities between the Progressives' reform proposals and the contemporary justiflcations.[or the displacement of politics with constitutional law. Dean Sandalow concludes that the distrust of politics rests not …

Dimer Excision In Escherichia Coli In The Presence Of Caffeine., Robert Rothman Jan 1980

Dimer Excision In Escherichia Coli In The Presence Of Caffeine., Robert Rothman

Articles

Article may be found at: http://jb.asm.org/cgi/reprint/143/1/520 The observation that polA1 and recL152 mutations result in both slow pyrimidine dimer excision and large repair patch size leads to the hypothesis that patch size is directly related to the rate of excision. In this study caffeine, a known inhibitor of excision repair, was used to examine the extent of correlation between excision rate and patch size by measuring patch size in the presence of several concentrations of caffeine. Both the rate of excision and the resistance to ultraviolet radiation were reduced with increasing concentrations of caffeine after irradiation. Caffeine also inhibited the …

Correlation Of Serum, Tumor, And Liver Serum Glycoprotein: N-Acetylneuraminic Acid Transferase Activity With Growth Of The R3230ac Mammary Tumor In Rats And Relationship Of The Serum Activity To Tumor Burden, Irene Evans, R. Hilf, M. Murphy Jan 1980

Hilf, M. Murphy

Articles

The observation that the activity of sialyltransferase (EC 2.4.99.1; serum glycoprotein:N-acetylneuraminic acid transferase) is often elevated in the serum of cancer patients necessitates an elucidation of the interrelationships of this serum enzyme with host tissues. Accordingly, the activity of this enzyme in serum, tumor, and liver was determined at various times after implantation of the R3230AC mammary carcinoma into Fischer rats. Results from samples obtained at numerous, sequential time points demonstrated that significant elevations in serum sialyltransferase enzyme activity occurred only in animals bearing large tumor burdens, i.e., greater than 20 g, or in animals with tumors present for longer …

Distribution Of Flurescent Latex Particles Following Clearance From The Hemolymph Of The Freshwater Crayfish,Orconectes Virilis (Hagen), Douglas Merrill, S. Mongeon, S. Fisher Jan 1979

Distribution Of Flurescent Latex Particles Following Clearance From The Hemolymph Of The Freshwater Crayfish,Orconectes Virilis (Hagen), Douglas Merrill, S. Mongeon, S. Fisher

Articles

By using a novel technique we have been able to follow the clearance and distribution of fluorescent latex particles injected into both the midventral sinus and pericardial sinus of the freshwater cray-fish,Orconecte virilis. The fluorescene of various tissues was determined over post-injection periods ranging from 1 h to 20 days. Particles were rapidly removed from the hemolymph (Figs. 1 and 2) and accumulated in the heart (Fig. 3), antennal glands (Fig. 4), gills (Fig. 5) and, to a lesser extent, hepatopancreas (Fig. 6). Other tissues contained fluorescence in concentrations proportional to their supply of hemolymph.

Effect Of Blocking Protein Synthesis At Nonpermissive Temperatures On Temperature-Sensitive Deoxyribonucleic Acid Mutants Of Escherichia Coli, Irene Evans, N. Forrest, A. Lawrence Jan 1979

Effect Of Blocking Protein Synthesis At Nonpermissive Temperatures On Temperature-Sensitive Deoxyribonucleic Acid Mutants Of Escherichia Coli, Irene Evans, N. Forrest, A. Lawrence

Articles

When protein synthesis was blocked in temperature-sensitive deoxyribonucleic acid synthesis mutants of Escherichia coli at nonpermissive temperatures, it reduced the amount of apparent subsequent chain elongation to approximately half that observed in the mutants either at nonpermissive temperatures alone or when protein synthesis was blocked at the permissive temperature. Blocking protein synthesis at the nonpermissive temperatures for periods of 40 min caused the loss of ability to reinitiate deoxyribonucleic acid synthesis at the permissive temperature.
