Franco-Irish Connections: Essays, Memoirs And Poems In Honour Of Pierre Joannon : Review, Eamon Maher Jan 2010

Franco-Irish Connections: Essays, Memoirs And Poems In Honour Of Pierre Joannon : Review, Eamon Maher

Articles

The name Pierre Joannon is synonymous with Irish studies and with Franco-Irish relations. I can think of few, if any, people who are more worthy recipients of this beautifully presented Festschrift than the Honorary French Irish Consul, scholar and former President of the Ireland Fund de France. You get some idea of his stature from the list of contributors to this book: two former Taoisigh, Garret FitzGerald and John Bruton, two Nobel Laureates, John Hume and Seamus Heaney, poets Brendan Kennelly and John Montague, a host of historians including Dermot Keogh, Joe Lee, Eunan O’Halpin and Kevin Whelan, distinguished intellectuals …

Reactive Oxygen Species Induced Cytokine Production And Cytotoxicity Of Pamam Dendrimers In J774a.1 Cells, Pratap Naha, Maria Davoren, Fiona Lyng, Hugh Byrne Jan 2010

Reactive Oxygen Species Induced Cytokine Production And Cytotoxicity Of Pamam Dendrimers In J774a.1 Cells, Pratap Naha, Maria Davoren, Fiona Lyng, Hugh Byrne

Articles

The immunotoxicity of three generations of polyamidoamine (PAMAM) dendrimers (G-4, G-5 and G-6) was evaluated in mouse macrophage cells in vitro. Using the Alamar blue and MTT assays, a generation dependent cytotoxicity of the PAMAM dendrimers was found whereby G-6 > G-5 > G-4. The toxic response of the PAMAM dendrimers correlated well with the number of surface primary amino groups, with increasing number resulting in an increase in toxic response. An assessment of intracellular ROS generation by the PAMAM dendrimers was performed by measuring the increased fluorescence as a result of intracellular oxidation of Carboxy H2DCFDA to DCF both quantitatively using …

The Quays In Salford: An Analysis Of Visitor Perceptions, Satisfaction And Behavioural Intention, Ruth Craggs, Peter Schofield Jan 2010

The Quays In Salford: An Analysis Of Visitor Perceptions, Satisfaction And Behavioural Intention, Ruth Craggs, Peter Schofield

Articles

Despite an extensive literature on urban regeneration, visitor perceptions of urban waterfront destinations and their subsequent outcomes remain largely
unexplored. The paper reports the findings from a survey of visitors to the Quays in Salford; it focuses on their perceptions, satisfaction and behavioural intentions. While the primary attractions were found to have an important influence, the secondary elements explain more of the variance in
overall satisfaction and intention to return to the Quays and the environmental aspects have a greater influence on visitor intention to recommend the destination. The implications of the findings for destination management and marketing are discussed.

Not So Fast! Economic Principles And Across-The-Board Cuts, Roger L. Cross Jan 2010

Not So Fast! Economic Principles And Across-The-Board Cuts, Roger L. Cross

Articles

The purpose of this paper is to address the irrationality of making budget decisions without awareness of the economic foundation of these decisions. It aims to propose that, in lieu of a universal economic principle, librarians should at least adopt the maxim, “first, do no harm.”

The paper argues the need to review budgetary distribution models in terms of economic principles and the argument incorporates the author's recent implementation of material cuts at his institution. The paper argues that sound economic principles are being ignored in budget decision making. The paper finds that application of across-the-board materials cuts is inequitable …

Graphic Novel Collections In Academic Arl Libraries, Cassie Wagner Jan 2010

Graphic Novel Collections In Academic Arl Libraries, Cassie Wagner

Articles

This study examines the extent to which ARL academic libraries collect graphic novels. Using a core list of 176 titles developed from winners of major comics industry awards and a library-focused “best of” list, the holdings of 111 ARL academic libraries were searched using the libraries’ online catalogs. Results suggest that most of the libraries studied do not aggressively collect graphic novels. Also examined were associations between date of publication, prior serialization, overall collection size, monograph budget, and ARL ranking and graphic novel holdings. To better serve scholarly research in this area of increasing interest, libraries will need to reexamine …

Controlling Residential Stakes, Lee Anne Fennell, Julie Roin Jan 2010

Controlling Residential Stakes, Lee Anne Fennell, Julie Roin

Articles

Local communities often suffer when residents have too small a stake in their homes-a point underscored by recent rashes of foreclosures and abandonments, and implicated by longstanding questions about the effects on communities of renters and owner-occupants, respectively. However, homeowners with too great a financial stake in their homes can also cause difficulties for local governance by acting as risk-averse NIMBYs. Local governments should have a strong interest in helping members of their communities move away from problematic forms of stakeholding and toward more desirable intermediate positions. This Article examines how and why governmental entities at the state and local …

Bleak Prospects: How Health Care Reform Has Failed In The United States, Richard A. Epstein Jan 2010

Bleak Prospects: How Health Care Reform Has Failed In The United States, Richard A. Epstein

Articles

This Article examines the probable fate that awaits the systematic implementation of ObamaCare. Any effort to pile a massive new transfer and entitlement program on top of a hundred years of previous reforms is likely to fall prey to the law of diminishing marginal utility of additional forms of government intervention. That consequence is all the more likely for legislation that has strong redistributivist objectives but which lacks any techniques for dealing with the massive costs increases embedded in the program. A recent history of the Massachusetts health care initiative provides some indication of the inability to constrain costs except …

The Civilizing And Sportization Of Gaelic Football In Ireland: 1884–2009, John Connolly, Paddy Dolan Jan 2010

The Civilizing And Sportization Of Gaelic Football In Ireland: 1884–2009, John Connolly, Paddy Dolan

Articles

Over the course of the last 125 years the sport of Gaelic football in Ireland has undergone a sportization and civilizing process as the rules governing the sport became stricter and players developed greater levels of self-control. However, the civilizing of Gaelic football was a particularly fragile and uneven process. The growing social desire to diminish displays of violence was moderated by ambivalence towards violence. Gradually the external social controls on players increased and, greater and more stable levels of internalization occurred reflected by more advanced levels of player self-restraint in the control of violence. At the same time the …

Public Interest(S) And Fourth Amendment Enforcement, Alexander A. Reinert Jan 2010

Public Interest(S) And Fourth Amendment Enforcement, Alexander A. Reinert

Articles

Fourth Amendment events generate substantial controversy among the public and in the legal community. Yet there is orthodoxy to Fourth Amendment thinking, reflected in the near universal assumption by courts and commentators alike that the amendment creates only tension between privately held individual liberties and public-regarding interests in law enforcement and security. On this account, courts are faced with a clear choice when mediating Fourth Amendment conflicts: side with the individual by declaring a particular intrusion to be in violation of the Constitution or side with the public by permitting the intrusion. Scholarly literature and court decisions are accordingly littered …

Constitutional Concepts For The Rule Of Law: A Vision For The Post-Monarchy Judiciary In Nepal, David Pimentel Jan 2010

Constitutional Concepts For The Rule Of Law: A Vision For The Post-Monarchy Judiciary In Nepal, David Pimentel

Articles

A new government has taken power in Nepal. Intent on replacing the monarchical Hindu state with a secular democracy, it has promised a new constitution. Although the Nepali government is currently operating under an Interim Constitution, it remains to be seen what the post-monarchy judiciary will look like. Those involved in the drafting should pay careful attention to how specific provisions for court governance will impact both institutional and decisional judicial independence. The Interim Constitution calls for a judicial council but not a sufficiently independent one. The Interim Constitution also allows broad exercise of emergency powers, depriving the courts of …

Low Stakes And Constitutional Interpretation, Adam M. Samaha Jan 2010

Low Stakes And Constitutional Interpretation, Adam M. Samaha

Articles

Many of us engage in debates, sometimes intense debates, over the proper method of constitutional interpretation for judges. This Essay offers six reasons to believe that these debates involve low stakes, in the sense that the choice among competing methods will not determine outcomes in a significant number of important cases. These reasons involve mainstream constraints, overlapping results, indeterminate results, intolerable results, interpretation without decision, and inconsequential decisions. After a suitably brief investigation of theoretical and experimental resources on low-stakes decision making, the Essay suggests how debates over constitutional interpretation by judges might proceed if more people become convinced that …

It Came From Beneath The Twilight Zone: Wiretapping And Article Ii Imperialism, Heidi Kitrosser Jan 2010

It Came From Beneath The Twilight Zone: Wiretapping And Article Ii Imperialism, Heidi Kitrosser

Articles

This Article was written for the 2010 Texas Law Review Symposium: National Security, Privacy, and Technological Change. Using the example of federal government wiretapping, the Article examines “exclusivist” invocations of evolving U.S. history. Exclusivity is the view that the President has a constitutional power to circumvent statutory restrictions that interfere with his judgment as to how best to protect national security. In addition to arguing from text, structure, and founding era history, exclusivists sometimes invoke post-founding, or evolving history to defend their position. In the case of the Bush Administration’s warrantless wiretapping program, for example, the administration and its supporters …

What Scribner Wrought: How The Invention Of Modern Dialysis Shaped Health Law And Policy, Sallie Thieme Sanford [email protected] Jan 2010

What Scribner Wrought: How The Invention Of Modern Dialysis Shaped Health Law And Policy, Sallie Thieme Sanford [email protected]

Articles

In March 1960, Clyde Shields, a machinist dying from incurable kidney disease, was connected to an "artificial kidney" by means of a U-shaped Teflon tube that came to be known as the Scribner shunt. By facilitating long-term dialysis, Dr. Belding Scriber’s invention changed chronic kidney failure from a fatal illness to a treatable condition. This medical advance has, in turn, had a profound impact on key areas of health law and policy. This paper focuses on the historical roots and current context of three interrelated areas: ethical allocation of scarce medical resources; public financing of expensive health care; and decisions …

Dynamic Federalism And Patent Law Reform, Xuan-Thao Nguyen Jan 2010

Dynamic Federalism And Patent Law Reform, Xuan-Thao Nguyen

Articles

Patent law is federal law, and the normative approach to patent reform has been top down, looking to Congress and the Supreme Court for changes to the broken and complex patent system. The normative approach thus far has not yielded satisfactory results. This Article challenges the static approach to patent reform and embraces the dynamic-federalism approach that patent reform can be an overlapping of both national and local efforts. Patent reform at the local level is essential as locales can serve as laboratories for changes, vertically compete with national government to reform certain areas of the patent system, and become …
