The Generalised Zakharov-Shabat System And The Gauge Group Action, Georgi Grahovski Jan 2012

The Generalised Zakharov-Shabat System And The Gauge Group Action, Georgi Grahovski

Articles

The generalized Zakharov-Shabat systems with complex-valued non-regular Cartan elements and the systems studied by Caudrey, Beals and Coifman (CBC systems) and their gauge equivalent are studied. This study includes: the properties of fundamental analytical solutions (FAS) for the gauge-equivalent to CBC systems and the minimal set of scattering data; the description of the class of nonlinear evolutionary equations, solvable by the inverse scattering method, and the recursion operator, related to such systems; the hierarchies of Hamiltonian structures. The results are illustrated on the example of the multi-component nonlinear Schrodinger (MNLS) equations and the corresponding gauge-equivalent multi-component Heisenberg ferromagnetic (MHF) type …

Down-Sizing The Little Guy Myth In Legal Definitions, Mirit Eyal-Cohen Jan 2012

Down-Sizing The Little Guy Myth In Legal Definitions, Mirit Eyal-Cohen

Articles

What is a “small business” in the eyes of the law? There is not one standard definition. Current legal definitions of a firm's size are inconsistent and overinclusive. They vary from one area of the law to another and within various sections of the same law. They create a skewed picture and result in data distortion that reinforces favoritism toward small entities, as studies on the contribution of small businesses to the economy are greatly dependent on these studies' delineation of the term “small.” In this time of huge deficits and rise in economic inequality, a lot of money is …

Fairness For Transactional Events, Edward Amsden, Matthew Fluet Jan 2012

Fairness For Transactional Events, Edward Amsden, Matthew Fluet

Articles

Transactional events are a recent concurrency abstraction that combines first-class synchronous message-passing events with all-or-nothing transactions. Transactional events provide both a sequencing combinator, which permits the description of behaviors in which multiple potential synchronization actions (including communications between threads) either all occur in sequence or none of them occur, and a nondeterministic choice combinator, which permits the description of behaviors in which exactly one of a set of potential synchronization actions occurs. While prior work gave a semantics and an implementation for transactional events, it provided no guarantees about which of the many non-deterministic executions might be exhibited by a …

The Challenges Faced By Portuguese-Speaking Universities In Africa, Stephen Thompson, Jorge Ferrao Jan 2012

The Challenges Faced By Portuguese-Speaking Universities In Africa, Stephen Thompson, Jorge Ferrao

Articles

A common challenge faced by members of the Association of Portuguese Language Universities (AULP) and by other higher education institutions around the world is providing access to up-to-date and relevant academic literature. In an age where more research is being published than ever before, institutions need to move with the times and recognise that we should change our approach to tertiary education. This report considers how a university based in a Portuguese speaking country can use e-learning to overcome some of the barriers presented by language in higher education.

Eric Stein (1913-2011), Daniel Halberstam, Steven Ratner, Mathias Reimann

Articles

On July 28,2011, Eric Stein, pillar of international law, pioneer of the legal study of European integration, and master of comparative law, passed away in Ann Arbor, Michigan. He was ninety-eight years old. He joined this Journal's Board of Editors in 1963, serving as a regular member until 1978, and thereafter as an honorary editor. Stein was the last of that great generation of European-educated jurists who fled Nazism and became leading figures in comparative and international law in the United States.

Antibiotic Resistance, Jessica D. Litman Jan 2012

Antibiotic Resistance, Jessica D. Litman

Ten years ago, when I wrote War Stories,' copyright lawyers were fighting over the question whether unlicensed personal, noncommercial copying, performance or display would be deemed copyright infringement. I described three strategies that lawyers for book publishers, record labels, and movie studios had deployed to try to assure that the question was answered the way they wanted it to be. First, copyright owners were labeling all unlicensed uses as "piracy" on the ground that any unlicensed use might undermine copyright owners' control. That epithet helped to obscure the difference between unlicensed uses that invaded defined statutory exclusive rights and other …

Do Sex Offender Registries Make Us Less Safe?, J. J. Prescott Jan 2012

Do Sex Offender Registries Make Us Less Safe?, J. J. Prescott

Articles

State legislatures enacted sex offender registration and notification (SORN) laws with the explicit and exclusive aim of reducing sex offender recidivism. The general idea that we ought to “regulate” released offenders — of any type — to reduce the likelihood of their returning to crime is an attractive one, at least in theory. Criminal recidivism generates significant social harm. Nevertheless, despite their now-widespread use, SORN laws became the norm without any systematic study of their consequences. Admittedly, the logic underlying these laws seems at first difficult to gainsay: if a known sex offender poses even a small risk to a …

Facebook, The Jobs Act, And Abolishing Ipos, Adam C. Pritchard Jan 2012

Facebook, The Jobs Act, And Abolishing Ipos, Adam C. Pritchard

Articles

Initial public offerings (IPOs)-the first sale of private firms' stock to the public-are a bellwether of investor sentiment. Investors must be bullish if they are putting their money into untested start-ups. IPOs are frequently cited in the business press as a key barometer of the health of financial markets. Politicians, too, see a steady flow of IPOs as an indicator that capital is fueling the entrepreneurial initiative that sustains the growth of new businesses. Growing businesses create jobs, so Republicans and Democrats can find common ground on the importance of promoting IPOs. That bipartisan consensus was on display this spring …

Has The Obama Justice Department Reinvigorated Antitrust Enforcement?, Daniel A. Crane Jan 2012

Has The Obama Justice Department Reinvigorated Antitrust Enforcement?, Daniel A. Crane

Articles

The Justice Department’s recently filed antitrust case against Apple and several major book publishers over e-book pricing, which comes on the heels of the Justice Department’s successful challenge to the proposed merger of AT&T and T-Mobile, has contributed to the perception that the Obama Administration is reinvigorating antitrust enforcement from its recent stupor. As a candidate for President, then-Senator Obama criticized the Bush Administration as having the “weakest record of antitrust enforcement of any administration in the last half century” and vowed to step up enforcement. Early in the Obama Administration, Justice Department officials furthered this perception by withdrawing the …

The Effective Tax Rate Of The Largest Us And Eu Multinationals, Reuven S. Avi-Yonah, Yaron Lahav Jan 2012

The Effective Tax Rate Of The Largest Us And Eu Multinationals, Reuven S. Avi-Yonah, Yaron Lahav

Articles

The United States has the second highest statutory corporate tax rate in the Organization for Economic Co-Operation and Development (OECD) (after Japan).1 This has not always been the case. After the Tax Reform Act of 1986 lowered the U.S. rate from 46% to 34%,2 the United States had one of the lowest statutory corporate tax rates in the OECD.3 In the past twenty-five years, however, the U.S. rate has remained essentially unchanged (it was raised to 35% in 1993),4 while most other OECD countries reduced their statutory rate so that the OECD average statutory corporate tax rate is 25.1%.

The Moral Dimension Of Employment Dispute Resolution, Theodore J. St. Antoine Jan 2012

The Moral Dimension Of Employment Dispute Resolution, Theodore J. St. Antoine

Articles

Dispute resolution may be viewed from the perspective of economics or negotiation or contract law or game theory or even military strategy. In this Article, I should like to consider employment dispute resolution in particular from the perspective of morality. I do not necessarily mean "morality" in any religious sense. By "morality" here I mean a concern about the inherent dignity and worth of every human being and the way each one should be treated by society. Some persons who best exemplify that attitude would style themselves secular humanists. Nonetheless, over the centuries religions across the globe have played a …

Wisdom Of The Ages Or Dead-Hand Control? Patentable Subject Matter For Diagnostic Methods After In Re Bilski, Rebecca S. Eisenberg Jan 2012

Wisdom Of The Ages Or Dead-Hand Control? Patentable Subject Matter For Diagnostic Methods After In Re Bilski, Rebecca S. Eisenberg

Articles

In 1980, the Supreme Court gave a reassuring signal to the then-nascent biotechnology industry about the availability of patent protection for the fruits of its research when it upheld the patentability of a genetically modified living organism in Diamond v. Chakrabarty. Twenty-five years later, the Court seemed poised to reexamine the limits of patentable subject matter for advances in the life sciences when it granted certiorari in Laboratory Corporation v. Metabolite. But the Federal Circuit had not addressed the patentable subject matter issue in Laboratory Corporation, and the Court ultimately dismissed the certiorari p etition as improvidently granted. Five years …

Venture Capital In Ireland In Comparative Perspective, Frank Barry, Clare O'Mahony, Beata Sax Jan 2012

Venture Capital In Ireland In Comparative Perspective, Frank Barry, Clare O'Mahony, Beata Sax

Articles

This paper assembles the most comprehensive set of data available to offer a comparative perspective on venture capital in Ireland. The paper charts the emergence of the sector and the co-evolution of the demand and supply sides of the market. On the demand side, a flow of investment opportunities emerged – particularly from the indigenous software sector – for which venture capital represented an appropriate financing vehicle. Concurrently, on the supply side, publicly provided funding and other elements of public policy dramatically enhanced its availability. State support to the demand-side has been a multiple of state support to the supply …

Idiosyncratic Distances: Impact Of Mobile Technology Practices On Role Segmentation And Integration, Nicolas Battard, Vincent Mangematin Jan 2012

Idiosyncratic Distances: Impact Of Mobile Technology Practices On Role Segmentation And Integration, Nicolas Battard, Vincent Mangematin

Articles

Mobile technologies have brought convenience, flexibility and connectedness in our lives by enabling us to be reachable anywhere and anytime. All of our environments such as work and home converge through a single device and we can now receive private calls at work and professional calls during the weekend. Mobile technologies have transformed geographical distances and allow unplanned interruptions. While boundary theory suggests that individuals create, maintain and modify their boundaries in order to classify and simplify their environments, we focus here on how people use their devices and manage the boundaries that have been erased by mobile technologies. Based …

Antimicrobial, Antioxidant And Free Radical-Scavenging Capacity Of Brown Seaweed Himanthalia Elongata From Western Coast Of Ireland, Gaurav Rajauria, Amit Jaiswal, Nissreen Abu-Ghannam, Shilpi Gupta

Articles

Water, methanol and mixtures (20–80%) thereof have been used for the extraction of phenolic compounds from Irish brown seaweed Himanthalia elongata for studying its antimicrobial and antioxidant properties. The 60%methanolic extract exhibited significantly (P < 0.05) the highest value of yield (6.8 6 0.24%), total phenol (286.0 6 4.61 mg gallic acid equivalents/g), flavonoid (109.8 6 2.68 mg quercetin equivalents/g) and condensed tannin content (35.6 6 1.03 mgcatechin equivalents/ g). Antimicrobial activity of 60% methanolic extract tested from disc diffusion and broth dilution methods was effective against various food spoilage and pathogenic bacteria studied. The same extract exhibited statistically highest reducing power and antioxidant capacity againstDPPHradical, metal ions, lipid peroxides and hydrogen peroxide radicals. The UV-visible spectroscopy showed absorption maxima at 205 and 260 nm and the presence of hydroxyl group (3,431 cm-1) and an aromatic ring (around 1,465, 1,505 and 1,624 cm-1) in Fourier Transform Infrared spectroscopy, suggested the presence of phenolic compounds in the extract.

The Biodiversity Of Thermoduric Bacteria Isolated From Whey, Joseph Meade, Seamus Fanning, Kevinia Mcgill, Ciara Walsh Jan 2012

The Biodiversity Of Thermoduric Bacteria Isolated From Whey, Joseph Meade, Seamus Fanning, Kevinia Mcgill, Ciara Walsh

Articles

Thermoduric gram-positive bacteria are indigenous in milk, cheese, whey and other dairy products. They are capable of surviving heat processes and can result in quality defects and a shortened product shelf life. In Ireland, premium products such as whey protein concentrate (WPC) are often adversely affected by these microorganisms, particularly during the winter months.A high bacterial count in the WPC can result in the product being sold at a lower grade, with an overall loss of revenue for the manufacturer. This study recovered thermoduric bacterial isolates (n = 140) from an Irish WPC process during the months of November–February.Using molecular …

Profiling Instances In Noise Reduction, Sarah Jane Delany, Nicola Segata, Brian Macnamee Jan 2012

Profiling Instances In Noise Reduction, Sarah Jane Delany, Nicola Segata, Brian Macnamee

Articles

The dependency on the quality of the training data has led to significant work in noise reduction for instance-based learning algorithms. This paper presents an empirical evaluation of current noise reduction techniques, not just from the perspective of their comparative performance, but from the perspective of investigating the types of instances that they focus on for re- moval. A novel instance profiling technique known as RDCL profiling allows the structure of a training set to be analysed at the instance level cate- gorising each instance based on modelling their local competence properties. This profiling approach o↵ers the opportunity of investigating …

New Non-Toxic Holographic Photopolymer Material, Dervil Cody, Izabela Naydenova, Emilia Mihaylova

Articles

There is an increasing need for environmentally friendly holographic recording materials which can be produced in bulk with little risk to the health of workers in manufacturing. This is why the development of non-toxic photopolymer materials is crucial, and has attracted attention in recent years. Composition and preliminary characterization of a new non-toxic photopolymer material are presented. It operates well at a range of spatial frequencies, and achieves diffraction efficiencies and refractive index modulation comparable to the known acrylamide-based photopolymers.

Comparison Of Micro- And Nanoscale Fe+3-Containing (Hematite) Particles For Their Toxicological Properties In Human Lung Cells In Vitro, Kunal Bhattacharya, Eik Hoffmann, Roel Schins, Jens Boertz, Eva-Maria Prantl, Gerrit Alink, Hugh Byrne, Thomas Kuhlbusch, Qamar Rahman, Hartmut Wiggers, Christof Schulz, Elke Dopp

Articles

The specific properties of nanoscale particles, large surface-to-mass ratio and highly reactive surfaces, have increased their commercial application in many fields. However, the same properties are also important for the interaction and bio-accumulation of the non-/biodegradable nanoscale particles in a biological system and are a cause for concern. Hematite (α-Fe2O3), being a mineral form of Fe(III) oxide, is one of the most used iron oxides besides magnetite. The aim of our study was the characterization and comparison of biophysical reactivity and toxicological effects of α-Fe2O3 nano- (d < 100 nm) and microscale (d < 5 μm) particles in human lung cells. Our study demonstrates that the surface reactivity of nanoscale α-Fe2O3 differs to that of microscale particles with respect to the state of agglomeration, radical formation potential, and cellular toxicity. The presence of proteins in culture medium and agglomeration were found to affect the catalytic properties of the hematite nano- and microscale particles. Both the nano- and microscale α-Fe2O3 particles were actively taken up by human lung cells in vitro, although, they were not found in the nuclei and mitochondria. …
