Reseacher As Whistleblower: The Ethical Challenges Posed By Sensitive Research, Tom Clonan Jan 2010

Reseacher As Whistleblower: The Ethical Challenges Posed By Sensitive Research, Tom Clonan

Articles

This paper will explore the complex ethical issues raised when ‘non traditional’ insider research is conducted in sensitive and secretive workplace settings. The paper will outline the experiences of the author between 1996 and 2000 - as a Captain in the Irish Army - when he conducted PhD research into the status and roles assigned female personnel in the Irish military. This research uncovered evidence of the widespread bullying, harassment, sexual harassment and sexual assault of female soldiers, sailors and air crew in the Irish military. The paper will address a number of ethical issues as they apply to the …

The Benefits Of Holidaying For Children Experiencing Social Exclusion: Recent Irish Evidence, Bernadette Quinn, Jane Stacey Jan 2010

The Benefits Of Holidaying For Children Experiencing Social Exclusion: Recent Irish Evidence, Bernadette Quinn, Jane Stacey

Articles

There is a general assumption in contemporary society that holidaying is beneficial in many ways. Yet, even in affluent societies, access to holidaying opportunities continues to be constrained by a variety of factors relating to inter alia income, gender, health and race. This is problematic because it means that sizeable minorities within advanced societies are being denied the benefits that researchers have attributed to the practice of holidaying. Recently, there has been a renewed interest in problematising the exclusionist nature of holidaying with researchers arguing that a lack of holiday opportunities may compound social deprivation, reinforce social problems and heighten …

A Macrobending Singlemode Fiber Refractive Index Sensor For Low Refractive Index Liquids, Pengfei Wang, Yuliya Semenova, Yong Li, Qiang Wu, Gerald Farrell Jan 2010

A Macrobending Singlemode Fiber Refractive Index Sensor For Low Refractive Index Liquids, Pengfei Wang, Yuliya Semenova, Yong Li, Qiang Wu, Gerald Farrell

Articles

An all-fiber refractive index sensor with a simple configuration is proposed and investigated. The proposed fiber refractometer consists of a full-loop structure of bare high-bend loss singlemode fiber-1060XP, employing the well-known whispering gallery mode (WGM) effect induced by the evanescent wave excitation to measure the refractive index of an external medium. A competitive sensitivity is achieved (average 725.76nm/RIU at a bend diameter of 19.3mm) compared with other fiber-optic sensors, plus benefits resulting from simplicity, low cost and ease of fabrication.

The Roberts Court And The Environment, Stephen M. Johnson Jan 2010

The Roberts Court And The Environment, Stephen M. Johnson

Articles

During the October 2008 Term, the Supreme Court decided five cases that raised issues of environmental law and the environment was the loser in each case. While it may be difficult to characterize the decisions of the Roberts Court, generally, as “pro-environment” or “antienvironment,” a couple themes consistently appear in the Court’s decisions. First, in most of the environmental cases, the Court has adopted a position advocated or defended by a federal, state or local government when governmental interests are at issue. Second, in all of the cases that implicate federalism concerns, the Court has rendered decisions that favor States’ …

Neither Fish Nor Fowl: Administrative Judges In The Modern Administrative State, Linda Jellum Jan 2010

Neither Fish Nor Fowl: Administrative Judges In The Modern Administrative State, Linda Jellum

Articles

This article examines the role of administrative adjudication in the United States constitutional system. It begins by noting that such adjudication fits uncomfortably within a system of divided powers. Administrative judges, including administrative law judges [ALJs] (who have the highest level of protection and status), are considerably more circumscribed than ordinary Article III judges. Indeed, administrative judges are usually housed in the agencies for which they decide cases, rather than in independent adjudicative bodies, and they do not always have the final say regarding the cases they decide. In many instances, the agency can appeal an adverse administrative judge's decision …

Implementing The 2005 American Heart Association Guidelines, Including Use Of The Impedance Threshold Device, Improves Hospital Discharge Rate After In-Hospital Cardiac Arrest, Ken Thigpen, Scott Davis, Roberta Basol, Peggy Lange, Sandeep Jain, John Olsen, Bernard Erickson, Timothy Schuchard, Tom P. Aufderheide

Articles

OBJECTIVE:

To determine the impact of the 2005 American Heart Association cardiopulmonary resuscitation (CPR) guidelines, including use of an impedance threshold device (ITD), on survival after in-hospital cardiac arrest.

METHODS:

Two community hospitals that tracked outcomes after in-hospital cardiac arrest pooled and compared their hospital discharge rate before and after implementing the 2005 American Heart Association CPR guidelines (including ITD) in standardized protocols. In CPR we used the proper ventilation rate, allowed full chest-wall recoil, conducted continuous CPR following intubation, and used an ITD. We compared historical control data from a 12-month period at St Cloud Hospital, St Cloud, Minnesota, …

Reactive Oxygen Species Induced Cytokine Production And Cytotoxicity Of Pamam Dendrimers In J774a.1 Cells, Pratap Naha, Maria Davoren, Fiona Lyng, Hugh Byrne Jan 2010

Reactive Oxygen Species Induced Cytokine Production And Cytotoxicity Of Pamam Dendrimers In J774a.1 Cells, Pratap Naha, Maria Davoren, Fiona Lyng, Hugh Byrne

Articles

The immunotoxicity of three generations of polyamidoamine (PAMAM) dendrimers (G-4, G-5 and G-6) was evaluated in mouse macrophage cells in vitro. Using the Alamar blue and MTT assays, a generation dependent cytotoxicity of the PAMAM dendrimers was found whereby G-6 > G-5 > G-4. The toxic response of the PAMAM dendrimers correlated well with the number of surface primary amino groups, with increasing number resulting in an increase in toxic response. An assessment of intracellular ROS generation by the PAMAM dendrimers was performed by measuring the increased fluorescence as a result of intracellular oxidation of Carboxy H2DCFDA to DCF both quantitatively using …

From Climate Change And Hurricanes To Ecological Nuisances: Common Law Remedies For Public Law Failures?, Stephen M. Johnson

Articles

Part I of this article explores the role that the common law played in addressing environmental problems prior to the development of a robust public law regime in the 1970s and the changing role of common law as the new regime was implemented. Part II of the article examines the reasons why there has been a renaissance in common law actions and why the trend could continue. Part III of the article discusses the recent federal appellate court decisions that could accelerate the common law renaissance, as well as some other recent federal court decisions that could slow the renaissance. …

Use Of A Bent Single Sms Fiber Structure For Simultaneous Measurement Of Displacement And Temperature Sensing, Qiang Wu, Agus Hatta, Pengfei Wang, Yuliya Semenova, Gerald Farrell

Articles

We have proposed the use of a single bent single-multiple-single mode (SMS) fiber structure to measure both displacement and temperature simultaneously and independently. Our experimental results show that this sensor has a sensitivity of 5.89 pm/μm for displacement and 11.6 pm/ºC for temperature.

Simple Design Technique For A Triangular Fbg Filter Based On A Linearly Chirped Grating, Qiang Wu, Gerald Farrell, Yuliya Semenova

Articles

A novel and simple design technique for triangular spectrum response of fibre Bragg grating (FBG) is pre- 21 sented based on a linear chirped grating. It is shown that this method is fast and can give a straightfor- 22 ward solution to meet a design target. The numerical simulation examples verified the effectiveness of 23 the design method. A general approach to design for multichannel triangular spectral responses for 24 FBG filters is proposed, which provides a solution that achieves a minimum change of refractive index 25 for the fibre.

Experimental Demonstration Of A Simple Displacement Sensor Based On A Bent Singlemode-Multimode-Singlemode (Sms) Fiber Structure, Qiang Wu, Yuliya Semenova, Pengfei Wang, Agus Hatta, Gerald Farrell Jan 2010

Experimental Demonstration Of A Simple Displacement Sensor Based On A Bent Singlemode-Multimode-Singlemode (Sms) Fiber Structure, Qiang Wu, Yuliya Semenova, Pengfei Wang, Agus Hatta, Gerald Farrell

Articles

A simple displacement sensor based on a bent singlemode-multimode-singlemode (SMS) fiber structure is proposed and experimentally investigated. The sensor offers a wider displacement range, not limited by the risk of fiber breakage, as well as a three-fold increase in displacement sensitivity by comparison with a straight SMS structure sensor. This sensor can be interrogated by either an optical spectral analyzer (OSA) or a ratiometric interrogation system: (1) if interrogated by an OSA assuming a resolution of 1 pm, it has a sensitivity of 28.2 nm for a displacement measurement range from 0 to 280 μm; (2) if interrogated by a …

Strain Sensor Based On A Pair Of Single-Mode-Multimode-Single-Mode Fiber Structures In A Ratiometric Power Measurement Scheme, Agus Hatta, Yuliya Semenova, Qiang Wu, Gerald Farrell Jan 2010

Strain Sensor Based On A Pair Of Single-Mode-Multimode-Single-Mode Fiber Structures In A Ratiometric Power Measurement Scheme, Agus Hatta, Yuliya Semenova, Qiang Wu, Gerald Farrell

Articles

The strain and temperature dependencies of a step-index single-mode–multimode–single-mode (SMS) fiber structure are investigated numerically and experimentally. For intensity-based strain measurement using a single SMS fiber structure, at a selected wavelength, it is found that there is a high strain dependence, but also a temperature dependence that will induce strain measurement error. To minimize the temperature-induced strain measurement error, two SMS fiber structures are proposed and demonstrated in a ratiometric power measurement scheme; one SMS structure acts as the strain sensor, and the other SMS structure acts as the temperature monitor. The extracted temperature information is used to determine a …

Corporate Social Responsibility And The Future Healthcare Manager, Sandra Collins Jan 2010

Corporate Social Responsibility And The Future Healthcare Manager, Sandra Collins

Articles

The decisions and actions of healthcare managers are often times heavily scrutinized by the public. Given the current economic climate, managers may feel intense pressure to produce higher results with fewer resources. This could inadvertently test their moral fortitude and their social consciousness. A study was conducted to determine what Corporate Social Responsibility (CSR) Orientation and Viewpoint future healthcare managers may hold. The results of the study indicate that future healthcare managers may hold patient care in high regard as opposed to profit maximization. However, the results of the study also show that future managers within the industry may continue …

Interest Groups And The Problem With Incrementalism, Saul Levmore Jan 2010

Interest Groups And The Problem With Incrementalism, Saul Levmore

Articles

Incrementalism, as opposed to dramatic change, is conventionally lauded in law as the prudent path of change-a path that gives credit to history and precedent. The conventional view, however, pays little attention to interest groups. Step-by-step change poses a serious problem when it rearranges the constellation of supporters and opponents of further moves. The core problem is that once an interest group loses and becomes subject to some regulation, it has reason to turn on its competitors and see to it that they also be regulated. The laws that emerge on the incrementalist's path therefore may not mark progress toward …

Against Feasibility Analysis, Jonathan Masur, Eric A. Posner Jan 2010

Against Feasibility Analysis, Jonathan Masur, Eric A. Posner

Articles

Feasibility analysis, a method of evaluating government regulations, has emerged as the major alternative to cost-benefit analysis. Although regulatory agencies have used feasibility analysis (in some contexts called "technology-based" analysis) longer than cost-benefit analysis, feasibility analysis has received far less attention in the scholarly literature. In recent years; however, critics of cost-benefit analysis have offered feasibility analysis as a superior alternative. We advance the debate by uncovering the analytic structure of feasibility analysis and its normative premises, and then criticizing them. Our account builds on two examples of feasibility analysis, one conducted by OSHA and the other by EPA. We …

The Right To Abandon, Lior Strahilevitz Jan 2010

The Right To Abandon, Lior Strahilevitz

Articles

The common law prohibits the abandonment of real property. Perhaps it is surprising, therefore, that the following are true: (1) the common law generally permits the abandonment of chattel property, (2) the common law promotes the transfer of real property via adverse possession, and (3) the civil law is widely believed to permit the abandonment of real property. Because the literature on abandonment is disappointingly sparse, these three peculiarities have escaped sustained scholarly analysis and criticism. This Article aims to provide a comprehensive analysis of the law of abandonment. After engaging in such an analysis, this Article finds that the …
