Due to limited resources and complex food access systems in urban areas, especially older adults are more vulnerable to poor dietary intake and food insecurity in low-income areas in South Africa. This study assessed the prevalence of food insecurity among the older adults and explored the availability of healthy foods in local shops. It was a crosssectional study conducted in an eldercare centre in Sharpeville, South Africa with an estimated representative sample of 88 participants. Validated tools were used to measure the socio-economic, dietary diversity intake (24-hour dietary recall), household food security and access from the participants. Listing of available …

Alpha Duties: The Search For Excess Returns And Appropriate Fiduciary Duties, Ian Ayres, Edward Fox

Modern finance theory and investment practice have shifted toward “passive investing.” The current consensus is that most savers should invest in mutual funds or ETFs that are (i) well-diversified, (ii) low-cost, and (iii) expose their portfolios to age-appropriate stock market risk. The law governing trustees, investment advisers, broker–dealers, 401(k) plan managers, and other investment fiduciaries has evolved to push them gently toward this consensus. But these laws still provide broad scope for fiduciaries to recommend that clients invest instead in specific assets that they believe will produce “alpha” by outperforming the market. Seeking alpha comes at a cost, however, in …

In cases that fall under Miranda v Arizona, police interrogators not only give a suspect reasons to confess; they also suggest that the suspect ought to confess. In doing so, interrogators effectively invoke the Wigmorean duty of a citizen to produce any evidence he has in his possession, including his own confession. That is, they invoke the duty against which the Self Incrimination Clause stands, so that the clause is applicable to police interrogations, and is violated where it is not waived. This means that “a Miranda violation” is a violation of the Self Incrimination Clause in the field, just …
Cannabis For Medical Use: Fda And Dea Regulation In The Hall Of Mirrors, Rebecca S. Eisenberg, Deborah B. Leiderman
Cannabis For Medical Use: Fda And Dea Regulation In The Hall Of Mirrors, Rebecca S. Eisenberg, Deborah B. Leiderman
Articles
A majority of Americans now live in states that purport to authorize medical use of cannabis, although federal law continues to prohibit both recreational and medical use. The current legal regime for cannabis is unstable and may be more effective at deterring research than it is at deterring medical use. Lack of data on medical cannabis products poses public health risks as well as policy and legal challenges. Modified regulatory approaches for other kinds of products provide alternative models for encouraging safety and effectiveness research and providing better information about cannabis products already in clinical use.

Moving Towards The Second Generation Of Lignocellulosic Biorefineries In The Eu: Drivers, Challenges, And Opportunities, Shady S. Hassan, Gwilym A. Williams, Amit K. Jaiswal
Articles
The EU aims to achieve a variety of ambitious climate change mitigation and sustainable development goals by 2030. To deliver on this aim, the European Commission (EC) launched the bioeconomy strategy in 2012. At the heart of this policy is the concept of the sustainable Biorefinery, which is based centrally on a cost-effective conversion of lignocellulosic biomass into bioenergy and bioproducts. The first generation of biorefineries was based on utilization of edible food crops, which raised a “food vs. fuel” debate and questionable sustainability issues. To overcome this, lignocellulosic feedstock options currently being pursued range from non-food crops to agroforestry …
Artificial Intelligence In The Medical System: Four Roles For Potential Transformation, W. Nicholson Price Ii
Artificial Intelligence In The Medical System: Four Roles For Potential Transformation, W. Nicholson Price Ii
Articles
Artificial intelligence (AI) looks to transform the practice of medicine. As academics and policymakers alike turn to legal questions, including how to ensure high-quality performance by medical AI, a threshold issue involves what role AI will play in the larger medical system. This Article argues that AI can play at least four distinct roles in the medical system, each potentially transformative: pushing the frontiers of medical knowledge to increase the limits of medical performance, democratizing medical expertise by making specialist skills more available to non-specialists, automating drudgery within the medical system, and allocating scarce medical resources. Each role raises its …

The 2017 tax legislation brought sweeping changes to the rules for taxing individuals and business, the deductibility of state and local taxes, and the international tax regime. The complex legislation was drafted and passed through a rushed and secretive process intended to limit public comment on one of the most consequential pieces of domestic policy enacted in recent history. This Article is an effort to supply the analysis and deliberation that should have accompanied the bill’s consideration and passage, and describes key problem areas in the new legislation. Many of the new changes fundamentally undermine the integrity of the tax …

Using Cognitive Mapping To Longitudinally Examine Political Brand Associations, Ewan Macdonald, Roger Sherlock, John Hogan
Articles
This paper uses cognitive mapping techniques to understand how brand associations, an important aspect of political brand equity are formed, differ, and change, from the perspective of citizens, across the four largest Irish political parties between 2013 and 2016. The paper focuses in particular upon the strength, favourability and uniqueness of these brand associations. The results constitute a first attempt to longitudinally explore changing political brand associations through cognitive mapping techniques, using data generated with the participation of hundreds of citizens. Our findings suggest that this approach can contribute to our understanding of how and why political brand associations change …

Modern doctrine and scholarship largely take it for granted that offenders should be criminally punished for reckless acts.1 Yet, developments in our understanding of human behavior can shed light on how we define and attribute criminal liability, or at least force us to grapple with the categories that have existed for so long. This Article examines recklessness and related doctrines in light of the shifts in understanding of adolescent behavior and its biological roots, to see what insights we might attain, or what challenges these understandings pose to this foundational mens rea doctrine. Over the past decade, the U.S. Supreme …

Level Of Service And The Transit Neighbourhood: Observations From Dublin City And Surburbs, David O'Connor, Brian Caulfield
Articles
Few studies have looked at the impact Level-of-Service (LOS) might have on the distances people walk to public transport. The relationship, if any, has implications for transit-oriented-development and the viability of different transit modes serving suburban areas. This paper examines pedestrian catchment areas and LOS across a light rail, a metro rail and two bus corridors in Dublin. Public transport users have been surveyed at 17 stops around the city and their trip origin identified. Catchment areas for bus services with high levels of service were found to be comparable and often greater than those for LRT or metro …

Combination Of Gold Nanoparticles With Low-Let Irradiation: An Approach To Enhance Dna Dsb Induction In Ht29 Colorectal Cancer Stem-Like Cells, Mahdi Abbasian, Zahra Arab-Bafrani, Azam Baharlouei, David Lightfoot
Articles
Purpose
High-linear energy transfer (high LET) irradiation has significant cytotoxic effects on different cancerous stem-like cells (CSLCs) such as colorectal CSLCs. A review of the literature has indicated that the presence of gold nanoparticles (GNPs) enables low-LET irradiation to produce highly non-homogeneous dose distributions like high-LET irradiation. The purpose of this study was to evaluate the radioresponsiveness of HT29 colorectal CSLCs under low-LET irradiation (X-ray) and in the presence of GNPs.
Methods
Radioresponsiveness was evaluated using the ϒ-H2AX foci formation assay, the clonogenic assay, the cell cycle progression assay and analyses of radiobiological parameters.
Results
In the presence of GNPs, …
The Impact Of Social Inclusion On The Social Development Of Students With A General Learning Difficulty In Postprimary Education In Ireland, Barry Ryan, Niall King
The Impact Of Social Inclusion On The Social Development Of Students With A General Learning Difficulty In Postprimary Education In Ireland, Barry Ryan, Niall King
Articles
Over the past decade, there has been a societal push for social inclusion in Ireland for students with special educational needs (SEN). As a result, the number of dedicated special needs schools has dramatically decreased across the country as students with SEN enrol, instead, in mainstream schools. Dedicated SEN schools provided an environment in which students with a general learning difficulty (GLD) could develop at a pace suited to them. However, this developmental pace is different for GLD students in a mainstream school. This research explores the social development of students with a GLD in a mainstream school in postprimary …

Systems In Play: Simon Nicholson's Design 12 Course, University Of California, Berkeley, 1966, Tim Stott
Articles
In 1966, British artist, designer and educator Simon Nicholson (1934–1990) offered a lower division course, Design 12, at the College of Environmental Design, UC Berkeley. Controversially, Nicholson promoted play as the principal method of design and invited children to assess students’ projects on the Berkeley campus and in local schools, parks, playgrounds and hospitals. This article presents Design 12 as an important example of environmental design pedagogy in the USA, which uniquely attempted to synthesize British post-war constructivism with ‘design science’ and adventure play. The result was a course that placed play at the centre of design pedagogy, where it …

Childminding In Ireland: Attitudes Towards Professionalisation, Miriam O'Regan, Ann Marie Halpenny, Noirin Hayes
Childminding In Ireland: Attitudes Towards Professionalisation, Miriam O'Regan, Ann Marie Halpenny, Noirin Hayes
Articles
In light of rapid changes in the early years sector in Ireland since 2000, questions arise about the professionalism of childminders (family day carers), the vast majority of whom are exempt from regulation. Fewer than 0.1% (<120) of childminders are registered with Tusla, the national regulator, despite the National Childminding Initiative, (NCMI) which has promoted professional, high quality childminding. To investigate current attitudes to NCMI’s process of professionalisation (Brannen and Moss [2003]), among childminders and parents, a cross-sectional study was designed using a mixed-method approach. Specifically an anonymous online survey was conducted with 325 participants, followed by a qualitative World Café forum for 40 members of Childminding Ireland, the national childminding body. Findings from both phases of research revealed many of these childminders were well-qualified and engaged, with a sense of professional identity, seeking a distinctive approach to support childminding. Moreover, both childminder and parent participants value the distinctive characteristics of childminding – close relationships, a nurturing pedagogy, a rich, home environment – to a greater extent than markers of professionalism. These findings call for an innovative approach to childminding in Ireland, one that facilitates an organic development of agentic, professional childminding as part of a competent ECEC system.
Social Care Graduates’ Judgements Of Their Readiness And Preparedness For Practice, Fiona Mcsweeney, David Williams
Social Care Graduates’ Judgements Of Their Readiness And Preparedness For Practice, Fiona Mcsweeney, David Williams
Articles
While research has been conducted on social work graduates’ views of their readiness and preparedness for practice, the views of social care workers have not been specifically researched. This paper reports on the views of social care graduates in Ireland of how ready they are to join the workforce and how their educational programme has prepared them. Two semi-structured interviews were conducted with the same participants. The first was at the end of their final year in college and the second between 9 and 12 months later when they were in employment. Findings indicate that participants, while apprehensive, felt ready …
Philanthropy-Supported Journalism, Harry Browne
Philanthropy-Supported Journalism, Harry Browne
Articles
There is a widespread perception that the market is failing to ensure the provision of high quality, impactful journalism, especially investigative work and in‐depth coverage of governmental and international affairs. One answer to that market failing has been the development of philanthropy‐supported journalism. Some writers see this as a potentially important, if partial, solution to journalism's problems, strengthening the editorial focus on creating social and policy impacts. Others have expressed concern that philanthropic support draws journalists toward elite orientations, with both funders themselves and their desired audiences representing the socioeconomic upper tiers.
A Comment On: Arts Festivals, Urban Tourism And Cultural Policy, Bernadette Quinn
A Comment On: Arts Festivals, Urban Tourism And Cultural Policy, Bernadette Quinn
Articles
When I wrote the 2010 article 'Arts Festivals, Urban Tourism and Cultural Policy' for the special issue of JPRTL&E in 2010, the focus on the ‘urban’ in the brief that I was given very much reflected the prominent attention being given to festivals and events in urban contexts at that time (Johansson & Kociatkiewicz, 2011; Stevens & Shin, 2012). I start this brief comment now by noting that this imbalance in the literature is being addressed by a recent rise of research interest in the arts, including festivals, in rural areas (including forthcoming special issues/sections in the Journal of Rural …

Distal Corporoplasty Using An Autologous Tunica In The Management Of Penile Prosthesis Pseudo Aneurysm, Michel Apoj, Elizabeth A. Phillips
Articles
Inflatable penile prosthesis placement is an effective and safe treatment option for erectile dysfunction. The 5-year revision rate is low (7%) and revisions are most likely due to infection or mechanical problems with the device.
Penile prosthesis aneurysm is a rare complication that is managed surgically. The choice of graft used during tunical reinforcement is critical to avoid subsequent complications. The use of autologous grafts from distant tissue often leads to deformations of penile tissue in addition to the increase in operative time, morbidity, and cost of the operation. The use of synthetics increases the susceptibility to infection and decreases …
