The Integrity Of Our Convictions: Holding Stakeholders Accountable In An Era Of Criminal Justice Reform, Barry Scheck Jan 2019

The Integrity Of Our Convictions: Holding Stakeholders Accountable In An Era Of Criminal Justice Reform, Barry Scheck

Articles

The article argues for the implementation of systemic mechanisms to ensure accountability and transparency among criminal justice stakeholders to move away from a "win-at-all-costs" mentality. It proposes a transition toward a "just culture" that prioritizes learning from error and forward-looking accountability through structural reforms in discovery, misconduct tracking, and indigent defense.

The Impact Of Law On The State Pension Crisis, Elizabeth S. Goldman, Stewart E. Sterk Jan 2019

The Impact Of Law On The State Pension Crisis, Elizabeth S. Goldman, Stewart E. Sterk

Articles

While some state and municipal pension plans have funds sufficient to meet obligations to retirees without imposing onerous obligations on current and future taxpayers, underfunding of plans in other states has reached disastrous proportions, raising the possibility of default on pension obligations, cuts in public services, steep tax increases, or some combination of the three. The substantial differential in pension funding might be attributed to divergent political pressures, different responses to uncertainty about investment returns, or other factors. Our examination of pension funding law in ten states-five with the best-funded plans and five with the worst-funded plans-highlights the role of …

Antitrust In Digital Markets, John M. Newman Jan 2019

Antitrust In Digital Markets, John M. Newman

Articles

Antitrust law has largely failed to address the challenges posed by digital markets. At the turn of the millennium, the antitrust enterprise engaged in intense debate over whether antitrust doctrine, much of it developed during a bygone era of smokestack industries, could or should evolve to address digital markets. Eventually, a consensus emerged: although the basic doctrine is supple enough to apply to new technologies, courts and enforcers should adopt a defendant-friendly, hands-off approach.

But this pro-defendant position is deeply- and dangerously- flawed. Economic theory, empirical research, and extant judicial and regulatory authority all contradict the prevailing views regarding power, …

Objective

Evidence on the impact of leisure time physical activity (LTPA) in pregnancy on birth size is inconsistent. We aimed to examine the association between LTPA during early and late pregnancy and newborn anthropometric outcomes.

Design

Individual level meta‐analysis, which reduces heterogeneity across studies.

Setting

A consortium of eight population‐based studies (seven European and one US) comprising 72 694 participants.

Methods

Generalised linear models with consistent inclusion of confounders (gestational age, sex, parity, maternal age, education, ethnicity, BMI, smoking, and alcohol intake) were used to test associations between self‐reported LTPA at either early (8–18 weeks gestation) or late pregnancy (30+ …

Efficacy Of Cold Plasma For Direct Deposition Of Antibiotics As A Novel Approach For Localized Delivery And Retention Of Effect, Agatha Los, Dana Ziuzina, Daniela Boehm, Lu Han, Denis O'Sullivan, Liam O'Neill, Paula Bourke

Articles

Antimicrobial coating of medical devices has emerged as a potentially effective tool to prevent or ameliorate device-related infections. In this study the plasma deposition process for direct deposition of pharmaceutical drugs on to a range of surfaces and the retention of structure function relationship and antimicrobial efficacy against mono-species biofilms were investigated. Two selected sample antibiotics—ampicillin and gentamicin, were deposited onto two types of surfaces—polystyrene microtiter plates and stainless steel coupons. The antimicrobial efficacy of the antibiotic-coated surfaces was tested against challenge populations of both planktonic and sessile Escherichia coli and Pseudomonas aeruginosa, with responses monitored for up to …

Subjective And Objective Assessment Of Taste And Smell Sensation In Advanced Cancer, Niamh Mcgettigan, Pauline Uí Dhuibhir, Michelle Barrett, Jessica Sui, Lucy Balding, Stephen Higgins, Norma O'Leary, Aileen Kennedy, Declan Walsh

Articles

Context: Taste and smell abnormalities (TSA) occur throughout the cancer trajectory regardless of cancer primary site and contribute to cancer-associated malnutrition. TSA etiology is poorly understood. Tumor-related inflammation is a possible cause. Objective: This study examined the prevalence, characteristics, and severity of TSA in advanced cancer and explored the relationship between TSA and nutritional status. No previous study combined subjective and objective measures for both taste and smell assessment in this population. Method: Consecutive advanced cancer hospice patients were recruited. A modified version of the “Taste and Smell Survey” assessed subjective TSA. Validated taste strips and “Sniffin’ …

Comparing Alternative Breast Milk Feeding Questions To U.S. Breastfeeding Surveillance Questions, Elizabeth O'Sullivan, Sheela R. Geraghty, Patricia Cassano, Kathleen M. Rasmussen Jan 2019

Comparing Alternative Breast Milk Feeding Questions To U.S. Breastfeeding Surveillance Questions, Elizabeth O'Sullivan, Sheela R. Geraghty, Patricia Cassano, Kathleen M. Rasmussen

Articles

Background: Most mothers in the United States express their milk, which is then bottle fed to their infants. The National Immunization Survey (NIS), used to report national breastfeeding prevalence, asks about infant breast milk consumption, regardless of whether it is consumed at the mother's breast or from a bottle. The NIS data are often erroneously interpreted, however, to mean prevalence of at-the-breast feeding. We hypothesized that over half of infants classified as breastfed at 3, 6, and 12 months by the NIS questions would also be consuming expressed breast milk.

Materials and Methods: A convenience sample of 456 …

An Open-Data-Driven Agent-Based Model To Simulate Infectious Disease Outbreaks, Elizabeth Hunter, Brian Mac Namee, John D. Kelleher Dec 2018

An Open-Data-Driven Agent-Based Model To Simulate Infectious Disease Outbreaks, Elizabeth Hunter, Brian Mac Namee, John D. Kelleher

Articles

Agent-based models are a tool that can be used to better understand the dynamics of an infectious disease outbreak. An infectious disease outbreak is influenced by many factors including vaccination or immunity levels, population density, and the age structure of the population. We hypothesize that these factors along with interactions of factors and the actions of individuals would lead to outbreaks of different size and severity even in two towns that appear similar on paper. Thus, it is necessary to implement a model that is able to capture these interactions and the actions of individuals. Using openly available data we …

Arrows In Biology: Lack Of Clarity And Consistency Points To Confusion For Learners, Leslie Kate Wright, Jordan J. Cardenas, Phyllis Liang, Dina L. Newman

Articles

In this article, we begin to unpack the phenomenon of representational competence by ex¬ploring how arrow symbols are used in introductory biology textbook figures. Out of 1214 figures in an introductory biology textbook, 632 (52%) of them contained arrows that were used to represent many different concepts or processes. Analysis of these figures revealed little correlation between arrow style and meaning. A more focused study of 86 figures containing 230 arrows from a second textbook showed the same pattern of inconsistency. Interviews with undergraduates confirmed that arrows in selected textbook figures were confusing and did not readily convey the information …

On The Exactitude Of Big Data: La Bêtise And Artificial Intelligence, Noel Fitzpatrick, John D. Kelleher Dec 2018

On The Exactitude Of Big Data: La Bêtise And Artificial Intelligence, Noel Fitzpatrick, John D. Kelleher

Articles

This article revisits the question of ‘la bêtise’ or stupidity in the era of Artificial Intelligence driven by Big Data, it extends on the questions posed by Gille Deleuze and more recently by Bernard Stiegler. However, the framework for revisiting the question of la bêtise will be through the lens of contemporary computer science, in particular the development of data science as a mode of analysis, sometimes, misinterpreted as a mode of intelligence. In particular, this article will argue that with the advent of forms of hype (sometimes referred to as the hype cycle) in relation to big data and …

Risks Of Excess Iodine Intake In Ghana: Current Situation, Challenges, And Lessons For The Future, Brenda A.Z. Abu, Wilna Oldewage‐Theron,, Richmond N.O. Aryeetey Nov 2018

Risks Of Excess Iodine Intake In Ghana: Current Situation, Challenges, And Lessons For The Future, Brenda A.Z. Abu, Wilna Oldewage‐Theron,, Richmond N.O. Aryeetey

Articles

In Ghana, iodine deficiency was first reported in 1994 among 33% of the population. A nationwide Universal Salt Iodization (USI) program plus other complementary interventions were subsequently implemented as a response. Our paper reviews the current risks of excess iodine status in Ghana and identifies policy and research gaps. A mixed methods review of 12 policies and institutional reports and 13 peer‐reviewed articles was complemented with consultations with 23 key informants (salt producers and distributors, food processors, regulatory agency officials, and healthcare providers) purposively sampled between May and August 2017. The findings show a strong policy environment indicated by regulations …

Vacuum Polarization For Varying Quantum Scalar Field Parameters In Schwarzschild–Anti–De Sitter Spacetime, Cormac Breen, Peter Taylor Nov 2018

Vacuum Polarization For Varying Quantum Scalar Field Parameters In Schwarzschild–Anti–De Sitter Spacetime, Cormac Breen, Peter Taylor

Articles

Equipped with new powerful and efficient methods for computing quantum expectation values in static-spherically symmetric spacetimes in arbitrary dimensions, we perform an in-depth investigation of how the quantum vacuum polarization varies with the parameters in the theory. In particular, we compute and compare the vacuum polarization for a quantum scalar field in the Schwarzschild–anti–de Sitter black hole spacetime for a range of values of the field mass and field coupling constant as well as the black hole mass and number of spacetime dimensions. In addition, a new approximation for the vacuum polarization in asymptotically anti–de Sitter black hole spacetimes is …

Use Of Auto-Germ To Model Germination Timing In The Sagebrush-Steppe, William C. Richardson, Dallin R. Whitaker, Kyler P. Sant, Nicholas S. Barney, Ryan S. Call, Bruce A. Roundy, Zachary T. Aanderud, Matthew D. Madsen

Articles

Germination timing has a strong influence on direct seeding efforts, and therefore is a closely tracked demographic stage in a wide variety of wildland and agricultural settings. Predictive seed germination models, based on soil moisture and temperature data in the seed zone are an efficient method of estimating germination timing. We utilized Visual Basic for Applications (VBA) to create Auto‐Germ, which is an Excel workbook that allows a user to estimate field germination timing based on wet‐thermal accumulation models and field temperature and soil moisture data. To demonstrate the capabilities of Auto‐Germ, we calculated various germination indices and modeled germination …

Assessment For Project-Based Courses, James R. Fugate Nov 2018

Assessment For Project-Based Courses, James R. Fugate

Articles

A project-based course is where students engage in a series of projects, which help lead students to a defined level of skill as specified in the course goals. Unlike a traditional lecture course where students are given examinations to assess the level of student knowledge and understanding, a project-based course may not include any formal examination. The assessment of student progress is often based on the quality of course projects. For this research, students in project-based courses were given a formal exam at the end of the course. The objective of the exam was to determine if there was a …

Global Investment Rules As A Site For Moral Inquiry, Steven R. Ratner Nov 2018

Global Investment Rules As A Site For Moral Inquiry, Steven R. Ratner

Articles

The legal regime regulating cross-border investment gives key rights to foreign investors and places significant duties on states hosting that investment. It also raises distinctive moral questions due to its potential to constrain a state’s ability to manage its economy and protect its people. Yet international investment law remains virtually untouched as a subject of philosophical inquiry. The questions of international political morality surrounding investment rules can be mapped through the lens of two critiques of the law – that it systemically takes advantage of the global South and that it constrains the policy choices of states hosting investment. Each …
