Revitalizing Biotechnological Advancement In The United States: Patent Eligibility Reform To Promote Innovation While Preserving Morality, Sydney Virtue

Patent protection has long been recognized as a key part of promoting innovation; however, current patent eligibility law in the United States often produces the exact opposite result. While the basic framework for patent eligibility is provided by the Patent Act, the United States Supreme Court has crafted several significant exceptions to patent eligibility—laws of nature, natural phenomena, and abstract ideas. These judicial exceptions have created a crisis in patent law and impeded biotechnological innovation, as they are too vague to be properly confined and carry tests that are too ambiguous for predictable application. This Article argues in support of recent legislation which clarifies legal title to potentially valuable substances derived from the treatment of mine drainage in West Virginia’s waters. West Virginia University has been researching the commercial viability of extracting rare earth elements and other critical minerals from coal mine drainage and coal mine waste. If successful, the research may foster a new industry and provide citizens and wildlife with cleaner water flowing in West Virginia’s rivers and streams. The assumed efficacy behind service dog intervention is based on the well-known potential for the development of a strong, emotional bond between humans and dogs. Occupational therapists can use knowledge of their specific scope of practice to aid in the referral process, and the assessment process, and to help assist clients with training and comfortability throughout the service dog placement process. Agritourism activity has increased dramatically over the past 10 years, both in number of operations and income. The types of agritourism activity have also expanded rapidly in recent years. The law, on the other hand, moves slowly. The disconnect between the pace ofchange in the industry and the legal regime creates uncertainty for operators, regulators, and policy makers. The difficulty in defining the rapidly changing industry lies at the center of much of the uncertainty. This research study aimed to discover what strategies of developmental programming are integrated into early childhood curriculum, whether occupational therapy had a role in the formation of the guidelines, and the importance of early intervention on child development. A case study with ethnographic methods was used, including observations and interviews, to gain an understanding of how sociocultural phenomena affect rural childcare centers in Morgantown, West Virginia. Data was collected and coded into 14 themes, and then analyzed by student researchers. “A Cruel System Indeed”: Extending The Statute Of Limitations For Claims By The Harmed Youth Of West Virginia’S Mismanaged Foster Care System, Caroline Toler

The current statutes of limitations in West Virginia pose a barrier for harmed youth to bring suits to recover. A child who experiences sexual abuse will have 18 years to bring a civil suit. However, a child who experiences another form of abuse (e.g., psychological or emotional abuse) must bring a suit within two years. In a novel argument, this Note proposes that state legislatures, and the West Virginia State legislature in particular, should extend the statute of limitations for civil suits by former foster youth harmed while in state care. In 1901, West Virginia guaranteed that women working outside the home would have a place to sit down at their workplace. In 2023, despite that law, no worker in West Virginia is functionally required to be given a chair. This Note explores the use of seating laws to prevent the modern and historic workplace issue of prolonged standing, or when an employee is required to stand in one place for too long at one time. The United States has the highest incarceration rate of any country in the world. Alarmingly, West Virginia’s incarceration rate is even higher. West Virginia’s staggering incarceration rate can largely be attributed to the increased criminalization and prosecution of individuals experiencing addiction. This Note considers what actions can be taken to limit incarceration and recidivism in West Virginia. The solutions proposed by this Note also aim to limit the collateral consequences of incarceration in West Virginia because many of West Virginia’s current issues are only exacerbated by incarceration. In this book, the authors update an earlier history of the Department of Physiology at West Virginia University that described its first 100 years. It covers the most recent half-century (1965-2022), a tumultuous time characterized by periods of faculty growth and development of the department’s research and educational programs interspersed with major challenges the department had to overcome. The latter included an autocratic chair who created a hostile work environment, an administrator who favored research centers over departments, and the dissolution of the Department of Pharmacology and Toxicology, which led to the creation of the Physiology and Pharmacology Department. Per- and polyfluoroalkyl substances (PFAS) are a group of synthetic chemicals that have been used to make coatings that resist heat, oil, stains, and water since the 1940s. PFAS take hundreds of years to break down in the environment and can build up in the bodies of animals and humans, leading to concerns about potential health impacts. This Science and Technology Note discusses the known health risks of PFAS exposure, recent PFAS regulations in West Virginia, and policy options to address potential PFAS exposure in West Virginians.

The objectives of this study were to 1) formulate a novel energy bar containing significant macronutrients and calories per serving with favorable ratings from consumers; 2) analyze responses to a consumer preference survey and sensory evaluation of novel energy bars compared to a commercially available energy bar. For the first study, fourteen iterations of an energy bar were synthesized with differing protein sources (whey, soy, pea, hemp), and characteristic variations (nougat, chocolate truffle, peanut butter, double-date caramel). A shortbread base, date caramel, and chocolate coating were included in every bar. Sensory evaluations determined that the most liked variation overall was …

Background: Use of manometers, inflating the endotracheal tube (ETT) cuff with a 5-mL syringe, displaying the pressure-volume loop (PV-L) on anesthesia machines, and auscultating with a stethoscope over the trachea have been shown effective in preventing ETT cuff overinflation in the operating room (OR). Purpose: The aims of this project were to implement and evaluate a best practice guideline for ETT cuff inflation in the OR. Methods: This project was conducted in several ORs at J.W. Ruby Memorial Hospital, in Morgantown, West Virginia. Introduction: The leading cause of mortality in patients with diabetes mellitus is heart failure. When mitochondrial health and function is disrupted, cardiac contractile function is compromised. Therefore, understanding mitochondrial regulation may benefit predicting and countering diabetic cardiomyopathy. MicroRNAs (miRNAs) play a crucial role in diabetic cardiac mitochondrial protein expression. Long noncoding RNAs (lncRNAs) have been shown to regulate miRNAs, but not in the mitochondrion. Additionally, it has yet to be confirmed if lncRNAs utilize the same mechanisms for mitochondrial import that miRNAs use, or if lncRNA presence in the mitochondrion fluctuates in diabetic mitochondria like miRNA presence does. The increase in human activity in space has revealed several kinds of physiological challenges brought on by the absence of Earth's gravitational pull. NASA observed that during spaceflight, astronauts experience a 1-1.5% monthly loss in the mineral density of weight-bearing bones, with rehabilitation efforts on Earth often proving ineffective. This issue extends to muscles, the neuro vestibular system, the cardiovascular system, and vision. Cancer has emerged as a significant cause of mortality among astronauts, with studies up to 2017 showing that 41.3% of natural cause deaths among U.S. astronauts were due to cancer, primarily due to space radiation exposure.
