Masking Your Rights: Facemask Requirements Under Mandatory Influenza-Vaccination Policies Violate Privacy Rights Of Health Care Workers, Janet S. Kim
San Diego Law Review
Hospitals should abandon the facemask requirements in their mandatory influenza-vaccination programs because the facemasks can infringe on the privacy rights of health care workers, and hospitals can still achieve their vaccination goals through less restrictive practices. Part II introduces the recent rise of mandatory influenza-vaccination policies for health care workers, how hospitals exempt certain employees, and the consequences for those exempted. Part III discusses the legal implications of requiring exempted employees to wear facemasks and other identifying material under federal and state privacy law. Sealing And Destruction Of Criminal Records For The Factually Innocent: A “Second Chance” For California Penal Code Section 851.8, Irina Fox
San Diego Law Review
This Article provides a comprehensive review of section 851.8 and proposes amendments to fairly balance the societal interests in preserving criminal records with the interests of factually innocent individuals in clearing their names. Part I reviews California law governing criminal record retention and dissemination and outlines the contemporary society’s main policy considerations for preserving arrest records and for their expungement. Part II scrutinizes Penal Code section 851.8, offers a synopsis of the most significant California case law interpreting the statute, and outlines the procedure for filing a petition under the statute—including a discussion of the statutory standards for establishing factual …

Up in the Air: A Global Estimate of Non-Violent Drone Use 2009-2015
The use of unmanned aerial vehicles (UAVs), or drones, has increased dramatically in recent years. While most attention has gone to military drone use, commercial drones have gained widespread popularity, with uses ranging from leisure activities by hobbyists to humanitarian aid and disaster relief support by non-governmental organizations (NGOs) and activist groups. This use has been hard to quantify and regulate.
In an effort to better understand the rapid growth of non-weaponized drone, this report analyzes cases of worldwide drone use reported during a six-year period (2009-2015). Utilizing a combination of qualitative and quantitative methods, we engage two distinct research …

Pharmaceutical counterfeiting is a growing area of public safety and national security concern. Biological medications are a growing portion of counterfeit medicines due to the high cost and opportunities for profit from these innovative drugs. Biologics are a unique target for counterfeiters in international commerce presentingunique hazards over traditional, more stable, pills. This Article explores the international biopharmaceutical supply chain and the regulatory weaknesses that compromise public health.
