Addressing Individual And Community Needs In The Aftermath Of Campus Sexual Misconduct: Restorative Justice As A Way Forward In The Re-Entry Process, David R. Karp Phd

Restorative justice is an approach to incidents of harm involving a high level of support and accountability for people who cause harm. To date, there is no federal regulation nor commonly applied standard of care for re-entry to campus by a student who has been found responsible for sexual misconduct. Restorative justice re-entry circles represent a promising approach to the reintegration of students, taking into account the needs of the individual survivor, the student who violated policy, and the safety concerns of the campus community. Extending Miranda: Prohibition On Police Lies Regarding The Incriminating Evidence, Rinat Kitai-Sangero

This Article addresses the question of whether lying to suspects during interrogations regarding the incriminating evidence against them is a legitimate deceit. The search for truth goes hand-in-hand with the human yearning for knowledge. Generally, lying is perceived as reprehensible. Certain types of lies, such as those concerning medical treatment or the sale of a house, may even result in civil or criminal liability. The purpose of this Gap Analysis is to identify challenges and opportunities for agencies in San Diego to better manage stormwater with climate-smart strategies. In this report, ‘climate-smart’ refers to a stormwater tactic that increases a system’s resiliency to both extreme dry and wet season flows while also enhancing local communities, businesses, and/or natural resources.

Locked Up: Parallel Correctional Officer, Deputy, And Inmate Decision-Making Experiences In County Jails, Mariko Catherine Peshon

Recidivism is a complex phenomenon. Greater than 65 percent of incarcerated adults return to jail within three years. While numerous empirical studies focus on factors that contribute to recidivism, there is limited existing research that examines decision-making as one of these factors. The purpose of this study is to address this gap in the literature and develop an understanding of the influence of decision-making processes on inmates and correctional officers and deputies in the California criminal justice system. Notice And The Claim Presentation Requirements Under The California Government Claims Act: Recalibrating The Scales Of Justice, Samantha Lewis

To recalibrate the scales of justice, this Comment advocates for a statutory amendment that encompasses two changes. First, the amendment would require plaintiffs to present their government claims against the state directly to the public entity that allegedly caused the harm, instead of the VCGCB, thereby accomplishing the statute’s objective of providing notice to the state entity. Second, instead of the VCGCB assessing claims against the state, each state agency would have its own government claims office (GCO) handle government claims for the respective individualized entity.
