California Negotiated Health Care: Implications For Malpractice Liability, Wilfred Knottnerus
San Diego Law Review
This Comment addresses the impact of California's new Medi-Cal payment system, selective provider contracting, on physician, hospital and state liability. The author argues that selective provider contracting encourages provider cost efficiency by contractually binding providers to a pre-determined cost allowance, thereby creating cost-consciousness in medical decision-making, and that such consideration may affect the physician's standard of care. The author further argues that a change in the physician's duty to the beneficiary would also affect hospital liability under respondeat superior and corporate negligence principles, and that selective provider contracting may expose the state to liability for negligent provider selection and review.

"Fundamental Miscarriage Of Justice": The Supreme Court's Version Of The "Truly Needy" In Section 2254 Habeas Corpus Proceedings, Larry Ainbinder
San Diego Law Review
This Comment examines the circumstances under which a state prisoner may challenge his or her conviction in a habeas proceeding when there has been procedural default at the trial level. The author argues that this is a hotly contested topic, since the Court's decision in Fay v. Noia, but that the Court, in Engle v. Isaac, has established a new strict burden for these prisoners. The author begins by exploring the arguments with respect to an expanded writ. The author then examines the case law that followed the decision in Fay, in which the cause and prejudice standard evolved, and …

Used Car Dealers' Duty To Disclose Major Known Defects, Douglas Dexter
San Diego Law Review
This Comment examines Congress' recent veto of the Used Car Rule, which would have required that a used automobile dealer provide a written list of major defects that the dealer knew existed in a car offered for sale. The author examines the nature of the proposed legislation, the reasons for its introduction by the Federal Trade Commission, and the objections that lead to its eventual demise. The author suggests that the courts expand the traditional fraud cause of action to include nondisclosure of major defects by used automobile dealers.

Moral Rights In California, Peter H. Karlen
San Diego Law Review
This Article critiques the California Art Preservation Act of 1979, the first major legislation in the United States on moral rights for artists. The author focuses his discussion on the restrictions on protection, such as the restrictions on the types of eligible art and artists, potential defendants, duration of moral rights, and remedies. The author also focuses on the relationship of this legislation to other art-related laws in the United States and elsewhere, with particular reference to relevant sections of the Copyright Revision Act of 1976.
