The Peacock Dress: The Language Of British Imperialism In India, 1899-1905, Rebecca Onken Jan 2022

The Peacock Dress: The Language Of British Imperialism In India, 1899-1905, Rebecca Onken

Copley Library Undergraduate Research Awards

Imperialism exists in tandem with colonialism. Empires seek out colonies for their resources so they can take the wealth in those countries for their own. Rarely do empires admit this, so they require a language with which to reframe their practices. The British Raj in India exemplifies this. A narrative of exploitation is at first hard to discern, because while the British drained India of its resources and broke down its industries, they appreciated Indian art and objects too, to the point of clothing themselves in Indian textiles, as in the case of the titular Peacock dress. But this appreciation …

Systemic Racism: Patterns Of Black Disadvantage And White Advantage Linked To Slavery, Roy L. Brooks Dec 2021

Systemic Racism: Patterns Of Black Disadvantage And White Advantage Linked To Slavery, Roy L. Brooks

San Diego Law Review

In this Article, I engage systemic racism in two ways. First, I discuss some of its current manifestations, Part II. In particular, I will offer powerful examples of systemic racism, Section A, and explain the link between slavery and extant systemic racism, Section B. Next, I analyze the forces in this country that sustain systemic racism well into the post-civil rights period, Part III. I will spend a fair amount of time examining socio-psychological paradigms and institutional practices or policies that perpetuate or contribute to manifestations of systemic racism. The former consists of various forms of racial bias, Section A, …

This Is The House That Law Built: A Systems Story Of Racism, Palma Joy Strand Dec 2021

This Is The House That Law Built: A Systems Story Of Racism, Palma Joy Strand

San Diego Law Review

In this essay, I explore the system-ness of racism. A systems understanding of racism enables us to more fully comprehend the magnitude and depth of racism, its reach and rootedness. This systems understanding provides the foundation for some initial and overarching observations about law and systemic racism.

A Pilot Study Exploring The Relationship Between Urban Greenspace Accessibility And Mental Health Prevalence In The City Of San Diego In The Context Of Socioeconomic And Demographic Factors, Alexis Wilderman, Marcus Lam, Zhi-Yong Yin Dec 2021

A Pilot Study Exploring The Relationship Between Urban Greenspace Accessibility And Mental Health Prevalence In The City Of San Diego In The Context Of Socioeconomic And Demographic Factors, Alexis Wilderman, Marcus Lam, Zhi-Yong Yin

Environmental and Ocean Sciences: Faculty Scholarship

The connection between urban greenspace and mental health is a robust but unsettled area of research in the public health and urban planning literatures. Inconsistent findings in prior studies are mostly due to differences in greenspace measurements and interrelations with socio-demographic factors. This study examines the relationships of mental health prevalence (MHP) with health prevention, socioeconomic and race-ethnicity factors, and proximity to greenspace at the census-tract level in the City of San Diego, California, using data from the CDC 500 Cities Project and US Census Bureau. We considered three greenspace proximity measures: distances to specified vegetation types, parks, and tree …

Using A Firearm, Using A Word: What Interpretation Just Is, Walter Benn Michaels Dec 2021

Using A Firearm, Using A Word: What Interpretation Just Is, Walter Benn Michaels

The Journal of Contemporary Legal Issues

My response to these hypotheticals is going to be useless, although, I hope, in a useful way. It’s going to be useless because I’m an English teacher, not a lawyer, and I have no idea what Mary or the judge should do. But, of course, Larry Alexander and Steve Smith already knew this when they asked me to contribute. Presumably, it’s in my capacity as a theorist of interpretation and in particular (since the hypotheticals might be understood to raise particular difficulties for intentionalists) as an intentionalist theorist that they asked for my views. But, as an intentionalist theorist, I …

Self-Measured Blood Pressure Monitoring: A Patient Empowerment Project, Alison Cusmano Dec 2021

Self-Measured Blood Pressure Monitoring: A Patient Empowerment Project, Alison Cusmano

Doctor of Nursing Practice Final Manuscripts

Hypertension is a public health issue estimated to affect 112 million adults by 2030. Primary care patients in an outpatient clinic in Southern California with elevated blood pressure readings in the office did not have an organized system for close follow-up. The purpose of this evidence-based project (EBP) was to educate patients on self-measured blood pressure monitoring (SMBP), Dietary Approaches to Stop Hypertension (DASH), diet interventions, and healthy weight loss to improve hypertension rates. Through these interventions, patients developed an understanding of their systolic and diastolic blood pressure goals. Nurse practitioners, medical assistants, and licensed vocational nurses screened for high …

Defamation Per Se Cases Should Include Guaranteed Minimum Presumed Damage Awards To Private Plaintiffs, Steven A. Krieger Oct 2021

Defamation Per Se Cases Should Include Guaranteed Minimum Presumed Damage Awards To Private Plaintiffs, Steven A. Krieger

San Diego Law Review

To combat the reputational harm associated with defamatory comments, forty states allow plaintiffs to recover presumed damages for reputational harm for defamatory statements considered “per se” defamation without having to prove the exact dollar figure associated with their reputational damages. While damages are presumed to a plaintiff’s reputation in a successful defamation per se lawsuit, the spectrum of presumed damages is so wide that there is almost no practical way for a plaintiff to reliably know the size of a presumed damages award, especially a lower-income plaintiff. Plaintiffs cannot evaluate the financial merit of a defamation lawsuit, which removes the …

Saving Class Members From Counsel, Jeremy Kidd, J.D., Ph.D., Chas Whitehead, J.D. Oct 2021

Saving Class Members From Counsel, Jeremy Kidd, J.D., Ph.D., Chas Whitehead, J.D.

San Diego Law Review

The U.S. class action regime is supposed to obtain justice for victims and hold wrongdoers accountable. Instead, the system is filled with pathologies that combine to harm class members and allow defendants to minimize their responsibility. Victims are deprived of their property and due process rights. Adding insult to injury, the modern movement towards cy pres settlements also deprives victims of their free speech rights. Cy pres was borrowed from the law of trusts, but its use in class actions is unjustified. It is leading to greater corruption and collusion, opening the door to significant rent seeking. Most reform proposals …

Catch Up Capta: Amending Capta To Guarantee Children Legal Counsel In Dependency Proceedings, Taylor Needham Oct 2021

Catch Up Capta: Amending Capta To Guarantee Children Legal Counsel In Dependency Proceedings, Taylor Needham

San Diego Law Review

This Comment will address children’s constitutional right to have legal counsel in dependency proceedings. Dependency proceedings include the entire dependency process, from the moment the child is removed from the parent’s custody until the child returns home or ages out of the foster care system. This Comment will not address the constitutional rights of parents to have legal counsel or the constitutional rights of children in private custody or other family law matters. Nor will it address the type of legal representation that children should receive.

While this Comment argues that all children have a constitutional right to legal counsel …
