A Quandary In Law? A (Qualified) Catholic Denial, Patrick Mckinley Brennan
A Quandary In Law? A (Qualified) Catholic Denial, Patrick Mckinley Brennan
San Diego Law Review
What I shall argue, more specifically, is that, on the view of traditional Catholic philosophy and theology, we cannot be in a true quandary in law, because - whether we readily admit it or fiercely deny it - we have received, and therefore can make, law. On the traditional Catholic view, it is a fact about who we are that we are capable of making law. While the Catholic tradition denies, then, that we are in an ontic (as opposed to ontological) quandary, it also acknowledges that the mainstream, "meager" ontologies of our making can undermine our resources for making …
Public Services Meet Private Law, Michael I. Krauss
Public Services Meet Private Law, Michael I. Krauss
San Diego Law Review
Some plaintiffs' lawyers believe that expenses incurred by governments after the criminal use of their products take issue with the claim that the government services for which compensation is claimed are free for all, and therefore ineligible for tort recovery. They argue that government services should not subsidize tortfeasors, and that proper accounting requires tortfeasors to internalize the social costs of their alleged misbehavior. They would do away with what they call the free public services doctrine (FPSD), which one author described as holding that a governmental entity may not recover from a tortfeasor the costs of public services occasioned …
Legal Commitments And Religious Commitments, Joseph Vining
Legal Commitments And Religious Commitments, Joseph Vining
San Diego Law Review
Person, individual, purpose, value, authority: Can these be realities for law without making a commitment to law into a religious commitment? Can the affinities between the world of law and the world of religious life be as close as they are without leading one to conclude, empirically or introspectively, that these dimensions of experience are the same? In a comment on Steven Smith's Law's Quandary, this essay suggests law has an ontology of its own. As Smith argues, the language of everyday life does not fully reach what is real for law, and law's ontology is clearly not limited to …
On Questions And Answers In Law's Quandary, Brian H. Bix
On Questions And Answers In Law's Quandary, Brian H. Bix
San Diego Law Review
This Article will explore a few central aspects of Smith's fascinating and provocative argument. Part I considers the connection between Smith's analysis and one standard Wittgensteinian argument about the causes of philosophical problems. Part II, starting from a different direction, explores the classical approach to law that Smith extols as superior to our own, raises some questions about Smith's portrayal, and considers the extent to which his approach can provide better answers to the quandaries Smith discusses than does conventional modern legal thought.
Constitutional Texting, Lawrence B. Solum
Constitutional Texting, Lawrence B. Solum
San Diego Law Review
"Constitutional Texting" introduces an account of constitutional meaning that draws on Paul Grice's distinction between "speaker's meaning" and "sentence meaning." The constitutional equivalent of speaker's meaning is "framer's meaning," the meaning that the author of the constitutional text intended to convey in light of the author's beliefs about the reader's beliefs about the author's intentions. The constitutional equivalent of sentence meaning is "clause meaning," the meaning that an ordinary reader would attribute to the text at the time of utterance without any beliefs about particular intentions on the part of the author. Clause meaning is possible because the words and …
