An Empirical Study Of Employee Relations And Managerial Malpractice Risks In A Four-Year Public Higher Education System, Robert Lee Brown Edd May 2007

An Empirical Study Of Employee Relations And Managerial Malpractice Risks In A Four-Year Public Higher Education System, Robert Lee Brown Edd

Dissertations

Over the last decade, the rapid rise in college tuitions and fees has become a national priority, with congressional committees and scholars interested in solving this persistently stubborn and often intractable problem. Although a number of reasons for this phenomenon have been discussed, one theoretically plausible but untested explanation involves the extent to which campus climate may be empirically linked to the costs of managing various legal claims against the university, including workers' compensation, employment practice, and stress claims. To test the empirical validity of this hypothesis, this study gathered campus climate and claims data from 23 campuses and 25 …

Experiences Of Sacramental Marriage, James Patrick O'Brien Edd May 2007

Experiences Of Sacramental Marriage, James Patrick O'Brien Edd

Dissertations

This study interprets the stories told by eight couples about their experiences approaching marriage as a religious sacrament. The eight couples represented a purposeful sample selected using the following criteria: (a) They self-identified as having a sacramental marriage within the Roman Catholic tradition; (b) they appeared to be information rich sources who could provide an emic, i.e., an insider, view of the sacramental marriage experience; (c) they participated in the Catholic Cursillo movement; (d) they engaged in observable religious practices; and (e) they parented children. Research methods included guided conversation, participant observation, and a timeline activity that asked participants to …

Effect Of Computer-Aided Instruction On Grades In Middle School Algebra, Patricia A. Taepke Edd May 2007

Effect Of Computer-Aided Instruction On Grades In Middle School Algebra, Patricia A. Taepke Edd

Dissertations

Computers and targeted software are increasingly common in the middle school algebra classroom, but the efficacy of computer-aided instruction on classroom achievement in middle school algebra remains unclear. Participants were 1452 middle-school algebra students who were seldom, occasionally, or often exposed to the algebra modules of Destination Math, an interactive mathematics software designed to be appropriate for in-school use. Data were collected over three years (2002–04) and included the cooperation of the algebra teachers, who were subsequently interviewed. Data were analyzed with ANOVA, ANCOVA, and multiple regression. Statistically significant effects were localized using pairwise tests with Bonferroni correction for multiple …

An Investigation Of The Community-Based English Tutoring Program (Cbet), Barbara J. Pongsrikul Edd May 2007

An Investigation Of The Community-Based English Tutoring Program (Cbet), Barbara J. Pongsrikul Edd

Dissertations

Currently in the California K-12 public schools, approximately 25% (about 1.5 million) of the students know little or no English, and their numbers are increasing. Because of this diverse student population, a research study by the Gevirtz Research Center in 2005 reports that it is necessary to develop educational programs that help language-minority families understand and participate in the school system in ways that will support the academic success of their children. As a result of the Proposition 227 Initiative in California, statewide family literacy programs were established as Community-Based English Tutoring (CBET) programs to provide adult English language instruction …

A Mixed Methods Study On Cbam And The Adoption Of Thin Client Computers By Adolescents, Cynthia Sistek-Chandler Edd May 2007

A Mixed Methods Study On Cbam And The Adoption Of Thin Client Computers By Adolescents, Cynthia Sistek-Chandler Edd

Dissertations

Although stages of change and adoption of innovation dynamics have been examined for adult populations, comparable research for adolescents is limited. Applying a change instrument grounded in Concerns-Based Adoption Model (CBAM) to an adolescent population, this study investigates perceptions of 45 middle school students who used thin client portable computers in a one-to-one program at home and at school for 3 years. A mixed methodology design identified which of the 7 stages of concern students passed through and why some students adopted the innovation more readily than others. The Change Facilitator Stages of Concern Questionnaire, a modified version of CBAM, …

Transition To Nursing Home Of Korean-American Elders, Myungja Kim Hahm Phd

Dissertations

The purpose of this study was to explore factors affecting Korean-American (KA) elders during the transition to nursing homes in the first month following admission. The three aims of this proposed study were (1) to explore culture specific factors that affect KA elders' perspectives during the transitional period to a nursing home, (2) to identify thoughts and feelings of KA elders about their admission into a nursing home, (3) to describe the adjustment process associated with admission to a nursing home. A grounded theory design was utilized to explore KA elders' perceptions/experiences associated with adjustment to a nursing home. Open-ended, …

The Web Of Law, Thomas A. Smith May 2007

The Web Of Law, Thomas A. Smith

San Diego Law Review

Scientists and mathematicians in recent years have become intensely interested in the structure of networks. Networks turn out to be crucial to understanding everything from physics and biology, to economics and sociology. This Article proposes that the science of networks has important contributions to make to the study of law as well. The network of American case law closely resembles the Web in structure and can be studied using techniques that are now being used to describe many other networks, some found in nature, and others created by human action. Studying the legal network can shed light on how the …

Examining Stage Theories And The Predisposition To Lead Within The Homosexual Community, David Robert Blair Edd May 2007

Examining Stage Theories And The Predisposition To Lead Within The Homosexual Community, David Robert Blair Edd

Dissertations

An application of homosexual stage-based self-integration theory suggests that until gay individuals have become fully self-integrated, their capacity for leadership within the community is diminished. Unfortunately, now more than ever before, leadership is needed in dealing with such pressing community issues as the disproportionately high suicide rate among gay teens, the ongoing struggle for gays to become fully self-integrated individuals, bringing equal rights to the gay population, and of course, developing a base of strong gay leaders to meet the ongoing challenges facing this population. To test the self-integration-leadership hypothesis, this study surveyed 150 men in gay Internet chat rooms …

Foreword, Shanish M. Aloor May 2007

Foreword, Shanish M. Aloor

San Diego International Law Journal

The impact of international law has reached past foreign policy and has now extended into every part of U.S. government. Our last issue emphasized the increasing importance of globalization on domestic issues such as national elections. In the past decade, international laws have had a practical effect upon the interpretation of United States domestic law. Influential jurists such as former Justice Sandra Day O'Connor have expressed "that with time [the judiciary] will rely increasingly on international and foreign law in resolving what now appear to be domestic issues, as we both appreciate more fully the ways in which domestic issues …

Can International Law Survive The 21st Century - Yes: With Patience, Persistence, And A Peek At The Past, Dana Zartner Falstrom May 2007

Can International Law Survive The 21st Century - Yes: With Patience, Persistence, And A Peek At The Past, Dana Zartner Falstrom

San Diego International Law Journal

With the end of the Cold War-the principal international political framework that shaped the international system since the end of WWII-an increasing number of global tensions have arisen which have brought to the fore questions about the ability of existing international law to provide a guiding framework for state behavior. Debates over the limits of state sovereignty, the appropriateness of humanitarian intervention, the justness of pre-emptive war, the definition of self-defense, the legality of replacing a government in the interests of your ideals, and how to deal with terrorism have dominated discussions around the world. Moreover, these discussions have caused …

Retrying The Acquitted In England, Part I: The Exception To The Rule Against Double Jeopardy For New And Compelling Evidence, David S. Rudstein May 2007

Retrying The Acquitted In England, Part I: The Exception To The Rule Against Double Jeopardy For New And Compelling Evidence, David S. Rudstein

San Diego International Law Journal

More than 240 years ago, Sir William Blackstone, perhaps the most important commentator on the English common law, wrote that when a man is once fairly found not guilty upon any indictment, or other prosecution, before any court having competent jurisdiction of the offence, he may plead such acquittal in bar of any subsequent accusation for the same crime. This plea of autrefois acquit (a former acquittal), Blackstone explained, is based upon the principle that no man is to be brought into jeopardy of his life, more than once for the same offence, which he called a universal maxim of …

Mexican Law And Personal Injury Cases: An Increasingly Prominent Area For U.S. Legal Practitioners And Judges, Jorge A. Vargas May 2007

Mexican Law And Personal Injury Cases: An Increasingly Prominent Area For U.S. Legal Practitioners And Judges, Jorge A. Vargas

San Diego International Law Journal

Since tort law cases are seldom filed in Mexico, and the number of judicial resolutions rendered by Mexican courts are few and relatively unimportant, is there a sufficient corpus of Mexican jurisprudence that may be tapped into by American judges to ascertain the rules of Mexican law that govern a case pending before an American trial judge or an appellate justice? Considering that American courts resolve a far larger number of personal injury cases governed by Mexican as compared to the nominal amount of cases decided in Mexico by Mexican courts, is there a risk that this rapidly growing number …

Here There Be Pirates: How China Is Meeting Its Ip Enforcement Obligations Under Trips, Kate Colpitts Hunter May 2007

Here There Be Pirates: How China Is Meeting Its Ip Enforcement Obligations Under Trips, Kate Colpitts Hunter

San Diego International Law Journal

This paper will examine whether China is meeting its obligations to protect IP rights under the TRIPS agreement, an international intellectual property trade agreement China acceded to upon joining the World Trade Organization (WTO). Moreover, it will address whether China's increased IP protection in law equals increased protection in fact. Part II will describe China's legal structure, its TRIPS obligations upon joining the WTO, and China's IP laws. Part III will discuss China's enforcement of these IP laws from the perspective of developed nations and from China's own perspective. Part IV includes suggestions on how China can improve its enforcement …

Regulatory Marketing Approval For Pharmaceuticals As A Non-Tariff Barrier To Trade: Analysis Under The Wto's Agreement On Technical Barriers To Trade, Mary Hess Eliason May 2007

Regulatory Marketing Approval For Pharmaceuticals As A Non-Tariff Barrier To Trade: Analysis Under The Wto's Agreement On Technical Barriers To Trade, Mary Hess Eliason

San Diego International Law Journal

At a fundamental level, pharmaceuticals serve two roles: both as a cure for disease and as a product. As a cure for disease, a drug's value cannot be quantified because it saves lives. As a product, profit analysis shapes every step of a drug's progression to market. In least developed nations the barriers to drug access are not solely economic. National regulatory systems for market approval are being used to prevent external pharmaceutical manufacturers from participating in a national market. This article will address how the regulatory framework of pharmaceutical registration may serve as a barrier to trade in drugs, …

Psychometric Testing Of The Walker's Feelings And Thoughts About Weight Scale In Taiwan, Shu-Wen Chang Phd Apr 2007

Psychometric Testing Of The Walker's Feelings And Thoughts About Weight Scale In Taiwan, Shu-Wen Chang Phd

Dissertations

Background: The majority of women do not return to their pre-pregnant weight after six weeks postpartum in Taiwan. Excessive postpartum weight retention or gain can lead to long-term obesity and increase a woman's risk of major health problems. Trends among Taiwanese women reveal an increasing prevalence of obesity. Limiting postpartum weight retention is important for preventing long-term obesity development. Objectives: The purpose of this study was to examine predictors of postpartum weight gain among Taiwanese women using the modified Thriving Model (Walker & Kim, 2002) as the guiding conceptual framework and to examine the psychometric properties of a Chinese Version …

Symptom Burden At End Of Life In Patients With Terminal And Life-Threatening Illness In Intensive Care Units, Peggy G. Kalowes Phd, Msn, Rn, Cns

Dissertations

The purpose of this study was to examine the symptom burden and severity of symptom distress reported by ICU patients at high-risk for death and to compare patient-rated symptoms and distress for concordance with symptoms reported by a family member. A prospective, correlational design with two data-points was used to study a convenience sample of 80 patients and 53 family members. The Condensed Memorial Symptom Assessment Scale (CMSAS) was used to gain patient/proxy report of symptoms on the first and third day after admission to the ICU. The majority of patients were symptomatic (98%), reporting an average of 10.23 symptoms. …
