Jeremy Waldron And The Philosopher's Stone, James Allan Feb 2008

Jeremy Waldron And The Philosopher's Stone, James Allan

San Diego Law Review

The author considers Jeremy Waldron's argument in favour of referring to, and on occasion perhaps even deferring to, foreign law. Waldron rests his argument on an analogy to how science works. The author argues this analogy is flawed. Indeed the author argues that Waldron's position on this issue is inconsistent with his earlier writings on the undesirability of strong judicial review under an entrenched bill of rights.

Speak No Evil: Circumventing Chinese Censorship, Jennifer Shyu Feb 2008

Speak No Evil: Circumventing Chinese Censorship, Jennifer Shyu

San Diego Law Review

This Comment will focus on the issue of the role of American corporations in enforcing Chinese censorship law. In the hands of the Chinese government, the increased freedom of speech granted by the Internet and brought to China via American corporations is curtailed by state-sponsored censorship. To do business in China, American companies must comply with Chinese Internet censorship laws, yet these very laws not only restrain the freedom of speech of Chinese citizens but also subject offenders to the whim of the Chinese secret police. As accurately stated in the hearing, Yahoo! aided China in arresting at least two …

Fighting Terrorism: Assessing Israel's Use Of Force In Response To Hezbollah, Zachary Myers Feb 2008

Fighting Terrorism: Assessing Israel's Use Of Force In Response To Hezbollah, Zachary Myers

San Diego Law Review

The Israel-Lebanon conflict has highlighted difficult questions surrounding military responses to terrorist attacks. While Israel's response was forceful, this Comment argues that it was legitimate under international law. There are inevitable problems that arise when a nation faces a terrorist militia that hides among civilians and generally operates outside the confines of international law. The wisdom of maintaining rigid laws of war given changing battlefield norms is a topic that is outside the scope of this Comment. Instead, this Comment will closely analyze Israel's controversial actions both under the international customary rules of war and the sometimes aspirational Protocol I …

The Human Right To Privacy, James Griffin Nov 2007

The Human Right To Privacy, James Griffin

Some Questions For The Barrier Theory, Alan Rubel Nov 2007

Some Questions For The Barrier Theory, Alan Rubel

San Diego Law Review

Having set out the basics, Rickless considers several questions one might pose for the Barrier Theory. For example, must the barrier be solid? No. Must the barrier be erected by, rather than merely used by, the rightholder? No. Must the barrier be morally permissible in the first instance? No. While Rickless's answers seem correct, I think that they raise some concerns about the Barrier Theory.

How To Understand Legislatures: A Comment On Boudreau, Lupia, Mccubbins, And Rodriguez, Larry Alexander Nov 2007

How To Understand Legislatures: A Comment On Boudreau, Lupia, Mccubbins, And Rodriguez, Larry Alexander

San Diego Law Review

Much has been written about legal interpretation, and I have serious disagreements with most of it. So it is quite refreshing to read an article on the topic that, from my perspective, gets the topic right from start to finish. As an added bonus, two of the authors are my former colleagues. My enthusiasm for the approach taken by Boudreau, Lupia, McCubbins, and Rodriguez (hereinafter BLMR) has not proven fatal to my task of commenting on the article. I am not reduced to saying "Right on" and then signing off. There are issues to be flagged. Nonetheless, so much of …
