School Web Sites Within The Educational Marketplace: A Case Study Investigating The Parents As Engaged Consumer-Users, Claudia Jane Beeman Edd May 2008

School Web Sites Within The Educational Marketplace: A Case Study Investigating The Parents As Engaged Consumer-Users, Claudia Jane Beeman Edd

Dissertations

Schools -- like their corporate counterparts -- recognize the many advantages that the Internet affords. Today's schools vie for students, and thus use the web to market their services and showcase their management team (administrators, teachers, staff) and academic accomplishments. In a sense, then, web sites are the public face of education; those that are well-designed and multi-featured can enhance a district's public image and create the perception of excellence and competence. This case study explores how one suburban, K-8 school district approaches web site development, specifically, the process by which decisions about design, development, and maintenance are made (and …

Foreword, Christina Clemm

San Diego International Law Journal

The authors of Volume 9: Issue 2 of the San Diego International Law Journal discuss a myriad of issues, tackling emerging and pressing problems in international law. Three articles discuss different aspects of international investment in real estate. The others discuss remedies for victims under international and national law; the limits imposed on rule against double jeopardy in the United States, United Kingdom, and potentially other countries; and the possibility of defamation liability of Internet and global publishers in foreign courts.

Retrying The Acquitted In England Part Ii: The Exception To The Rule Against Double Jeopardy For Tainted Acquittals, David S. Rudstein May 2008

Retrying The Acquitted In England Part Ii: The Exception To The Rule Against Double Jeopardy For Tainted Acquittals, David S. Rudstein

San Diego International Law Journal

Parliament enacted a statute in 1996 intended to limit the double jeopardy bar in some situations in which the defendant obtained an acquittal through improper means, thereby permitting the government to retry the person for the same offense of which he previously was tried and acquitted. The statute, part of the Criminal Procedure and Investigations Act 1996, allows a retrial when an individual's acquittal was tainted, which, under the statute, means an acquittal resulting from interference with, or intimidation of, a juror, witness, or potential witness. In allowing a retrial in such circumstances, the statute creates an exception to the …

Acquisition Of Real Estate In Mexico By U.S. Citizens And American Companies, Jorge A. Vargas May 2008

Acquisition Of Real Estate In Mexico By U.S. Citizens And American Companies, Jorge A. Vargas

San Diego International Law Journal

Buying real estate in Mexico, or enjoying the beneficiary rights through a real estate trust, known in Mexico as fideicomiso, involves a considerable amount of money and effort. One must take into account that this legal transaction is executed in Mexico in accordance with Mexican law-a foreign legal system belonging to the civil legal tradition, contrasted by the U.S. legal system derivative of the common law tradition-and recognize that Americans and U.S. legal entities are typically quite unfamiliar with Mexican law. This Article provides a complete overview of the process of acquiring real estate in Mexico by Americans and U.S. …

Confronting The Limits Of The First Amendment: A Proactive Approach For Media Defendants Facing Liability Abroad, Michelle A. Wyant May 2008

Confronting The Limits Of The First Amendment: A Proactive Approach For Media Defendants Facing Liability Abroad, Michelle A. Wyant

San Diego International Law Journal

This Article confronts the limits this issue imposes on the First Amendment in four parts. Part I described the potential for conflicting defamation laws and forum shopping to undermine the American media's speech protections in the context of the Internet and global publications and outlines the Article's overall method of analysis. Part II first orients these conflicting defamation laws with respect to their development from the common law. It then frames them in terms of the underlying structural and policy differences that have produced their substantive divergence. This frame provides the analytical perspective through which this Article examines the varying …

Teachers' Beliefs About The Factors That Support Successful Second Language Acquisition Of Elementary School Students, Joann M. Mcdonald Edd May 2008

Teachers' Beliefs About The Factors That Support Successful Second Language Acquisition Of Elementary School Students, Joann M. Mcdonald Edd

Dissertations

Second language acquisition has increased in importance in elementary schools throughout the United States due, in part, to the growing numbers of English Language Learners (ELLs) as well as an economic and social demand for native English speakers to learn world languages. The purpose of this study was to investigate elementary teachers' beliefs regarding the factors that contribute to successfully learning a second language, whether students are ELLs learning English as a new language or English speakers learning a new language. More specifically, this study compared the opinions of elementary teachers of successful ELLs with teachers of English speakers successfully …

An Ethnography Study Of Hiv Positive Midlife Black Women, Charlotte Stoudmire Phd May 2008

An Ethnography Study Of Hiv Positive Midlife Black Women, Charlotte Stoudmire Phd

Dissertations

Black women, ages 45 and older, are disproportionately affected by the HIV/AIDS epidemic. In 2001, Black women comprised 11% of all older women in the United States; however, they accounted for more than 50% of AIDS cases and more than 65% of HIV cases (Winningham et al., 2004). The literature review reflected little research specifically looking at the reason(s) for the increase in HIV in Black women, ages 45 to 60. Furthermore, few research studies focused on HIV patient health beliefs and their experiences in living with HIV. This study was conducted with an ethnography research method coupled with the …

The Paradox Of Majority Underrepresentation In Special Education In India: Constructions Of Difference In A Developing Country, Maya Kalyanpur Phd Feb 2008

The Paradox Of Majority Underrepresentation In Special Education In India: Constructions Of Difference In A Developing Country, Maya Kalyanpur Phd

School of Leadership and Education Sciences: Faculty Scholarship

In contrast to the phenomenon of minority overrepresentation in special education in developed countries such as the United States, a paradoxical situation occurs in many developing countries, whereby majority populations are underrepresented in the educational system. The author examines some of the prevailing and traditional societal and political-economic factors specific to India that contribute to this underrepresentation, such as a paucity of resources that affects children from low socioeconomic backgrounds, gender differences in child rearing and educational expectations that affect girls, and negative attitudes toward disability.
