ABSTRACT

Myanmar, previously known as Burma, generates a significant yearly refugee exodus stemming from ongoing ethnic conflicts, political instability, human rights violations, and the targeted persecution of Christian minority groups. Individuals seek shelter and improved opportunities in other nations. From 2011 to 2023, for example, Burmese refugees represented the largest group among U.S. refugee arrivals, accounting for 18 per cent.

Presently, there is a lack of knowledge about what the Burmese-Catholic youth refugees experiences during their integration journey into the US society. This qualitative study aimed to shed light on how the larger socio-cultural and religious environment intersects with Burmese-Catholic …

My research aimed to enhance learning outcomes for the coaches participating in a peer coaching internship program. The research question was: how can I work and engage peer coach alumni to better support the professional development of future peer coaches? I incorporated the perspectives of alumni coaches to identify key areas for improvement to support the professional development of future peer coaches. I conducted three cycles: alumni reflections, workshops, and a roundtable resume discussion. The purpose of my research was to explore how integrating students as partners in professional development enhances student leader training. The study addressed gaps in student participation in training session planning, guided by two research questions: How can integrating students as partners in student leader professional development initiatives contribute to training success? And, what insights can be gained from including undergraduate student leaders in curriculum development for professional training? Research cycles included a survey, workshops, and reflective journaling. To be Indigenous is to be la luz del mundo, to stand in your light and spread your sunrays, no matter winds or clouds of colonization that strive to dim you. This qualitative study explored ways Indigenous Latine families negotiate a sense of place within onto-epistemological realities and their home culture of learning and Western education. This research is desire-based (Eve Tuck, 2009), creating our own project of modernity, grounded in one Indigenous family’s experience within their Andean community. The rapid expansion of policy-mandated ethnic studies (ES) in U.S. schools suggests the need to reconceptualize the field of ES for the school curriculum. This exploratory case study sought to contribute to a better understanding of the ways in which secondary ES curricula can be negotiated and made by teachers and their collaborators, illuminating its future possibilities in public schools. The research explored how teachers, academics, and ES graduate students collaborated in a Collective to use and relate various knowledge resources, including local oral histories, to develop community-focused ES curricular guidance. During the fifteenth through seventeenth centuries in Italy - more commonly known as the Italian Renaissance and early Baroque periods - masters like Titian, Leonardo da Vinci, Michelangelo, and Caravaggio made a name for themselves and secured legacies through the widespread popularity and study of their masterpieces. We Were All Originalists . . . For A Minute: Has The Supreme Court Abandoned The Search For Original Public Meaning? Should It?, Steven Semeraro

Predicting the Supreme Court’s next turn is tricky business. The two obstruction-of-justice cases considered here may turn out to be what used to be called “sports,” i.e., cases where the Court used a mode of analysis that it abandons in future cases without explanation. Perhaps, though, these cases hold the promise of a new, more open frontier of judicial interpretation in the service of our self-governing spirit. One in which courts and the parties to litigation cooperatively seek to advance legislative purposes to better our society.

A potential legal watershed formed in May 2024, as the Drug Enforcement Administration (DEA) proposed rescheduling cannabis. However, these efforts will likely prove insufficient to address the current and ongoing exclusion of those in the cannabis industry from accessing mortgage lending or participating in government-backed home loan programs (GHLPs), without which those in the industry are effectively denied the opportunity of homeownership. To promote the full inclusion of the cannabis industry in mortgage lending while preserving financial stability, a balancing adjustment must be made to the current mortgage regulation calculus.

This dissertation explores the lived experiences of disabled students in inclusive classrooms, with a focus on those participating in extensive support needs (ESN) programs. Intentionally inclusive of students who communicate through diverse methods, including augmentative and alternative communication devices, picture exchange communication systems, American Sign Language, and other nonspoken forms, this phenomenological case study centers the perspectives of students in one middle school’s ESN program through mobile interviews and reflective document analysis. Student perspectives are triangulated through surveys reflecting the perspectives of parents, guardians, and school staff. In America’s ongoing discussions regarding religious liberty, situations such as the conflict over New York’s yeshivas demonstrate how grave the stakes can be. Meyer and Pierce advanced the freedom of parents to educate children according to their faith and traditions, but as they relied on substantive due process, they do not offer a firm foundation upon which to build a legal case defending parents who want to enroll their children in yeshivas or similar faith-based schools. Fortunately, recent developments in First Amendment jurisprudence offer a much firmer foundation.

The modern interest in the twin cases of Meyer v. Nebraska, and Pierce v. Society of Sisters has sparked a renewed curiosity in the intellectual foundations and current applicability of those two cases. In this instance, I stress less the constitutional underpinnings of the cases in order to focus more on their natural law approach to the parent-child relationship. Based on Lockean principles, I conclude that the standard rules of abuse and neglect offer the sole justification for such intervention, where the state is put to a high standard of proof for intervention. The Education Trilogy cases were important milestones in American constitutional history. They protected private schools, religious and otherwise, from the threat of closure in many states. This preserved educational freedom for parents who preferred private education for their children. As a constitutional matter, the Trilogy became the foundation of a due process jurisprudence that moved beyond liberty of contract, property rights, and police power considerations to a broader protection of fundamental rights.

This essay, written for a conference marking the centennial of the Supreme Court’s decisions in Meyer v. Nebraska (1923) and Pierce v. Society of Sisters (1925), suggests that both the ongoing importance and the frustrating elusiveness of these decisions reflect the fact that questions of the formation of persons– as contrasted with matters of the expression or manifestation of personhood– are of crucial importance in the protection of liberty and yet are difficult to grasp and address within constitutional and liberal premises. Pierce v. Society of Sisters and Meyer v. Nebraska were cases about parental rights in general, and parental choice in particular. Both centered on a challenge to a state’s legal effort to reduce or eliminate the educational choices available to parents—in the former, by requiring students to attend public schools, in the latter, by requiring instruction in all schools, public and private, be conducted in English. This paper was prepared for a Symposium, held in March 2024, marking the centennial of the Supreme Court’s decisions in Meyer v. Nebraska (1923) and Pierce v. Society of Sisters (1925). At their inception, Meyer and Pierce reflected constitutional principles of economic freedom and parental control of their children’s education. In 1923 and 1925, respectively, the U.S. Supreme Court rulings in Meyer v. Nebraska and Pierce v. Society of Sisters established limits on the ability of government to constrain what children’s education contains and where it occurs. For a century, the U.S. Supreme Court has provided substantive protection, through the Due Process Clause of the Fourteenth Amendment, to a parent’s liberty interest in directing the education and upbringing of her children. The seminal cases for this protection—Meyer v. Nebraska and Pierce v.
