A New Jurisprudence Of Constitutional Duty: Moving Beyond Deshaney Through The Nmcra, Levi A. Monagle, Aaron E. Whiteley

The United States Supreme Court’s holding in the seminal case of DeShaney v. Winnebago County Department of Social Services has long foreclosed the viability of a wide array of failure-to-protect claims under the Due Process Clause of the Fourteenth Amendment to the United States Constitution. The linchpin of DeShaney is a “constitutional duty” analysis that is implicated only in select circumstances and serves as a threshold inquiry and a gatekeeping device. With the New Mexico Supreme Court’s articulation of a foreseeability-free duty analysis in Rodriguez v. Del Sol Shopping Center in 2014, and the Legislature’s passage of the New Mexico …

All Cases Great And Small: Fufilling The Nmcra's Promise Of Attorney Fees, Isaac M. Green, Seth E. Montgomery

Section 5 of the New Mexico Civil Rights Act (NMCRA) permits a court to award “reasonable” attorney fees to a “prevailing plaintiff.” In this way Section 5 parallels its federal analog, 42 U.S.C. § 1988, which similarly allows a “prevailing party” to recover “reasonable” attorney fees in federal civil rights suits. But despite this language in the federal statute, a string of U.S. Supreme Court decisions have circumscribed the availability of attorney fees in suits brought under § 1983. High energy density, low-cost chemical conversion batteries are widely studied for their potential application to applications in which current battery technologies are unsuitable replacements for fossil fuel-powered systems. The demonstration of rechargeable chemical conversion batteries, and particularly batteries without the fatal flaw of high overpotential due to the difficulties inherent to chemical conversion reactions, is of great interest to further both this aim. In this work, a secondary Al-CO2 battery was demonstrated using a homogeneous aluminum iodide redox mediator to enable the battery’s discharge and charge at a high energy density and a low overpotential of 0.05 Volts. The 3-space, 1-time dimensional scalar wave equation, or 3+1 wave equation, describes the propagation of scalar or acoustic waves. The unforced homogeneous equation admits a class of outgoing solutions relative to a chosen fixed center, so called “multipole” solutions. This thesis examines near-to-far signal propagation in the context of these multipole solutions. Given a time-series (history of values) for a multipole solution recorded at a radius r1, near- to-far signal propagation recovers the corresponding time-series at larger radius r2 ≫ r1. This propagation takes into account both the appropriate time delay r2 − r1 and corrections to the wave shape. …

Bioremediation capability should be developed along with biofuel technology to mitigate the potential damage of future spills. Biobutanol is being developed since n-butanol is more energy dense and less volatile than ethanol. A bottleneck for industrial production of biobutanol is its toxicity; most microbes cannot survive ~1.5% v/v. Thus, microbial bioremediation of n-butanol would need microbes that can both tolerate and metabolize butanol. We used ecological and evolutionary biology approaches to find bacteria that could tolerate and metabolize butanol. Ecological community-level assays followed by 16S amplicon sequencing were completed to identify butanol-tolerant artificial bacterial communities. Secondly, we looked for bacteria …

This thesis presents a comparative analysis of language dynamics in two distinct contexts: the Tres Fronteras region, where Spanish and Portuguese intersect, and Cauca, Colombia, where Namtrik and Spanish coexist. Through qualitative research methods including interviews and ethnographic observations, the study examines the roles of these languages in shaping social interactions, cultural identities, and community dynamics.

By exploring language use patterns, attitudes, and policies in these regions, the thesis seeks to uncover similarities and differences in the ways Spanish, Portuguese, and Namtrik influence individuals' sense of belonging and cultural expression. The Enzymatic Regulation Of Contraction-Induced Toll-Like Receptor 4 Shedding From C2c12 Myotubes, Rebekah C. Gridley

Health, Exercise, and Sports Sciences ETDs

Stimulated contractions are shown to increase toll-like receptor 4 (TLR4) release from C2C12 myotubes in vitro. The purpose of this study was to determine if the release of TLR4 from myotubes is controlled by proteolytic membrane cleavage. A broad-spectrum metalloprotease inhibitor was used to test this hypothesis in a C2C12 cell culture model, and TLR4 concentrations in the cell culture supernatant were measured via enzyme-linked immunosorbent assay (ELISA) following stimulated myotube contractions.

ELISA analysis revealed TLR4 concentrations below the sensitivity threshold of the ELISA kit for all experimental conditions. In confirming the effectiveness of the electrical pulse stimulation (EPS) treatment, …

The International Atomic Energy Agency has acknowledged the need to “efficiently verify and maintain knowledge of spent fuel in shielding/storage/transport containers at all points in their life cycle”. Cosmic-ray muon scattering tomography has shown potential to create reconstruction images of dry cask contents that would be useful for in-situ verification of spent fuel within dry casks.

Between 2009 and 2022 in the United States (U.S.), pedestrian fatalities increased 82.3% and bicyclist fatalities increased 70.8%. Several studies have researched crash characteristics such as the people and roadways involved in these crashes. Dental plaque biofilm remaining on oral structures causes disease processes such as gingivitis, periodontitis, and dental caries. This study's purpose was to determine which sequence of dental biofilm removal is more effective, toothbrushing followed by flossing or flossing followed by toothbrushing. The study was conducted using an experimental approach with a split mouth design. A pre and post plaque index score was determined for each participant using Ramfjord’s tooth assignment and all data was recorded on a plaque control data sheet. Diatom assemblage reconstruction from the Valles Caldera sediment core (VC-3) was utilized to infer climatic and aquatic changes during a 50-thousand-year [ka] period in the Mid-Pleistocene (435-385 ka). This 50 ka interval spans most of Marine Isotope Stage 11 (MIS 11) – one of the most prominent interglacials of the past 500 ka – and is widely considered an analog for the Holocene and future climate regimes. Nearly all records from MIS 11 are either marine or ice-core based, making VC-3 unique among lacustrine sediment records as it captures insolation variations and climatic changes during the mid-Pleistocene. Rural schools struggle to recruit and sustain quality educational leaders and systems that contribute to student success. Rural Native American schools pose more of a challenge because of the unique cultures that play a role in sustaining leaders in their communities. I explored the reasons for high principal turnover in rural Native American serving schools. I conducted a qualitative study using semi-structured interviews to collect narratives related to turnover from eight current, former, and retired principals. ABSTRACT

Purpose: The purpose of this study was to assess the oral health education and dental care access of families of children with Down syndrome in New Mexico.

Methods: The data were gathered from a survey available to members of the Rio Grande Down Syndrome Network for 14 days containing 13 questions.

Results: The most reported age range for the individuals in care were 0-14 years at 41.6%. Most individuals with Down syndrome receive dental services every six months (62.5%) at a regular dental office (54.2%). Caregivers reported the individuals are taking 1-2 prescription medications (54.2%) and not aware of …

All-atom molecular dynamics (MD) simulations are essential for examining the structural and dynamic aspects of proteins at high resolution, complementing experiments limited by resolution, size, and complexity. Advancements in algorithms and hardware have enhanced the role of computational tools in scientific research, allowing for more accurate simulations of proteins with standard residues. However, simulating real biological systems, which include non-standard residues such as lipid membranes, remains challenging despite the assistance of tools like CHARMM-GUI. In enhanced geothermal systems, the efficient transfer of heat from the formation to the fluid circulating through the fracture network can be compromised when thermal short-circuiting occurs due to preferential flow through highly conductive fractures. This study introduces a pioneering approach using newly developed phenol polymer nanocomposites as an engineering solution to address the challenges associated with preferential flow in geothermal wells, which can lead to thermal short-circuiting. Multiple phenol polymer nanocomposites were formulated, incorporating aluminum oxide, COOH-functionalized graphitized multi-walled carbon nanotubes (MWCNTs), and graphene nanoparticles, each with a 0.5 wt.% polymer dosage.
