Saving Stare Decisis: Preclusion, Precedent, And Procedural Due Process, Max J. Minzner Jan 2010

Saving Stare Decisis: Preclusion, Precedent, And Procedural Due Process, Max J. Minzner

Faculty Scholarship

Judgments do not bind nonparties. This core due process constraint on issue preclusion means that courts can only adjudicate questions of fact and law with respect to those individuals appearing in court. However, the operation of stare decisis routinely extinguishes the rights of nonparties without notice or an opportunity to be heard. This Article examines the due process challenge to the operation of precedent. The traditional justifications for applying a due process analysis only to preclusion and not to precedent are inadequate. Instead of excepting stare decisis from the operation of procedural due process, we should see it as meeting …

The Prevalence Of Osteoarthritis In Wild Vs Captive Great Ape Skeletons, Demelza J. Poe Dec 2009

The Prevalence Of Osteoarthritis In Wild Vs Captive Great Ape Skeletons, Demelza J. Poe

Anthropology ETDs

This research examined whether the prevalence and skeletal distribution of osteoarthritis (OA) differed between wild and captive great ape skeletons. A secondary, but important, aspect of this research focused on the development of improved aging techniques based on methods commonly used on human osteological samples. Tests were conducted pertaining to the effect that wild versus captive status, sex, and species has on vertebral body lipping, marginal lipping, and eburnation. Age was considered a co-factor. Of the aging methods examined, use of the basilar suture to distinguish between adult and old adult specimens proved to be very imprecise. The ribs and …

Inland Island Change: Lter Network Synthesis Prospectus, Long Term Ecological Research Network Dec 2009

Inland Island Change: Lter Network Synthesis Prospectus, Long Term Ecological Research Network

Long Term Ecological Research Network

Climate change will profoundly affect socio-ecological systems, particularly those built around terrestrial ecosystems where climate is a major driver of ecological processes and ecosystem services. While socio-ecological systems will vary in their responses to climate change, the relative sensitivities of different systems, and the mechanistic basis and consequences of these differential sensitivities, are largely unknown. At present, our ability to predict social and ecological consequences of potential climate changes in different systems is constrained by a lack of fundamental data derived from common conceptual frameworks and approaches. The LTER network is uniquely positioned to meet this critical need with a …

What Do Healthcare Providers Think Of Patients Who Use The Internet?: An Exploratory Study, Matt Willis Dec 2009

What Do Healthcare Providers Think Of Patients Who Use The Internet?: An Exploratory Study, Matt Willis

Communication ETDs

The Internet is a technology that is influencing multiple human factors (i.e. cognitive and social). Adults who seek information on the Internet about their health conditions are becoming more common. Providers have been wary of patient information searches, fearing that, at worst, conflicting information may provoke confrontation and doubt and, at best, the information is trivial or already well known to the provider. For this exploratory study a survey was conducted that investigates trends in healthcare provider information technology use and information seeking opinions. This survey was followed by a highly structured interview of n=21 providers. The researcher shows two …

Faculty Scholarship

This article presents a critical analysis of press coverage of Latinos and the presidential election during the Democratic Primary, from January through June 2008. The foundation of this article is a content analysis of 408 articles published in four newspapers about Latinos and the presidential election during the primary season. Consumer Willingness To Pay For Water Conservation In The Framework Of Renewable Energy Projects, Amber Riter Aug 2009

Consumer Willingness To Pay For Water Conservation In The Framework Of Renewable Energy Projects, Amber Riter

Economics ETDs

This research focuses on consumer valuation of the benefits associated with renewable electricity generation, specifically for water conservation. Previous contingent valuation studies in this area conclude that consumers are willing to pay for these benefits, but do not explicitly consider the environmental benefit of water conservation. The impact of this benefit is tested for a unique sample of New Mexican consumers by performing a split-sample study with a treatment variation in the benefit related information given to the respondent. The study is performed using the Internet survey mode for a sample population of 2000 University and University Hospital Staff. A …

Effects Of Socialization During The Elementary Student Teaching Practicum On Pre-Service Teachers' Application Of Theories And Practices Learned In The Professional Teacher Education Program, Glenn Hushman Aug 2009

Effects Of Socialization During The Elementary Student Teaching Practicum On Pre-Service Teachers' Application Of Theories And Practices Learned In The Professional Teacher Education Program, Glenn Hushman

Health, Exercise, and Sports Sciences ETDs

Socialization is the process of gathering knowledge and constructing it in a social context. This gathering of knowledge is often acquired formally through an educational process or informally by interaction with other people (Capel, 2007). A physical education teacher goes through a socialization process where beliefs, attitudes, behaviors, and teaching philosophies are influenced. The purpose of this study was to examine how pre-service teachers application of theory and practice learned during the professional teacher education program (PETE) was influenced by aspects of socialization while immersed in the student teaching practicum. Data were collected using a variety of qualitative techniques and …
