The Relationship Between Adverse Childhood Experiences And Risky Health Behaviors: Avenues For Prevention In New Mexico, Arianna Trott

This study was designed to assess if adverse childhood experiences (ACES) predict risky health behaviors in New Mexico. The purpose was to determine if any factors support improved outcomes for people who have experienced ACES in New Mexico. Lastly, the study aimed to identify if urban-rural status impacted outcomes of risky health behaviors related to ACES. This study used data from the 2019 New Mexico Community Survey across twelve counties (N = 853). Multiple logistic regression and hierarchical linear modeling were used to analyze the data. Chronic criminal legal system (CLS) involvement among individuals with serious mental illness (SMI) is of growing concern. Mental health courts (MHCs) are a known diversion strategy currently used by the CLS to address this problem. MHCs are seen as an effective method for linking individuals with SMI to needed treatment, removing them from a detention setting, and subsequently reducing recidivism. The Intergovernmental Panel on Climate Change—the UN’s expert science panel—has repeatedly found that limiting climate change to prevent catastrophic harms will require at least some use of carbon capture and sequestration (CCS), and may entail substantial deployments of this technology. There is significant uncertainty, however, about the level of lifecycle greenhouse gas (GHG) reductions achievable in practice from varying CCS applications; some applications could even lead to net increases in emissions. This research analyzed changes in motor vehicle volumes and motor vehicle speeds after the installation of an intersection mural in Albuquerque, NM and changes in crash frequency after mural installations in Philadelphia, PA. Data was collected manually on site for the Albuquerque study and secondary data – including installation dates and physical characteristics – were used for the Philadelphia crash analyses. Statistics were computed to determine trends in motor vehicle speeds and volumes relative to the Albuquerque mural installation. Psychosocial And Neuroprediction Of Criminal Recidivism In A Sample Of Adult Female Offenders, Bethany G. Edwards

Recidivism is costly and damaging to society. Despite the narrowing gender gap in the criminal justice system, research on female recidivism falls behind that in males. Biopsychosocial theories suggest a combination of psychosocial and neurobiological factors likely promotes criminal risk in females. This study examined the utility of various risk factors in predicting recidivism in female offenders (n = 298). Results highlight specific psychosocial risk factors (i.e., impulsive/antisocial psychopathic traits, incarceration history, substance use, education, and age) that were especially helpful in identifying females at elevated risk. After first providing brief biographies of the justices and their personal relationship, the article examines two subject matter areas where their differing views were most fully developed and made a significant contribution to the development of the law:

  • First, the restructuring of the law of negligence with an emphasis on the creation and nature of a duty of care; and
  • Second, the legal principles governing the jurisdiction of the New Mexico appellate courts and the resulting tension between legislative and judicial authority over provisions governing access to the appellate courts.

Adult guardianship is used as a method to restrict the decisionmaking rights of some individuals with intellectual or developmental disabilities who have been deemed “incompetent.” However, the use of guardianship to remove someone’s decisionmaking rights violates the equal protection rights granted by the New Mexico Constitution. Discrimination against people with developmental disabilities must be substantially related to an important governmental interest, and the current state of guardianship fails to meet that bar. Further, guardianship violates the state constitutional guarantee of due process because it infringes on the fundamental right to the least restrictive means of care. New Mexico must adopt …

The APS (Albuquerque Public Schools) Vision Zero for Youth Initiative adopts the global Vision Zero traffic safety movement’s goal of eliminating traffic fatalities and injuries to pedestrians and cyclists from vehicular crashes. The APS Vision Zero for Youth Initiative is comprised of a traffic-safety curriculum for K-8 students, an action plan that sets traffic-safety goals and progress evaluation frameworks for the school district, and a campaign to build a new culture of traffic safety for students, families, and local communities.

The Navajo Nation, the Ute Mountain Ute Tribe, the Southern Ute Tribe, the Crow Nation, and the Cheyenne River Sioux Tribe submit this amicus brief in support of Respondent Castro-Huerta.1 The signatory tribes do so to contest the State of Oklahoma’s argument that states have inherent criminal jurisdiction over crimes committed by non-Indians against Indians in Indian Country. This Article comprehensively reviews the law of stated culpability requirements in Model Penal Code (MPC) jurisdictions. Part I provides an overview of section 2.02(4), explaining how the provision works and its role in the MPC’s culpability scheme. Part II then identifies section 2.02(4)’s main weaknesses, drawing on both the provision itself and the Code’s commentary. Next, Part III reviews the law in the twenty-five states with culpability provisions influenced by the MPC, identifying specific problems that section 2.02(4) has created in the case law. This essay interrogates the regulation of routine venting and flaring of natural gas as a source of prohibited “waste,” using New Mexico’s recently adopted Waste Rule as an example. It begins with a survey of both the environmental and economic benefits to be achieved by limiting or eliminating venting and flaring and the direct and indirect costs of doing so, including the forgone opportunity to produce crude oil. The Paris Agreement’s goal to hold warming to 1.5°-2°C above pre-industrial levels now appears unrealistic. Profs. Robin Kundis Craig and J.B. Ruhl have recently argued that because a 4°C world may be likely, we must recognize the disruptive consequences of such a world and respond by reimagining governance structures to meet the challenges of adapting to it. Design and Planning Assistance Center - Projects

DPAC was contracted by the City of Santa Fe to facilitate public engagement to inform the master plan and redevelopment of Santa Fe Midtown. We worked with Midtown Engagement Partners (MEPs), the City of Santa Fe, local design teams, and the Strategic Economics/Opticos team, among others, on a distributed model of public engagement, combining diverse methods to gather input from the public. Together, we organized listening and planning sessions, site visits, a block party and posolada, online conversations, and interactive planning exercises. This work revealed a common vision for belonging, culture, equitable development, and environmental and community health.

In United States v. Cooley, a Ninth Circuit panel denied a petition for rehearing en banc, holding that a tribal officer, who was not cross-deputized, could neither search nor detain a non-Indian on a federal or state highway right-of-way through the reservation unless that individual had committed an “apparent” crime in the officer’s presence. Narrowly defining tribal police authority, the panel ruled that the officer conducted an extra-jurisdictional search and seizure. Affirmed Or Delegated? Finding Inherent Tribal Civil Power To Issue Protection Orders Against All Persons In Light Of Spurr V. Pope, Kelly Gaines Stoner, Cherokee Ancestry, Lauren Van Schilfgaarde, Cochiti Pueblo

Federal courts have wreaked havoc on tribal jurisdiction by injecting incertitude over their most basic authority, including the authority to issue and enforce civil protection orders. This jurisdictional incertitude causes not just legal disruption, but also further compromises the safety of Native people who are disproportionately victimized, especially by gender-based forms of violence. While Congress has been slow to remedy the onslaught of judicial limitations on tribal jurisdiction, Congress has at least remedied tribal authority to issue and enforce protection orders in 18 U.S.C. § 2265(e). However, even in this remedy, jurisdictional incertitude remains.

A fundamental policy choice in economic development among local policy makers is the appropriate mix of “outside” strategies that use incentives to attract companies, and “inside” strategies that invest in smaller and local businesses. Using a mixed-methods research design, including national and state surveys along with qualitative analysis of interviews conducted with policy elites, I examine the role of ideology, elites, community, competition, social capital (trust and influence), and electoral politics in these policy decisions. The law of servitudes has changed dramatically in the last hundred years. Legal scholars have been successful in documenting these changes in case law, but less successful in articulating a unified set of principles that guide the current law of servitudes. One explanation that received significant attention is the idea that efficient recording systems in the United States have liberated property owners from the constraints of traditional property laws disfavoring servitudes and have allowed these owners the broader freedoms of contract law. Collectively, the epidemic increases in the United States of opioid-related deaths and suicides during the first two decades of the 21st century have exposed shortcomings in current forensic and epidemiological approaches for determining and codifying manner of death-a vital function fulfilled by medical examiners, coroners and nosologists-the foundation for the National Violent Death Reporting System (NVDRS), an incident-based surveillance system providing individual-level information on decedent characteristics, manner, cause and circumstances of suicide, homicide and other violent injury deaths.
