Developing A Measure Of Ambivalence About Drinking Less Alcohol: Psychometric Properties And Construct Validity, Samara Lloyd Rice
Developing A Measure Of Ambivalence About Drinking Less Alcohol: Psychometric Properties And Construct Validity, Samara Lloyd Rice
Psychology ETDs
The resolution of ambivalence is an appealing explanation of how at-risk drinkers make changes in their alcohol consumption; however, limited research about this potential mechanism of change exists due to the lack of a specific measure of ambivalence about drinking less alcohol. An initial item pool measuring ambivalence was assessed in two different samples of at-risk drinkers, undergraduate college students participating in the study for research participation credit (N1 = 129) and participants recruited from online sources (N2 = 128) using an online web survey. Three different methods of measuring ambivalence were tested: a double-barreled items method, a difference score …
Considering A Voice Of The Body For Adult Transformative Learning Theory, Elizabeth Boleyn
Considering A Voice Of The Body For Adult Transformative Learning Theory, Elizabeth Boleyn
Organization, Information and Learning Sciences ETDs
Unknowingly, much of the population of the Western World are thinking machines who live and learn isolated from somatic experiences. They distrust their bodies in the learning process and are stuck living out unquestioned realities of embodied socioculturalism and rationalism which guide decision making, learning and ways of being. Considering a voice of the body involved delving into the physical dimension of somatic transformative learning from the bodily-lived experiences of seven women who were in a first-level experiential Nia® dancing and movement training program. Together, these women offered a voice of the body offering that phases of transformative learning was …
Parallel Independent Component Analysis With Reference For Imaging Genetics: A Semi-Blind Multivariate Approach, Jiayu Chen
Electrical and Computer Engineering ETDs
Imaging genetics is an emerging field dedicated to the study of genetic underpinnings of brain structure and function. Over the last decade, brain imaging techniques such as magnetic resonance imaging (MRI) have been increasingly applied to measure morphometry, task-based function and connectivity in living brains. Meanwhile, high-throughput genotyping employing genome-wide techniques has made it feasible to sample the entire genome of a substantial number of individuals. While there is growing interest in image-wide and genome-wide approaches which allow unbiased searches over a large range of variants, one of the most challenging problems is the correction for the huge number of …

Factors Contributing To Weight Gain In Children Who Take Atypical Antipsychotics, Martha Faulkner
Nursing ETDs
Children and adolescents with serious emotional disturbance (SED) who take atypical antipsychotics (AAs) gain significant amounts of weight. The purpose of this retrospective chart review study was to determine if type of AA, diagnosis, ethnicity/race, age, gender or months in treatment contribute to BMI z change score (weight gain). The sample was 110 children with SED who took AAs for 1-36 months, M age=10.5 years (SD=3.4, range 5-17), 67% male, 53% Hispanic or Latino. The average weight gain in the study was 22 pounds (0.33 BMI z change score). The percent of children classifed as overwieght or obese increased from …

A Narrative Study Of The Lived Experiences Of Family Caregivers Through Different Stages Of Mental Illness, Reshma Kamal
Individual, Family, and Community Education ETDs
This narrative study examines life histories of family caregivers caring for a mentally ill relative dealing with either schizophrenia or bipolar disorder through different stages of the mental illness. Its goal was to enhance understanding of the lived experiences of the families in question during three different stages of the mental illness which centered on mental illness as the life- course stage (Denzin, 1989). A narrative analysis of the life histories of the main caregivers through three different stages of the mental illness was conducted. They were life before, during, and after the onset of the mental illness. Family Systems …

Quiet On The Set!: Writing Socially In An Elementary After-School Video Club, Charles Jurich
Language, Literacy, and Sociocultural Studies ETDs
The research presented is a qualitative case study of an after-school video club for elementary age students. The focus of the project revolved around one main question: how do students socially read and write videos? The broader goal of the question was to understand how students socially read and write multimodal texts with video as a subset. The study was approached from sociocultural approach to literacy that recognizes videomaking as a new literacies practice. As a literacy practice, videomaking incorporates multiple authors, multiple communicative modes (visual, spatial, aural, gestural, and linguistic), and involves complex and dynamic social interactions between both …

Mystics, Radicals, Sinners, And Saints: Freedom, Rebirth, And The American West, Brian King
History ETDs
This dissertation explores the lives of John Muir, the Taos Society of Artists, Mabel Dodge Luhan, Everett Ruess, Edith Warner, and the Taos hippies who journeyed to the American West in search of freedom. In the Western setting, with its diverse yet distinctive and stunning terrain, these individuals felt that their mind or soul—not just their physical body—had been liberated. They felt reborn. In the grand Sierras, John Muir discovered that physical and spiritual freedoms were intertwined. The Taos Society of Artists and Mabel Dodge Luhan found their connection with the natural world in northern New Mexico where three cultures …

Invention And Contention: Place, Identity And Memory Of The Spanish Past In The American Southwest, 1848-1940, Brian Luna Lucero
History ETDs
As the twentieth century unfolded, American writers, critics, and boosters presented a narrative of the arid Southwest as an exotic place blessed with a romantic history that could inspire, captivate and renew the many new white citizens flocking to rapidly growing cities. The history of Spanish colonialism in the area became a precious and exclusive cultural and economic resource. This dissertation tells the story of the commemoration of the Spanish past from 1848 to 1940 in three Spanish towns that grew into prominent American cities: Tucson, Arizona; Albuquerque, New Mexico; and San Antonio, Texas. In chapters centered on space, historic …

Think Like A (Mindful) Lawyer: Incorporating Mindfulness And Professional Identity Into The First-Year Curriculum, Nathalie Martin
Think Like A (Mindful) Lawyer: Incorporating Mindfulness And Professional Identity Into The First-Year Curriculum, Nathalie Martin
Faculty Scholarship
In this article, I add to the existing mindfulness literature by discussing other ways that law teachers might consider incorporating mindfulness and emotional intelligence into one or more of their classes. I also discuss the related idea of helping students develop a professional identity. Next, I focus on providing these tools in a first-year mandatory class and then attempt to provide a rationale, and a roadmap, for doing this. After explaining briefly what mindfulness and emotional intelligence are, I review literature from other disciplines on the benefits of mindfulness practice and emotional intelligence training. Next, I discuss how this training …
Interest Rate Caps, State Legislation, And Public Opinion: Does The Law Reflect The Public’S Desires?, Nathalie Martin
Interest Rate Caps, State Legislation, And Public Opinion: Does The Law Reflect The Public’S Desires?, Nathalie Martin
Faculty Scholarship
Because New Mexico has one of the highest consumer usage rates and highest concentrations of payday and title loan shops in the nation,2 we thought it would be an ideal place to measure the public’s knowledge of and interest in these ubiquitous loans. We also measured knowledge of interest rate caps in the context of credit cards, as a point of comparison. Our data are consistent with that of previous studies showing that the general public overwhelmingly supports interest rate caps both in general and for certain types of loans. More uniquely, we also found that many consumers are unaware …
Mental Retardation And The Death Penalty: The Need For An International Standard Defining Mental Retardation, Allison Freedman
Mental Retardation And The Death Penalty: The Need For An International Standard Defining Mental Retardation, Allison Freedman
Faculty Scholarship
I. INTRODUCTION
Within the international community, there is a consensus against the imposition of the death penalty on individuals with mental retardation. The United States Supreme Court and several international human rights bodies have recognized that individuals with mental retardation should not be subject to the death penalty. Additionally, most countries maintain that individuals who are insane or mentally retarded are shielded from execution. However, reports of individuals with mental retardation who are facing the death penalty continue to surface.
One reason for this may be the lack of an international standard defining mental retardation. There is currently great variation …

University Libraries & Learning Sciences Faculty and Staff Publications
Learner support is the critical link in online education. A learner support system is comprised of human and non-human resources that contribute to the learning process of an online course and should be designed as an integral part of the course. For example, if the online course requires students to access library resources to complete a research paper, then, easy access to library resources must be provided as part of the learner support system for that course. Learner support for online learners will differ based on the context, learner characteristics such as needs, expectations, prior learning experiences, etc., and the …

Executive Mba Students’ Information Skills And Knowledge: Discovering The Difference Between Work And Academics, Todd Quinn, Lora Leligdon
University Libraries & Learning Sciences Faculty and Staff Publications
This study explores Executive MBA students’ information seeking skills and knowledge in academic and workplace environments in order to improve on library instruction. Our research consisted of a survey and 12 qualitative interviews, sampled from two University of New Mexico EMBA cohorts. The themes that emerged included: EMBA’s specific skills and knowledge of their own industry’s information, difficulty in finding new information, several barriers, and lack of transferability. By discussing adult learning theory and focusing on transferability, we can help students acknowledge and transfer their information skills and knowledge between academics and work.

Multi-Criteria Decision Making Based On Dsmt-Ahp, Jean Dezert, Jean Marc Tacnet, Mireille Batton-Hubert, Florentin Smarandache
Branch Mathematics and Statistics Faculty and Staff Publications
In this paper, we present an extension of the multicriteria decision making based on the Analytic Hierarchy Process (AHP) which incorporates uncertain knowledge matrices for generating basic belief assignments (bba’s). The combination of priority vectors corresponding to bba’s related to each (sub)- criterion is performed using the Proportional Conflict Redistribution rule no. 5 proposed in Dezert-Smarandache Theory (DSmT) of plausible and paradoxical reasoning. The method presented here, called DSmT-AHP, is illustrated on very simple examples.

Hall V. Florida: The Supreme Court's Guidance In Implementing Atkins, James W. Ellis
Faculty Scholarship
In Atkins v. Virginia, the U.S. Supreme Court concluded that criminal defendants with mental retardation could not be sentenced to death or be executed because such an execution would constitute cruel and unusual punishment and therefore was prohibited by the Eighth Amendment. A dozen years later, in Hall v. Florida, the Court has reiterated the constitutional holding of Atkins and has given the states guidance on its implementation. The Court held that Florida could not impose an arbitrary IQ score limitation on the right of capital defendants to seek relief under Atkins. While the holding in Hall was relatively narrow, …
Creating And Selling Films & Printed Documents: The Challenge Of The Joint Authorship And First Sale Doctrines, Sherri L. Burr
Creating And Selling Films & Printed Documents: The Challenge Of The Joint Authorship And First Sale Doctrines, Sherri L. Burr
Faculty Scholarship
The joint creation of intellectual property can arise in many forms, and legal issues may arise concerning joint authorship. The selling of intellectual property can also take different forms, which may invoke Copyright laws' first sale doctrine or licensing. This article takes a critical look at the copyright provisions governing joint authorship and first sales of work, in particular the influence of these doctrines on film and the printed word. Joint film products begin with idea treatments and screenplays that may be co-written with two or more authors, and include directors who oversee the making of the entire film, and …
Domestic Violence Torts, Righting A Civil Wrong, Camille Carey
Domestic Violence Torts, Righting A Civil Wrong, Camille Carey
Faculty Scholarship
Tort law, especially personal injury law, has become an integral aspect of American society. Domestic violence injuries – including physical injury, pain and suffering, and death – have been conspicuously absent from the development of tort law. The common law history of chastisement, coverture, and spousal immunity contributed to the current dearth of domestic violence tort claims. Today tort law offers a number of underused claims that can be used to address domestic violence harms. Victims can use existing common law causes of action – such as battery, assault, and intentional infliction of emotional distress – to sue their abusers …

Neutrosophic Principle Of Interconvertibility Matter-Energy Information, Florentin Smarandache, Stefan Vladutescu
Branch Mathematics and Statistics Faculty and Staff Publications
The research aims to reveal and prove the thesis of the neutral and convertibility relationship between constituent constructive elements of the universe: matter, energy and information. The approach perspective is a computationally-communicative neutrosophic one. We configure a coherent and cohesive ideation line. Matter, energy and information are fundamental elements of the world. Among them, there is an inextricable multiple, elastic and evolutionary connection. The elements are defined by the connections between them. Our hypothesis is that the relationship between matter, energy and information is a neutral one. This relationship is not required by the evidence. At this level, it does …

A Framework For Understanding Tribal Courts And The Application Of Fundamental Law: Through The Voices Of Scholars In The Field Of Tribal Justice, April L. Wilkinson, Kiowa Tribe Of Oklahoma
Tribal Law Journal
Through an examination of scholarly articles, this paper examines traditional tribal justice systems set in tribal communities in an effort to establish a framework for understanding tribal courts and the unique challenges they face. The research presented describes a spectrum of traditional aspects within tribal courts, and analyzes the impact that changing social dynamics have had on the tribal court construct. A rigorous review of available research concerning traditional tribal courts showed scholars repeatedly arguing that traditional law, also called fundamental law, which existed before Western style courts, exists beyond the tribal court setting and is fundamental to a tribal …

Any manifestation of life is a component of communication, it is crossed by a communication passage. People irrepressibly generate meanings. As structuring domain of meanings, communication is a place where meanings burst out volcanically. Manifestations of life are surrounded by a halo of communicational meanings. Human material and ideatic existence includes a great potential of communication in continuous extension. The human being crosses the path of or is at the intersection of different communicational thoroughfares. The life of human beings is a place of communication. Consequently, any cognitive or cogitative manifestation presents a route of communication. People consume their lives …

The study starts from evidence that several communication acts fail, but nobody is called to intervene and nobody thinks of intervening. Examining different branches (specialties) of the communication discipline and focusing on four possible practices, by comparison, differentiation, collating and corroboration, the current study brings arguments for a branch of the communication discipline that has as unique practical aim the communicational intervention, the practical, direct and strict application of communication research. Communication, as discipline, must create an instrument of intervention. The discipline which studies communication globally (General Communication Science) has developed a strong component of theoretical and practical research of …

Advancing The Grounded Study Of Religion And Society In Latin America, Richard L. Wood

In rediscovering the interpenetration of popular culture and politics in Latin America, and thus the ways these realms mutually constitute one another, scholars have also witnessed the analytic irruption of one particular cultural fi eld: religion. Close attention to grassroots political culture allows us to probe how peoples spiritual subjectivity and political subjectivity overlap and cross-fertilize one another. In the process, religion shapes political outcomes in ways often unintended. Two further analytic insights are discussed: First, analysis of lived religion must partially decenter religious institutions from the focus of analysis but also pay attention to how institutions shape spiritual and …
