Issues Of Statelessness In International Law; Two Cases: The Baltic States And Israel/Palestine, Margaret E. Keen
Issues Of Statelessness In International Law; Two Cases: The Baltic States And Israel/Palestine, Margaret E. Keen
Student Thesis Honors (1996-2008)
Law pertaining to statelessness in the modern international community has evolved from a non-issue prior to the Twentieth Century, when it first became a notable problem, to recognition that nationality is a fundamental human right. Currently, international law is attempting to assert an obligation on states prohibiting statelessness. In addition, a trend can be identified that may be leading ultimately to recognition of a right of an individual to a nationality based on his or her subjective priorities and self-identification. This paper will begin by reviewing the origin of the problem of statelessness and the history of the development of …

Civil Commitment Of Pregnant Women As A Means Of Protecting Fetuses From Maternal Drug And Alcohol Abuse, Dana S. Hardy
Civil Commitment Of Pregnant Women As A Means Of Protecting Fetuses From Maternal Drug And Alcohol Abuse, Dana S. Hardy
Student Thesis Honors (1996-2008)
During recent years, courts and legislatures have expanded the legal rights of fetuses, which historically were treated as part of the woman carrying them. This expansion of fetal rights has often resulted in conflict between the rights of the fetus and the rights of the woman carrying it. While concern for the health of fetuses is important to the health of our society, the maternal-fetal conflict is often unnecessary, as the health interests of fetuses could be more effectively promoted in ways that would not conflict with the interests of the mother. In this paper I will specifically address whether …
Turning Blood Into Whine--"Fear Of Aids" As A Cognizable Cause Of Action In New Mexico, Eric J. Knapp
Turning Blood Into Whine--"Fear Of Aids" As A Cognizable Cause Of Action In New Mexico, Eric J. Knapp
Student Thesis Honors (1996-2008)
Madrid v. Lincoln County Medical Center is the first New Mexico case to recognize a cause of action for the negligent infliction of emotional distress (NIED) arising from possible exposure to the virus that causes acquired immunodeficiency syndrome (AIDS). The court in Madrid held that recognition of emotional distress claims arising out of a negligently created fear of contracting the human immunodeficiency virus (HIV) through a medically sound channel of transmission does not require proof of actual exposure to the virus. In arriving at its decision, the Madrid court rejected the tort-recovery principles formulated in the "fear of future disease" …

Bioethics Policy: Looking Beyond The Power Of Sovereign Governments (Foreword), Robert L. Schwartz
Bioethics Policy: Looking Beyond The Power Of Sovereign Governments (Foreword), Robert L. Schwartz
Faculty Scholarship
Lawyers are trained to think in terms of power exercised by a sovereign-an institution authorized to enforce a procedurally appropriate decision with coercive force.' Generally, lawyers have a broad notion of what constitutes a sovereign. In the United States, for example, this notion includes the federal government, state governments, most tribal units, traditional territorial governments and their agencies-e.g., school boards, local public park districts, water run-off management districts, and flea abatement boards-and a host of other institutions. As a result, it is difficult for lawyers to recognize that policy also may emanate from other institutions that possess only persuasive authority, …
