Unicameral Bone Cyst Of The Pelvis In A 13-Yearold Boy Treated With Cannulated Screw Decompression After Open Curettage And Grafting: A Case Report, Reilly J. Kuehn, David H. Chafey
Unicameral Bone Cyst Of The Pelvis In A 13-Yearold Boy Treated With Cannulated Screw Decompression After Open Curettage And Grafting: A Case Report, Reilly J. Kuehn, David H. Chafey
UNM Orthopaedic Research Journal
Although studied for more than a century, the cause of unicameral bone cyst (UBC) remains uncertain. UBC of the pelvis in younger patients has been particularly problematic because its rarity often results in misdiagnosis and improper treatment. Surgical treatment has typically involved percutaneous or open curettage and bone grafting; however, some studies have described the use of a continuous decompression device to address high recurrence rates of the lesion. We present a 13-year-old male patient in whom, after two unsuccessful operations, open curettage and grafting and insertion of a cannulated screw led to resolution of pain caused by a large, …

Workup And Treatment Of Acute Peripheral Nerve Injuries: A Review, Scott D. Evans
Workup And Treatment Of Acute Peripheral Nerve Injuries: A Review, Scott D. Evans
UNM Orthopaedic Research Journal
Peripheral nerve injury (PNI) can be a devastating and life-changing condition, normally caused from traumatic and iatrogenic events. Proper treatment of PNI remains difficult, with less than half of surgical procedures resulting in good or excellent outcomes. Subsequently, physicians should be aware of important principles that can help with management of acute PNI. I reviewed studies on PNI involving anatomy and classification schemes; workup such as electrodiagnostic tests, imaging procedures, and surgical indications; and operative treatment options (including nerve repair and use of nerve grafts and conduits, and nerve, muscle, and tendon transfers). Although treatment of these injuries continues to …
Teaching Legal Frameworks, David Herring
Teaching Legal Frameworks, David Herring
Faculty Book Display Case
This book chapter describes the process of developing legal frameworks. Legal frameworks are a critical element in basic legal analysis. They set out the questions courts ask when addressing a particular issue. Law students need to learn the applicable framework before proceeding with any type of rigorous legal analysis. This chapter also discusses an approach to teaching law students the skill of constructing legal frameworks, providing three concrete examples in the areas of Civil Procedure and Constitutional Law.

Giving Credit Where Credit Is Due: What We Can Learn From The Banking And Credit Habits Of Undocumented Immigrants, Nathalie Martin
Giving Credit Where Credit Is Due: What We Can Learn From The Banking And Credit Habits Of Undocumented Immigrants, Nathalie Martin
Faculty Scholarship
Undocumented immigrants currently make up more than 5% of the U.S. labor force and 7% of school-age children. Numbering over eleven million, undocumented immigrants unquestionably comprise a significant segment of the population, yet most lack financial security and stability on multiple fronts. In addition to the everyday risk of deportation, many risk being taken advantage of on the basis of their immigration status, in both employment and debtor–creditor relationships. While some of these financial conditions are well chronicled, this Article describes the first empirical study of the debtor–creditor relationships of undocumented immigrants. Through live interviews of undocumented immigrants in New …

Let The Sun Shine In: Promoting Civic Engagement With Sunshine Week, Cindy Pierard, Josefine Smith, Caitlin Wells
University Libraries & Learning Sciences Faculty and Staff Publications
Sunshine Week is a national effort to promote the importance of open government and freedom of information. Although originally begun as a news media initiative, it has grown to include community groups, libraries, schools, governments, and others who are committed to civic engagement and access to information. For academic libraries, Sunshine Week offers opportunities for forge collaborations with campus and community partners, and to connect programming with broader student learning goals. This chapter makes the case for Sunshine Week as a mechanism for bringing together campus and community groups around issues of common concern, either as a standalone effort or …
Spatial Terrorism, Dawinder S. Sidhu
Spatial Terrorism, Dawinder S. Sidhu
Faculty Scholarship
Terrorism, under federal law, generally means an act of politically- or socially-motivated violence perpetrated against innocents. Terrorism within the meaning of federal law, in other words, exists only if a cognizable motive is uncovered. This definition also sees the United States as an undifferentiated landscape—by its own terms, it fails to take into account any geographic nuance in acts of mass violence. This Article suggests that spatial considerations are relevant in determining whether an act of mass violence constitutes an act of terrorism for purposes of federal law. It points to cities—which are characterized by a highly concentrated, fluid population, …
Moneyball Sentencing, Dawinder S. Sidhu
Moneyball Sentencing, Dawinder S. Sidhu
Faculty Scholarship
Sentencing is a backward- and forward-looking enterprise. That is, sen-tencing is informed by an individual’s past conduct as well as by the criminal jus-tice system’s prediction of the individual’s future criminal conduct. Increasingly, the criminal justice system is making these predictions on an actuarial basis, computing the individual’s risk of recidivism according to the rates of recidivism for people possessing the same group characteristics (e.g., race, sex, socio-economic status, education). The sentencing community is drawn to this statisti-cal technique because it purportedly distinguishes with greater accuracy the high-risk from the low-risk, and thereby allows for a more efficient allocation of …
A Sentencing Commission For The Administrative State?, Max J. Minzner
A Sentencing Commission For The Administrative State?, Max J. Minzner
Faculty Scholarship
Since the 1980s, oversight of punishment in the federal criminal system has been centralized. A single body, the Sentencing Commission, regulates criminal punishment through the Sentencing Guidelines. The Guidelines are designed to bring consistency and transparency to criminal punishment, but come with the inevitable cost of a loss of case-by-case judicial discretion. In contrast, punishment in the federal administrative state is almost completely decentralized. No single body oversees agency punishment practices. The administrative model makes the opposite choice of the criminal model. It favors individualized punishment determinations over the benefits of consistency and transparency. In this Essay, I consider the …
Beyond The Affordable Care Act's Premium Tax Credit: Ensuring Access To Safety Net Programs, Mary Leto Pareja
Beyond The Affordable Care Act's Premium Tax Credit: Ensuring Access To Safety Net Programs, Mary Leto Pareja
Faculty Scholarship
The United States took a gigantic step toward universal health care with the passage of the Affordable Care Act (ACA'). Under the ACA, nearly everyone is required to have coverage, and correspondingly, no one can be turned away. To ease the financial burden of the individual mandate, the ACA subsidizes coverage for lower-income people. The primary subsidy is a refundable tax credit called the Premium Tax Credit, first available in 2014. To claim the credit, a person must file a tax return--but not just any return. The ACA requires married individuals to file jointly. For many, this is problematic if …
Should Agencies Enforce?, Max J. Minzner
Should Agencies Enforce?, Max J. Minzner
Faculty Scholarship
This Article explores an important but understudied structural choice: the decision to vest enforcement authority in administrative agencies. Each year, agencies routinely bring enforcement actions producing billions of dollars in civil penalties and industry-reshaping consent decrees. Where do they get this power? Congress grants enforcement authority to administrative agencies because it believes that agency subject matter expertise will generate appropriate enforcement choices. Similarly, the Supreme Court has strongly deferred to agency enforcement because it sees it as intimately intertwined with other agency regulatory decisions. Scholars have also generally taken for granted that specialist agencies will be enforcement experts because they …

The Pediatric Orthopaedic Trauma Season: Does It Exist?, Ava A. Boswell, Seth B. Mccord, Cole L. Paffett, Anthony Kallur
UNM Orthopaedic Research Journal
Background: It remains unclear whether pediatric trauma, including fracture, occurs more frequently at a certain time of the year. We developed a database based on the University of New Mexico orthopaedics consult log (OCL) with the aim of determining whether pediatric fractures have a seasonal predilection.
Methods: The OCL for 2009 and 2010, representing a total of 2385 patient visits, was reviewed, and data on patients who were 17 years of age or younger who were treated for trauma were collected. The months and seasons of the year in which the trauma occurred were recorded.
Results: The OCL for 2009 …

Motion-Tracking Drill System Using A Haptic Device For Evaluating And Training Motor Skills Of Orthopaedic Resident Physicians Outside The Operating Room: A Pilot Study, Ashkan Pourkand, Christina Salas, Deana M. Mercer, David I. Grow
UNM Orthopaedic Research Journal
Background: Although experience within the operating room can help surgeons learn simple bone-drilling techniques, outside training may be better suited for complex procedures. We adapted a rotary handpiece with dual trigger and drilling attachments to a haptic device to train and evaluate motor skills of orthopaedic resident physicians outside of the operating room.
Methods: A total of 7 participants with varying levels of skill in orthopaedic surgery were asked to perform a task three times: drill a hole (at 45° from the normal angle) through both cortices of a synthetic diaphysis of a distal radius. Acceleration and acoustic data were …

Lipoma Of The Index Finger In A 64-Year-Old Man: A Case Report, Norfleet B. Thompson, Moheb S. Moneim
UNM Orthopaedic Research Journal
Lipomas are benign tumors composed of adipose tissue and typically encountered in middle-aged patients. Although the etiology remains unknown, this lesion can occur throughout the body. However, it is rarely seen in the finger. Typical treatment has often involved observation, but excision techniques have also reported successful outcomes. We describe a 64-year-old male patient who reported to our clinic with a painless soft-tissue mass in the index finger of his left hand, and we performed operative excision for treatment. The findings of physical examinations, radiographs, and magnetic resonance imaging tests had indicated the presence of lipoma, and results of pathological …
