A Park For Everyone: The National Park Service In Urban America, Sarah J. Morath

Cooperative Federalism In Biscayne National Park, Ryan B. Stoa Jan 2016

Cooperative Federalism In Biscayne National Park, Ryan B. Stoa

Natural Resources Journal

Biscayne National Park is the largest marine national park in the United States. It contains four distinct ecosystems, encompasses 173,000 acres (only five percent of which are land), and is located within densely populated Miami-Dade County. The bay has a rich history of natural resource utilization, but aggressive residential and industrial development schemes prompted Congress to create Biscayne National Monument in 1968, followed by the designation of Biscayne National Park in 1980. When the dust settled, Florida retained key management powers over the Park, including joint authority over fishery management. States and the federal government occasionally share responsibility for regulating …

Working Together To Combat Invasive Species Threats: Strategies For Facilitating Cooperation Between The National Park Service And States, Stephanie Showalter Otts, Catherine Janasie, Paula Cotter

Natural Resources Journal

Invasive species are a significant environmental and economic threat throughout the United States. Over 6,500 non-native species have been documented on national park lands. To adequately address invasive species issues, the National Park Service must work cooperatively with state governments to prevent the introduction and spread of non-native species. A variety of mechanisms, both formal and informal, are available to the National Park Service to cooperatively manage park ecosystems with their neighboring land management agencies. Coordination of programs can be achieved through simple informal working relationships between agency staff, incorporation of state laws into park policies, or negotiation of formal …

The National Park Service Organic Act And Climate Change, Eric Biber, Elisabeth Long Esposito Jan 2016

The National Park Service Organic Act And Climate Change, Eric Biber, Elisabeth Long Esposito

Natural Resources Journal

This article examines the future of the National Park Service Organic Act in a changing climate. Managers and scholars have raised questions about whether the Organic Act gives the Park Service sufficient authority to undertake the steps necessary to adapt to climate change. This article concludes that the Organic Act and park-specific enabling acts, as interpreted by the courts, grant the Park Service wide discretion to pursue management options for adaptation to climate change impacts on national park resources. It also concludes that the Organic Act, properly understood, does impose some necessary constraints on agency decision-making, constraints that prevent inappropriate …

Project ECHO Bibliography

BACKGROUND: Approximately 100,000 persons with sickle cell disease (SCD) live in the United States, including 15,000 in the Midwest. Unfortunately, many patients experience poor health outcomes due to limited access to primary care providers (PCPs) who are prepared to deliver evidence-based SCD care. Sickle Treatment and Outcomes Research in the Midwest (STORM) is a regional network established to improve care and outcomes for individuals with SCD living in Indiana, Illinois, Michigan, Minnesota, Ohio, and Wisconsin.

METHODS: STORM investigators hypothesized that Project ECHO

Border Town Bullies: The Bad Auto Deal And Subprime Lending Problem Among Navajo Nation Car Buyers, Megan Horning Jan 2016

Border Town Bullies: The Bad Auto Deal And Subprime Lending Problem Among Navajo Nation Car Buyers, Megan Horning

Student Published Scholarship

This article argues that due to the circumstances of Navajo Nation residents, Navajo car buyers have a greater need for cars and are therefore disproportionately harmed by unfair border town auto deals and subprime auto loans. Additionally, this article suggests several ways to address these issues while acknowledging the conundrum created if Navajo Nation residents are prevented from buying cars.

Part I of this article describes the current U.S. auto sales and lending process, including the stages of car buying, credit score calculation, and how national auto sales, lending, and investment markets profit from unfair car sales and subprime lending. …

Habeas Corpus In New Mexico, Max Minzner

New Mexico Law Review

In January 2015, the New Mexico Supreme Court implemented major revisions to the procedural rules governing petitions for habeas corpus and post-conviction relief. These changes clarified the limits on post-conviction relief, expanded and altered the process, and adopted a new rule to clarify the relief available to petitioners who have completed their sentence. This Article, written by the Chair of the Ad Hoc Committee on Habeas Corpus, describes the changes to assist judges and lawyers in implementing the new rules. The amendments have three major components. First, the rules now include a clear path for petitioners seeking to vacate their …

Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan Jan 2016

Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan

New Mexico Law Review

The movement to reduce over-prosecution and mass incarceration has focused almost exclusively on non-violent offenders despite data showing that over half of all prisoners incarcerated within the United States are sentenced for crimes of violence. As a consequence of the focus on nonviolent offenses, the majority of current and future defendants will not benefit from initiatives offering alternatives to criminal prosecution and incarceration. A discussion of alternatives to the criminal justice system in cases of violent crime must begin by acknowledging that violent crime is not monolithic. Many incidents meet the statutory elements of a violent crime, that is, the …

From Out To In: The Opportunity And Need For Clinical Law Programs To Effectively Serve Low-Income Lgbt Individuals, Sarah Steadman

Faculty Scholarship

Although the recent legalization of same-sex marriage in the U.S. is heartening for lesbians and gays, the resulting discriminatory legislative backlash against the LGBT population shows that this community continues to be marginalized and at risk. Over two hundred anti-LGBT bills have been introduced in state legislatures since January 2016. North Carolina recently passed anti-LGBT legislation that eliminated and prohibits LGBT anti-discrimination protections, and bars transgender individuals from using gender congruent public bathrooms. One result of recent and historical discrimination is LGBT individual's newfound and pre-existing fears of encountering anti-LGBT bias when seeking legal services, even as recent developments have …

Final Report: Predicting Effects Of Climate Change On Riparian Obligate Species In The Southwestern United States, Jacek Tomasz Giermakowski, James R. Hatten, Matthew J. Johnson, Jennifer A. Holmes, Erika M. Nowak, Michael Peters

Faculty and Staff Publications

The Lower Colorado River and Rio Grande Basins are home to many riparian vertebrate species with different degrees of rarity. In our study, we focused on two species of birds and two species of gartersnakes that are associated with riparian areas: the Yellow-breasted Chat (Icteria virens), the Yellow Warbler (Setophaga petechia), the Northern Mexican Gartersnake (Thamnophis eques megalops) and the Narrow-headed Gartersnake (T. rufipunctatus). While the extent of distributions of these species is relatively large, they are often patchily distributed in populations that are small; in addition, both gartersnake species are listed as threatened under the Endangered Species Act. Aside …

It is wrong to marginalize Muslims in part because such attitudes intensify the very dangers they purport to alleviate. Simply put, Islamophobia feeds ISIS-inspired terrorism.
